CITY COUNCIL CHAMBERS 1225 MAIN STREET, SEBASTIAN, FLORIDA 1. Mayor McPartlan called the Regular Meeting to order at 6:00 p.m. 2. A moment of silence was held. 3. The Pledge of Allegiance was recited. 4. AGENDA MODIFICATIONS - None 6. PROCLAMATIONS, AWARDS, BRIEF ANNOUNCEMENTS Presentations of proclamations, certificates and awards, and brief timely announcements by Council and Staff. No public input or action under this heading. 17.111 A. Hurricane Preparedness Presentation by FPL External Affairs Manager Bart Gaetiens and Account Manager Nancy Flickinger Mr. Gaetjens said since it is the beginning of the hurricane season, he wanted to show how FPL prepares and help customers prepare. He displayed a PowerPoint presentation. (See attached) He described how FPL has joint utility agreements; and since 2004 they have upgraded their power lines, feeders and poles. During events or for day-to-day operations, FPL is able to communicate with customers by cell phone texts, automated phone messages and Facebook. He cautioned people to stay clear of downed power lines; treat intersections without signals as a four-way stop; and not use generators within closed structures. Anthony, FPL Vegetation Manager, said to be proactive, the vegetation is trimmed out from the main feeders each year by July 315' and Sebastian has been completed at this point. He said they are working on 550 miles of lateral lines along the Treasure Coast. He explained feeder lines are cleared every year and neighborhood lines are cleared every six years. Regular City Council Meeting June 28, 2017 Page Two He said the line from the pole to a house is called the service drop and is the customer's responsibility. They should call to disconnect the power before they trim near the service drop line. CONSENT AGENDA All items on the consent agenda are considered routine and will be enacted by one motion. There will be no separate discussion of consent agenda items unless a member City Council so requests, in which event, the Item will be removed and acted upon separately. If a member of the public wishes to provide input on a consent agenda Item, he/she should request a Council Member to remove the item for discussion prior to start of the meeting or by raising his/her hand to be recognized. A. Approval of Minutes — June 14, 2017 Regular City Council Meeting 17.112 B. Resolution No. R-17-17 — Abandonment of Rear Easements - 219 Englar Drive (Transmittal, R-17-17, Map, Report, Approvals, Application) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, VACATING PORTIONS OF CERTAIN EASEMENTS ON LOTS 12 & 19, BLOCK 551, SEBASTIAN HIGHLANDS UNIT 16; PROVIDING FOR CONFLICTS HEREWITH; PROVIDING FOR RECORDING; PROVIDING FOR EFFECTIVE DATE. 17.113 C. Resolution No. R-17-18 — Requesting FDEP and SJRWMD to Reduce Permit Application Fees (Transmittal, FS218.075, Financial Info, R-17- 18) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA REQUESTING ST. JOHN'S RIVER WATER MANAGEMENT DISTRICT AND FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION TO REDUCE PERMIT APPLICATION FEES IN ACCORDANCE WITH FLORIDA STATUTES SECTION 218.075; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. 17.104 D. Resolution No. R-17-19 — Home Rule and Unfunded Mandates (Transmittal, R-17-19) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, REQUESTING THE FLORIDA LEGISLATURE TO SUPPORT A PROPOSAL REQUIRING STAFF ANALYSIS FOR PROPOSED LEGISLATION TO INDICATE WHETHER THE PROPOSAL IS AN UNFUNDED MANDATE OR IMPACTS THE HOME RULE OF FLORIDA MUNICIPALITIES. 17.114 E. Approve Road Closures for Christmas in July — Shop with a Cop Event, July 22, 2017 from 9 a.m. to 4 p.m. (Transmittal, Application, Schematic, List) MOTION by Vice Mayor Coy and SECOND by Mr. Dodd to approve consent agenda items A-E. 2 Regular City Council Meeting June 28, 2017 Page Three ROLL CALL: Motion carried 5-0. No public input or action except for City committee member nominations and appointments under this heading. 17.115 A. Parks and Recreation Advisory Committee (Transmittal, Applications, Ad, Roster) i. Interview, Unless Waived, Submit Nominations for Two Regular Member Positions — Term to Expire 5/31/2020 ii. Interview, Unless Waived, Submit Nominations for One Alternate Member Position — Term to Expire 5/31/2020 The City Clerk reported that Ms. Webster would like to serve again, alternate member Ms. Gilroy would like to move up to a regular member position, and Mr. Sunnycalb had submitted an application. Mayor McPartlan nominated Ms. Webster to serve again, Ms. Gilroy to move up to the regular member position and Mr. Sunnycalb serve as the alternate. Mr. Dodd seconded the nominations. There were no other nominations. 17.116 B. Police Pension Board (Transmittal, Application, Ad, Roster) i. Interview, Unless Waived, Submit Nominations for Two Members — Term to Expire 6/2021 The City Clerk reported that Mr. Williamson was not in attendance but would like to serve on the Board and Ms. Vicars was available to interview. Mr. Dodd nominated Mr. Williamson and Ms. Vicars to the positions. Vice Mayor Coy seconded the nominations. There were no other nominations. 