LOCAL PLANNING AGENCY
PLANNING AND ZONING COMMISSION
MINUTES OF REGULAR MEETING OF JANUARY 15,1998
Vice Chmn. Munsart called the meeting to order at 5:06 pm.
The Pledge of Allegiance was said.

ANNOUNCEMENTS:
Vice Chmn. Munsart announced that Mr. Mather, Mr. Fischer and Mr. Driver are excused
from tonight's meeting, and Ms. Kilkelly will be voting.
OLD BUSINESS:
A. Land Development Code Revisions - Continuation of Draft Review - Amended
Articles, Chapters 7, 8, 9, and 10.
Mr. Massarelli suggested starting in Chapter 7, page 4 in the revision booklet, which covers walls
and fences. He gave information about measuring to determine the height of a fence or wall. He
also gave information about berms being used to raise a fence higher. There was much discussion
on this issue.
Ms. Kilkelly mentioned the deletion of terminology about a berm not being considered as part of
the ground, and staff noted that this was a mistake on the part of Les Solin, and it will be included
in the Code.
There was discussion on height of fences versus the height of a growing plant -type barrier. It was
suggested to make a drawing to insert in the code book, showing how to measure for a fence.

Mr. Massarelli summed up the discussions that covered measuring fence heights as follows
Side and rear yards - fence is measured from the finished floor elevation
Front yards - fence is measured four feet from the ground elevation, as long as
the slope does not exceed 3 to 1
- if on a berm which is less than 2 to 1, it is from the ground under
the berm
He noted that the exception is along CR 512.
There was much discussion about how to define the "front yard" and where fences can be located.
Front, rear, and side yard designations and visibility triangles on comer properties were also
discussed. Trellises and their height were discussed. It was determined to allow trellises as long as
they are not a continuous structure constituting a fence.
Easements were discussed as were prohibited fences & walls. Mr. Massarelli suggested inserting
"piano wire" in the prohibited materials for fencing.
There was consensus of the Board that the finished side of a fence should face out and the vote was
as follows:

Mr. Thomas suggested asking the City Attorney for an opinion on whether fences should be
installed on the property line or inside the line.
Barbed wire and razor wire were discussed.
A break was taken at 6:34 pm, and the meeting will resume after the regular P & Z meeting.
Chmn. Munsart re -opened the Local Planning Agency meeting at 8:43 pm with all previous
members and Mr. Schulke present.
Mr. Pliska requested going back to section 7-4 on fences around property. Sketches were made on
a blackboard depicting several scenarios of front, rear and side yard lines on inside lots and corner
lots and where fencing should be placed.
It was suggested to come up with wording to describe allowing fencing to be placed at the forward -
most corner of a residence, on each side.
Section 20A-2.7.8 Waterways, watercraft, and marine related structures
Mr. Massarelli noted that live-aboards are not allowed in the City of Sebastian and noted some
environmental problems associated with this issue. There was much discussion on this issue and

the Board members gave the following consensus:

Waterways of the City were discussed.
Chmn. Munsart suggested that public piers or docks should have a handrail. There was discussion
on requiring it on one side of a pier over a certain length, and not in the area where boats are
moored.
There was discussion on street access and setbacks and easements
Chmn. Munsart adjourned the meeting at 10:02 P.M.
