RE: Park Place and Palm Lake Club Water and Sewer Systems,
Sebastian, Florida
Dear Mr. Asher:
As per our telephone conversation yesterday, I am writing this
letter to you to request a "Schedule of Fixed Assets with
Accumulated Depreciation" for the water treatment and distribution
systems in the above referenced mobile home parks. This schedule
should include the installed costs for the wells and water
treatment plant at Park Place, water distribution systems for both
Park Place and Palm Lake Club, and gravity sewer collection systems
for both developments. It is my understanding that a 10" trunk
line gravity sewer which is routed through Palm Lake Club, and the
lift station and force main which serves Park Place and Palm Lake
Club will remain as property of Indian River County and will not be
transferred to the City of Sebastian.
I would like to schedule a meeting with you at your earliest
convenience. We must determine the specific water and sewer
systems components to be transferred to the City, so there is no
misunderstanding between the City and County when operation of the
systems becomes the City's responsibility on May 1, 1993.

TECHNICAL INFORMATION ON THE PARK PLACE WATER TREATMENT PLANT
March 22, 1993
1) The west well consists of a 6" diameter galvanized steel
casing with a 3" diameter PVC drop pipe. It has a Goulds
Catalog No. SPB15035 pump (Serial No. 1659721) with a 5-5/16"
diameter impeller manufactured in June 1989. The pump has a
5 HP, 3 phase, 240 volt Baldor Motor. The pump has a 2" PVC
discharge pipe.
2) The east well consists of a 4" diameter galvanized steel pipe
casing with a 2" drop pipe. It has a Transamerica Delaval
Model No. 50SPLZ3P pump manufactured in Dayton, Ohio. The
pump has a 5 HP, 3 phase, 3480 RPM, 240 volt Magnatech
Electric Motor (Part No. 6-36-324-01) Model No. SPBF4. The
pump has a 2" galvanized discharge pipe.
3) The east and west wells operate from "sensitivity floats".
One well can operate independently of the other. There are
three (3) taped settings in the clear sight glass for the
ground storage tank. The sight glass is located in the
southeast corner of the plant's control room. The sight glass
is marked as follows:

EAST WELL (Backup) ON
The east well only comes on when the west well can not keep up
with the demand.
4) The plant is classified as a Category III, CLASS C, 100,000
gallon per day plant which requires an operator three days per
week, 1/2 hour check minimum each time.
5) The chlorine room is a small, white fiberglass shed which is
located at the northeast corner of the plant. It contains a
Pennwalt Scale with adjusting nuts on the top. The scale
holds two 150 lb. chlorine cylinders. There is one Regal gas
chlorinator (or rotameter) which sits on the top of the
cylinder being used. A cylinder is used about every 20 to 30
days. The feed rate will be around 15# per day to provide
enough chlorine to meet the minimum of 0.2 ppm in Palm Lake
Club.

6) The chlorine is injected in the finished water line on the
east side of the plant. The injection tee is housed in a
meter box. The chlorinated water travels to the rear of the
plant where it is fed into the 4" PVC raw water header before
it goes into the aerator and groundwater storage tank. See
diagram below:

7) There is a drain valve at the rear of the plant which drains
the ground storage tank. The valve should be opened once per
month to flush out sediments from the tank. The water should
be run until it is clear.

On May 1, 1993, operation of the Park Place Water Treatment
Plant will be transferred from the Indian River County Utilities
Department to the City of Sebastian Utilities Department. In
discussing this with City Manager Robb McClary on April 16, 1993,
I suggested that the City have a short "Transfer of Operations"
ceremony at the water plant site. Since May 1, 1993, falls on a
Saturday, he suggested that a ceremony be planned for 10 AM on
Monday, May 3rd.
I have already discussed this with Terry Pinto and Harry Asher,
Indian River County Director and Assistant Director of Utilities on
Monday, April 19th and they seem amenable to the idea.
Therefore, I am requesting your invaluable assistance and
expertise in notifying the City Council Members, City Manager, the
Board of County Commissioners, County Administrator James Chandler,
Director Terry Pinto, and Assistant Director Harry Asher,,.members
of the Press Journal and Sebastian Sun staff, and others you may
deem appropriate to attend this event. I am planning to place the
City of Sebastian decal over the current Indian River County decal
on the door of the plant to symbolize the transfer of operations.
Perhaps you have a ceremonial "key" we can utilize also.
Hopefully, the weather will co-operate and be fair on that
particular morning. If not, perhaps we should schedule a "rain
date" for the following day at the same time.
If you have any constructive comments or criticism, I would
appreciate in knowing about them as soon as possible.
I hadn't planned on serving refreshments but should anyone need
of liquid refreshment, they can drink the water. I'll bring the
cups and ice.
For the benefit of all those who are invited, I will furnish
you with a location map to identify the plant site. If you need
anything else, please don't hesitate to let me know. Of course I
have no doubt that you will.