9. PUBLIC HEARINGS - None 10. UNFINISHED BUSINESS 17.117 A. Approve Velocity Lease Extension of Hangar B Until October 2045 (Transmittal, Lease, Letter) The City Manager said Mr. Duane Swing is requesting the lease extension and staff is recommending approval. MOTION by Mr. Hill and SECOND by Vice Mayor Coy to approve the Velocity lease extension until October 2045. ROLL CALL: Motion carried 5-0. PUBLIC INPUT New information or requests to city council not otherwise on the prepared agenda Ben Hocker, Sebastian, said Hurricane Matthew came October 6 and there hasn't been any activity at the Yacht Club dock, Main Street dock or Working Waterfront except for the demolition of the Boudrot dock. He asked what is happening. The City Manager reported the poles are being built offsite and were going to be delivered around the 4`" of July but he asked them to come July 10 to avoid the festival activities. Jim Sunnycalb invited the public to walk with him and other dog owners in the 4t' of July parade in honor of fallen K9 Officer Diesel. 12. NEW BUSINESS 17.118 A. Resolution No. R-17- 20 — Interlocal Agreement Between Indian River County and the City of Sebastian — Airport Zoning Regulations (Transmittal. Agreement, R-17-20) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF SEBASTIAN AND INDIAN RIVER COUNTY CONCERNING AIRPORT ZONING REGULATIONS AS PRESCRIBED BY FLORIDA STATUTE; PROVIDING .FOR CONFLICT; PROVIDING FOR AN EFFECTIVE DATE. The City Manager said this is required by a new Florida Statute and the City could either enter into an interlocal agreement to adopt and enforce protection zoning regulations or create a board to adopt and enforce procedures. He recommended entering into the agreement with the County as the City of Vero Beach has done. MOTION by Mayor McPartlan and SECOND by Mr. Dodd to approve Resolution No. R-17-20. ROLL CALL: Motion carried 5-0. 17.119 B. Mr. Hill —Aye Mayor McPartlan - Aye Mr. Dodd —Aye Agreements, Info Sheet, E -Mail) Ms. Kinchen —Aye Vice Mayor Coy — Aye The City Manager said the current lease purchase agreement will expire in November this year and he would like to piggyback onto the Plantation Preserve agreement to purchase new golf carts. He recommended approval. Mr. Dodd pointed out the Golf Course is purchasing the 80 carts and they are being financed just like a car with the Golf Course revenues as opposed to the City's general fund. MOTION by Mr. Dodd and SECOND by Mr. Hill to approve the lease/purchase agreement with Club Car and DLL Financial Services to purchase 80 carts. Regular City Council Meeting June 28, 2017 Page Five Mr. Hill asked if there could be a cooler on one side of the carts as opposed to two sand buckets. The City Manager noted the Procurement Manager was able to add an umbrella to cover the clubs that was not included in the Plantation Preserve contract and requested the opportunity to see if an additional request would be granted. CITY MANAGER MATTERS Mayor McPartlan - Aye Mr. Dodd — Aye The City Manager cited the July 4 Waste Management collection schedule. 15. CITY CLERK MATTERS - None 16. CITY COUNCIL MATTERS A. Charter Officer Evaluations in Accordance with Resolution No. R-12-08 (Transmittal, R-12-08) Mayor McPartlan and Vice Mayor Coy reported they would meet with the officers in the near future. Mr. Hill reported that he has met with the City Manager and City Clerk. Mr. Dodd said he has met and completed the forms for the City Manager and City Clerk and he appreciated the City Attorney's legal advice. MOTION by Mr. Hill and SECOND by Vice Mayor Coy to provide increases for the Charter Officers as provided in their contracts which follows suit to the union negotiated contract. Mayor McPartlan noted he is in regular communication with the officers and feels they are Aces in his book. ROLL CALL: Motion carried 5-0. Mayor McPartlan - Aye Mr. Dodd —Aye Ms. Kinchen —Aye Engagement Letter for Zitzman Appeal Vice Mayor Coy — Aye Mr. Hill —Aye The City Manager said the City was recently served a Circuit Court appeal on a recent magistrate order. In agreement with the City Attorney Ginsburg, he requested engaging outside counsel to handle the appeal. If the expense exceeded his spending authorization, he would report back to Council. Regular City Council Meeting June 28, 2017 Page Six Mr. Dodd asked that the engagement letter include other services that might be needed while City Attorney Ginsburg is getting well. He suggested the outside attorney could work together with Mr. Ginsburg and lay the ground work on issues that might come up. The City Manager requested that be a separate engagement letter but the same person. It was the consensus of Council to proceed with two engagement letters --one for the Circuit Court appeal and on a temporary basis, one for any legal issues that might come up. B. Council Member Hill Mr. Hill said in addition to the public input speaker, he is receiving a lot of feedback regarding the repair of the docks and they probably could have done better regarding the hurricane repair. For the most part, Council and staff are very good at what they do, but at times they should realize that they should do better next time. C. Council Member Kinchen Ms. Kinchen wished everyone a happy 4'h of July. D. Mayor McPartlan Mayor McPartlan also wished everyone a happy 4'h of July. He noted that he watches the replay of the committee meetings and said he appreciated the volunteers serving on the boards and committees. He also noted the employees are working hard to prepare for the 4'h of July and he thanked the City employees and police. He also thanked the City Manager for leading the team. E. Vice Mayor Coy Vice Mayor Coy wished everyone a safe and happy 4`h of July. During the parade, she asked the public to refrain from squirting the parade participants. F. Council Member Dodd - None 17.
