Persons whose substantial interests are affected by this permit have a right, pursuant to Section 120.57, Florida Statutes, to petition for an administrative determination (hearing), unless the right to petition has been waived. The petition must conform to the requirements of Chapters 17-103 F.A.C., and must be filed (received) in the Department's Office of General Counsel, 2600 Blair Stone Road, Tallahassee 32399-2400, within fourteen (14) days of receipt of this notice. Failure to file a petition within that time constitutes a waiver of any right such person has to an administrative determination pursuant to Section 120.57, Florida Statutes. The petition shall contain the following information; (a) the name, address and telephone number of each petitioner, the applicant's name and address, the Department Permit File Number and the county in which the project is proposed; (b) A statement of how and when each petitioner received notice of the department's action or proposed action; (c) A statement of how each petitioner's substantial interests are affected by the department's action or proposed action; (d) A statement of the material facts disputed by Petitioner, if any; (e) A statement of facts which petitioner contends warrant reversal or modification of the department's action or proposed action; (f) A statement of which rules or statutes petitioner contends require reversal or modification of the department's action or proposed action; and (g) A statement of the relief sought by petitioner, stating precisely the action petitioner wants the department to take with respect to the department's action or proposed action. .-, ., This Order (Permit) is final and effective on the date filed with the Clerk of the Department unless a petition is filed in accordance with the above paragraph. Upon the timely filing of a petition this Permit will not be effective until further Order of the Department. Any party to the Order has 'the right to seek judicial review of the Order pursuant to Sectiop 120.68, Florida Statutes, by the filing of a Notice of Appeal pursuant to Rule 9.110, Florida Rules of Appellate Procedure, with the Clerk of the Department in the Office of General Counsel, 2600 Blair Stone Road, Tallahassee, Florida 32399-2400; and by filing a copy of the Notice of Appeal accompanied by the applicable filing fees with the appropriate district Court of Appeal. This permit is issued under the provisions of Chapter(s) 403, Florida Statutes, and Florida Administrative Code Rule(s) 17-3, 17-4 and 17-600. The above named permittee is hereby authorized to perform the work or operate the facility shown on the application and approved drawing(e), plans, and other documents attached hereto or on file with the department and made a part hereof and specifically described as follows: Construction of a dry -line sewage collection/transmission system for the Fischer Industrial Park, serving 52 industrial lots, generating a flow of 77,063 gPd• The dry -line sewage collection/transmission system shall consist of: (A) 4,118 LF of 8" PVC gravity, (B) 3,216 LF of 4" PVC forcemain, (C) associated manholes and (D) a lift station with dual 140 gpm pumps. Location: North of Vickers Road, west of FEC Railroad, Sebastian, Indian River County, Florida. General Conditions are attached to be distributed to the permittee only. Number: Permit/Certification Number: CS31-177104 Date of Issue: Expiration Date: 04/01/92 1.. where water and sewer mains cross with less than eighteen inches vertical clearance, the sewer will be twenty feet of either ductile iron_ pipe or concrete encased vitrified clay or PVC pipe, centered on the point of crossing. When a water main parallels a sewer main, a separation of at least ten feet should be maintained when practical. 2. This construction permit is only for the construction of the sewage collection/transmission system. It does not pertain to any potable water, dredge and fill, or stormwater aspects of this project; additional permits may be required from this office. 3. The applicant shall retain a professional engineer registered in the State of Florida, to observe construction of the project and to assure conformity to the application, plans and specifications as approved. Upon completion of construction, the engineer. shall provide the department with a certification of completion of construction on DER Form 17-1.205(8) and record drawings in accordance with Rule 17-604, F.A.C. This project, as permitted, shall not be placed in operation until written acceptance of the Certification of Completion has been received from the department. 4. There shall be a physical 6' separation between this system and the existing sewer system. 5. The pumps shall not be installed until this permit is cleared for use by the department. 6. Any connections to and/or extensions of this system, beyond the intent of this permit, shall require separate written approval from the department and the utility.
