Fischer announced that Ms. Kilkelly would be voting in place of Mr. Driver and Mr. Johns. OLD BUSINESS: None NEW BUSINESS: PUBLIC HEARING - MODEL HOME PERMITS - 141:} & 1425 BARBER STREET - AMERON HOMES, INC. William Brognano, 144 S. Wimbrow Drive, Sebastian, was present representing Amor~ Homes. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF FEBRUARY 20, 1997 There were ten (10) notices of hearing sent out. There were no objection or non-objection letters rec~ved. Jan King gave staff presentation and explained that a third lot will provide parking for both models. Staff recommended approval. Chnm. Fischer opened and closed the public hearing at 7:05 P.M., with no public inlmt. MOTION by Vesia/Mather I make a motion we approve a conditional use permit for two model homes ~r Ameron Homes, Inc. A voice vote was taken. 7 - 0 motion carried~ PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 1782 LACONIA STREET - CAR1 WEBER - BOOKKEEPING Cad Weber, 1782 Laconia Street was present and identified herself, There were eight (8) notices of hearing sent out. There were no objection or non-objection letters received. Jan King gave staff presentation and recommended approval. Chron. Fischer opened and closed the public hearing at 7:11 PM., with no public input. In response to questions from Mr. Pliska, Ms. Weber responded that she will only be doing business with small businesses, not private individuals. MOTION by Munsart/Vesia I move that we grant a Home Occupational Licergse to Caddad Weber ~t 1782 Lac, oma Street for a Bookkeeping and Tax Service. A voice vote was taken. 7 - 0 motion carried. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 510 ACACIA AVENUE - PAUL COSNER - WHOLESALE DISTRIBUTION Paul Comer, 510 Acacia Avenue, Sebastian, was presertt and identified himself. There were twenty-two (22) notices of hearing sent out. There were no objection or non-objection letters received. Jan King gave staff presentation and recommended approval. 2 PLANNING AND ZONING COMMiSSION MINUTES OF REGULAR MEETING OF FEBRUARY 20, 1997 Chnm, Fischer opened and closed the public hearing at 7:11 P.M. with no public input. After a question by Mr. Munsart, it was explained that the area of Mr. Cosner's home to be used for his business was changed to his family room to comply with code. MOTION by Munsart/Kilkelly I move that we grant a Home Occupational License to Paul Cosner Enterprises, at 510 Acacia Avenue for wholesale distribution service. A voice vote was taken. 7 - 0 motion carried. ACCESSORY STRUCTURE REVIEW - SECTION 20A-5.7.D TERRACE - TIM GATH 787,,. BAYFRONT Tim Garb, 787 Bayf-ront Terrace, Sebastian was present and identified himself. jan King gave staff presentation and recommended approval. She explained that it comes before Planning and Zoning because of the size. Mr. Gath commented that be had already poured the slab, and with approval would be buildi~ this structure this weekend. He also noted that he will use white lap siding because next yom' he plans to redo his home with white lap siding. Mr. Massarelli noted to the Commission that Mr. Gath does have an Occupational.Liceaise with the City as a Handyman, and cautioned the applicant that he cannot use this structure to conduct his business or store anything related to his business. Mr. Gath agreed. MOTION by Math~/Munsart I make a motion to appwve the application of Tim Gath, 787 Bayfrom Terrace for an accessory structure. A voice vote was taken. 7 - 0 motion carried. RECOMMENDATION TO CITY COUNCIL - PRELIMINARY PLAT - FISCHER'S LAKE iSLAND SUBDIVISION Chnm. Fischer removed himself from the Commission for conflict of interest, turned the..mecting over to Mr. Munsart, and submitted a Form 8B for voting conflict. Mr. Massarelli gave staff presentation, and explained changes in the property since the earlier prelimmm~ plat was approved, thereby necessitating a new preliminary plat application. He noted that one of the issues is stabilization of the storm water masmgement tract, the lake that is in the center of the property. The Water Managemeat District requires stabilization and planting in that area to avoid erosion and to mimic the old littoral zone. