If approved, set second reading and public hearing for 14 March 2018. Background: Ridgewood Sebastian, LLC, represented by Mr. Chuck Mechling, has submitted a request for annexation of 182.87 acres of land located south of Sebastian Industrial Park, west of the FEC railroad and Old Dixie Highway, and north & east of Sebastian Highlands and South Moon Under residential subdivisions (a.k.a. the Brown Sandmining area). The subject property is currently vacant in an unincorporated enclave of Indian River County, contiguous to the existing corporate limits and boundaries of the City of Sebastian. The applicant has suggested that a request for a future land use designation of "low density residential" (max. 5 units per acre) and a PUD-R (residential planned unit development) will follow under separate cover in the near future. The proposed development anticipates 550 single-family and 140 duplex villa residential units at a density of approximately 3.77 units per acre. WHEREAS, the owners of real property in an unincorporated enclave of Indian River County, contiguous to the existing corporate limits and boundaries of the City of Sebastian, and being reasonably compact, petitions the governing body of the City of Sebastian to be voluntarily annexed into the municipality; and WHEREAS, the City Council of the City of Sebastian, Florida finds and determines that the annexation of said parcel is in the best interest of the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: Section 1. PROPERTY. The following described property now lying and being in an unincorporated area of Indian River County, Florida, is hereby annexed into the corporate limits of the City of Sebastian, Florida and the boundary lines of said City are hereby redefined to include said real property: See attached Exhibit `1' and as shown on the map within said Exhibit `1', containing 182.87 acres, more or less. Section 2. INTERIM LAND USE AND ZONING CLASSIFICATION. The interim land use and zoning classifications for this property shall be consistent with the provisions of state law. Section 3. FILING. A certified copy of this ordinance shall be filed with the Clerk of the Circuit Court, as well as the Chairman of the County Commission of Indian River County, Florida, and with the Florida Department of State within seven days of adoption. Section 4. NOTICE. That notice of this ordinance has been posted in accordance with Section 171.044, Florida Statutes. Section 5. CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6. SEVERABILITY. In the event a court of competent jurisdiction shall hold or determine that any part of this Ordinance is invalid, unenforceable or unconstitutional, the remainder of the Ordinance shall be invalidated and it shall be presumed that the City Council of the City of Sebastian did not intend to enact this Ordinance without such invalid or unconstitutional provisions. Section 7. EFFECTIVE DATE. This Ordinance shall become effective immediately upon its adoption by the City Council. The subject property consist of 182.87 acres, more or less, located south of vacant "industrial -zoned" land, west of the FEC railroad and Old Dixie Highway, and north and east of Sebastian Highlands and South Moon Under residential developments. The subject property is currently vacant land in an unincorporated enclave of Indian River County, contiguous to the existing corporate limits and boundaries of the City of Sebastian. The proposed development is within the service boundary for municipal services and has provided capacity concurrency for County utility services. Current land use and zoning will remain with the County until such time as the applicant provides petition to the City for land use and zoning amendments. The applicant has suggested that a request for a future land use designation of "low density residential" (max. 5 units per acre) and a PUD-R (residential planned unit development) will follow under separate cover in the near future. The proposed development anticipates 550 single-family and 140 duplex villa residential units at a density of approximately 3.77 units per acre. Attachment "A" provides the Vision Statement and technical information for the property. STAFF FINDINGS 1. A petition for annexation has been executed by the owners of the subject property and is consistent with Chapter 171 F.S. 2. The proposal is consistent with the goals, objectives and policies of the City's Comprehensive Plan. The annexation of the property removes an unincorporated enclave which is contiguous, compact, and within the municipal service boundary. 3. The proposal will not have an adverse impact on the public health, safety, welfare, or aesthetics of the city or region. 4. Level of Service (LOS) impacts will be addressed during Land Use and Zoning review. 