CITY OF SEBASTIAN POLICE PENSION BOARD MINUTES OF SPECIAL MEETING FEBRUARY 9, 2018 1. Call to Order — Chairman Jason Gillette called the meeting to order at 9:55 a.m. Present Board Members Jason Gillette Christine Vicars Paul Williamson Randy Moyer Tim Wood Also Present Ken Gillgore, Plan Administrator Janet Graham, Technical Writer 2. Vote to Excuse Absent Board Member(s) -- None. 3. Old Business A. Certification of Election Results Mr. Killgore stated that there was one nominee, Mr. Wood, and that a motion would be in order. Mr. Gillette called for a motion. A motion to accept the election results was made by Ms. Vicars, seconded by Mr. Williamson and passed unanimously by voice vote. 4. New Business A. Next Quarterly Meeting: March 20, 2018. 5. Adiourn Chairman Gillette called for any further business. Hearing none, he adjourned the meeting at 9:56 a.m. By: Jason Gillette jg OLICE PENSION BOARD Page 2 MINUTES OF SPECIAL MEETING FEBRUARY 9, 2018 restrictions on the patient's activity. The other IMEs are the ones from Hartford Insurance, the last one being on October 12, 2017. This examination looked at his capabilities not as a police officer, and indicated that there were no functional limitations of his neck, that he had received maximum medical improvement regarding his shoulder, that he does complain of chronic shoulder pain, especially with above - shoulder activity, no other significant objective findings, thus no functional limitations were recommended regarding the shoulder symptoms. There are some additional records that were received in a second packet which indicate that he has undergone some additional treatments, not necessarily shoulder related, and that he is employed. He was working as of October 12, 2017 as a building inspector full time for the County. Ms. Jensen stated that case law states that if a person has been terminated from their employment because the employer finds that they are unable to perform their functions, they have to determine that the person is disabled. They do not, on the basis of that determination, have to determine that they are permanently and totally disabled. So the decision before the Board today is whether he is permanently and totally disabled. Ms. Jensen stated that the other unusual circumstance in this case' is the significant length of time since Mr. Johnson was terminated in 2016. There was a hearing scheduled for September 2016, and this is now February 2018. She then asked if anyone had any questions after their review of the documents. Ms. Vicars questioned the description of the duties of a building inspector. Ms. Jensen stated that she needs to check the requirements of the building inspector job. Mr. Gillette asked about the time frame that Mr. Johnson has been a building inspector. Ms. Jensen stated it was described as 11 months in the doctor's report, which was as of October 2017. Ms. Jensen stated that it was also indicated that Mr. Johnson had become a federal investigator. Mr. Scarpa stated it was November 23, 2016 when Mr. Johnson became an investigator, and he is currently an investigator. Mr. Johnson described his job of investigator being mostly office work, verifying licenses and permits, and nothing physical other than driving. Mr. Williamson questioned some items in the file, one of which in 2016 said Mr. Johnson was not totally disabled, no restrictions, maybe a 1 % impairment.* In October 2017 a report was described as no functional limitations in his neck, and shoulder had full range of motion, power and sensation. Another report in 2016 said he may be not in a position where he would defend himself, but he could do detective work, etc. OLICE PENSION BOARD Page 3 MINUTES OF SPECIAL MEETING FEBRUARY 9, 2018 Mr. Scarpa reviewed the history of Mr. Johnson's injury *on April 1, 2013 and the treatments and diagnoses he received following the injury, as well as the opinions of examining physicians and treating physical therapists. Board members then reviewed and discussed the various medical reports that were in the record. Mr. Scarpa described the legal standard for permanent impairment. Ms. Jensen stated that the amount of time that has elapsed since the Department's IME, which was in August 2016, makes this determination difficult. She stated that the Board can either grant the disability, deny the disability, or can request additional information. She stated that one medical report suggests an additional functional capacity examination at a later point. She then suggested a functional capacity examination at this time in order to see what Mr. Johnson's capabilities are presently in order to have * a more recent medical approach. Mr. Gillette suggested another functional capacity examination to get the most current information. A motion to have another functional capacity examination was made by Mr. Williamson, seconded by