MAHONEY, MRS TAYLOR, MR THOMPSON/ MR. WADSWORTH MR. EISENBARTH, MR. KRULIKOWSKI ABSENT; MR. FULLERTON, EXCUSED ALSO PRESENT; HECTOR FRANCO' CITY ENGINEER LINDA KINCHEN' SECRETARY ANNOUNCEMENTS; NONE APPROVAL OF MINUTES.: MR. WADSWORTH REQUESTS CHANGES TO PAGE TWO PARAGRAPH SEVEN REMOVING THE WORDS "PERMISSION FROM THE BOARD" AND INSERTING "THE BOARDS OPINION AS TO SEEING THE MAYOR AGAIN." MOTION TO APPROVE THE MINUTES AS CORRECTED BY MR. MAHONEY SECONDED BY MR. WADSWORTH. PASSED UNANIMOUSLY. OLD BUSINESS; COMMITTEE WITHIN THE COMMISSION IT WAS DECIDED AFTER DISCUSSION THAT THE ENTIRE BOARD WANTED TO BE IN ON THE WORKSHOP REVIEWS OF THE CODE AND THE MEETING WAS SET TENTATIVELY FOR FEBRUARY 91-H AT 7|00 P.M. IF THE COUNCIL CHAMBERS ARE AVAILABLE. SECRETARY TO REPORT BACK AT THE NEXT MEETING. OLD BUSINESS CONT; 5l2 LETTER MR. EISENBARTH TAKES THE FLOOR AND GIVES HIS FEELINGS AND COMMENTS. AFTER DISCUSSION BACK AND FORTH HE FEELS THE LETTER COULD BE SENT AS IT STANDS. DISCUSSION CONTINUES AMONG OTHER MEMBERS AND SOME MINOR CHANGES ARE MADE TO PARAGRAPH TWO AND A DELETION OF THE FIRST PARAGRAPH ON PAGE TWO AND REPLACEMENT WITH A NEW PARAGRAPH. AFTER ALL CHANGES HAVE BEEN MADE THE FOLLOWING MOTION WAS PRESENTED. MOTION BY MR. THOMPSON TO WRITE THE LETTER AS CHANGED TO THE MAYOR AND CITY COUNCIL AND ASK THE CHAIRMAN TO SIGN THE LETTER AND SEND IT TO THE MAYOR WITH CARBON COPIES TO THE CITY CLERKCITY ATTORNEY' CITY ENGINEER AND PLANNING AND . ZONING COMMISSION MEMBERS. SECOND BY MR. MAHONEY. 1-:'A8SED UNANIMOU8LY. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JANUARY 8TH, 1987 PAGE TWO NEW SITE PLAN GERARD IZZO MR. IZZO IS PRESENT IN HIS OWN BEHALF MR. THOMPSON ASKS IF THERE IS A SURVEY IN THE FILE. ORIGINAL SURVEY IS PRESENTED TO HIM FROM MASTER FILE. MR. THOMPSON QUESTIONS WHETHER THE APPLICANTS PLAN MEETS THE 15 FOOT SETBACK REQUIREMENT. MR. KRULIKOW8KI POINTS OUT THAT IT DOE.'' MEET THE REQUIREMENTS AND MR. THOMPSON SAYS HE STANDS CORRECTED. MR. THOMPSON THEN QUESTIONS THE FACT THAT THE PROPERTY DOES NOT MEET THE WIDTH REQUIREMENTS AND ASKS IF ANYONE CAN TELL HIM IF THI8 IS GRANDFATHERED. MR. FRANCO SAYS THE PROPERTY IS GRANDFATHERED IN BECAUSE IT WAS PLATTED BEFORE THE CODE WENT INTO EFFECT AND IN NO WAY CAN YOU IMPOSE CURRENT REGULATION8 AND REFUSE TO ALLOW SOMEONE TO BUILD ON THEIR PROPERTY. MR. FRANCO INDICATES THAT THIS IS ALSO