REPORT ON WATER DEMAND FOR
POTENTIAL CUSTOMERS ALONG THE EXISTING
INDIAN RIVER COUNTY WATER MAIN LYING IN THE CR 512
AND ROSELAND ROAD RIGHTS-OF-WAY
Indian River County has installed a 16" diameter water main
along those portions of the north side of County Road 512 (CR 512)
and west side of Roseland Road rights-of-way within the Sebastian
City Limits (see attached map). Currently, the City of Sebastian
does not have any public water distribution system within either
corridor to provide service to adjacent properties. Only the
adjacent Sebastian Lakes Condominium Development and the North
Indian River County Library are presently connected to a public
water supply system. They are served by the General Development
Utilities water system through a connection on Laconia Street.
Representatives from Christ the King Lutheran Church have made
a request to the City of Sebastian that they be allowed to connect
to the existing County water main. The Church has a site west of
Roseland Acres residential subdivision on the south side of County
Road 512 west of the southerly entrance of San Sebastian Springs.
The Church plans to start construction in the near future. The
engineer for the project. Mosby and Associates, Inc. has determined
that the Church will have an estimated sewage flow of 780 gallons
per day. If the sewage flow is estimated to be 85% of the water
demand, the water demand would be approximately 920 gallons per
day. Of course, the only time during the week when maximum demand
would occur would be on Sunday.
Lots 1 through 6 within Roseland Acres Subdivision are
immediately adjacent to the south side of CR 512. Lots 1 and 2 in
Roseland Acres Subdivision are undeveloped. The existing United
Church of Sebastian occupies lots 3 through 6. Currently, the
Church has its own individual water system on site. The sewage
flow is estimated to be 450 gallons per day. Water demand as
calculated above would be 530 gallons per day.
All other property lying within the Sebastian City limits and
adjacent to the County Road 512 and Roseland Road consists of
previously platted residential lots. Those lots that are adjacent
to the CR 512 corridor within the San Sebastian Springs Subdivision
are lots 123, 124, and 147 through 154 for a total of 10 lots.
Lots that are adjacent to the CR 512 corridor within Unit 5 of
Sebastian Highlands are Lots 18-49 in Block 169 for a total of 32
lots. All of the aforesaid lots are separated by the 100 foot wide
right-of-way that was formerly the Trans -Florida Railroad right-of-
way. However, the railroad right-of-way has been purchased by
Indian River County to expand County Road 512. The existing 16"
diameter water main is located approximately 10 feet to the north

of the existing CR 512 pavement. Therefore, services from the main
would have to run approximately 140 feet to all of the residential
lots along the north side of CR 512.
Along the Roseland Road corridor, there are 38 lots adjacent
to the right-of-way in Unit 5, 35 lots in Unit 4, and 24 lots in
Unit 3 for a total of 97 lots in the Sebastian Highlands
development.
Although the Shiloh Youth Ranch is shown to be within the
boundaries of the City Limits, the City believes the map to be in
error and that the property is actually within Indian River
County's territorial jurisdiction. The last residential properties
within the City Limits adjacent to the Roseland Road right-of-way
are located in Point -O -Woods Subdivision, which consists of 22
lots. A water distribution system would have to be constructed
within the subdivision to supply water to all of the individual
lots.
The total potential customers located immediately adjacent to
the County Road 512 and Roseland Road corridor are as follows:

Currently, the April 21, 1992 Interlocal Utilities Agreement has no
provisions for the sale of bulk water from the County to the City.
The Agreement only provides for bulk wastewater rates for
wastewater service that Indian River County provides City
customers. Therefore, an analysis must be done of the cost for
Indian River County to provide bulk water treatment and
transmission of service, and to develop rates to recover the costs

RESUME OF CONVERSATION: I called Reverend Paul Hauenstein of
Christ the King Lutheran Church and told him that the Interim City
Manager, Kay O'Halloran; Finance Director,. Marilyn Swichkow; City
Engineer, Dan Eckis; and I would try to meet within the next two
weeks to discuss relinquishing the City's service territory for
portions of County Road 512 and Roseland Road. I explained to him
about the meeting Kay, Marilyn, and I had with the County on
October 14th to discuss providing water to Wal Mart. At the same
meeting, I had presented my "Report on Water Demand for Potential
Customers Along the Existing Indian River County Water Main Lying
in the CR512 and Roseland Road Rights -Of -Way". However, the group
did not discuss it because Marilyn Swichkow, Finance Director, did
not want to address it at that time. Wal-Mart was a major
consideration at the time because it had political ramifications if
water couldn't be provided to it by the City or County.

