This agreement made on the _t g day of February, 2004, by and between DALE
ANN BERMEL, whose address is 929 Louisiana Avenue, Sebastian, FL 32958, Grantor,
and the City of Sebastian, a municipal corporation of the State of Florida, whose address
is 1225 Main Street, Sebastian, Florida 32958, Grantee.
NOW THEREFORE, in consideration of the sum of Ten Dollars ($10.00) and
other good and valuable consideration, the receipt of which is hereby acknowledged,
Grantor grants and conveys unto Grantee, its successors or assigns, a perpetual public
easement to lay out, construct, inspect, operate, maintain, repair and install sidewalks,
utilities, drainage facilities, together with the right to remove trees, bushes, undergrowth
and other obstructions interfering with the location, construction and maintenance of the
facilities all over, under, across and through the following described land (hereinafter
referred to as "Easement Area"):

IN WITNESSETH WEEREOF, the Grantor, and the Grantee have executed this
Easement on the day and year first written above.

I had a resident call and tell me that FPL had been out to repair a line behind her house (462 Ponoka St)
that is in a City Right of Way. In the process they had to use her driveway and yard to get back to the ROW
to make the repair and broke her driveway. They are going to take care of the driveway but they (Ford
Smith out of Ft. Lauderdale) told her to call the City and tell us that it was the City's responsibility to clear
out our ROW so that they can get to their pole line located in our ROW. If they are using our ROW, what is
our responsibility as far a clearing it out for them to have access. This area has been natural for years. Last
year we did rehabilitate the drainage in some of that ROW (located between Ponoka and Collier Club) so
that it would no longer pond between the two developments. My thought is that if FPL wants to use our
ROW for their lines that they would have to make their own access. Is this true?
