DESCRIPTION AND CONDITIONS
512 Corridor
Indian River County entered into a Professional Services Agreement with Masteller & Moler, Inc.
on January 21, 1997. Due to the request by the Board for inclusion of special landscape design; we
have had the Engineer obtain the service of a landscape design professional. Those services are being
presented as an Addendum to this Agreement. Also, at the County's request, two items have been
added to the Scope of Services, one is the construction phasing so the project can be broken into two
projects for construction; and the second is to expand the drainage design to include areas on the
existing CR 512 right-of-way which had been draining through the San Sebastian Springs
Subdivision, to collect that area and direct it into the new CR 512 system. Also, in the process of
coordinating the project with the City of Sebastian, the City has informed us they would like to have
a drainage pipe constructed on CR 512 right-of-way, which will allow them to convey the run-off
coming from a portion of the Sebastian Highlands Subdivision, and remove it from flowing through
the San Sebastian Springs Subdivision as well. These items of work are included in the attached
Addendum to the Agreement. The landscape design has its own Scope of Services, which is attached
as "Exhibit A". Included along with the Addendum is an Interlocal Agreement with the City of
Sebastian providing for the County to include the additional services in its Professional Services
Agreement and for the City to reimburse the County for the cost thereof for the design and permitting
of the drainage pipe on CR 512 right-of-way, and for the County to include the subject drainage pipe
in the construction contract for CR 512, Roseland Road to I-95. The City of Sebastian will reimburse
the County for the construction of the subject pipe. The fees for the above work are as follows:
Professional Services - Landscape Design $33,000.00
Construction Phasing $ 9,550.00
Drainage Design Expansion $ 4,100.00

TOTAL; $61,910.00
The charges associated with Section V 5. described above is $61,910.00. The Agreement shall be
increased from $471,500.00 to $533,410.00.
ALTERNATIVES
Alternative No. 1 - The Board approve the Addendum No. 1 to the Professional Services Agreement
for CR 512 with Masteller & Moler, Inc. and the Interlocal Agreement with the City of Sebastian for
the inclusion, on the Professional Services Agreement with Masteller & Moler, Inc., and in the
construction contract, for the drainage pipe in CR 512 right-of-way, and that the Board direct the
Chairman to execute these two agreements on behalf of the Board.
Alternative No, 2 - Not to approve these agreements.

AMENDMENT NO. 1 TO THE PROFESSIONAL
ENGINEERING SERVICES AGREEMENT
CR 512 CORRIDOR IMPROVEMENTS
IRC PROJECT NO. 9611
THIS is an amendment to the existing AGREEMENT dated January
21, 1997, between MASTELLER & MOLER, INC. (ENGINEER) and Indian
River County (COUNTY). This Amendment addresses changes in
"Section III - Scope of Services " and "Section V - Compensation",
of the AGREEMENT.
SCOPE OF SERVICES
The section of the AGREEMENT entitled "Section III - Scope of
Services" shall be revised to include the additional professional
services as described in the attached Addendum No. 1.
The section of the AGREEMENT entitled "Section V -
Compensation" shall be revised in response to the Scope
modifications set out in the attached "Addendum No. 111. The
charges associated with Section V 5._ described above is $61,910.00.
AGREEMENT shall be increased from $471,500.00 to $533,410.00.

executed, shall be governed by and construed by the laws of the
State of Florida.

