RECOMMENDATION: Adopt R-17-36
BACKGROUND: Hanlex Sebastian, LLC, has filed for site plan review for
a proposed development of a Dollar General retail store to be located on a 1.4 acre tract
within Chesser's Gap Planned Unit Development (PUD). Since the project is located within
a PUD, the site plan requires City Council approval. The site plan should be given
consideration that it is in accordance with, or that it meets the intention of, the previously
approved revised conceptual plan for the PUD development.
The proposed development, located on the southeast
comer of the intersection of Fleming Street and Sebastian Boulevard/CR 512, includes the
demolition of an existing Exxon gas station and canopy followed by construction of a three -
unit, 13,144 SF retail building, associated parking, water/sewer service, drainage, and
landscaping. Access to the site will be accomplished from existing entrances on Sebastian
Boulevard and the adjacent Elks Lodge site. Proposed stormwater drainage will be
accomplished via a tie-in to the existing Chesser's Gap master stormwater system as
approved by SJRWMD.
The Planning and Zoning Commission at their regular
meeting on Thursday, 21 September 2017, recommended approval of the site plan with two
conditions. Those conditions are stated within R-17-36.

RESOLUTION NO. R-17-36
A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN
RIVER COUNTY, FLORIDA, APPROVING A SITE PLAN
FOR THE DOLLAR GENERAL RETAIL STORE WITHIN
CHESSER'S GAP PUD; PROVIDING FOR CONFLICTS
HEREWITH; PROVIDING FOR EFFECTIVE DATE.
WHEREAS, the City has received an application for site plan approval for a
proposed Dollar General Retail Store; and
WHEREAS, the site is located at 727 Sebastian Boulevard and lies within the
approved Chesser's Gap Planned Unit Development located at the intersection of
Fleming Street and CR 512; and
WHEREAS, on September 21, 2017, the Planning and Zoning Commission
recommended approval of the site plan;
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE
CITY OF SEBASTIAN, as follows:
Section 1. SITE PLAN APPROVAL. The City Council of the City of
Sebastian does hereby approve the site plan within the Chesser's Gap Planned Unit
Development for the Dollar General Retail Store as prepared by Z Development Services
and Robert Ziegenfuss, P.E., with a latest revision date of 10/3/17 on certain sheets, and
maintained on file with the Community Development Department, subject to the
following two conditions:
1. Copies of soil test results and inspections done by FDEP
regarding the removal of the underground gas tanks should be
submitted to staff before building permits can be issued.
2. The subject property shall plat into the Chesser's Gap
Subdivision. The requisite final plat shall be approved by City
Council and recorded before a Certificate of Occupancy is issued
for the project.
Section 2. CONFLICT. All resolutions or parts of resolutions in conflict
herewith are hereby repealed.
Section 3. EFFECTIVE DATE. This resolution shall take effect
immediately upon its adoption.
The foregoing Resolution was moved for adoption by Councilmember
Hill The motion was seconded by Councilmember
Kinchen and, upon being put into a vote, the vote was as follows:
