MARCH 8, 1995'
1. CALL TO ORDER
Meeting was called to order at 5:05 p.m. by John Kanfoush,
Chairman.

2. APPROVAL OF MINUTES - January 11, 1995
Motion by Edra Young and seconded by Phillip Foster to approve
the minutes of January 11, 1995 as written.
3. NEW BUSINESS
CODE ENFORCEMENT - PRIVATE SECTOR, BRUCE COOPER, DIRECTOR OF
COMMUNITY DEVELOPMENT: Bruce Cooper presented an overview of
the role of code enforcement in the private sector along with
handicap parking code enforcement. The City of Sebastian is
one of few cities who are enforcing handicapped parking
accessibility retroactively, meaning existing businesses as
well as new businesses must comply based on Florida Statute 553.
A friendly letter was sent to all businesses letting them know
they must be in compliance. Even if a business has only one
parking space, it must be for handicapped.

Various parking situations and remedies were discussed. Wendy
inquired whether the code enforcers routinely checked new
businesses for accessibility and they do not, only if a complaint
is received.
Bruce explained the meaning of the grandfather clause,
and conforming and non -conforming use in relation to building
renovations, parking, etc.
Edra Young asked how she could be notified of the burning
that goes on at night and fills her home with smoke causing her
breathing problems. She was asked to call the police department
and fill out a incident report which will be forwarded to Bruce
Cooper's office for investigation.
Eugene Ewert, Senior Sergeant, Police Department was present
to answer questions regarding parking violations and how they
are enforced.
John Kanfoush inquired what violations determine if a ticket
is issued or not. The Florida Statutes rules are very specific,
and the option of issuing or not issuing a ticket is left to
the discretion of the officer. Also, if a car is illegally
parked and the owner cannot be found to issue a ticket, the
car can legally be towed away.
Phillip Foster brought up the problem he had with a car
illegally parked in a striped van access handicap parking
place. Discussion followed.
4. COMMITTEE MEMBER ISSUES
John Kanfoush brought in a article that he thought shows that
action will be taken if enough publicity is given a subject,
referring to the Sports Complex handicapped access sidewalk.
Edra Young inquired about the status of handicapped access
to the boardwalk at the Riverfront.
George Schum mentioned that AARP would like a representative
from this committee to speak at their September 20th meeting.
John Kanfoush volunteered and if for some reason he could not
attend, Wendy said she would speak. This may be a good
opportunity for the committee to stress the need for
additional handicapped parking in areas where seniors
congregate. Discussion followed.
REVIEW NOMINATION FOR VACANT POSITION:
A motion to accept the application of Catherine Ackerman for the
alternate position was made by George Schum and seconded by
Phillip Foster with the stipulation that she be asked to be
present at the meetings even though she is an alternate member.
Her application will be presented to City Council for approval.

5. OLD BUSINESS
UPDATE OF BARBER STREET SPORTS COMPLEX: Wendy gave an update on
the accessibility conditions at the Sports Complex which are
bad because of all the rain. A meeting has been scheduled to
come up with a way to complete the concrete walkway project at
a less expensive more direct route and still maintain green
area for drainage, etc. Completing this project is the
committee's priority.
The blue lines outlining the handicapped parking spaces
throughout the city need to be repainted.
The:restroom entrances at City Hall need to be enlarged to
accommodate wheelchairs and how to accomplish this without a lot
of expense is a concern. Depending on the project, alternate
arrangements can sometimes be worked, out.
It would be beneficial if someone from the committee would
look over the plans for the sidewalk at the sports Complex to
make sure they are really handicapped accessible.
Wendy had duplicates of ADA and EEO regulations and manuals that
she made available to the committee.
6. OTHER BUSINESS
Phillip Foster announced that the Parent To Parent
organization, a group for parents with disabled children, is
having a fund raiser and needs volunteers to sell tickets
this coming Saturday, March llth.
7. ADJOURN
A motion to adjourn the meeting at 6:20 p.m. was made by John
Kanfoush and seconded by Edra Young.
