Fischer EXCUSED ABSENCE: Mr. Munsart Mr. Pliska Mr. Schulke ALSO PRESENT: Robert Massarelli, Community Development Director Tracy Hass, Planner II Jan King, Zoning Technician Ann Brack, Recording Secretary . ANNOUNCEMENTS: Chrnn. Fischer announced that Mr. Libertino's request would be added to the agenda after the COR discussion. All members approved. He also announced that Ms. Kilkelly and Mr. Driver will be voting tonight in place of Mr. Pliska and Mr. Munsart. Mr. Massarelli introduced the new Planner II, Tracy Hass. NEW BUSINESS: PUBLIC HEARING - MODEL HOME PERMIT - 456 WATERCREST STREET - ANDERSON/MULLER, INC. Mr. Henry Muller, 5954 River Run Drive, Sebastian, was present. There were seven (7) notices of hearing sent out and there were no objection or non-objection letters received. Jan King gave staff presentation. Staff recommends approval "ith the condition that the parking angle be changed to the opposite direction. Chrnn. Fischer opened and closed the public hearing at 7:07 P.M. 'l'ith no public input. MOTION by JohnslDriver I make a motion that we approve a model home permit for AndersonlMuller, Inc. at 456 Watercrest Street, this pemtit being subject to him reversing the angle of the parking. A voice vote was taken. 6 - 0 motion carried. . PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 1534 DEWITT LANE - RICHARD & LEANN JUDD - LAWN MAINTENANCE Richard Judd of 1534 DeMtt Lane, Sebastian, was present There were eighteen (18) notices of hearing sent out and there were no objection or non-objection letters received. Jan King gave staff presentation. Staff recommends approval. Chrnn. Fischer opened and closed the public hearing at 7:09 P.M. with no public input. MOTION by VesialJohns I make a motion that we approve occupational license to Richard Judd, doing business as Barefoot Services at 1534 De'l'itt Lane, Sebastian. A voice vote was taken. 6 - 0 motion carried. VERIFICATION OF PERMITTED USES IN COR ZONING - REQUEST BY CONTEMPORARY HEAL TH INNOVATIONS - PETER HOL YK, M.D. . Mr. Massarelli explained the letter that he received from Peter Holyk, M.D. 'l'ith a proposal for a health and nutrient consultation, toxic and heavy metal total body detoxification and therapy establishment. They Mil also be selling supplements and other supplies to their patients. After much discussion, it was determined that the application could be made for a conditional use pemtit. 2 . PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF MARCH 6, 1997 DISCUSSION - DAYCARE - TRACT I, SOUTH WIMBROW DRIVE - LIBERTINO Mr. Massarelli noted that he had received a request to put a daycare center on Wimbrow Drive. He proceeded to point out various sources of infonnation for discussion and a determination. There was much discussion about what qualified for major and minor collector roads, and which classification best suited South Wimbrow Drive. Mr. Johns agreed with Ms. Kilkelly that this seemed to be a good place for a daycare center. Ms. Kilkelly suggested that Mr. Massarelli confer with Mr. Solin on his intention when the Code was written. The Commission agreed with this decision. RECOMMENDATION TO CITY COUNCIL - PROPOSED ORDINANCES PROCEDURAL CHANGES TO THE LDC - 0-97-X13D TO 0-97-X15C Ordinance 0-97-X13D was discussed. It was determined that Mr. Massarelli would create a chart to show what quasi-judicial cases will go to City Council and what cases to Planning and Zouing. He also noted that the City Attorney will be at the next Commission meeting and she can talk about the entire quasi-judicial process and any problems involved. Mr. Mather requested that this Ordinance be brought back on March 20, 1997. . Ordinance 0-97- X 13 E was discussed. All changes were accepted by the Commission members. MOTION by Johns/Mather I make a motion that we recommend to City Council approval of Ordinance number 9-97- X13E. A voice vote was taken. 6 - 0 motion carried. Ordinance 0-97- X 14b was discussed. MOTION by Mather/Johns I make a motion to recommend to City Council 0-97-XI4b. A voice vote was taken. 6 - 0 motion carried. Ordinance 0-97 -14c was discussed. It was agreed that throughout the Ordinances, wherever the change was made to "Community Development Director...", Mr. Massarelli would include the phrase "...coordinating the review with the Engineer and other staff", or similar wording. . After more discussion, it was decided that after consultation with the City Manager on the organizational chart, Mr. Massarelli will bring this ordinance back before the Commission. 3 . PLANNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF MARCH 6, 1997 Ordinance 0-97-XI4D had a typo error on page I - change "complacence" to compliance. There were several sections of this ordinance that were discussed.. It was also agreed to retain paragraph "i" on page five (5). Ms. Kilkelly suggested the sentence "no landclearing, grubbing or construction shall be initiated until approval" be inserted. There was more discussion and more changes were made, both typing corrections and word usage. MOTION by Kilkelly/Driver I move that we recommend to City Council the approval of Ordinance 0-97-XI4D as ammended at this meeting. A voice vote was taken. 6 - 0 motion carried. 0-97-XI5B was discussed and it was determined to bring this ordinance back March 20, 1997. 0-97-XI5C was discussed and it was determined to bring this ordinance back March 20, 1997. . Mr. Massarelli gave the Commission members a general idea of a schedule, to include workshops with City Council and various other actions on ordinances. There was a reminder from Mr. Mather of the thirty-five (35) foot height limitation in PUD-R. CHAIRMAN MATTERS: None MEMBERS MATTERS: Mr. Mather made a statement to be made part of the record in reference to the recommendation made to City Council on the Vicker's Grove Sandmining. It was approved by all members of the Planning and Zoning Commission, including Mr. Mather. DIRECTOR MATTERS: Mr. Massarelli noted that the Adamson Carwash Special Use Permit was approved last night by the City Council, and they did add another restriction on the time, from 6:00 A.M. to 10:00 P.M.; the Fischer Lake Island preliminary plat was approved; the Park Place final plat was approved; and they have received the Park Place preliminary development plan to get it back on track. He suggested a workshop with this Commission, soon, for the Comprehensive Plan and a schedule for events in the Comprehensive Plan and some guidance on how to do it. He also suggested, in the latter half of the summer, to work on the ordinances to take care of changes to the LDC to implement the Comprehensive Plan. . The meeting was adjourned at 9:01 P.M.