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF FEBRUARY 20, 1997 He noted that there will be private wells and septic tanl/s on the property instead of water and sewer by Indian River County - this change will be made to the prelimimry plat. He also noted a short road called Erica's Way at the northern end of this property - this has been modified into a road and proper sixty (60) foot right-of-way, and the proper cul-de-sac design, to provide access to the three lots. This would create a third Block and the plat will be modified to reflect this, Mr. Massarelli then spoke on Lake B~y being placagt in a drainage easeanent. Al~o hotel was a twenty (20) foot mainteamnce easeax~at around tl~ Lake. He then suggested that recreational improvengnts be handled as a separate site plan. Staff recommends approval with the conditions listed m the staff report. Mr. Randy Mosby, Mosby & Associates of Veto Bez. ch was present representing th~ applicant, and gave a presentation of this plat and a history of the previous plat. He noted'that no wetlands are involved with this plan. He noted thc legal description for final outfall and Mr. Massarelli commented that he did not have a copy of tl~. Mr. Mosby also noted that m areas where drainage patterns are appropriate, he has reduced the right-of-way to fiRy (50) feet.to remove grass, swales, and has gone to the more expensive curb and He made reference to .the curve on the very northern tip of the subdivision, and agreed to soRen this curve to give more area for maintenance of that curve and right-of-way. He also agreed to the recommendations including the minor ohanges, as included in the staff report. Ms. Kilkelly suggested developing a landscape plan. for Track A that would allow an emergency vehicle to drive through it in the event that the ~ access would be blocked, llgre was much discussion of this subject. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF FEBRUARY 20, 1997 Mr, Mosby agreed to design Track A to provide an emergency entrance, Mr. Massarelli referred to the City Code and noted that the Planning and Zoning Commission could require a second access, and suggested that a slight modification of Track A is.: a reasonable compromise. RECOMMENDATION TO CITY COUNCIL - PUD FINAL PLAT - PARK PLACE - MR. NELSON HYATT At this point Mr. Schulke removed himself from the Commission for conflict of interest, and submitted a Form 8B Conflict of Interest. Mr. Massarelli gave a brief history on the procosdi~s of this project, noting that he thought this was the first PUD applied for in the City. He. suggested the Commission send their recomme~/ations to City Council and in addition, take .th~ preliminary development.plan that was approved ten (lO) years ago and have City Coundl "re-approve" them in order to. e~abli,h' ~other beginning date. Eighteen (18) months from rhea, renewal would have to take place, or City Council will terminate. Because of the time that has lapsed on this project, this process would put it back on.track and make it manageable. He noted that this is the first time there has been v, final PUD on this project. He also noted that the lighter colored area on the plans was already built out, and that portion has beem sold to another party. He will be notifying this other party .of their situation, as they have an expired preliminary PUD, but not a terminated one. They need W come m, get. it back on track and get it to a final PUD. if they have conespondmme from Mr.. C/~er · stating that this is not requirod, we will work with the applicant. He emphasized the fact?that this needs to be brought to closure. PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF FEBRUARY 20, 1997 Mr. Massarelli proceeded to give staff pr~-ntation. He noted that homeowner doonmmts have been provided, and the security bond is one thing that is ~ for the unconstmcted portions of the project. He gave some information on two (2) lots on a curve, and also about drainage easements. Staff also recommends a twenty (20) foot wide maintenance cascment across tbe back of thc lakc in case a truck ever needs to brought in there. Staff recommends approval of thc rccommcndalion to City Council for final PUD and final plat for a portion of Park Place with the following conditions: 1. That the applicant provide a statement as to when thc improvements will be complY, ed and a surety bond for the furore improvements. 2. That the applicant provide a twenty (20) foot wide maintenance easement along the stormwater nmnagotmmt lake. Mr. Joseph Schulke of Knight, McCmire and Associates, was pre, sent representing tho applicant. He indicated agreement with the twenty (20) foot. easements along the lakes, explained some of the other easements already providcd, and agreed with the conditions set forth above. He also pointed out a misnumbered lot, and assured the Commission that this would be corrected. MOTION by Mather/Mnn-~art 'I makc a motion that wc recommend to City Council for approval Park Place Plat One (1), final PUD, fund Plat, drawings by William H. Hayhurst, date revision of 2/12/97, all three (3) sheets. A voice vote was taken. 