SUBJECT: County vs. City Water Service for Portions of CR 512 and
Roseland Road within City Limits
Indian River County has previously installed a 16" water main
within the County Road 512 right-of-way west of Roseland Road and
within the Roseland Road right-of-way north of County Road 512.
The City does not have any water mains within either corridor and
most probably won't have water mains in this specific area for many
years to come. If possible, duplication of water mains within
these corridor segments should be avoided to avoid the potentiality
of tapping the wrong main in the future.
Representatives of Christ the King Lutheran Church have expressed
a desire to connect to the County water main rather than install
their own treatment system on their site. Christ the King Lutheran
Church is in the beginning stages of constructing a new church
building on County Road 512 on the west side of Roseland Acres
subdivision. The Church could easily tap the County's 16" water
main, if permission were obtained. However, the County has no
jurisdictional rights within the City's boundaries to allow taps
from City customers. There is no agreement for the County to serve
City customers with water other than the Interlocal Agreement to
serve water to Wal-Mart.
All total, two churches within Roseland acres, a small triangular
lot west of Roseland Acres, and 119 residential lots along Roseland
Road (including 22 lots in Point -O -Woods Subdivision) could connect
to the County's water main now and the City could avoid the
construction of duplicate water mains sometime in the future. The
City could enter into an "Interlocal Agreement", such as it did
with Wal-Mart North, so that the County's service territory could
include only the above named lots. I have enclosed a map showing
the specific lots the County could serve.

It may be possible to have the City serve the two Churches and
triangular lot west of them if a water line was installed from
Sebastian Lakes once Sebastian Lakes conveys its water mains to the
City. Easements from both churches would have to be obtained.
As you suggested in early December, we should have a meeting to
discuss this matter which would involve Dan Eckis, City Engineer
and Marilyn Swichkow, Finance Director. Since Dan will be out of
town until January 3, 1994, I would suggest a meeting be held
during the latter part of that week, possibly January 6 or 7.
Please inform me as to when it would be convenient with your
schedule.

I presented my case before the group, citing reasons why the County
ought to service the area. See the attached copy of my December
23, 1993 memo to Kay O'Halloran. After much discussion, the
outcome of the meeting was that the City should not relinquish any
more of its service area to the County. Therefore, the City will
not request the County to service those customers along the CR 512
and Roseland Road corridors. Dan suggested running a 2" water main
down CR 512 to serve the churches from coming off the water main
inside Sebastian Lakes. I informed the group that at this time,
the City does not own the water lines in Sebastian Lakes. The City
is in the process of finalizing an agreement for the Sebastian
Lakes condominiums to acquire the water system, but the City only
owns up to the meter on Laconia Street. Dan suggested that we
engage the engineer for Sebastian Lakes at this time to design the
water system to serve the churches along CR 512, since they are
working on the as-builts for Sebastian Lakes. I didn't want to get
into a conflict of interest by having the City work with the
engineers for an entity the City is currently negotiating an
agreement with. I told Dan I would be more comfortable is using a
local engineer to design the system and permit it.
I was able to reach Reverend Paul Hauenstein on January 12, 1994 at
11:30 am. to inform him of the status of the above.

RE: Proposed Utility Easement in the Southwest Corner of
Sebastian Lakes Condominium Development, Sebastian,
Florida
Dear Barbara:
I have attached a copy of the sketch of the subject easement
that we discussed with City Attorney Charles Nash yesterday in the
course of our conversation about the Water and Wastewater Service
and Contribution Agreement. I spent time on site yesterday in
determining the routing of the easement and approximate dimensions.
The purpose of the easement would be to provide for a future
installation of a water main within County Road 512 to serve two
churches and a small undeveloped lot west of Sebastian Lakes and
south of County Road 512.
I have routed the easement to minimize the disturbance to the
existing residents. The majority of the easement will be adjacent
to the. south property line of Sebastian Lakes along which an
electric powerline now exists. Approximately 200 feet north of a
15 foot wide utility easement would be located on the north and
west side of Building No. 7. Only an irrigation system, yard
lighting, and a small three foot wide concrete walkway would be
affected by installation of a water main within the easement. The
City, of course, would repair the irrigation system, lighting
system, and walkway if damaged, and would replace all disturbed
areas with sod at the time of construction of the water main.
For a metes and bounds legal description, the City would
engage a licensed surveyor. My interest at this time is to have
assurance from Sebastian Lakes that the easement will be granted to
the City in the general location shown, with the actual bearings
and dimensions to be determined later.

