CITY OF SEBASTIAN PLANNING AND ZONING COMMISSION ~qIA~.MEETING JANUARY 26, 1994 CHAIRMAN THOMPSON OPENED THE MEETING AT 2:10 P.M. ROLL CALL: PRESENT: MR. MUNSART MR. SHROYER MR. FIRTION CHAIRMAN THOMPSON MR. BARNE~ MR. FALKE MR. FISCHER ABSENT: MR. SCHULKE, EXCUSED MR. GOLDSTEIN, EXCUSED ALSO PRESENT: BRUCE, COOPER, DIR. OF COMMUNITY DEVELOPMENT, RICK TORPY, ASST. CITY ATTORNEY, JAN KING,~' ZONING TECHNICIAN', AND SUZI HOLMES, BOARD SECRETARY. ANNOUNCEMENTS: APPROVAL OF MINUTES: NONE OLD BUSHINESS: NONE NEW'BUSINESS: ANNEXATION. MR. COOPER STARTED THE DISCUSSION BY MENTIONING THERE NEEDS TO BE A DETERMINATION OF W~ERE WE WOULD START FIRST AND WHAT STAFFS RECOMMENDATIONS ARE ON ANNEXATION. HE REFERRED TO THE FOUR ENCLAVES WITHIN THE CITY THAT SHOULD BE PURSUED. HE ALSO RECOMMENDED THE SOUTHEAST END OF THE SEBASTIAN HIGHLaNDs NEAR PARK PLACE AND UP TO WALMART. MR. COOPER NOTED THAT OUR EXISTING CITY LIMITS ARE SPORADIC AND ARE NOT CONDUCIVE, FOR MANY ASPECTS. MR. COOPER SUGGESTED THAT WE OFFER INCENTIVES FOR PROPERTIES TO ANNEX SUCH AS, POLICE PROTECTION AND EVENTUALLY UTILITIES. MR. BARNES QUESTIONED IF WE'VE EVER ATTEMPTED TO ANNEX ANY PROPERTY IN THE PAST? MR. COOPER REPLIED THAT WE'VE TRIED WITH NO AVAIL. MR., BARNES WONDERED ABOUT THE PROPERTY TO THE EAST? PLANNING AND ZONING COMMISSION SPECIAL MEETING OF 1-26-94 PAGE TWO MR. COOPER.REPLIED ONLY THE ENCLAVES AND PROPERTY WEST'OF TOWN. MR. BARNES QUESTIONED WHAT WOULD IT COST THE CiTY TO ANNEX ALL OF THE PROPERTIES? 'QR. COOPER DIDN'T KNOW OFF HAND~BUT STATED ANNEXING ~HEM IN WOULDN'T BE THE COSTLY PART, PROVIDING THE SERVICES-WOULD BE. AN URBAN STUDY WOULD BE DONE TO DETERMINE WHAT VACANT AND POTENTIAL LANDS ARE THERE, FUTURE GROWTH AND WHAT IS ACTUALLY DEVELOPED AND HOW WOULD WE PROVIDE THOSE SERVICES TO THEM. MR.-BARNES EXPRESSED CONCERNS ABOUT ANNEXING PROPERTIES THAT UTILITIES AREN'T PLANNING ON SERVICING. CHAIRMAN THOMPSON SUGGESTED PRIORITY ONE SHOULD BE ENCLAVES. MR. SHROYER 'SUGGESTED STARTING FROM THE NORTH END OF THE CITY LIMITS AND WORK DOWNWARD. MR. TORPY ADVISED ON THE LEGALITIES OF OFFERING TAX iNCENTIVES FOR ANNEXING INTO'THE CITY. MR. TORPY STATED THE ISSUE WOULD BE USING PUBLIC FUNDING TO FURTHER PRIVATE ENDEAVORS AND TO BE CAUTIOUS OF' THAT. MR. FALKE FEELS WE'RE PREMATURE TO DO ANYTHING BECAUSE WE DO NOT HAVE MUCH TO OFFER AT THIS-POINT. MR. SHROYER STATED POSSIBLY A TAX BREAK FOR 5 OR 6 YEARS. P & Z COMMISSIONERS SPOKE AT LENGTH ABOUT THE MANY PERSPECTIVE AREAS TO ANNEX. MR. COOPER SUGGESTED DEVELOPING A MAP BASED UPON WHAT WE HAVE COME UP WITH. CHAIRMAN THOMPSON ASKED IF IT WAS THE CONSENSUS OF THE COMMiSSI~ON TO INCLUDE THE SCHUMANN DRIVE EAST AREAS. MR. SHROYER SUGGESTED JOHN'S ISLAND.