RE: CITY OF SEBASTIAN WATER PROJECT - PHASE I
INDIAN RIVER COUNTY PROJECT NO. UW -95 -28 -DS
Dear Mr. Frame:
The County has completed the preliminary design for the above -referenced project. Pursuant to
the County/City of Sebastian Utility Agreement (specifically Sections 4.04 - 6.07 and 6.08,
Section 6.07 (C)), the County is requesting of the City to impose a special assessment for water
improvements under the provisions of Chapter 170, Florida Statutes or in the alternative,
pursuant to the City's home rule powers.
The Phase I water expansion will involve constructing all of the necessary water mains, valves,
fire hydrants, etc. to provide potable water service and fire protection to the associated property
owners. The cost of construction will be assessed to the benefiting property owners, based on the
square footage of the property being served. This is a standard assessment method practiced by
the County. Initially, construction cost will be funded from bond funds. Payment of the
assessment fees will not be required until the project has been completed. The assessment can
then be paid in full, or financed over a ten year period at an annual interest rate of 8.5%.

• A description of the project
• Construction plans and specifications
• An assessment plat
• Estimated total project cost
• A proposed assessment roll
• The proposed apportionment method showing the proposed assessment for each
benefited parcel

According to the Agreement (Section 6.07 (C), after receiving the above information, the City
shall conduct a hearing under either Section 170.08, Florida Statutes or the City's procedures for
levying a home rule special assessment as to the propriety and advisability of making the
improvements and funding them with special assessments.
Following the testimony at the hearing, the Council shall make final decision on whether to levy
the special assessments. If the Council elects not to levy the special assessments, the County
may proceed by law to levy the special assessments, and the City's election not to levy the special
assessments shall constitute complete and full authority for the County to levy such special
assessments.