INDIAN RIVER COUNTY PROJECT #9611
COUNTY ROUTE 512 CORRIDOR IMPROVEMENTS

ADDENDUM SCOPE OF SERVICES:
L LANDSCAPE DESIGN:
Indian River County has requested that the scope of services for this project be expanded to
include Landscape Design Services. The County has established a budget of approximately $20
to $25 per linear feet of roadway ($467,000.00 maximum) for design and construction of
landscape improvements to be included within the CR 512 project.
The Scope of Services to be provided are included within Exhibit "A" attached hereto entitled
"Attachment to Agreement for Professional Services."
The Scope of Services for this project will be expanded to provide for the above described
Landscape Design Services for the Lump Sum Fee of $33,000.00 to be apportioned to the "East"
(Phase III) and "West" (Phase IV) Sections of the project in the amounts of $18,150.00 and
$14,850.00, respectively as described in Item Il.
II. CONSTRUCTION PHASING:
The County has determined it is in their best interest to sequence the project's construction by
constructing first the "East" improvements from Roseland Road to approximately 800 feet west
of the Sebastian River Middle School site including the intersection of CR 512 with CR 510 and
the bridge at the South Prong of the Sebastian River followed by the "West" improvements from
the Sebastian River Middle School west to Interstate 95. The "East" portion of the project will
be known as Phase III, while the "West" section will be referred to as Phase. IV.
Expanded Design Services shall be provided to include plans for the interim roadway
improvements necessary to allow for transition of the new "East" four -lane improvements into
the existing two-lane "West" section near the Sebastian River Middle School. The design
services shall include provisions for interim roadway improvements, drainage, utility
accommodations, specifications, traffic control (MOT) striping/signage. This work does not
include separating the project's drainage design into two (2) separate SJRWMD permit
applications.
The Scope of Services for this project will be expanded to provide for the above described
Construction Phasing Services for the Lump Sum Fee of $9,550.00.

III. DRAINAGE DESIGN EXPANSION:
The original professional services agreement for this project included providing drainage design
services to include the treatment and attenuation of stormwater runoff from the proposed project
improvements. The original professional services agreement for this project was also based on
providing improvements to allow for continuation of existing drainage of traversing systems.
Indian River County has determined that this project's drainage scope should be expanded to
provide for improved control of runoff from a contributing area beyond the limits of this project.
Specifically, the County has requested that all stormwater runoff from the existing four -lane
County Route 512 right-of-way east of Roseland Road (CR505) which in its existing condition is
conveyed in a westerly direction to the traversing system at approximately Station 318+00 on CR
512 be diverted to the proposed project's stormwater management System "E." This will
eliminate a portion of the CR 512 Phase I project drainage from outfalling through the San
Sebastian Springs Subdivision.
Analysis shall be completed to determining the extend and conditions of the increased drainage
shed area to be diverted to the project's stormwater management system. The stormwater
management system shall be re -designed to include the expanded drainage area to provide for
treatment and attenuation of runoff from the expanded drainage area. The design shall inlcude a
Conflict Structure at approximately Station 318+00 to allow for the existing drainage ditch south
of CR 512 to continue to flow north across the CR 512 right-of-way to drain Roseland Acres and
portions of Sebastian Highlands Unit 13 through San Sebastian Springs.
The expanded scope of services does not include consideration to modify the drainage
contribution through San Sebastian Springs from the Sebastian Highlands Unit 5, Unit 13, and
Roseland Acres areas.
The Scope of Services for this project will be expanded to provide for the above described
Drainage Design Expansion services for the Lump Sum Fee of $4,100.00.
W. CITY OF SEBASTIAN ADDITIONAL SCOPE OF SERVICES
The scope of engineering services to be provided to the City of Sebastian for. the "Blossom Ditch
Diversion System" project are intended to provide for redirecting the existing Blossom Ditch
which currently serves as the outfall system for Sebastian Highlands Unit #5. The Blossom
Ditch currently flows through San Sebastian Springs and the City desires that the San Sebastian
Springs ditch not be utilized as the Blossom Ditch outfall. The diversion is intended such that
the Blossom Ditch drains directly to the South Prong of the Sebastian River via a route within
the County Route 512 Right-of-way.