THE OPINION OF THE CITY ATTORNEY. MR. THOMPSON INDICATES HE WOULD LIKE THE RECORD TO SHOW THAT IT WAS MR. PALMERS OPINION WHICH ALLOWS THIS PROPERTY TO BE GRANDFATHERED IN. MR. WADSWORTH THEN MADE A MOTION TO TABLE THE SITE PLAN TILL THE NEXT MEETING FOR TOM PALMERS WRITTEN LEGAL OPINION AND PRESENCE AT THE MEETING, SECONDED BY MRS. TAYLOR. MR. THOMPSON VOTES NO, ALL OTHERS AYE.': -:5. MR. EISENBARTH MADE A MOTION TO PUT THE ITEM BACK ON THE AGENDA SO THEY CAN ADVISE THE APPLICANT IF THERE IS ANYTHING ELSE HE NEEDS TO CORRECT PRIOR TO THE NEXT MEETING' SECONDED BY MR. THOMPSON. UNANIMOUS. APPLICANT IS ADVISED THAT HIS PROPOSED STOP SIGN IS IN THE ROAD RIGHT-OF-WAY AND NEEDS TO BE MOVED BACK ON TO THE PROPERTY. MR. MAHONEY POINTS OUT THAT THERE CAN ONLY BE PALMS USED FOR 35% OF THE LANDSCAPE, APPLICANT '=-S*HOW'-:*- 100% PALMS. MR. KRULIKOWSKI FELT THE LANDSCAPING SHOULD BE MORE DETAILED AND THAT THE MATERIAL"=-*# WERE NOT LISTED ON THE PLANS. MR. THOMPSON QUESTIONS WHETHER THERE IS ENOUGH GREEN AREA TO MEET THE CODE. MR. THOMPSON ASKED THE APPLICANT WHERE THIS PROPERTY IS LOCATED. MR. IZZO SAYS THREE LOTS DOWN FROM - MARTIN LANE ON INDIAN RIVER DRIVE. NO FURTHER DISCUSSION OR ACTION DUE TO THE MOTION TO TABLE. PLANNING AND ZONING COMMISSION REGULAR MEE-TING MINUTE: -.S JANUARY 8TH, 1987 PAGE THREE NEW BUSINESS CONT; 1621 RETAIL BLDG THIS IS A MODIFICATION TO APPROVED SITE PLAN WITH CHANGES IN PARKING AND USE. MATT TAYLOR OF UNLIMITED DRAFTING REPRESENTS APPLICANT MR. EI8ENBARTH ASKS IF THE SIDEWALK CAN BE CONTINUED ON US HIGHWAY #l. MR. STRNAD FROM THE AUDIENCE STATES IT ALREADY HAS BEEN CONTINUED AND IS IN PLACE. THERE IS DISCUSSION REGARDING WHETHER ALL LETTERS HAVE BEEN PROVIDED AS TO DRIVEWAY EASEMENTS FROM PROPERTY OWNERS NORTH AND SOUTH. IT IS DETERMINED THAT THEY ARE ALL PRESENT. MR. WADSWORTH MADE A MOTION TO APPROVE THE COMPACT PARKING ' SECONDED BY MR. THOMPSON. UNDER DISCUSSION IT IS POINTED OUT THAT THERE SHOULD BE A MOTION TO APPROVE THE SITE PLAN AS REVISED AND THE PARKING TOGETHER. MR. THOMPSON WITHDRAWS HIS SECOND. AFTER MORE QUESTIONS FROM THE COMMISSION THE FOLLOWING MOTION WAS MADE. MOTION TO APPROVE THE MINOR MODIFICATION, CHANGE OF USE AND ADDITIONAL COMPACT PARKING SPACES ON THE SITE PLAN DATED DECEMBER 1986 FOR STRNAD DEVELOPERS WITH THE PROVISIONS IN MR. FRANCO'S LETTER OF JANUARY 8TH, 1987 BEING MET. SECOND