1. Call to Order — Chairwoman Carbano called the meeting to order at 6:06 pm.

Regular Meeting March 28, 2017
Ms. Carbano called for additions, deletions or corrections to the minutes.
A motion to approve the March 28, 2017 minutes as presented was made by Mr. Hosey
and seconded by Ms. Carbano.

CONTRACTOR LICENSE REINSTATEMENT:
IN THE MATTER OF MR. RICHARD S. RUSSELL
IRRIGATION CONTRACTOR LICENSE NO. 1423
CONTRACTOR WISHES TO APPEAR BEFORE THE BOARD TO SEEK
REINSTATEMENT OF HIS EXPIRED LICENSE. LICENSE HAS BEEN EXPIRED SINCE
9/30/2004. CITY CODE OF ORDINANCE SECTION 26-168 (C) STATES THAT A
CERTIFICATE THAT HAS NOT RENEWED WITHIN 3 FULL YEARS AFTER
EXPIRATION MAY NOT BE RENEWED, RESTORED OR REINSTATED THEREAFTER
EXCEPT BY REAPPLICATION AND REEXAMINATION.
SECTION 26-168
Mr. Eseltine, City Building Official, stated that Mr. Richard Russell is before the Board
this evening requesting that his Irrigation License, which expired on 9/30/2004, be
reinstated. He explained that as per the City Code of Ordinances Section 26-168(C) all
fees have to be paid and if the license has been expired for more than 3 full years
reapplication and reexamination is required. He stated that since the City does not do
examinations any longer the applicant would have to take the examination at another
location. He stated that Mr. Russell has a license in Indian River County which has been
active from 2001 to 2016.
Mr. Crockett asked if there could be a reciprocal agreement with Indian River County
since his license is active there. Mr. Eseltine responded that is not possible because
the Indian River County License is based on the reciprocal agreement with Sebastian.
Mr. Richard Russell, 1290 12" Street SW, Vero Beach, FL responded to Ms. Carbano's
question regarding why he did not put his license on inactive by stating that he was
young and wanted to work for himself and was not good with paperwork. He explained
that the person he hired to handle the paperwork was not as conscientious as he
believed them to be, consequently he was not aware the license expired and he was not
doing work in Sebastian. He commented that at the time he was doing work in
Sebastian permits were not required for irrigation jobs as they are now. He explained
that he has a client in Sebastian and he would like to expand his business into
Melbourne and other areas, as a result he needs to get his license reinstated and be
able to get a letter of reciprocity from the City. He stated that he understands the Code,
is willing to pay the necessary fees and if the Board does not decide to reinstated his
license he will understand their position.
Mr. Eseltine stated that Mr. Russell is correct regarding permits for irrigation not being
required then as they are now.

Mr. Crockett asked if there is a way for Mr. Russell's license to be reinstated. Mr.
Eseltine responded that in accordance with the fee schedule Resolution R1220, he
would pay $75 per year for 12 years and $60 for the current year for a total of $960 to
bring his license current. Mr. Crockett asked Mr. Russell if he is in a position to pay the
total fee. Mr. Russell responded that he is able to pay the entire fee.
Mr. Hosey asked for details regarding when the requirement for permits for irrigation
work was implemented. Mr. Eseltine responded that they start appearing in the 2012
Fee Schedule so it would be around that timeframe. Mr. Hosey stated that he can
understand how a person just starting in business may not be aware of when their
license expires and without having to pull a permit the reminder is not there. Mr.
Eseltine responded that although a permit was not required, the work had to be done by
a licenses contractor. He stated that in 2012 the City became concerned about the
irrigation work being done and determined that inspections would be helpful to prevent
any problems caused by installation of pumps, etc.
Mr. Eseltine explained the testing process and stated that Mr. Russell passed the test
given by Sebastian and as a result he was licensed and a Letter of Reciprocity was
provided to him for other municipalities. However, now that his license has expired the
City cannot give him a letter unless the Board approves reinstatement. He commented
that Mr. Russell has kept his license current in Indian River County which demonstrates
good faith on his part.
Mr. Russell stated that he has been working the entire time since his Sebastian license
expired. He explained that he has licenses to work in various towns in the area. He
stated that he understands if the Board won't reinstate his license, but the expense will
be the same or more if he has to go elsewhere and retake the test; he would prefer to
pay the City the back fees and have the license reinstated.
Mr. Manero asked if Mr. Russell has the required insurances. Mr. Russell responded in
the affirmative.
Ms. Carbano asked if Mr. Russell has employees. Mr. Russell responded that he does
not now, but did when he owned his business. He explained that he sold his business
in 2012 and in 2014 started working alone.
Mr. Crockett asked what Mr. Russell's preference would be, to reinstated his license in
Sebastian or go elsewhere and take the test. Mr. Russell responded that he would
prefer to pay the fees and have his license reinstated in Sebastian.
Ms. Carbano called for any further questions; hearing none she called for a motion

A motion that the Board reinstate Mr. Russell's license after a payment of $960 was
made by Mr. Crockett, seconded by Mr. Manero.