It is our understanding that the City of Sebastian has met with the St. Johns River Water
Management District regarding the above described concept and that the District has indicated
favorable acceptance of the rediversion plan, on the basis that the outfall be equipped with a
baffle box structure for containment of silts and sediments. On the basis of the above described
concept, approved by both the City of Sebastian and Indian River County, we propose to perform
the following engineering services under our Contract with Indian River County:
Scone of Services
We shall, through a visual field inspection and available topographic information, confirm
the drainage basin area contributing stormwater runoff to the Blossom Ditch from the
Sebastian Highlands Unit #5 area upstream of San Sebastian Springs. Computations will
be finalized to determine the anticipated stormwater runoff from the Blossom ditch drainage
basin that will need to be diverted via a conveyance system along the County Route 512
Right-of-way to the South Prong of the Sebastian River.
Once the stormwater computations have been developed, we shall design a stormwater
conveyance system to accept and convey runoff from the Blossom Ditch to the South Prong
of the Sebastian River. The design shall also include a baffle box to provide removal of silts
and sediment prior to discharge to the River. The design of the stormwater conveyance
facilities and baffle box shall be completed in a manner consistent with the County Route
512 Four (4) Lane Roadway Improvements project. It is intended that the proposed
construction be included within the Four (4) Lane CR 512 Roadway Improvement
construction plans. We shall coordinate providing plans to the City, County and SJRWMD
to assure acceptance of the Conceptual Design.
It is anticipated that permitting of the above described stormwater conveyance diversion will
need to be permitted separately through the SJRWMD independent from the County Route
512 project.
The Scope of Services for this project will be expanded to provide for the above described City
of Sebastian Additional Scope of Services for the Lump Sum Fee of $15,260.00.
The Scope of Services described under Item IV are to be billed to Indian River County, however,
benefit the City of Sebastian. As such, this work will not be initiated until the issuance of a
Notice to Proceed from the County. It is understood that the Notice to Proceed will be issued
once the County has an acceptable agreement with the City of Sebastian for this additional Scope
of Services and reimbursement provision.

DRAINAGE DESIGN EXPANSION
A. Evaluate by Field Observation & Topographic Survey review the size of the CR 512 Basin
Area beyond the project limits contributing to the existing ditch and culvert draining north at
Station 318+00.
B. Revise System Modeling Input Nodal Data to separate East area of CR 512 from contributing
to San Sebastian Springs, to reflect increased basin area to be delivered to System E and
reduce area draining to existing ditch and culvert at Station 318+00.
1) Rerun hydrology for 02 -yr, 10 -yr, 25 -yr, 50 -yr and 100 year stone events.
2) Design by trial and error revised appropriately to Wet Detention System "E" to provide
proper control of runoff for the expanded Basin E drainage area. Run hydraulics until
model provides reasonable results.
C. Revise the Construction Plan design for System E Wet Detention System.
D. Re -design Stormwater Conveyance East of South Prong of the Sebastian River.
E. Design a Conflict Structure at Station 318+00 to allow CR 512 runoff from East of culvert to
be directed to System E while allowing contributing ditch from South at Station 318+00 to
continue to drain north through San Sebastian Springs.
F. Revise Stormwater Management Report Text and Computations to incorporate description of
design change to System E.

PROJECT NAME AND LOCATION:

SCOPE/SERVICES:

Meet with County staff and Client to review proposed Approach to the Project, and to
define the specific direction to proceed. Unless otherwise directed by the County, the
design shall conform to FDOT Standard Index 546 regarding sight lines, clear zones, etc.
PRELIMINARY DESIGN PHASE:
Prepare preliminary landscape design concept drawings (plan view) at an appropriate scale,
using digital files provided by Client as base maps. In addition, prepare a Preliminary
Project Design Report booklet, to include photographic images of selected project
improvements, including the plant palette, and other design elements. Photo -realistic
images shall be prepared to illustrate the proposed enhancements to be made at the I-95
Interchange (both "before" and "after" conditions). Color illustration drawings and
sketches shall be prepared to depict other proposed enhancements. The proposed irrigation
design criteria shall be outlined, and cut sheets provided for the system components.
Design for any "hardscape" improvements such as planters, low landscape walls,
decorative site lighting features, signage, or decorative paving will be included in the scope
of landscape architectural work, provided that the construction cost for these design
elements falls within the anticipated total landscape construction budget of $20-25 per 11,
including design fees.
Prepare preliminary opinion of probable landscape and irrigation construction costs.
Coordinate with Client and County regarding the proposed improvements.
Attend preliminary design phase project review meeting with the County and Client.
FINAL DESIGN PHASE-