BY MR. WADSWORTH. PASSED UNANIMOUSLY. NEW BUSINESS CONT: ALTERNATE MEMBER ALL THREE APPLICANTS ARE PRESENT. AFTER SOME DISCUSSION AND MANY COMMENTS ABOUT ALL THREE BEING DULY QUALIFIED AND A DECISION FOR RECOMMENDATION BEING VERY HARD THE FOLLOWING NOMINATIONS ARE MADE. CHAIRMAN NOMINATES MRS POOLE MR. WADSWORTH NOMINATES MR. PEPPER. NO FURTHER NOMINATIONS/ CHAIRMAN CLOSE' -3 NOMINATIONS VOICE VOTE; MR. THOMPSON - MARJORIE POOLE MRS. TAYLOR - MARJORIE POOLE PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JANUARY 8TH' 1987 PAGE FOUR MR. MAHONEY - MRS. POOLE MR. EISENBARTH - MRS. POOLE MR. WADSWORTH - MR. PEPPER MR. KRULIKOWSKI - MRS POOLE MRS POOLE WINS FIVE TO ONE MR. WADSWORTH STATES HE WILL CHANGE HIS VOTE TO MRS POOLE TO SHOW UNANIMOUS APPROVAL. ALL APPLICANTS ARE ENCOURAGED TO KEEP THEIR APPLICATIONS ON FILE AS THE COMMISSION FEELS THEY WOULD ALL MAKE GOOD MEMBERS AND TELLS THEM THE DECISION WAS VERY HARD TO MAKE. MR. THOMPSON MADE A MOTION TO SEND A LETTER TO THE CITY COUNCIL RECOMMENDING MARJORIE POOLE BE APPOINTED ALTERNATE. SECONDED BY MR. WADSWORTH. UNANIMOUS CHAIRMANS MATTERS; NONE MEMBERS MATTERS; MRS TAYLOR SAYS WOULD LIKE TO HAVE ADDRESSES PUT ON THE APPLICATIONS TO MAKE IT EASIER TO LOCATE PROPERTIES. SECRETARY IS ASKED TO MAKE SURE THEY ARE SUBMITTED. MR. MAHONEY ASKS IF A P. H DATE HAS TO BE SET FOR CHESSERS GAP AND IS ADVISED IT IS ALREADY SCHEDULED FOR THE NEXT MEETING. MR. EISENBARTH SAYS HE FEELS SOMETHING SHOULD BE DONE IMMEDIATELY REGARDING APPLICANTS BEING RESPONSIBLE FOR THE COST OF ALL MAILINGS AND THAT THE COMMISSION SHOULD NOT WAIT TILL THE COUNCIL REVIEWS ALL THE FEES. HE MADE A MOTION TO WRITE TO THE COUNCIL TO RECOMMEND THAT APPLICANTS BE REQUIRED TO PAY FOR.ALL MAILINGS AND THAT THIS BE ADDED TO THE APPLICATION AS SOON AS POSSIBLE. SECONDED BY MR. THOMP8ON. MR. EISENBARTH QUESTIONS LETTERS REGARDING MINUTES AND SAYS LAST WEEKS WERE WHAT HE HAD IN MIND AND SECRETARY SAYS SHE REALLY DIDN'T DO ANYTHING DIFFERENT TO HER KNOWLEDGE. MR. WADSWORTH REPORTS THAT HE AND MR. KRULIKOWSKI HAVE A - - MEETING SET UP WITH THE MAYOR AND MR. CLOUTIER REGARDING' THE PROBLEMS BROUGHT UP BY THE COMMISSION FOR FRIDAY MORNING. ENGINEERS MATTERS; NONE PAW PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JANUARY 8TH, 1987 PAGE FIVE THE CHAIRMANG WELCOMES THE NEW MEMBER OF THE PRESS AND ASKS WHICH PAPER HE REPRESENTS.
