Permit #42-061-0332NG
Section 24, Township 31, Range 38
Indian River County
Dear Janice:
I have received your certified letter dated April 5, 1994. I have
discussed this matter with the engineer of record, Mosby and
Associates, following receipt of your first certified letter sent
February 22, 1994. I was advised by Mr. Mosby that he would be
responding to your questions. However, it is apparent that some
time has passed and you have not received his response. i will
contact him again to expedite this matter.
Please note upon comparing the permit number it does not agree with
the permit that is on record at City Hall. The City's copy is in
reference to a permit issued June 3, 1993 number 42-061-0651NG.
This is evident from some of the comments referencing the breech,
the type "C" inlet, trench drain, and with inlet in the center core
area which had been eliminated by the modification permit (42-061-
0651NG).
The other comments refer to the functioning capability of the
system, I agree that several problems with a recovery do exist.
The City, under my direct supervision, had excavated the northeast
retention pond two or three feet below the bottom of the pond and
was back filled with clean permeable fill. It is apparent that the
subsurface conditions are not conducive to peculation.

I would like to thank you for your indulgence in this matter. I
assure you that the engineer has been notified and will be
providing responses to your comments. Hopefully, we will be able
to resolve our comments to your satisfaction. If you have any
question or need additional information please do not hesitate to
contact me at this office.

(Please reference Permit number on all submittals.)
Dear Mr. Eckis:
on March 31, 1994, District staff re -inspected the above -referenced
permitted project. Based upon this inspection, the following
discrepancies have yet to be resolved with the stormwater system:
Northeast Retention Area:
1. A four (4) inch PVC pipe is located in the west berm
connecting the retention area to the Rosebush Lane Swale.
2. Standing water, algae growth and dead grass is in the
bottom of the retention area, an indication of a recovery
problem.
Northwest Retention Area;
1. A breech is located within the east berm connecting
the retention area to the Rosebush Lane Swale.
2. Wetland type vegetation is growing in the retention
area, an indication of a recovery problem.
3. The type 11C" inlet with a 15 inch C.A.P is not
constructed in the east end of the retention area.
The pipe between the east and west retention areas is not in place.
The trench drain with a type "C" inlet within the center of the
project could not be located.

Within 30 days of receipt of this letter the following must be
completed to resolve the above referenced discrepancies:
1. Remove the PVC pipe from the west berm of the
Northeast Retention area.
2. Fill in the breech in the berm of the Northwest
Retention area and construct the type "C" inlet with
the 15 inch C.A.P. as depicted on the permitted plans
dated July 18, 1993.
3. Determine the cause of the recovery problem within
both retention areas and submit a corrective proposal
to the Melbourne office for a permit determination.
4. Place the pipe between the two retention areas as
depicted in the permitted plan.
5. Locate or construct the trench drain with the type
"C" inlet within the center of the project.
6. Notify the Melbourne Office when the corrective
work is completed so that a follow-up inspection may
be arranged.
Also be reminded that the operation phase of the permit shall not
become effective until a Florida Registered Professional Engineer
certifies that all facilities have been constructed in accordance
with the design approved by the District. Within 30 days after
completion of construction of the surface water management system,
the permittee shall submit the certification of completion or one
(1) set of plans which reflect the system as actually constructed
and notify the District that the facilities are ready for
inspection and approval.
If you have any questions, please contact Janice Unger or Eddie
Carr at 407/984-4940.
