Mrs. VanBuskir:; has a long history of harassment of this permit and project, which is in compliance (--ee enclosure). It appears from her September 23, 1997 letter (copy enclosed) that she is seeking easement to a little dock she wants on this ne=arly completed lake. All her concerns have been answered by all State and local legislative bodies, yet she continues to seek the answered questions. The enclosed documents will show her long standing involvement in the permit process. The project is in compliance in all aspects - size, depth and permits. Thant. you. Also over the last 3 to 4 months, residents living on Lance Street have made numerous complaints to the County Utilities Department regarding water quality. „'they are very concerned about the tea colored water coming into their homes. You are correct in your statement that our most recent permit issued for the Vickers Sand Mine authorized the expansion of the sand mine to 107.7 acres. This permit was issued in May 1997 and is valid for 5 years after issuance. To confirm the present size of the pit, we have requested that the permittee provide a boundary survey demonstrating that they have not exceeded the permitted size (see attached letter from Janice Unger, Compliance Manager). In regards to the complaints about the water quality in some adjacent wells on Lance Street, Jorge Morales contacted you in order to get the names and.addresses of the people who have been experiencing problems. You were unable to provide us with any -specifics; however, you did mention that Indian River County Utilities had been contacted but that no response had been provided. Mr. Morales contacted Indian River County and was told that the houses along Lance Street are connected to Indian River County Utilities and that the water lines serving these homes are currently being replaced to deteriorating conditions causing high levels of iron in the ,water. I will attempt to provide answers to the questions which are within the authority of the' St Johns River Water Management District and that which was authorized by the above permit. 1) Although a specific restoration plan was not approved as part of the permit, the approved plans do include a requirement for a finished side slope for the pit and conditions which specifically require that all exposed areas be stabilized after completion of construction in order to prevent erosion. I have enclosed a copy of the approved•plans and permit for your information. 3) District staff does monitor the progress of the sand mine; however, the particular type of material used for stabilization (including concrete rubble) is not specificed in the permit. 4) Our staff reviews water quality data taken from monitoring wells located adjacent to the sand mine. This is to insure that the excavation of the pit is not causing higher chloride groundwater to migrate upward into the surface water mine. To date, the monitoring data does not indicate that this is occurring. 1 have enclosed a copy of the latest monitoring report - 11 _ vZN 7) As stated above, the permittee monitors the water quality through sampling a series of monitor wells. I am not aware of water quality testing occurring within the mined area. I am concerned with your statements regarding the type of material being placed in the mined area and I will send a copy of your letter and my response to the Florida Department of Environmental Protection (FDEP). (Sec. 20A -SM) The first submittal of the 1997 annual report was not acceptable to staff because it was incomplete. In compliance with code enforcement proecdums. the apphcam was notified of the deficiencies. Within mine days of the date of my letter. a revised annual repo -r waR submitted. The revised report was found to complete sad acceptable to iiaff., I have also responded to the additional questions and comments which yott addressed to the City Council on Fcbruary 4, 1998. The first sand alining regulations were approved on Novanbet 30, 1988 (0-88-27). The Vickers Subdivision Preliminary Plat wet approved by Resolution R-40-44 on Septornbat 13. NO and again on June 12. 1991 by Resolution R-91-18. The location of Gilson Avenue next to the sand mining opaationa was approved at that time. Vickers Road is assumed to be the road for Vickers Grove industrial Subdivision. That road is propwod to be a private road, therefor, the mining activity is exempt from setback requirements. Attached you will find a historyof all City Council actions taken on Vickers Grove Industrial Subdivision and Vickers Sud Mine. I trust this information will answer your questions. To bier answer any future questions you may have, we am in the process of composing a history of Vickers Grove Sand mime. This history will be made available to you as soon as possible. On 2112/98, 1 visited the site and contacted Charles Cramer, Director of Operations. Together we proceeded to investigate the compliant. The investlgation revealed that the dredge unit had been lifted by crane onto the south bank of the sand mine where engine maintenance (such as replacing wam impellers and engine parts) and refurbishment ( such as painting and lubrication) was being performed. Mr. Cramer stated that they overhaul the unit approximately every five years. Attached you will find a copy of the District's laboratory analysis report. On this report the Station name P -RM-- represents a blank sample (D.I. water), the UNKNOWN sample is the actual sample from the mine, and FD---- represents the duplicate sample I took to test for precision. As you can see, the duplicate sample produced results that were very close to the UNKNOWN sample, indicating a high degree of precision in the results. In accordance with Mrs. Van Buskirk's request, I sent Aer a copy of the results and