KILKELLY, MR. THOMPSON, MR. WADSWORTH, MR. MAHONEY, MR. KRULIKOWSKI, MR. SHROYER, MR. LINDSEY ABSENT, MR. FULLERTON, EXCUSED ALSO - BRUCE COOPER, LINDA KiNCHEN ANNOUNCEMENTS; MR. THOMPSON ANNOUNCES HE MAY BE ABSENT FOR THE NEXT MEETING AND REQUESTS HE BE EXCUSED. APPROVAL OF MINUTES; A MOTION TO APPROVE THE JANUARY 18, 1990 MINUTES AS PRESENTED WAS MADE BY MR. THOMPSON SECOND MR. WADSWORTH PASSED UNANIMOUSLY. MODEL HOME PERMIT; FERGUSON BRUCE FERGUSON IS PRESENT TO ANSWER QUESTIONS MR. COOPER STATES THAT A LETTER WAS RECEIVED TODAY FROM A RESIDENT WHO WOULD LIKE IT READ INTO THE RECORD. PUBLIC HEARING OPENED AT 7:15 P.M. LETTER READ INTO RECORD BY SECRETARY FOR MR. SMITH AND MR. REESE - NO OTHER COMMENTS PUBLIC HEARING CLOSED AT 7:18 A MOTION TO APPROVE THE MODEL HOME PERMIT FOR BRUCE FERGUSON WAS MADE BY MR. WADSWORTH SECOND MR. MAHONEY PASSED UNANIMOUSLY - MR. SHROYER VOTED iN MR. FULLERTON'S ABSENCE. HOME OCCUPATIONAL LICENSE - KLEEN KUT LAWN SERVICE RICHARD WALTER IS PRESENT MR. WALTER STATES HE STORES ALL HIS EQUIPMENT AT THE FISCHER TRADE CENTER AND HIS EMPLOYEE MEETS HIM THERE AND DOES NOT COME TO HIS HOUSE AT ALL. PUBLIC HEARING OPENED AT 7:35 P.M, CLOSED AT 7:35 P.M, NO COMMENTS THERE IS SOME DISCUSSION BY THE BOARD REGARDING THE EMPLOYEE SITUATION SINCE OUR CODE SAYS EMPLOYEES MUST BE RELATIVES LIVING IN THE HOUSE. SOME OF THE COMMISSION FEEL THAT SINCE NO EQUIPMENT IS KEPT AT THE HOUSE AND SINCE THE EMPLOYEE PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES FEBRUARY 1, 1990 PAGE TWO MEETS MR. WALTER AT THE TRADE CENTER THERE IS NO PROBLEM WITH IT. MR. THOMPSON MADE A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR RICHARD WALTER AT 561 DRAWDY WAY LOT BLOCK 59 UNIT 2 WITH THE UNDERSTANDING THAT THIS IS A HOME OCCUPATIONAL LICENSE FOR CONVENIENCE ONLY AND THAT APPLICANT STATES NO EMPLOYEES WILL COME TO THE HOUSE. SECOND BY MR. WADSWORTH. PASSED 6-1 WITH MRS. TAYLOR VOTING NO PRELIMINARY PLAT - FISCHER ISLAND RANDY MOSBY REPRESENTS PROJECT RANDY GIVES A BRIEF DISCUSSION AND OVERVIEW OF THE WHOLE SAN SEBASTIAN PROJECT. MR, COOPER STATES THAT THE LETTER FROM HRS WHICH IS MISSING FROM THE FILE SHOULD BE A CONDITION OF APPROVAL IF GRANTED. THERE WAS SOME DISCUSSION REGARDING THE LOTS WHICH WILL REQUIRE HOUSES TO BE ON STILTS AND WHAT THE ACTUAL MEAN HIGH WATER LINE IS RANDY STATES THE LOTS ARE 26 THRU 50 AND THE MEAN HIGH WATER HAS BEEN ESTABLISHED AT 1.7 FEET. MR. MAHONEY QUESTIONS THE REQUEST FOR RECREATION DEDICATION CREDIT AND FEELS THAT IT IS MINIMAL AND SHOULD NOT BE GRANTED. MR. THOMPSON MADE A MOTION TO RECOMMEND APPROVAL TO THE CITY COUNCIL OF THE SUBMITTED PRELIMINARY PLAT AND SUPPLEMENTAL INFORMATION FOR FISCHER ISLAND SUBJECT TO THE ITEMS LISTED IN THE JANUARY 26, 1990 TRC LETTER AS LISTED BELOW: 1) APPLICANT TO SIGN FORMAL AGREEMENT TO HOOK UP TO PUBLIC WATER AND/OR SEWER WHEN AVAILABLE, INCLUDING ESCROW REQUIREMENTS PER LAND DEVELOPMENT CODE. 2) APPLICANT TO PROVIDE DETAILED CALCULATIONS REGARDING DEDICATION OR PAYMENT IN LIEU OF PARKS AND RECREATION LAND AS REQUIRED BY LDC, SECTION 20A-17.1(H). (APPLICANT IS REQUESTING A WAIVER OF THESE REQUIREMENTS). THIS ITEM HAS BEEN PROVIDED. 