ORtDA. w PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JANUARY 3, 1991 CHAIRMAN KRULIKOWSKI CALLED THE MEETING TO ORDER. PRESENT; MR. MAHONEY, MRS. KILKELLY, MR. THOMPSON, MR. SHROYER,ALTERNATE, MR. FULLERTON, MRS. O'CONNOR, MR. KRULIKOWSKI, MR. WADSWORTH, ABSENT; MR. LINDSEY, EXCUSED ALSO PRESENT; BRUCE COOPER, DIRECTOR OF COMMUNITY DEVELOPMENT, LINDA KINCHEN, SECRETARY, ATTORNEY TORPY ANNOUNCEMENTS; A MOTION TO PUT THE HOME OCCUPATIONAL LICENSE FIRST ON THE AGENDA WAS MADE BY MR. WADSWORTH SECOND BY MRS. KILKELLY PASSED UNANIMOUSLY ------------------------------------------------------------ APPROVAL OF MINUTES: DECEMBER 6, 1990 A MOTION TO APPROVE THE MINUTES AS SUBMITTED WAS MADE BY MR. WADSWORTH SECOND MR. THOMPSON PASSED UNANIMOUSLY. ------------------------------------------------------------- HOME OCCUPATIONAL LICENSE - HELEN CLARK 674 LAKE DRIVE - REAL ESTATE - APPLICANT STATES IS FOR MAIL AND PHONE WORK ONLY NO CLIENTS TO HOUSE. PUBLIC HEARING OPENED - 7:05 P.M. ED MELANY ADJACENT OWNER ASKS IF EVER WILL CONVERT TO COMMERCIAL AREA BY APPROVING THIS PERMIT - CHAIRMAN ADVISES HIM THAT IS NOT THE INTENTION OF THE CITY. DICK SPRAGUE LIVES BEHIND HOUSE ASKS WHO POLICES THE BUSINESS ONCE APPROVED - BRUCE STATES THE NEIGHBORS CAN AND WILL COMPLAIN TO HIS OFFICE IF THERE IS A PROBLEM AND THE LICENSE CAN BE REVOKED. PUBLIC HEARING CLOSED 7:10 P.M. A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR HELEN CLARK WAS MADE BY MR. WADSWORTH, SECOND MR. FULLERTON, PASSED UNANIMOUSLY. ------------------------------------------------------------- AMATEUR RADIO TOWER - GREICO - EDWARD GREICO OF ROSEBUSH TERRACE IS PRESENT TO ANSWER QUESTIONS. MR. KILKELLY ASKS IF IT CAN BE MOVED BACK OUT OF THE 25 FOOT SET BACK AREA. MR. WADSWORTH ADVISES THE APPLICANT TO CONTACT FPL WHEN READY TO INSTALL TO AVOID PROBLEMS WITH POWER LINES AND FOR SAFETY REASONS. FULLERTON IF THE PROPERTY OWNER WILL MOVE iT BACK TO THE BUILDING LINE ON CLEARMONT AND CONTACT FPL BEFORE INSTALLATION, SECOND MR. WADSWORTH - PASSED 6-1 WITH MRS. KILKELLY VOTING NO - FENCE REQUEST - DAMIAN GILLIAMS - STEVE LULICH ATTORNEY IS PRESENT TO ANSWER QUESTIONS, APPLICANT iS OUT OF TOWN, MR. FULLERTON STATES HE HAS NO PROBLEM WITH THE REQUEST. MRS. KILKELLY IS DEFINATELY AGAINST 8 FOOT FENCES FOR THE HIGHLANDS AREAS. A MOTION TO APPROVE THE 8 FOOT FENCE FOR DAMIEN GILLIAMS AT 713 LAYPORT DRIVE FOR THE EASTERLY AND SOUTHERLY SIDE OF THE HOUSE WAS MADE BY MR. THOMPSON, SECOND MR. WADSWORTH - PASSED 5-2 WITH MR. MAHONEY AND MRS. KILKELLY VOTING NO. 8FOOT FENCE REQUEST MR. WALKER - MR. THOMPSON STATES MR. WALKER IS OUT OF TOWN AND CANNOT BE PRESENT TONIGHT BUT HE SPOKE