No. 9611 - Sebastian Highlands, Unit 5 Drainage
Dear Ms. Campbell:
My understanding is that you are in receipt of a letter from Mr. Stephen Moler, concerning the
inclusion of a drainage outfall in the plans for the above Indian River County roadway project.
Indian River County is in conceptual agreement to coordinate with the City of Sebastian in having
this outfall structure constructed on CR 512 right-of-way. There are issues however that need to
be resolved prior to the construction of this outfall concerning the financial obligations and the
maintenance responsibilities of each of the parties, the City of Sebastian and Indian River County.
I have spoken with Mr. Terry O'Brien, of the Indian River County Attorneys Office, concerning
an agreement that could be drafted for the purpose of reaching an understanding between the
parties on these matters. Practically speaking, what we would do is include the items for your
work in our contract, as separate items on the bid sheet, and for which the contractor would place
a unit bid amount for each item. The cost of the City work could then be determined, and the
City would not incur any costs for any incidental County work. This way the City would have an
accurate as possible estimate of how much the work would cost, and could approve, or
disapprove, having the work done under the County's contract, in the foil knowledge of the actual
cost, realizing that additional work, or quantity overruns, would need to be provided for.
However, before we would award the bid the County would like to have a certain percentage of
the total work, based upon the engineer's estimate, put in an escrow account, from which the
County could pay our contractor when billed. The City could remit subsequent payments as
reimbersal to the County as the work progresses. The County would have assurance that money
would be available to make the first months obligation when the contractor presents his draw
request.

As to maintenance responsibilities, because the storm drain line would be separate, it should be
easy to determine financial obligation for maintenance and the County would require no different
regulations than of other public utilities for maintenance activities, or construction, in the right-of-
way, if in the future excavation, or other work, in the right-of-way might need to be done on the
City's storm drain line.
It appears that to progress from here we would need to have some official action by the City, such
as a resolution requesting County staff to include the engineering services on the County
agreement as additional services and an agreement to reimburse that amount to the County for the
engineering services arrived at by a negotiation with Masteller & Moler, Inc., subject to City staff
approval of the negotiated amount. If this seems acceptable and correct to you, let me know and
we can prepare the documents necessary from the County's standpoint and begin the process of
getting the engineering services underway after arriving at a statement for the Scope of Services
County Engineer