Church
I met with Wayne Westerman this afternoon, who was in City Hall
meeting with our Finance Department, prior to 2:00 p.m. I asked
him if he would be interested in giving me an estimate to do the
engineering work for designing an 8" water main from Sebastian
Lakes to CR 512 and a 2" water main from the 8" water main to
Christ the King Lutheran Church, which is currently being built.
I told him that I had spoken with David Fisher, a representative of
the Church, about a week ago. Dave said that he would talk to
Randy Mosby about the project. However. I never heard from Randy.
I reviewed all the material I had with Wayne. He said he would
provide me with a cost estimate by next week to do the engineering
and have an independent surveyor prepare the easement needed in
Sebastian Lakes. Wayne wanted to know how many flush valves the
Church would have for the purpose of design.
I called Reverend Paul Hauenstein around 3:45 p.m. He told me that
there were two urinals with flush valves and 6 standard toilets.
He also informed me that there would be 175 seats (125 in the
multi-purpose room and 50 in the Narthex) for determination of the
impact fees. I relayed the conversation I had with Wayne and the
status of the project. I strongly emphasized that Reverend Paul
talk to Indian River County Environmental Health Department to
allow or a temporary well and pump for potable needs because it
would take time for the City to have a water main designed,
permitted, and built to accommodate the needs of his church.

SUBJECT: Christ the King Lutheran Church
RESUME OF CONVERSATION: I explained to Dave that on January 10,
1994, I had a meeting with Interim City Manager Kay O'Halloran,
Finance Director Marilyn Swichkow, and City Engineer Dan Eckis in
regard to serving the Church with water. I was in favor of having
the County serve the two churches on CR 512, since the County water
main was already installed in the CR 512 right-of-way. However,
none of the others agreed with me. They rationalized that the City
already gave away part of its service territory to Wal-Mart on
North U.S. 1. They didn't want to give up any more territory
within the City to the County, even though both churches are very
small consumers.
Dan suggested that I run an 8" line or 2" line to the properties.
The 8" could be used for future expansion across CR 512 to serve
San Sebastian Springs. I argued that both churches are only minor
users of water. It would be expensive to run a water main to
service the churches. The impact fees paid by the churches
probably wouldn't cover the cost of running the line.
I had offered an alternative to the group by telling them that once
Sebastian Lakes was dedicated to the City on February 9, there was
a possibility of running a water main to CR 512 and down to the
churches. I told Dave that I had requested an easement through the
property. It hasn't been approved yet. I would still need a
surveyor and engineer to design the system and permit it after I am
ensured that I can obtain the easement. Dave said he would contact
Randy Mosby who engineered the site plants to see if he would
design and permit the water line.

As per our previous discussions, the City intends fully to

February 9, 1994, the Sebastian Lakes Utility Company entered into
an agreement with the City to convey its existing water and sewer
systems within Sebastian Lakes to the City. Unfortunately, the
easement which the City needs to construct the water main must be
granted by the Sebastian Lakes Condominium Association. As you
know. I met with the general membership and Board of Directors at
their meeting on February 22, 1994. To date, I have not received
any favorable news about the Association granting the easement.
The City may have to resort to possible legal action to procure the
easement. Needless to say, I cannot predict how long this will
take but the City shall persevere since the City has committed to
providing potable water to your Church.