As verification of our meeting on April 12, 1993, this is a written
statement summarizing our verbal agreement. Bio -Services has been
Providing certified operator services for the community water
treatment plant at both City Hall and Golf Course since 1984 for
the City of Sebastian. In keeping with the terms of our standard
contracts with the City of Sebastian, our firm agrees to perform
the following services to operate the Park Place Water Treatment
Plants
Operation of one Category III Class C (100,000 GPD) Water Treatment
Plant will be on a three (3) day per week (Monday. Wednesday, and
Friday) on-site inspection basis in accordance with the directives
as outlined in Florida Administrative Code Chapters 17-550,555, 560
and 602. Plant visits will include, but are not limited to the
following:
1) Chlorine (free) residual, and PH testing on plant
effluent and remote tap
2) Maintaining a compressed air volume in the hydropneumatic
tank at all times to prevent the tank from becoming
waterlogged
3) Operational surveillance and adjustment to maximize plant
efficiency
4) Monthly flushing of sediments from the ground water
storage tank
5) Monthly Total Coliform Bacteria testing on the two wells
(raw) and remote taps

6) Honthly Operating Reports (see attached copy) as well as
Bacteriological Reports (see attached copy) will be
completed, certified, and forwarded to the Florida
Department of Environmental Regulation - Orlando District
Office as prescribed by the FAC Chapters 17-550, 555,
560, and 602.
Replacement of chlorine gas cylinders, general repairs, and
maintenance costs are not included in the basic operation contract.
Bio -Services will be responsible for ordering the chlorine on an as
needed basis with the costs to be invoiced accordingly to the City.
General repairs and maintenance requirements, other than prevent-
ative maintenance, will be brought to your attention as the need
arises. Bio -Services agrees to assist in emergency situations on
a 24 hour basis.
The monthly costs for the bi-weekly visits plus the bacteriological
sampling, analysis, and reports submission will be $200.00/month.
The costs for the gas chlorine will be invoiced following
confirmation of delivery of the cylinders to the plant.
This agreement will remain in effect until cancelled by either
party by submission of written notification 30 days prior to
termination date. It is also understood that this agreement is
sufficient to comply with the present requirements set forth by the
Florida Dept. of Environmental Regulation (FDER). Should these
requirements change, this contract would then have to be
renegotiated to comply with the new directives.

2) Need a computer print out of the last meter readings taken by
Indian River County - want to meet meter reader on April 30th.
Harry and Lori said that they would furnish me with a computer
print out.
3) Is there an Operation and Maintenance Manual for the Park Place
Plant? No, according to Harry.
4) Ask Harry about the billing procedure for Park Place surcharge
for Nelson Hyatt. Lori gave me a sample copy of the bill for
Park Place which shows "Park Place Surcharge $10.00".
5) Talk to Harry about a ceremony on Monday, May 3rd about
transferring ownership of the plant. I spoke with both Harry
and Terry Pinto and invited them to the ceremony.
6) Talk to Harry about painting the aerator and tank on west side
at Park Place Plant. He wrote down a note about this.
7) Talk to Harry about emergency repairs and who to contact at
Indian River County in case of an emergency. Harry would help
the City out only if we had a dire need. He was reluctant
because he did not want to become caught in a situation whereby
Indian River County crews were responding to an emergency in
Sebastian and an emergency in Indian River County occurred
simultaneously.

8) Talk to Harry about the deed to the Park Place Plant and
$777,000 - what does that represent? The $777,000 represents
water distribution system, plant, and wells, gravity sewer
collection system, and one lift station and force main within
Park Place itself. It does not pertain to any real estate such
as the property the water plant is situated on. The City has
the right to have the use of the water plant property for ten
(10) years but then has to pay fair market value for it to
Nelson Hyatt if the plant is operational beyond that time peri-
od.
9) Ask Harry for the original Consumptive Use Permit for the
well at Park Place Plant and DER Permit. Harry said that he
would look for these.

