PRESENT; MR. MAHONEY, MRS. KILKELLY, MR. SHROYER,ALTERNATE, MR. THOMPSON, MR. WADSWORTH ABSENT; MR. LINDSEY, MR. KRULIKOWSKI, MRS. O'CONNOR, MR. FULLERTON ALL EXCUSED ALSO PRESENT; LINDA KINCHEN, SECRETARY ANNOUNCEMENTS; CHAIRMAN STATES HE HAS A 9:30 P.M. APPOINTMENT THAT HE WOULD LIKE TO KEEP IF POSSIBLE. APPROVAL OF MINUTES - DECEMBER 5, 1991 - MOTION TO APPROVE THE MINUTES AS PRESENTED BY MR. THOMPSON SECOND MRS. KILKELLY PASSED UNANIMOUSLY f----------------------------------------------------------- HOME OCCUPATIONAL LICENSE - ALL AROUND MAINTENANCE - APPLICANT NOT PRESENT - MOTION TO POSTPONE BY MR. MAHONEY SECOND MR. THOMPSON PASSED UNANIMOUS. ------------------------------------------------------------- HOME OCCUPATIONAL LICENSE - CASTLECARE HOME AND ESTATE MANAGEMENT - MERILL G. CORNELL IS PRESENT - 117 MELTON AVENUE PUBLIC HEARING OPENED AT 7:10 P.M. CLOSED AT 7:10 P.M. NO COMMENT A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR CASTLECARE HOME AND ESTATE MANAGEMENT AT 117 MELTON AVENUE WAS MADE BY MRS. KILKELLY SECOND MR. MAHONEY PASSED UNANIMOUSLY. ------------------------------------------------------------- HOME OCCUPATIONAL LICENSE - DISCUSSION ONLY COOKING CLASSES. MR. MAHONEY FEELS WILL PROBABLY OVERLAP AT TIMES CAUSING A PROBLEM WITH TRAFFIC A MOTION TO DEFER THE APPLICATION UNTIL THE APPLICANT CAN BE PRESENT TO ANSWER QUESTIONS WAS MADE BY MR. THOMPSON SECOND MRS. KILKELLY - PASSED UNANIMOUSLY. ------------------------------------------------------------- FENCE PERMIT DISCUSSION - JOHN TAGLIAVIA - MEMBERS FIND NOTHING IN THE CODE TO DISALLOW THIS REQUEST. A MOTION TO APPROVE THE FENCE SUBJECT TO THE CITY ATTORNEY'S OPINION OF FENCE BEING A STRUCTURE OR NOT WAS MADE BY MR. SHROYER SECOND MR. MAHONEY - BACK FOR AN ORDINANCE CHANGE IF ATTORNEY FINDS IT UNALLOWABLE. MOTION PASSES 3-2 WITH MRS. KILKELLY AND MR. HOMPSON VOTING NO - BECAUSE THEY FEEL THE WRONG SEQUENCE IS BEING FOLLOWED. /00111 PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JANUARY 2, 1992 PAGE TWO A MOTION TO PUT THE HOME OCCUPATIONAL LICENSE FOR ALL AROUND MAINTENANCE BACK ON THE AGENDA DUE TO APPLICANTS ARRIVAL WAS MADE BY MR. MAHONEY SECOND MR. THOMPSON PASSED UNANIMOUSLY. HOME OCCUPATIONAL LICENSE - ALL AROUND MAINTENANCE GERALD SCHUCKERS 1026 INDIAN RIVER DRIVE #19 MR. SHROYER ASKS IF EQUIPMENT WILL BE STORED IN THE STORAGE SHED AND MR. SCHUCKERS STATES WILL BE ON THE TRAILER. MR. MAHONEY STATES TRAILER MUST BE STORED ELSEWHERE. PUBLIC HEARING WAS OPENED AT 7:55 P.M. CLOSED AT 7:55 P.M. NO COMMENTS - A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR ALL AROUND MAINTENANCE AT 1026 INDIAN RIVER DRIVE SUBJECT TO CODE RESTRICTIONS BEING FOLLOWED AND BRUCE COOPERS LETTER OF RESTRICTIONS BEING FOLLOWED MADE BY MR. MAHONEY SECOND MR. SHROYER PASSED UNANIMOUSLY. ----------------------- CHAIRMANS MATTERS: NONE MEMBERS MATTERS: MR. MAHONEY ASKS REGARDING MALABAR METALS SAYS ON MAY 16, 1991 WE AGREED TO LET THEM GO IN THERE SUBJECT TO A CODE CHANGE - BRUCE TO BE ADVISED. ALSO STATES THAT THE BATHHOUSE FOR THE INLET MARINA PROPOSED LOCATION ALREADY HAS A STRUCTURE ON IT AND ADVISES IT WILL NEED TO COME BACK TO THE COMMISSION IF LOCATION CHANGES. MRS. KILKELLY ASKS MR. SHROYER TO EXPLAIN HIS STATEMENT AS TO WHY HE FEELS THE CODE IS JUST A GUIDE AND NOT CAST IN STONE. MR. THOMPSON STATES CITY COUNCIL WILL BE CHANGING THE PLAYGROUND AREA FOR CHILD CARE FACILITIES. BUILDING OFFICIAL MATTERS - SECRETARY SPEAKS FOR BRUCE COOPER IN HIS ABSENCE AND REQUESTS THE BOARD THINK BACK TO WHETHER OR NOT THE SECURITY APARTMENT FOR FISCHER TRADE CENTER WAS EVER APPROVED - THREE MEMBERS FROM THE APPROVAL TIME STATE HE DID NOT REMEMBER IT BEING APPROVED AS AN APARTMENT STATE THERE WAS SOME TALK OF A SECURITY TRAILER ON THE PREMISES BUT NOT AN APARTMENT. A CODE CHANGE WILL BE REQUIRED TO ALLOW THIS USE AND IT WILL NEED TO COME BACK BEFORE THE BOARD. THERE WAS NO FURTHER BUSINESS TO COME BEFORE THE BOARD. THE MEETING WAS ADJOURNED AT 8:25 P.M.
