On March 31, 1994, District staff re -inspected the above -referenced
permitted project. Based upon this inspection, the following
discrepancies have yet to be resolved with the stormwater system:
Northeast Retention Area:
1. A four (4) inch PVC pipe is located in the west berm
connecting the retention area to the Rosebush Lane Swale.
2. Standing water, algae growth and dead grass is in the
bottom of the retention area, as indication of a recovery
problem.
Northwest Retention Area;
1, A breech is located within the east berm connecting
the retention area to the Rosebush Lane Swale.
2. Wetland type vegetation is growing in the retention
area, an indication of a recovery problem.
3. The type "C" inlet with a 15 inch C.A.P is not
constructed in the east end of the retention area.
The pipe between the east and west retention areas is not in place.
The trench drain with a type "C" inlet within the center of the
project could not be located.

Within 30 days of receipt of this letter the following must be
completed to resolve the above referenced discrepancies:
1. Remove the PVC pipe from the west berm of the
Northeast Retention area.
2. Fill in the breech in the berm of the Northwest
Retention area and construct the type "C" inlet with
the 15 inch C.A.P. as depicted on the permitted plans
dated July 18, 1993.
3. Determine the cause of the recovery problem within
both retention areas and submit a corrective proposal
to the Melbourne office for a permit determination.
4. Place the pipe between the two retention areas as
depicted in the permitted plan.
5. Locate or construct the trench drain with the type
"C" inlet within the center of the project.
6. Notify the Melbourne Office when the corrective
work is completed so that a follow-up inspection may
be arranged.
Also be reminded that the operation phase of the permit shall not
become effective until a Florida Registered Professional Engineer
certifies that all facilities have been constructed in accordance
with the design approved by the District. Within 30 days after
completion of construction of the surface water management system,
the permittee shall submit the certification of completion or one
(1) set of plans which reflect the system as actually constructed
and notify the District that the facilities are ready for
inspection and approval.

The District received your letter of April 12, 1994 about the above
referenced projects. Two permits we're issued for two separate
projects. Permit #42-061-0651NG is for the property south of the
existing sports complex covered by permit #42-061-0332NG.
Therefore, the noncompliances for permit #42-061-0332NG still exist
and need to be addressed. Enclosed are copies of the permitted
plans for both projects for you information.

In response to your letter dated April 5, 1994, and as a follow-up to Mr. Dan Eckis's letter of
April 12, 1994, we have the following response:
Northeast Retention Area -
The city will remove the four (4) inch PVC pipe located in the west berm connecting the
retention area to the Rosebush Lane swale.
2. The retention areas of the Barber Street Sports Complex were designed and permitted
in accordance with the rules and regulations of the St. John's River Water Management
District. It is apparent that a recovery problem does exist and the existing subsurface
conditions are not performing as predicted by the soils testing firm for this project.
The ideal corrective action to solve the problem would be to deepen the retention areas
and turn them into lakes, but this is not an acceptable alternative to the City due to
the liability of the lakes. We are open to suggestion from the Water Management
District as to acceptable corrective action.
Northwest Retention Area.-

With regard to the pipe between the east and west retention areas, this pipe is strictly an
equalization pipe. The site drainage is basically equally split between the two retention ponds.
If the District insists that this equalization pipe is essential to the functioning of the stormwater
system, then the City will install the pipe.