The following is a prepared text which was written by Richard B.
Votapka, Utilities Director, for an oral presentation at the
Transfer Ceremony held at 10 AM, Monday, May 3rd at the Park Place
Water Treatment Plant. Rich Votapka first welcomed everyone
present and then delivered his oral presentation based on the text
below:
Today marks an historic day in the City of Sebastian. It
represents the entry of the City into the operation and maintenance
of its first municipal water supply and distribution system.
Although it is a small system consisting of 164 customers in Park
Place and 20 in Palm Lake Club, it never the less is a beginning.
It brings to mind the time I had started work 16 years ago in 1977
for Beindorf and Associates. The firm at that time was engaged in
joint co-operation with Sverdrup and Parcel in working for Indian
River County in the renovation and expansion of the water system in
the Gifford area. I spent two years working with Leon Young,
Supervisor of Customer Service of Indian River County Utilities in
order to upgrade the old UDU (Urban Development Utilities System)
to bring good, potable water to the residents of Gifford. Now
after 16 years later, I am again working with Leon Young, in
starting out on a small segment of the City of Sebastian's future
large municipal system. The 200 residents we will serve today will
grow into 22,000 by the year 2005 according to the demographic
projections. Currently, the City is negotiating with GDU, which,
if negotiations are successful, could catapult us into having a
system of approximately 1400 customers by mid -summer.
Today, however, we want to recognize the joint spirit of co-
operation between the County and the City leading up to this event.
I thank all of the many personnel and staff of the Indian River
County Utilities Department who have been so helpful to me in
furnishing me with information and showing me many things in the
field that I need to know to get started. I really appreciate them
for their efforts and am deeply grateful.
I know that the turn of events which led us here today have taken
place over a considerable amount of time. So at this time, I'd
like to afford an opportunity to others who may wish to say a few
words about this historic occasion.

TRANSFER CEREMONY
As a symbol of Sebastian's takeover of operations of this plant
from Indian River County, I will attempt to place the official seal
of our City over that of the existing County's seal on the door of
the plant. This will signify the change being made here today.
I want to thank each and everyone of you for attending this small
ceremony and invite you for a cursory look at the interior of the
plant if you'd care to have the opportunity.
Those in attendance were Mayor Lonnie Powell, Councillor Norma
Damp, Councillor Robert Freeland, City Manager Robb McClary, City
Clerk Kay O'Halloran, Utilities Department Secretary Pat Brown,
Indian River County Environmental Health Director Mike Galanis,
Indian River County Utilities Director Terry Pinto, Park Place
Developer, Nelson Hyatt, and Associate,Michael Cairns, Sebastian
Sun Editor George Ricker, Jane Burton, Operator of Bio -Services of
Vero, and seven residents from Park Place. The ceremony lasted
approximately 15 minutes. Robb McClary, Mayor Powell, and Terry
Pinto all spoke briefly. Most of the residents took the time to go
into the plant and look around. I changed the locks on the
chlorine room and the door to the plant.

RE Park Place Water and Sewer Systems
I met with Steve Pitiak at 11:40 AM to 3:00 PM in my office.
He contends that the company broke the original agreement because
of;
1) Nash made a statement that the City didn't have a valid
reason to transfer the franchise. Steve is saying that Indian
River County should have transferred all of the franchises back to
their original owner including Park Place.
Steve said originally the City granted a franchise to the
Village of Lake Dolores. Once that was sold to the Park Hill
Brothers, the franchise was transferred. Park Hill Brothers
faulted, the judge ruled that Nelson was entitled to regain the
utilities back.
According to Steve Pitiak, Nelson Hyatt violated a state law by
signing an agreement with the County Chapter 723 by not notifying
the Homeowner's Association 90 days prior to executing the
agreement of the impending sale of the utility. By not notifying
the Homeowner's Association by law, no one knew that the utility
would be sold.
In the advertising by the County in the Press Journal under
legal notices in July 1989, the County did not put the full name of
the utility in the paper. It said "Village of Lake Delores"
(spelled Dolores). It should have read "Lake Delores Utilities and
Cable Television Systems, Inc. Water and Sewer." Steve is saying
that State Law requires use of the full name.
No one from Park Place showed up at the Public Hearing held on
July 11, 1989, at the County Commission Chambers. On June 9th and
16th, 1989, the Notice to the Public was published. Individuals in
Park Place were not notified by mail or any other means. Neither
was the President or offices of the Homeowner's Association.
Approximately one month notice was given, not the required 90 days.