~'GOLF CLUB WEST, BUT FEELS ANYTHING EAST OF SCHUMANN DRIVE WOULD NOT BE TO THE BEST iNTEREST OF THE CITY EXCEPT NORTH O.F JOHN'S ISLAND GOLF CLUB. MR~ FIRTION AGREED WITH MR. SHROYER. MR. MUNSART SUGGESTED SQUARING OFF THE CITY LIMITS AS MUCH AS POSSIBLE. MR. FIRTION SUGGESTED ADDING ROSELAND AS WELL. MR. FISCHER SUGGESTING RUNNING A LINE STRAIGHT NORTH OF PLANNING AND ZONING COMMISSION SPECIAL MEETING OF 1-26-94 PAGE THREE COUNTY ROAD 512 TO CONNECT INTO THE SOUTH END OF SAN SEBASTIAN SPRINGS. NUMBER OF AUTOMOBILES MR. TORPY STARTED' BY SAYING THAT FROM A CONSTI'TUTIONAL STANDPOINT YOU CAN'T COME OUT WITH AN ORDINANCE THAT SIMPLY SAYS YOU CANNOT OWN "X" AMOUNT OF.-CARS PERIOD. THAT'S A LIMITATION OF SOMEONES RIGHTS TO ACQUIRE AND OWN PROPERTY. MR, TORPY SUGGESTED AN ORDINANCE THAT LIMITS WHERE AND ~ VEHICLES ARE PLACED:, AS OPPOSED TO HOW MANY YOU HAVE. HE ALSO STATED THAT WE ARE DISCUSSING VEHICLES THAT DO NOT FIT WITHIN THE JUNK VEHICLE ORDINANCE, BUT VEHICLES THAT ARE FULLY FUNCTIONAL. MR. BARNES WONDERED ABOUT REGISTRATION AND INSURANCE. MR. COOPER RESPONDED THAT IF THE TAG IS NOT ON THE VEHI'CLE, 1T CAN BE CHECKED OUT BUT, IF IT'S STILL OPERABLE THE FACT THAT THE TAG IS NOT ON THE CAR IS NOT SUFFICIENT. MR. SHROYER SUGGESTED RESTRICTING THE AMOUNT OF VEHICLES ~~-bS~B~ TO PARK ON"THE GRASS, ALSO 30% COVERAGE RESTRICTION FROM THE LAND DEVELOPMENT CODE AND POSSIBLY USING THESE.TWO ITEMS IN CONJUNCTION. MR. TORPY REMINDED THE COMMISSIONERS THAT ENFORCING A JUNK' VEHICLE ORDINANCE IS DIFFICULT~ TO ENFORCE AN ORDIN~NCE~THAT REGULATES THE AMOUNT OF VEHICLES A PERSON HAS WILL BE JUST AS DIFFICULT, IF NOT MORE. MR. TORPY SUGGESTED DRAFTING~AN ORDINANCE THAT WOULD REGULATE MORE THAN ONE TYPE OF PARKING SITUATION AND TO CREATE RESTRICTIONS THAT ARE RELATED TO ESTHETICS AND PUBLIC HEALTH SAFETY ISSUES. MR. TORPY FEELS IF THIS A COMMUNITY WIDE PROBLEM THI~ NEEDS TO BE ADDRESSED BUT, IF IT'S AN iSOLATED INCIDENT THERE.NEEDS TO BE MORE OF A CREATIVE WAY TO ENFORCE THE PROBLEM~ MR. COOPER STATED THAT UNDER CURRENT CODES THERE IS NO OTHER. WAY TO ENFORCE THE PROBLEM, AS LONG AS THE VEHICLE IS 'OPERABLE. MR. FISCHER FEELS THAT IT IS AN ISOLATED INCIDENT. MR. SHROYER AGREED. MR. BARNES AGREED, BUT FEELS AS THE CITY GROWS SO WILL THE PROBLEM. PLANNING AND ZONING COMMISSION SPECIAL MEETING OF 1-26-94 PAGE FOUR MR. SHROYER MADE A MOTION TO DROP THE WHOLE ISSUE. SECONDED BY MR. FISCHER FOR DISCUSSION. MR. BARNES FEELS THE EASIEST WAY TO ADDRESS THIS PROBLEM IS TO HAVE THE REGISTRATION OF VEHICLES MANDATED. MR. FALKE AGREED. MR. COOPER FEELS WE SHOULD REQUIRE THEM TO BE LICENSED AND REGISTERED. CHAIRMAN THOMPSON FEELS THAT WE ARE AT THE POINT IN ALL oF OUR ORDINANCES THAT WE ARE ABOUT TO TAKE ALL OF THE CITIZENS AND VOTERS RIGHTS AWAY, AND DOESN'T FEEL WE SHOULD [~O THAT.
