Florida Requesting permission from the State of Florida Department of Transporta- tion, hereinafter called the Department, to construct, operate and maintain Intersection improvements to the intersection of Schumann Drive and U.S.#1 to include deceleration lane improvements and left turning lane median improvements from MP Station 17035 to MP Station 1. Applicant declares that prior to submitting this application he has ascertained the location of all existing utilities, both aerial and underground. It is expressly stipulated that this permit is a license for per- missive use only and that the placing of facilities upon public property pursuant to this permit shall not operate to create or vest any property right in said holder. 5. Whenever it Is determined by the Department that it is necessary for the construction, repair, improvement, maintenance, safe and efficient operation, alteration, or relocation of all, or any portion of such highway, or that it is necessary for the public transportation facility, any and all facilities shall be immediately removed from said highway or reset or relocated thereon as required by the Department, all at the expense of the permittee unless reimbursement is authorized. 6. The construction and maintenance of such facility shall not interfere with the property and rights of a prior permittee. 7. The PERMIT HOLDER covenants and agrees that it will indemnify, defend, and hold harmless the DEPARTMENT and all of the DEPARTMENT'S officers, agents and employees from any claim, loss, damage, lost, charge or expense arising our of any act, action, neglect or omission by the PERMIT HOLDER during the performance of the.work whether direct or indirect, and whether to any person or property to which the DEPARTMENT or said parties may be subject, except that neither the PERMIT HOLDER nor any of its subcontractors will be liable under this section for damages arising out of injury or damage to persons or property directly caused or resulting from the sole negligence of the DEPARTMENT or any of its officers, agents or employees. 8. In case the permit holder fails to meet any of the Departments Requirements, the permit holder will be BARRED from preforming further work under this permit and will be required to bring the permitted work into compliance or remove said work from the right-of-way at no cost to the Department, AND THE PERMIT HOLDER WILL STILL BE BOUND BY THE INDEMNITY PROVISION OF PARAGRAPH 7 9. All work shall meet the Departments Standards and be certified by THE ENGINEER OF RECORD, that the work has been substantially completed in accord with the Department Standard Specification for Road and Bridge Construction, and in accord with all rules, regulation, policy, plans, special provision, and safety standards pertaining to this type work. All materials and equipment may be subject to inspection by the Maintenance or Resident Engineer. 11. The attached sketch and special provision covering details of this installation shall be made a part of this permit. 13. The permittee shall commence actual construction in good faith within &U. days from the day of said permit approval and shall be completed within 12c days. If the beginning date is more than 60 days from date of permit approval, then permittee must review the permit with the D.O.T. Maintenance Engineer to make sure no changes have occurred in the highway that would affect the permitted construction. 14. Effective July 1, 1986, according to the State Statue, the Permittee must notify the local Law Enforcement Agencies prior to the closing of one (1) or more lanes of the State Highway for a period that exceeds two (2) or more hours for repair, reconstruction or alteration of,the roadway. All areas within the Department's Rights of Way will be restored to a condition equal to or better than that now existing. 2. All construction will be in accord with the Department's Standard Specifications (Latest Edition). The index sheets, radii and dimensions as shown on the plan and the notes attached. 3. Prior to excavating, contact the Clerk of Circuit Court for possible Gas Line conflict. 4. All grassed areas that are disturbed by this construction, will be graded and re -seeded or sodded as per Department of Transportation Specifications. The material used will be a natural topsoil reasonably free of subsoil, roots, rocks, stones, weeds and from any other material not suitable for planting. 5. Before starting construction, the contractor is to notify the Department so that a Pre -construction meeting may be arranged on the Job Site. (See Note Below) 6. Should this work fail to meet the Department's Standards, it will be removed and/or restored to its original condition by the Permittee. 7. This work will be subject to the final approval of the Department. 8. The applicant will save and keep the State of Florida harmless from any and all damages, claims or injuries that my occur by reason of this construction of said facility. 9. Existing swales between the edge of pavement and the Rights of Way lines will be maintained and pipe culverts will be constructed by the Permittee if deemed necessary by the Der•.rtment. 10. Swales are to be constructed a minimum of 8 feet from the edges of pavement and at least 6" below the edges of pavement. The driveways are to be constructed in such a manner that it will not block water in the swale. 11. A copy of this permit, plans and notes will be on the Job Site at all times during construction. 12. Class I Concrete will be used in all concrete work unless otherwise specified. Class I Concrete will have the required strength of 2500 PSI in 28 -days. See Section 345 of the Standard Specifications. 13. All radial connections to State Roads will not be less that 15' minimum for all Asphalt Driveways. 14. Asphalt Driveways will be constructed within minimum 6" limerock base, or 6" sand asphalt base or 8" shell base, primed, with minimum 1}" asphalt Type S-1 or Type I. 15. Prior to starting construction, the contractor is to notify all Utility Companies that have service in the are of construction. This extends to landscaping and sprinkler systems that exist whether public or private. 16. Existing Ratio of Pavement Slope is to be extended across the proposed pavement for deceleration lane and left turn storage lane, including tapers. 17. Construct shoulders in areas of driveways and turnouts as deemed necessary by the Department. 18. All construction on driveways, where possible, will be started so that construction will be completed before the weekend or any holiday. 19. Validity of this -Permit is contingent upon Permittee obtaining necessary Permits---- from all other Agencies involved. 20. Permittee is cautioned that Utilities may be located within the construction area. Note: Mr. Earl Jacobs, Maintenance Engineer, Fort Pierce, Telephone 461-1780. ATTACHMENT "S" SAFETY Rev. July 84 STATUTES F.S. 338 F.S. 335.18 During this construction, primary consideration will be given to the Safety and Convenience of the Public. The safety requirements contained in this permit are construed to mean, the broad base, complex meaning of the word Safety. (a) Poor construction is unsafe. (b) Fill, subgrade, base course and surface improperly laid and improperly compacted is unsafe. (c) Project constructed with an unsafe foundation is an unsafe project when completed. Contrast in surrounding areas increases the safety factor on any construction job, therefore: (a) Grassing and landscaping will be restored as soon as physically possible. (b) Temporary Pavement Stripping Tape will be applied each day prior to com- pletion of the days operations. This includes temporary asphalt applica- " or.. Permanent stripping will be completed as soon as practical. (c) This Department's Manual on Traffic Controls and Safe Practices for Streets and Highway Construction, Maintenance and Utility Operations will be adhered to at all times. Safety is defined by the writer as "The science and art applied with knowledge gained through education and continual learning to understand - foresee and eliminate a hazard before it occurs." Should the Permittee and/or the Permi.ttee's Contractor, fail to work this pro- ject in a safe manner, the permit holder will be barred from performing further work under this permit and will be required to bring the permittee's work into compliance or remove said work from the right-of-way at no cost to the Depart- ment.