a letter discussing the results. Rather than duplicating my efforts and writing another discussion, I attached a copy of this letter for your review. This sample was obtained on May 12, 1998, from the shoreline near the northwest corner of the pit (near Lance Street). The results of the analysis of this sampling are attached and discussed in this letter. Please be aware that the borrow pit is not designed, or constructed, to have any off-site surface water discharge. According to Chapter 62-302, Florida Administrative Code, which describes Surface Water Quality Standards, the pollution limits, or criteria, apply to receiving waters, outside the zone of mixing. Since the borrow pit does not have a surface water discharge, and thus has no off-site receiving waters of the State, these water quality standards do not apply in this case. As such, in the following discussion, any reference or comparison of the concentration of a particular parameter (chemical) to a State water quality criterion (concentration limit) is strictly for the purpose of illustration of which parameters may be considered high in an unlikely, hypothetical case, where a surface water discharge may have occurred. The water temperature was 27.3 degrees Celsius, the pH was 7.02 standard units, the dissolved oxygen was 7,01 mg/L (milligrams per liter) and the conductivity, an indicator of the abundance of dissolved ions, was 392 umhos/cm (micromhos per centimeter). Harden oceLA field Hushes The calculated water hardness, at 142 mg/L, is considered moderately hard, and entirely acceptable for most water uses. The levels of calcium (46.05 mg/L) and magnesium (6.49 mg/L), both of which contribute to total hardness, and sodium, which was found to be 18.64 mg/L, were at normal, unremarkable levels. The total phosphorus (TP) level in the water was found to be 1.828 mg/L. High levels of phosphorus have been linked to excessive invasion by nuisance or exotic vegetation and algae blooms in receiving waters. There is currently no numerical standard for total phosphorus in State waters. The standard states that the level of nutrients (such as TP) must be limited to prevent the violation of other water quality standards and can not cause or contribute to the degradation of the quality of the receiving waters. Since there are no receiving waters, it is impossible to speculate whether this level of phosphorus would violate the standard, however, under most circumstances I have encountered, this level would be considered significantly high. The following parameters (aluminum, cadmium, chromium, copper, iron, nickel, lead, and zinc) are all metals, some of which have been found to exert some degree of toxicity to aquatic life at high concentrations. Once again, since this borrow pit does not have a off-site discharge, any possible effects of these concentrations are limited to this waterbody, and no violation of any State water quality standards is indicated. The level of aluminum was measured to be 29,740 ug/L (micrograms per liter). There is no aluminum standard for potable water supplies (Class 1) or recreational fresh waters (Class III). In marine waters or shellfish propagation areas (Class III Marine and Class Il, respectively), the aluminum standard is equal to, or less than 1500 ug/L. The cadmium concentration, at 0.161 ug/L, is well below the standard of 9.3 ug/L for Class II or Class III marine waters and the standard for Class I or Class II fresh waters. This latter standard is determined mathematically and based on the total hardness of the water. Based on a total hardness of 142 mg/L, the cadmium standard would be 3.35 ug/L. The concentration of chromium was found to be 38.99 ug/L, which is above the standard of 11 ug/L for Class I and III fresh water but below the standard of 50 ug/L for Class II or III marine waters. The level of copper was analyzed to be 5.95 ug/L, which is above the standard of 2.9 ug/L for Class II or III marine waters, but well below the standard of 38.47 ug/L (calculated, based on hardness) for Class I and III fresh waters. The iron concentration of the sample was evaluated at 7,748 ug/L, which exceeds the water quality standard of 300 ug/L for most classes of water (except for Class III fresh waters, which have a standard of 1,000 ug/L). Nickel levels were found to be at 15.7 ug/L, which exceeded the standard of 8.3 ug/L for Class II or III marine waters, but was well below the standard of 49.4 ug/L (calculated, based on hardness) for Class I and III fresh waters. Likewise, lead levels, at 10.31 ug/L, were found to exceed the 5.6 ug/L standard for Class II or III marine waters, but were also below the standard of 18.54 ug/L (calculated, based on hardness) for Class I and III fresh waters. Finally, the level of zinc (13.98 ug/L) was well below the standards for all classes of water, which range for 86 ug/L to 344 ug/L. In summary, the water sampling indicated somewhat high levels of total phosphorus (nutrient) and somewhat elevated levels of several metals (depending upon which hypothetical standard is applied), while the rest of the parameters (mostly salts and physical parameters) were within acceptable limits. The dissolution into the water column of metals and salts, which are naturally occuring in the different layers excavated by a mine such as this one, is a normal process of the mining activities. Vickers Sand Mine has consistently submitted monthly, or quarterly, groundwater quality reports from several monitoring wells surrounding the pit, and these reports have not indicated any degree of groundwater contamination. Only previous permits issued from SJRWMD appear on the Annual Report dated 1-6-97. 3. Which permit # is the one that expires March 12,2001? 4. Is this in compliance with City code? 5`.