TO THE NEIGHBOR WHO HAS NO OBJECTIONS TO THE FENCE. A MOTION TO DEFER THE REQUEST UNTiL. MR. WALKER CAN BE PRESENT WAS MADE BY MRS. KILKELLY, SECOND MR. FULLERTON - PASSED UNANIMOUSLY. RECESS CALLED AT 7:55 P.M. BACK TO ORDER AT 8:05 P,M. WATERFRONT HEIGHT DISCUSSION RESUMES, MR. THOMPSON ASKS SOME QUESTIONS SINCE HE WAS NOT AT THE LAST MEETING. MR. FULLERTON COMMENTS THAT HE IS DEFINATELY AGAINST RAISING THE LIMIT, A MOTION TO ADVISE THE APPLICANT TO STAY AT THE 25 FOOT HEIGHT LIMIT AND ABIDE BY THE CODE WAS MADE BY MR, WADSWORTH SECOND MRS. O'CONNOR PASSED 5-2 WITH MRS, KILKELLY VOTING NO BECAUSE SHE WOULD LIKE TO SEE AN AMENDMENT CHANGE AND MR. KULIKOWSKI VOTING NO BECAUSE HE IS IN FAVOR OF A CHANGE. MR, FULLERTON STATED BY VOTING YES ON THIS MOTION THAT HE WAS NOT IN ANY WAY AGAINST THE PROJECT. NUSIANCE ORDINANCE DISCUSSION MR. KRULIKOWSKI ASKS MR. WADSWORTH IF HE HAD A CHANCE TO REVIEW THE DEL RAY ORDINANCE AND IF iT WAS OF ANY HELP. MR. WADSWORTH STATES YES HE DID REVIEW IT BUT FOUND NOTHING THAT FIT THE CITY OF SEBASTIAN. MR. THOMPSON STATES HE IS iN FAVOR OF A RECOMMENDATION TO CITY COUNCIL TO USE THEDRAFT AS A CHANGE. BRUCE AND THE ATTORNEY GO OVER THE AREAS WHICH WERE CHANGED. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JANUARY 3, 1991 PAGE THREE A MOTION TO RECOMMEND TO CITY COUNCIL THAT THEY USE THE ATTACHMENT TO ll-l-90 LETTER FROM BRUCE COOPER AS A BASES FOR A NEW ORDINANCE CHANGING 16.3 AND 16.~ TO l0 INCHES IN EACH CASE WAS MADE BY MR. THOMPSON SECOND FOR DISCUSSION BY MRS. KILKELLY, ATTORNEY STATES THE COMMISSION SHOULD PAY PARTICULAR ATTENTION TO SECTION 16,4 A AND B AND 16.3 TO 16.6 BECAUSE TIMING IS IMPORTANT. MR. WADSWORTH WANTED MORE TIME TO REVIEW THE ORDINANCE BASED ON THE ATTORNEYS COMMENTS. MR. THOMPSON WITHDRAWS HIS MOTION BASED ON STAFF COMMENTS A MOTION TO PUT THIS ON THE NEXT AGENDA FOR ACTION WAS MADE BY MR. THOMPSON SECOND MR. WADSWORTH PASSED 6-1 WITH MR. MAHONEY VOTING NO STATING HE IS PREPARED TO DEAL WITH THIS TONIGHT. CHAIRMANS MATTERS; NONE MEMBERS MATTERS; MR. THOMPSON ASKS ABOUT PARKING FOR THE TOZZOLO MODEL ON BARBER AND BRUCE STATES HE DOESN'T THINK IT HAS BEEN C,O. YET. BUT WILL CHECK, MR. MAHONEY ASKS IF THE LDC REQUIRES CHANGES TO COME TO PLANNING AND ZONING FOR APPROVAL - REFERING TO THE FENCE ORDINANCE - BRUCE STATES NO THE COUNCIL CAN APPROVE ANY CHANGES WITHOUT THE APPROVAL OF PLANNING AND ZONING. ATTORNEYS MATTERS; NONE BUILDING OFFICIAL MATTERS; WANTS TO KNOW IF THE COMMISSION WOULD LIKE FRED AND MARY'S ADDED TO THE NEXT AGENDA AND THEY PICK THERE PACKAGES UP LATE OR HOLD FOR NEXT MEETING - COMMISSION PREFERS TO HOLD FOR NEXT MEETING, MEETING ADJOURNED AT 9:35 P,M.