2) The City of Sebastian is the original franchise. There was
never a public hearing held to transfer the franchise for Lake
Dolores; no appraisals were determined to find out the value of the
utility although $777,000 is stated in the Takeover Agreement.
Steve asked "Can we legally charge Park Place a $10 surcharge
for the water/sewer system without charging the residents of Palm
Lake Club for using the system?" I asked Steve about the agreement
with Palm Lake Club. Steve said the County entered into agreement
with Fischer to pay him approximately $48,000 to oversize the water
and sewer mains for future development. The County would reimburse
them by paying to them 1/2 of the impact fees.
The surcharge was for water and sewer.
Steve's recommendation is to leave out the $10 surcharge in the
Resolution. He said that if " I was insistent, then he and several
of the residents will go around the City and fight it."
He wanted me to ask the Finance Dept. and City Manager if the
Resolution Amendment in regard to the $10 surcharge can be
temporarily withdrawn from consideration by Council until legal
clarification is received. (Marilyn and Robb said "No".)
Steve wanted me to ask the City Attorney if the Interlocal
Agreement is still valid since the County did not turn over the
Sewage Treatment Plant to the City. (Charley Nash said it was
valid.)
Steve wanted me to check with City Clerk as to Exhibit "A" in
the Nelson Hyatt agreement. (I found Exhibit "A" in the City
Attorney's files after consulting with Sally Maio)."
Steve reiterated several times to tell me not to proceed with
showing the $10 surcharge on the Resolution. He said the residents
would pay this regardless of whether the surcharge was included in
the rate resolution or not.
Our meeting ended at 3:00 PM.

SUBJECT : Minor Maintenance Items at the Park Place Water
Treatment Plant
On Thursday, May 27, 1993, I met with Building Maintenance
Foreman, Jerry Converse, to look at some minor maintenance items
that I would like to have done at the Park Place Water Treatment
Plant. Basically, the items consist of the following:
1) Placing screening over openings in the plant that could permit
snakes, lizards, insects and other undesirable creatures to gain
access to the plant via many of its openings.
2) Replacement of a plastic louver in the front door to the plant.
3) Replacement of louvers in the exhaust fan above the front door.
4) Construction of a 2 foot by 8 foot long concrete apron in the
front of the plant, so I can roll a 190 pound chlorine cylinder
into the chlorine room. Sketches of the above items appear as
attached.
I would request that you schedule Jerry to do the work at his
earliest convenience. Any costs incurred shall be charged to the
Utilities Department.

The ground is starting to dry out around the lot at 1010 West
Lakeview Drive. It hasn't rained for several days. No water is in
one meter box, but there is a little water in the other box. The
ground in the drainage swale is still wet. Around the meter boxes,
the ground is dry. The whole street floods when it rains because
the elevation of the ground is low.

I called Mike Newman of Newman & Sons when I learned through GDU
that his company services the emergency generators at both the
Filbert Street Water Treatment Plant and the Bailey Drive
Wastewater Treatment Plant. I told Mike that I was trying to
locate a portable trailer mounted generator to service the 100,000
gal/day Park Place Water Treatment Plant. The plant has two 5 HP
well pumps and two 20 HP high service pumps. The total watts I
calculated were as follows:
2 - 5 HP pumps = 10 HP
2 - 20 HP pumps= 40 HP
TOTAL 50 HP
x 750 watts/HP
37,500 watts (Round up to 40 kw)
Mike said to use a multiplier of 2-1/2 times the amount of the
total horsepower. Therefore, 2-1/2 x 40 kw = 100 kw. Mike said
that he did not have a portable generator that size and could not
help us. He suggested that I call GRECO in Orlando. Florida and

Pursuant to our phone conversation this morning, our water
treatment plant operator, Tom Stirtzinger, will takeover operation
of the Park Place Water Treatment Plant on January 1, 1994.
Replacement of chlorine gas cylinders, general repairs, and other
maintenance will be performed by City Utilities personnel as well.
I would like your firm to continue taking the monthly total
coliform bacteria testing on the two wells and remote taps so that
DER receives these on a timely basis. Please prepare a written
quote for me in regard to the monthly coliform bacteria testing as
well as other tests that will be required this year for the plant.
Our plan at present is to connect the Park Place/Palm Lake
Club water system to the City (former GDU system) water system and
discontinue operation at the Park Place Water Plant by June of
1994.

without proper anti -syphon or back flow prevention
devices constitutes a cross -connection and is considered
a sanitary hazard. Gate valves and single check valves
are not approved devices for cross connection control.
I have enclosed some pertinent literature which
addresses back flow prevention.

if at my time the residual disinfectant coacentration in the distribution system drops below the equivalent of 0.2 mp/L of Gee available chlorine, immediately
increase the chlorine dose and/or flush appropriate portions of the distribution system until the residual dismfeclmt ememtratim is at least equivalent to 0.2 mg/L
of free available chlorine and notify the Department or the appropriate ACPHUby wire or telephone within 2 hours pursuant to Rule 62-555.350(3) FAC.