HA E:On the basis of the approved Preliminary Project Design Report, prepare final construction
drawings:
A. Final landscape drawings shall include plant schedule with botanical and
common names, and plant size specifications.

B. Proposed landscaping shall meet or exceed Indian River County requirements.
C. Irrigation drawing shall be designed to provide 100% automatic coverage to all
landscaped areas, taking into account the proposed plant material watering
requirements, and soil conditions.
D. Hardscape construction drawings shall be prepared for any design elements
identified in the preliminary design report. These shall include layout &
dimensioning, grading, and construction details. Electrical engineering, if
required, shall be subcontracted under the landscape architect's design contract.
Prepare final opinion of probable construction costs for landscape and irrigation
improvements.
Prepare landscape and irrigation bid breakdown form, and Division II technical
specifications. Prepare of list of pre -qualified landscape contracting funis. (Irrigation
work to be subcontracted through the Landscape Contractor).
BIDDING PHASE:
Review, and tabulate bids for landscape and irrigation construction. Make recommendation
to Client regarding award of Contract for landscape & irrigation construction.
Attend a pre-bid conference to review the proposed project with the prospective bidders,
and to answer questions as required.
Issue any necessary written Addenda (for Client to incorporate and issue) to clarify issues
to the prospective bidders.
MEETINGS: Landscape Architect shall coordinate with Client throughout the project, and
shall meet as needed with the Client to facilitate proper coordination of the Landscape
Architect's work with that of the Client. County review meetings are anticipated to be at
certain key milestones as follows:
A. One meeting to review the approach to the project, and to chart a course of
action regarding landscape and irrigation enhancements.
B. One meeting. to review preliminary landscape design concept drawings,
preliminary design report booklet, preliminary opinion of probable landscape
and irrigation construction costs; to receive review comments, and authorization
to proceed with final landscape and irrigation design and the preparation of final
construction drawings.
C. One meeting to present final construction drawings and specifications, and to
discuss the bidding phase of the project.
It is anticipated that this number of meetings will be adequate for the project; however, if
additional meetings are required, the cost will be considered as additional services to be
billed on an hourly basis.
CONSTRUCTION REVIEW:
Attend pre -construction conference at the site to coordinate with the Landscape Contractor.
Assist the Client as required to prepare proposal requests, change orders to the contract for
construction, and perform other such contract administration functions relative to the
landscape and irrigation portions of the project.

Observe the work of the contractor on an intermittent basis not to exceed a total of eighteen
(18) site visits as requested by Client to observe work progress and to determine if the
construction is proceeding in general accordance with the contract documents.