Ms. Vicars. Motion passed with a vote of three in favor, being Mr. Gillette, Mr. Williamson, and Ms. Vicars, and two opposed, being Mr. Moyer and Mr. Wood. Ms. Jensen stated she would investigate which doctor to use for an IME. Mr. Gillette stated he would also investigate what doctors other law enforcement departments use. Motion was made by Mr. Williamson to use Dr. MacDonald of Melbourne, seconded by Ms. Vicars. Motion passed with a vote of three in favor, being Mr. Gillette, Mr. Williamson, and Ms. Vicars, and two opposed, being Mr. Moyer and Mr. Wood. 3. The claim will be barred if it is not filed within 52 weeks of the qualifying event. o One of the following eleven circumstances ("qualifying events") must be present: 1. "Seeing for oneself a deceased minor'; 2. Directly witnessing the death of a minor; 3. Directly witnessing an injury to a minor who subsequently dies before or upon arrival at a hospital; 4. Participating in the physical treatment of an injured minor who subsequently dies before or upon arrival at a hospital: 5. "Manually transporting" an injured minor who subsequently dies before or upon arrival at a hospital; 6. "Seeing for oneself a decedent whose death involved grievous bodily harm of a nature that shocks the conscience" (grievous bodily harm): ' 7. Directly witnessing a death that involves grievous bodily harm: 8. Directly witnessing a homicide; 9. Directly witnessing an injury to a person who subsequently dies before or upon arrival at a hospital with grievous bodily harm; 10. Jensen i (I RE: Federal, State, and Local Death Benefits DATE: March 2018 As we are all painfully aware, first responders are now subject to far more accidents and violence than in the past. In 2017 so far in Florida alone,11 first responders have been killed in the line of duty - 2 firefighters and 9 police officers. Below is a description of the federal, state, and local benefits that are provided to support the families of first responders killed in the line of duty. Federal Public Safetv Officer Benefits (PSOB) The PSOB Program provides death benefits in the form of a one-time lump sum payment to eligible survivors of public safety officers whose deaths are the direct and proximate result of a traumatic injury sustained in the line of duty. For deaths occurring on or after October 1, 2017, the PSOB benefit is approximately $350,000.00. Certain educational benefits are also available for eligible survivors if they meet a very fact specific set of criteria. The application process for these benefits is lengthy and requires the submission of a number of documents as well as personal information. The application and review process can span many months. These benefits can be applied for at www.osob.00v. Additionally, the federal government offers the Public Safety Officers' Education Assistance (PSOEA) Program. This program provides financial assistance forthe spouses and eligible children of local police, fire, and emergency public safety officers who have been killed or permanently disabled in the line of duty seeking higher education. Lump Sum Section 112.19(2) & Section 112.191(2), Florida Statutes The following benefit(s) is payable to the first responder's named beneficiary for their life: a. $50,000.00 if the death is accidental. b. $ 100,000.00 if: (i) the death is accidental and the officer was in "fresh pursuit" or responding to an emergency; or (ii) the death is accidental and the firefighter was responding to an emergency involving the protection of life or property, or participation in a training exercise. c. $150,000.00 if unlawfully and intentionally killed. Under Sections 112.19(2)(j) and 112.191(2)(i), the above mentioned benefits are required to be adjusted to reflect the current Consumer Price Index. The current adjusted benefit amounts are: a. $65,576.04 b. $131,152.08 C. $197,677.91 2. Funeral Benefits (Police Only) Section 112.19(f), Florida Statutes The following benefit(s) are payable if a law enforcement, correctional or correctional probation officer is killed in the line of duty while engaged in the performance of law enforcement duties or as the result of an assault under riot conditions: 1. $1,000 toward the funeral expenses of the deceased officer. 2. Health Insurance Section 112.19(2)(g) & Section 112.191(f), Florida Statutes Any political subdivision of the state that employs a full-time law enforcement officer, corrections officer, or.firefighter who is killed in the line of duty on after July 1, 1993, as a result of: (i) an act of violence inflicted by another person while the officer is engaged in the performance of law enforcement duties, or as a result of an assault against the officer under riot conditions; or (ii) an act of violence inflicted by another person while the firefighter is engaged in the performance of firefighter duties, or as a result of a fire which has been determined to have been caused by an act of arson, or as a result of an assault of the firefighter under riot conditions shall pay the entire health insurance premium for the employee's surviving spouse, until they remarry, and for each dependent child of the employee until the child reaches the age of majority or until the end of the calendar year in which the child turns 25 if: at the time of the employee's death, the child is dependent upon the employee for support; and the surviving child continues to be dependent for support, of the surviving child is a full-time or part-time student and is dependent for support. 