5. A fiscal analysis of the proposed project reflects the annual value of the project to the City. a. Approximately 6.90 acres of recreation land will be required to be set aside for this project. In addition, over $600,000 will be provided to the Recreation Fund. b. Stormwater will be self-contained within the development and approximately $41,000 will be collected annually in Stormwater Fees. c. Proposed value of the single family homes = $275,000 x 550 units x City of Sebastian mileage (3.400) = $514,250 per annum. d. Proposed value of the duplex homes = $239,000 x 140 units x City of Sebastian mileage (3.400) = $113,764 per annum. Total assumed annual taxable revenue = $628, 014 6. The put -pose for this request is to secure the proper zoning and density for a planned residential development. Although the maximum density would allow 5 units per acre, it is anticipated 550 single-family and 140 duplex villas residential units (3.77 units per acre) will be planned. The following information is provided to support the property's negligible impact on the environment, public facilities, and compatibility with the neighboring properties: • Environment Prior to submittal of a conceptual development plan, an environmental survey will be conducted on the property for the presence of wetlands and endangered species. Mining operations were previously performed on the property that created four large ponds. These ponds will be incorporated into the stormwater management system for retention of stormwater runoff prior to any off -site discharge. There also appears to be an environmentally sensitive area in the southwest comer adjacent and contiguous to the Indian River County owned preserve property. Wetlands are protected by state and federal regulations and the master plan will be designed to avoid impacts to this area. Gopher tortoise habitat may also exist due to the site's location on the coastal sand ridge; however, provisions will be made during development to protect or relocate tortoises. • Transportation A traffic impact analysis will be performed prior to submittal of the conceptual development plan. The property will be containing 2 to 3 ingress/egress points that will help evenly distribute the projected traffic. • Utilities The property will be served by public water and sewer facilities provided by Indian River County Utility Services. Several points of connection are available to existing water and sewer facilities along Old Dixie Highway just north of the property and along the property's southern boundary. There is also a water main stub -out near the western property line at Del Monte Road. Assuming 250 gallons per day per unit, an estimated 172,500 gallons per day of projected flow will be generated for the property. The Indian River County plant information shown in Attachment `F' demonstrates that the North and Central Wastewater Treatment �+ Facilities and the North and South County Public Water System have more than adequate capacity to handle the additional projected flows. W • Recreation The demand for recreation area shall be determined by multiplying the city's recreation area level of service standard (4.0 acres per 1,000 population or .0040 acre multiplied by each person served by the development), Therefore, assuming 2.5 persons per unit (550 single-family and 140 duplex villas), a total of 6.90 acres of recreational area is needed •■ for the property. • Compatibility with neighboring properties As mentioned earlier, the property is directly adjacent to two residential neighborhoods (Sebastian Highlands and South Moon Under) and also near The Laurel Reserve. The proposed "low density residential" land use is compatible with these developments. All three neighborhoods were developed with a density between 1.1 units per acre and 3.44 units per acre, which is consistent with the subject property. As seen above, the proposed annexation of the 182.87 acres will not adversely affect the .� neighboring properties, is consistent with the comprehensive plan, and would be an asset to the City of Sebastian. Objective 1-2.1 of the future land use element states that the City of Sebastian OR desires to develop a plan that would prevent urban sprawl and disjointed urban service delivery systems. The Spirit of Sebastian fits this mold in every essence of the definition. The concept of this infill land tract prevents urban sprawl and utilizes existing infrastructure. It is a tract of land surrounded by the City of Sebastian with all water, sewer, and road systems in place. This community will allow for a positive and productive tax base assisting the City of Sebastian and its future needs. In reference to the fiscal impact analysis of the community, our tax base will stay ahead of the basic services and their costs. The Spirit of Sebastian, a deed �• restricted gated community, will feature a community center, various parks, and recreational facilities that will be constructed and maintained by the development. Our experience, over the years with Collier Club and SandCrest, is that the majority of our residents have been second -homeowners and retirees, allowing for less fiscal impact on city services. This demographic frequents •. local businesses, restaurants, and other leisure based activities which supports our local economy. We feel this infill location enhances the economic business plan of the Sebastian riverfront district and its future land use elements.
