SUBJECT: Albatross Side Lot Ditch, or Lack of Same
On October 23, 1995 at 7:30 a.m., Randy from Code Enforcement,
informed me of a problem with a resident backing his boat in and
out through the swale causing swale damage. I told Randy an
auxiliary driveway would be required for boat access but that I
would check it in the field anyway. 585 Albatross is a new house
experiencing severe standing water problems due to a side lot ditch
being omitted by General Development Corporation when the area was
developed. The ditch was intended to go between lots 13 & 14 of
block 264.
Please find attached a copy of the drainage map for the Albatross
Terrace / Croquet Lane Water Shed area. Also, a copy of a field
report dated October 23, 1995, as well as a sheet showing existing
elevations of culverts in relation to lot numbers.
After some investigation, I found the owner of lot 13 owns lot 14
as well. The owner constructed a garage on lot 14 after being
granted a "Unity of Title" for lots 13 and 14. When the garage
driveway culvert elevation request came through the Engineering
Department, the omitted ditch was discovered. Jerry Thomas was the
temporary Public Works Director at the time. I brought this
problem to his attention before I set driveway culvert elevation
stakes, asking him how I should proceed.

After some discussion out in the field we determined that due to
the "Unity of Title" for lots 13 and 14, the best location for the
side ditch was between lots 14 and 15. As you can see from the
existing field elevations I set the driveway culvert for the garage
accordingly. The issue died at this point. Now, with the drainage
problem at the new house at 585 Albatross we can address the long
standing drainage problems for the Albatross / Croquet drainage
area.

A question has arisen on whether the City does have easements for side lots in Unit 10; the side lot ditch
that drains about 14 acres is missing, and there is no easy way to drain the area unless the City ditches
between two lots that are under common ownership (house on one lot, garage on another). By copy of this
easement, we respectfully request Ms. O'Halloran to see if the record reflects that the side lot easement
between 13 and 14, Block 264, Unit 10, was abandoned.
The cover page for Unit 10 (PB 6, P 37, IRCo) has the following language with respect to drainage
Casements:
"...(deals with rights of way)... reserving to the GENERAL DEVELOPMENT CORPORATION, it
successors and assigns, the reversion or reversions thereof whenever discontinued by law. Unless otherwise
indicated, a strip of land 10 feet wide at the rear of each lot and 6 feet wide at the sides of each lot, and a
strip of land 20 feet wide at the lot line abutting to and adjacent to a canal, waterway, or drainage right-of-
way, is reserved by the GENERAL DEVELOPMENT CORPORATION or its assigns for the installation
and maintenance of public utilities and drainage facilities, with the following exception (deals with corner
lots)..."

1. Albatross @ Croquet Missing Culvert: We need to see if there is a legal easement between the
garage and house on the two `united' lots. If so, then the City will have the right to insist on digging a ditch
there per the original plans. If the Owner wants it piped, it should be a this cost.
If there is no easement (or the easement was abandoned), then the intersection drainage will have to be
rebuilt. If there are no easements in this plat (rights not owned by the City), then the City will either have to
procure an easement, and either ditch or pipe it.
This is a ±14 acre basin, and very flat, so it needs to be rebuilt with bigger pipes.
We will contact Mr. McClelland to see what the status of the easement is.
2. Cemco Homes on Lot 25-272-10: We have asked Kevin Smith to redesign the drainage to drain to
the from, and resubmit.
3. Tozzolo Homes on Lot 1-188-6: We advised Wayne Tozzolo about the 3:1 requirement, and he
agreed to field stake for inspection before moving any earth.

SUBJECT: Albatross @ Croquet, Missing Ditch
Recently I had an inquiry as to the status of the missing ditch at Albatross Terrace and
Croquet Lane. In reviewing my file, the most recent correspondence was a copy of a memo to Cliff
McClelland Regarding the legal status of Lots 13-14, Block 264, Unit 10, dated 10/7/95.
The memo asks Mr. McClelland to check with Ms. O'Halloran to see if there is any record of an
abandonment of easement.
After the inquiry by a concerned resident, I called the City Clerk's office, and they provided
me with a memo stating that there is no record of an abandonment of easement for the above
mentioned lots. I can provide you with a copy if you wish.
Before I respond to the resident, could you mail or fax something to me in writing indicating
any progress or the current status of this particular drainage issue? (My records may be incomplete).

The City Clerk's office has no record of the abandonment. Before proceeding further, we suggest that either
the City or the Owner of the Lots 13-14 research the Public Records to see if there was an abandonment by
the City. I would point out that a unity of title is filed by the Owner, not the City, and does not, in and of
itself, abandon any affected easment
As you may recall, and as indicated by copy of our file data enclosed herewith for your perusal, there was a
question raised by the former City Attorney as to whether the City actually is successor to the easements
reserved by GDC. While this may be legal nit-picking, it could come into play if `push -comes -to -shove' on
this one location.
If there is no abandonment, it should be a matter of setting policy now as to whether the City will bear the
expense of rerouting the drainage to the east, to flow between Lots 14 and 15, or shall the City exercise its
right to open a ditch in the easement? Does the City assume that this Owner filled the ditch, and thus has
some responsibility?
While this firm has no particular favor of either decision, the City may wish to consider that, in lieu of an
open ditch in the easement between 13-14, that the Owner may wish pay the costs to install a culvert (z
36';± $6,000). The easement, in this case would remain.
Alternatively, the City might wish to sell the easement to the Owner of 13-14, to help defray the costs of
rerouting the drainage to tine east. Your own survey, based on assumed datum, indicates that, at the very
least, the driveway for the garage must be rebuilt with a sunstantially larger pipe at proper grade.
Once these policy issues are settled, we can readily advise you concerning the engineering issue as to the
proper design for either location, Lots 13-14, or 14-15.