Review and approve:
A. Shop drawings and samples.
B. Results of tests and inspections.
C. Other data which the contractor or subcontractors are required to submit.
Monitor contractors progress relative to established schedules and report status to Client by
preparing field reports for each site visit.
Project close out shall begin upon notice from the Contractor that his work, which is
believed to be acceptable to the Client, is substantially complete and in general accordance
with the contract documents. At this point in time, the Landscape Architect shall conduct a
walk-through with the Client's representative to verify that the work conforms to the
contract documents, and to establish a "punch list" of items to be completed or corrected.
Upon notice by the contractor that the "punch list" has been completed, and that the work is
ready for final inspection and acceptance, the Landscape Architect shall conduct a walk-
through to verify "punch list" completion for final acceptance of the work by the Client.
If deficiencies are found, these will be itemized and a follow up walk-through will be made
to verify final completion of the work.
Visits for the purpose of project close out as described above, are included in the eighteen
(18) site visits indicated above.
Meet with Client to review design recommendations contained in the preliminary design
report. On the basis of the Client's prioritization, and anticipated funding available for
implementation, prepare a grant application package to the FDOT Highway Beautification
Grant Program. Work shall include preparation of all necessary drawings, cost estimates,
maintenance information, and application forms.
Review design drawings, cost estimates, and grant information with Client. Submit the
approved grant application package to FDOT by February 1, 1999.
FEE ARRANGEMENT:
The Client agrees to pay the Landscape Architect for professional services as follows:
A lump sum of Twenty Eight Thousand, Six Hundred Fifty Seven Dollars ($28,657.00),
according to the following schedule of values: '

ADDITIONAL SERVICES:
Additional services may include, but not be limited to the following items:
1. Making revisions in drawings, specifications, or other documents when such
revisions are inconsistent with written approvals or instructions previously given,
and are due to causes beyond the control of the Landscape Architect.
2. Changes in design concept and/or budget subsequent to receiving approvals at the
preliminary design stage
3. Providing services other than the normal landscape architectural services required
for landscape approval of the project.
4. Site grading and drainage design
5. Site visits other than those defined in SCOPE/SERVICES, for the purpose of
approving the Contractor s requests for payment.

INTERLOCAL AGREEMENT
between
INDIAN RIVER COUNTY, FLORIDA
and
CITY OF SEBASTIAN, FLORIDA
This Interlocal Agreement, entered into this day
1998 by and between INDIAN RIVER COUNTY, FLORIDA, a political
subdivision of the State of Florida, by and through its Board of County
Commissioners, hereinafter referred to as COUNTY, and the CITY OF
SEBASTIAN, FLORIDA, a municipal corporation of the State of Florida,
hereinafter referred to as CITY, for the purpose of providing road and drainage
facilities.
WITNESSETH:
WHEREAS, the COUNTY and CITY share mutual concerns with respect
to road and drainage facilities for CR 512 and Sebastian Highlands
Subdivision; and
WHEREAS, the COUNTY has an existing Engineering Service Agreement
dated with Masteller and Moler Engineers for the design of
improvements to CR 512; and
WHEREAS, both the COUNTY and CITY can assist each other through a
joint effort that will facilitate a solution to the road and drainage problems in
the area; and
WHEREAS, an undertaking of this nature is in keeping with the "Florida
Interlocal Cooperation Act of 1969" as set forth in Chapter 163, F.S.
NOW, THEREFORE, in consideration of the mutual terms, conditions,
promises, covenants and premises hereinafter set forth and pursuant to the
statutory authority contained in Chapter 163, F.S., the COUNTY and CITY
agree as follows:
1. The COUNTY shall cause to be added to the existing professional services
agreement services, for the design, permitting, and other necessary services
as directed by the CITY, to incorporate the installation of a drainage pipe
and appurtenant structures and other necessary facilities in the COUNTY's
construction contract for CR 512 Improvements (Project 9611).
2. The COUNTY in connection with the construction of CR 512 shall provide
for the new installation of drainage pipe to serve a portion of Sebastian
Highlands Subdivision also known as Blossom Ditch.
3. The CI'T'Y shall make timely payments to reimburse the COUNTY as the
engineering work progresses.
4. The CITY shall pay to the COUNTY upon installation of the drainage pipe
and baffle box all costs associated with said installation.
5. The COUNTY shall provide the CITY with proposals and bids for the
proposed project indicating scope, cost and schedule for CITY approval prior
to giving notice to proceed.
IN WITNESS WHEREOF, the parties hereto have caused this interlocal
agreement to be executed by their duly authorized officials on the day and year
first written above.