As of Monday, March 7, 1994, Mrs. Virginia Zahn, President of the
Sebastian Lakes Condominium Association, informed me that she would
have a letter written to the City granting a utility easement to
the City as requested, but subject to the review and approval of
the Association's attorney.
Following your directive at this morning's staff meeting to write
a memo on this subject, I called Mrs. Zahn at 11:15 a.m. to learn
when I could expect the letter. Mrs. Zahn informed me that new
elections for Association Board Members were held yesterday and
that all new members were elected. She told me that to protect the
Board from liability, she now requests, again, a letter from the
City informing the Association Board that the City will evoke its
right of eminent domain powers to acquire the easement. I told
Mrs. Zahn that I had already discussed this approach with you and
neither one of us want to threaten Sebastian Lakes with legal
action to obtain an easement. We would prefer to acquire the
easement through more amicable means.
Mrs. Zahn told me that the only other alternative was to have the
Board issue ballots as to whether or not the Association could
grant an easement. This process may take three or four weeks to
complete, since the people do have the right in their Association
rules and regulations to vote on granting an easement.

I told Mrs. Zahn that I had written a letter to the pastor of
Christ the King Lutheran Church committing the City to provide
water to the Church in the future. I explained that the City was
in the process of trying to obtain a utility easement from
Sebastian Lakes and could not guarantee when this would
materialize. I told Mrs. Zahn that my letter would enable the
Church to receive approval from the Indian River County
Environmental Health Department to use its irrigation well as a
temporary water supply until such time as the City installs the
water main. Therefore, since the Church could be temporarily
served water by its own system. I preferred that the Association
take a vote of their members as soon as possible rather than the
City issuing a threatening ultimatum involving eminent domain
action.

I am in receipt of your letter of March 28, 1994.
Unfortunately, I am not in a position now to assure you that the
City will have a new water main and service installed to serve your
church six (6) months from now. As you can see by the March 29,
1994 attached letter from Charles McKinnon, Attorney for the
Sebastian Lakes Condominium Development, the Association doe not
prefer not to grant an easement to the City for the 8" water main
to be installed on the Association property. Until I can secure an
easement on the Sebastian Lakes property, the City cannot provide
water service to your church. Unfortunately, my efforts are being
frustrated by the Association and I cannot guarantee when, or if,
the easement will be granted.
I plan to contact the Association President, Virginia Zahn,
again in view of Mr. McKinnon's letter to try to schedule an on
site meeting to walk over the proposed easement route. Hopefully,
this will abate the concerns or fears the Association members may
have against the proposed easement. I will keep you informed
periodically of my progress, if there is any.

Today at 10:00 a.m., Ed Clark of Christ The King Lutheran Church called me. He said
that he and representatives of his Church had met with Terry Pinto, Indian River County
Utilities Director regarding connection to the County water main on CR512. He said the
County was willing to provide service. Ed asked me to write a letter to Terry Pinto
requesting that the City would like for Indian River County to serve both his Church and
the United Church of Sebastian. Ed said that the United Church of Sebastian definitely
wanted to connect to public water especially due to the expense of operating its own
private water system.
At 11:10 a.m., Tom Golladay of the United Church of Christ called me to confirm what
Ed Clarke had told me earlier. Tom also wanted me to write a letter to Indian River
County Utilities to request connection to the County water system.

Dear Mr. Pinto:
Representatives of the Christ the King Lutheran Church and the United Church of Sebastian
have requested potable water service to be provided to them by the City of Sebastian.
Originally, the City of Sebastian Utilities Department had proposed to install a water main
from Sebastian Lakes to both churches. However, through default of an agreement on the
part of Sebastian Lakes with the City, provision of service to both churches at this time is
economically unfeasible.
There exists a 12" County water main along the north side of County Road 512. Since both
churches are located on the south side of County Road 512, it would only be a matter of
running a service line from the main to the church properties. Therefore, in the best interests
of Christ the King Lutheran Church and the United Church of Sebastian, the City requests
that Indian River County provide water service to both churches.

Lutheran Church, called me at 9:40 AM to inquire about the status
of Indian River County supplying water to the Church. I checked
the file but found nothing new since October 18, 1994. As of that
date, I had informed Ed Clark that City Manager Joel Koford had
City Attorney Cliff McClelland working on an agreement to allow
Indian River Co. to serve the Church. To date I have not heard of
any new development in the agreement. I told Ed that the only
agreement prepared by the City as to utilities in this area was
a wastewater service agreement known as the "Sebastian Lakes
Service Area Agreement" which includes Christ The King Lutheran
Church. Unfortunately, the Agreement does not allow the County
to serve the Church with water.
I referred Ed to see Mr. Koford about this matter since I am
not allowed to talk to Atty. McClelland without first being
authorized by the City Manager.