3) APPLICANT IS REQUESTING A WAIVER FROM LDC SECTION 20A-17.1(N) REQUIRING STREET LIGHTING. STAFF HAS PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES FEBRUARY 1, 1990 PAGE THREE NO OBJECTION TO WAIVER REQUEST IF APPLICANT PROVIDES LIGHTING AT DRIVEWAY ENTRANCES PRIOR TO ISSUANCE OF CERTIFICATE (S) OF OCCUPANCY FOR EACH INDIVIDUAL LOT AS LONG AS STREETS ARE PRIVATELY MAINTAINED AND NOT DEDICATED TO THE CITY. (PLANNING AND ZONING CONCURS WITH STAFF RECOMMENDATION THAT WAIVER BE APPROVED,) 4) APPLICANT TO PROVIDE ASSURANCES, INCLUDING FORMAL CALCULATIONS AND PHYSICAL MONUMENTS, THAT SAND REMOVED FROM FISCHER ISLAND SUBDIVISION LAKE EXCAVATION WILL NOT BE TAKEN OFF SITE. FISCHER ISLAND SUBDIVISION LAKE EXCAVATION IS NOT PART OF CURRENT SAND MINING PERMIT IN SAN SEBASTIAN SPRINGS WEST PRELIMINARY SUBDIVISION. SURVEY MONUMENTS TO BE IN PLACE AT START OF FISCHER ISLAND LAKE EXCAVATION TO ASSIST IN IDENTIFICATION OF SEPARATE CONSTRUCTION AND MINING ACTIVITIES. 5) APPLICANT TO PROVIDE OVERVIEW OF PROJECT IN CONJUNCTION WITH ADJACENT PROJECTS AND FUTURE DEVELOPMENTS, ( THIS ITEM HAS BEEN PROVIDED.) 6) PRELIMINARY PLAT DRAWINGS TO BE SEALED. 7) COMMENTS FROM HRS TO BE PROVIDED. AND THAT A WAIVER NOT BE APPROVED FOR SECTION 20Ai.I(H) OF THE LAND DEVELOPMENT CODE. SECOND BY MR. SHROYER. ROLL CALL VOTE: MR. SHROYER - YES, MRS, TAYLOR - YES MR. MAHONEY - YES, MR. WADSWORTH- NO, MRS. KILKELLY - NO ONLY BECAUSE SHE FEELS THE RECREATIONAL WAIVER SHOULD BE GRANTED - MR. THOMPSON - YES AND MR. KRULIKOWSKI - NO. MOTION PASSES 4-5 AS STATED. CHAIRMANS MATTERS - NONE MEMBERS MATTERS; MRS. KILKELLY IS UPSET BY AN ACCESSORY BUILDING GOING UP AT FLORALAND AND GLENCOVE SHE FEELS THAT THE BUILDING OFFICIAL SHOULD HAVE BROUGHT THIS MATTER BEFORE THE BOARD AS STATED ON PAGE 81g IN THE CODE, MRS, KILKELLY REQUESTS THIS BE AN AGENDA ITEM ON THE NEXT MEETING FOR DISCUSSION AND POSSIBLE CHANGE, PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES FEBRUARY 1, 1990 PAGE FOUR MR. MAHONEY QUESTIONS WHY THE EXTRAORDINARY FEE ORDINANCE DID NOT COME BEFORE THE PLANNING AND ZONING COMMISSION. BRUCE STATES IT MUST HAVE BEEN AN OVERSITE AND SINCE IT WAS NOT APPROVED AND THE COUNCIL REQUESTED MORE WORK IT SHOULD COME BEFORE THEM AFTER REVISIONS. BUILDING OFFICIAL MATTERS; BRUCE STATES HE HAS COMPLETED THE LISTS OF EXPIRATIONS ON PUD'S AND SUBDIVISIONS AND WILL PROVIDE THE BOARD WiTH A COPY WHEN TYPED. HE ALSO STATES HE HAS COMPLETED A SEPARATE LIST OF HOME OCCUPATIONS WHICH HAVE BEEN APPROVED AND WILL BE HAVING THE CODE ENFORCEMENT OFFICER SPOT CHECK THEM. MEETING ADJOURNED AT 9:30 P.M.