6 - 0 motion carried. CHAIRMAN MATTERS: Chairman Fischer brought up the subject of "Handyman License" and therc was discussion on it. Mr. Massarelli suggested that this subject should be brought befor~ the Construction Board. MIgMBERS MATTERS: Mr: Munsart apologized for missing the workshop meeting earlier in the day. DIRECTOR MATTgi~.; Mr. Massarelli noted that he had hired a Planner R, Tracy Haas, who will be starting Monday, March 3. He then noted thc large number of projects that have been processed, and his rocemly layed out work plan for the next seven (7) montkq including concurrency. Fisher announc.~! that if any action is taken at this meeting, Ms. Kilkelly would be voting in place of the absent members. At this point the Secretary explained the now sound system. Mr. Pliska announced that he would miss the next two (2) meetings - (March 6 and 20, 1997). DISCUSSION ITEMS: A. ACCESSORY STRUCTURES Jan King c, xplained the process of handling Aoe~ssory Structure reviews in tl~ Building At this point Mr. Pliska went to the tripod drawing board to show his ideas about property owners who own two or tlmm adjoining lots, abandon the center property lines and easements, and unify the properties, and how he felt that the 30% coverage rule became a problem. Mr. Massarelli asked the members to identify the problems with accessory struceau'ea, They are as follows: 1. Too many buildings on one lot 2. Height of side walls 3. Overall height compared to principle structure 4. "Compatible" definition - metal / di~ roofpitehes / aesthetics 5. Size - square footage 6. Attached and detached 7. Screening issue / landscaping 8. Oversized structures being allowed to encroach in the setbacks-rear and side (Jan King referred to the code under "reqmred yards' on page 325) 9. PI~ of high accessory buildings 10, Definition Mr. Massarelli also asked if it is the intent of the City to regulate accessory structures m commercial and industrial areas. He noted that if it is over five hundred (500) sq. t~., it is dealt with in site plan. This is not the case with residential. There was much discussion on attached and detac~d as used in the code. It was suggested that anything over two hundred (200) sq. ft. and detached needs to come before this Commission. Mr. Massarelli suggested establishing some criteria that would brin8 these to the Commission. He noted that compatibility - that architecturally, if it is the same material, color, roof linc as the primary house - it could be approved by staff. If it is not the same, or is an add-on after the primary house has been constructed it would have to come to the commission. Mr, Schulke suggested being more strict with standards for attached accessory buildings, md being a bit more lenient with ~ ones. Mr. Massarelli noted that when he spoke of criteria, he thought of color, texture, matm~ architectural style, structural type, roofmatmal, stucco, block, frame, etc. was discussion about location of accessory buildings and a su~on of a forty (40) foot s~tback was made. The next discussion was on the number of accessory buildings allowed on a property. There was a suggestion that where there is more than one accessory building, possibly twO (2) or three 0), that there could be veBctative screening required. Mr. Massarelli suggested staff:come bac~ with suggestions on this discussion. B, HOME OCCUPATIONAL LICENSES There was a discussion on limiting the number of umewals on Home Occupational ~. It was also suggested that violators be given just a certain number of violations then have their Home Occupational License revoked. Code enforcement was also discussed. The next issue of discussion was deliveries. It was determined that large commeax~ carriers would not be considered '~normal" traffic. "Employees" was the next issue, and the topic :of"address of conveuic~e" was covered. Ho also commonted on "sam, ~s", and dropping Hom~ Occupational Liceming from the Code, Mr. Massar~lli brought up tho issue of the 3/4 ton truck versus the 1 ~ truck. H~ noted that there is a series of applicatiom coming in with 1 ton trucks, and since 1 ton tmclc~ are allowed for re~id, nts, it doesn't soem to be reasonable that having a Home Occupational Licea~ puts a limit on tho siz~ of track allowed to 3/4 ton. ~ suggested obtaining oxamples of Hom~ Occupational Liceme guidelines fix)m oth~ municipalities to see how other citie~ handle flaean.