Dear Mr. Fisher:
This letter is in response to your formal request on behalf of
Christ the King Lutheran Church for permission to the above
referenced connection. Even though the physical connection to the
County's existing water main is possible, the City must politically
resolve the issue of bulk water rates for the sale of water by the
County to the City. In all of the resolutions passed by Indian
River County to effectuate the City's takeover of the water and
sewer systems from the County, no bulk rates were ever established
for the sale of water from the County to the City. Therefore,
there is no legal mechanism or authorization established whereby
the County will charge the City for sale of County water to City
customers. Water was not an issue during City/County negotiations
in 1991 and 1992 because the County had not installed any water
mains around or within the City. Since negotiations were concluded
though, the County has installed a water main along County Road 512
and Roseland Road within the Sebastian City Limits. Therefore, it
is only logical that Christ the King Lutheran Church wants to
connect to the County's potable water main in lieu of installing
its own well and treatment system.
The current City water rates, which were adopted by the City
Council, are identical to Indian River County rates. Based on the
usage figure of 780 gallons per day of sewage flow calculated by
your consultant engineer, I have calculated your minimum monthly
bill which the Church could expect based on a maximum of five (5)
Sundays in a month. Total gallonage per month based on Sunday
services alone (not including other meetings held during the week)
would be approximately 4000 gallons. The estimated monthly bill
would be $20.46.

Attached are pages 7 and 8 of Indian River County Ordinance
No. 91-9 which show the minimum required number of ERU's for a
church. Based on the County's ordinances, the impact fee for the
Church would be $1,570.00 or $3,140.00 if the Church has banquet
facilities.
At this point in time, the City has operated the Park
Place/Palm Lake Club water and wastewater collection systems since
May 1, 1993. Our first utility bills were sent out in June to all
customers within the City. The County, in turn, billed the City on
its bulk rate charges for sewer only because the County does not
provide water to any customer in the Park Place and Palm Lake Club.
The bulk rate charges by the County to the City are so high that
there is little money to pay for the processing of the bills by the
City. Also, the County is also holding the City responsible for
delinquent accounts that it initially turned over to the City on
May 1, 1993.
Dialogue has been established between our Finance Director and
the County Administrator in regard to scheduling a meeting to
resolve these aforesaid issues. At the same time, bulk sewer rates
are discussed, bulk water rates can be discussed. Due to union
negotiations, loss of personnel in the Finance Department, budget
preparations and workshops, the GDU rate increase discussions and
meetings held to reopen negotiations with GDU, new cable TV
franchise regulations, and other items of business, our Finance
Director has not had the time meet with the County Administrator.
Hopefully, within the month of September the issues can be
satisfactorily resolved. I will bring up your specific situation
for discussion and respond to you as soon as possible with a
definite answer.
I would appreciate your patience with regard to the Church's
situation, and hope that you understand the problems the City is
currently experiencing with the County in this transitional
takeover period. The current problems must be resolved first with
the County on existing accounts before other issues are introduced
which may further complicate City/County relations at this time.

This is to repeat and confirm our request for permission to connect
to the new potable water utility line now installed within the City
limits along CR -512.
As you know, our formal site plan for the subject project indicates
such a connection and we consider it to be a very important aspect of
our project during construction and our ongoing occupancy there.
Also, as we have discussed, our neighbor to the east of our site, The
United Church of Sebastian, would like to share our engineered
connection to the existing water line, enabling them to save
considerable expense by change over from their own on site water
supply system. We are agreeable to sharing the costs of such a
connection with them and are ready to proceed with the detailed
engineering design required to implement same. such an arrangement
would, of course, bring additional ERU and monthly billing revenue to
the City of Sebastian's newly organized utility system and be in
accord with the requirements of HRS and the Indian River County
utilities system.
We thank you for your explanations thus far as to why such permission
is being delayed, but we respectfully re-emphasize our request for
such a connection and urge you to expedite a favorable resolution of
the matter.
