Chairman Fischer called the Special Meeting to order at 7:00 p.m.

This is the first public hearing, and the second public hearing will be held on Wednesday, February
141 1996 at the City Council Meeting.

RECOMN[ENDATION TO CITY COUNCIL - PUBLIC HEARING - AMENDED
DEVELOPER'S AGREEMENT - SEBASTIAN LAKES PUD -R
The Public Hearing was opened at 7:02 p.m. There were 56 notices of the hearing sent out.
There were no objection or non -objection letters received back.

Mr. Williams explained an amendment to a Developer's Agreement in reference to Sebastian
Lakes PUD -R. Members of P & Z Commission received the most recent copy of this agreement
at tonight's meeting.
Chairman Fischer inquired about the changes, and Mr. Williams explained that they were minor.
Mr. Koford explained the relationship between the City of Sebastian and Indian River County as
pertains to decisions and responsibility for improvements on Roseland Road. Roseland Road is
presently a City road, but the possibility exists that it may become a County road in the future.
Because of County maintained drainage and City location, the eifort-shall be joint.
There was no public input. The public hearing was closed at 7:15 p.m.
Mr. Thompson noted that there were no exhibits with the Amended Developers Plan, and Mr.
House explained that he would be having legals, which are a survey showing pieces of right-of-
ways and the property itself delivered by Monday, February 12, 1996
In answer to an inquiry by Mr. Thompson, Mr. House, and Mr. Williams replied that PTC and
Lennar and all parties are in agreement.
Mr. Koford explained that this agreement gives the City what it wants for Laconia Road and
Roseland Road.
In response to Mr. Pliska's question, Mr. Koford replied that he thinks that Roseland Road will
remain with the City of Sebastian, but at some later time, it may be maintained by the County.
RECOMMENDATION TO CITY COUNCIL - AMENDED DEVELOPER'S
AGREEMENT - SEBASTIAN LAKES PUD -R
MOTION by Thompson/Johns
I move that we recommend to the City Council that they approve the agreement between
the City and the two Developers, the draft dated 8 February 1996, with the provision that prior to
the agreement going to the City Council , that there be official correspondence within the official
file that shows that the consultant City Engineer, the Engineer of record, and representing the
PTC, and that there be also a letter from Lennar Northeast Partners Limited showing that they
have no objections to this agreement as presented.
Roll call was taken. 7-0 motion carried.

Chmn. Fischer mentioned that the Solin and Associates' contract will be coming before City
Council at their meeting on Wednesday (2/14/96) for their action.
The meeting was adjourned at 7:32 p.m.