4. Educational Benefits Section 112.19(3) & Section 112.191(3), Florida Statutes Benefits provide for waiver of certain educational expenses that the surviving spouse or child of the deceased first responder would incur while obtaining a career certificate, undergraduate or post graduate degree from a Florida public college or university.. This benefit applies to first responders who were accidentally killed on or after June 22,1990 or unlawfully and intentionally killed on or after July 1, 1980. Benefits under this section will continue until the child reaches age 25. Benefits for a surviving spouse must commence within 5 years after the death occurs, and the opportunity will remain available until the 10' anniversary of the death. Workers Compensation Benefits Section 440.16, Florida Statutes (XI10 th-O.W110.1 Federal, State, and Local Death Benefits Page 4 Workers' Compensation Benefits are payable to law enforcement officers, firefighters, emergency medical technicians and paramedics who die while acting in the line of duty or as the result of an accident occurring in the line of duty. - Benefits are payable if death results from the accident within 1 year or follows continuous disability and results in death within 5 years of the accident. Under this section, the following amounts shall be paid: a. Within 14 days of receiving a bill, the cost of actual funeral expenses not to exceed $7,500.00. b. Compensation not to exceed $150,000 or 66 2/3% of average wage payable to the following order of preference: 1) To the spouse, if no child, 50% of average weekly wage until the spouse's death. 2) To the spouse, if there is a child, compensation under (1), plus an additional 16 2/3%. 3) To the child(ren), if no spouse, 33 1/3% for each child to age 18 or remarriage. 4) To the parents, 25% each, during continuance of dependency. 5) To siblings and grandchildren, 15% for each brother, sister, or grandchild. C. Full waiver of Postsecondary student fees for instruction at any career center for up to 1,800 classroom hours or payment of student fees at any community college for up to 80 semester hours. The benefits are in addition to other benefits provided and shall terminate 7 years after the death of the deceased employee, or when the total payment in eligible compensation under paragraph b has been received. (b) Deceased members vested or eligible for retirement with spouse as beneficiary. This subsection (b) applies only when the member's spouse is the sole designated beneficiary. The spouse beneficiary of any member who dies and who, at the date of his death was vested or eligible for early or normal retirement, shall be entitled to a benefit as follows: (1) If the member was vested, but not eligible for normal or early retirement, the spouse beneficiary shall receive a benefit payable for ten years, beginning on the date that the deceased member would have been eligible for early or normal retirement, at the option of the spouse beneficiary. The benefit shall be -calculated as for normal retirement based on the deceased member's credited service and average final compensation as of the date of his death and reduced as for early retirement, if applicable. The spouse beneficiary may also elect to receive an immediate benefit, payable for ten years, which is actuarially reduced to reflect the commencement of benefits prior to the early retirement date. (2) if the deceased member was eligible for normal or early retirement, the spouse beneficiary shall receive a benefit payable for ten years, beginning on the first day of the month following the member's death or at the deceased member's otherwise early or normal retirement date, at the option of the spouse beneficiary. The benefit shall be calculated as for normal retirement based on the deceased member's credited service and average final compensation as of the date of his death and reduced as for early retirement, if applicable. (3) A spouse beneficiary may not elect an optional form of benefit, however, the board may elect to make a lump sum payment pursuant to section 58-55(g). (4) A spouse beneficiary may, in lieu of any benefit provided for in (1) or (2) above, elect to receive a refund of the deceased member's accumulated contributions.
