CHAIRMAN CALLED THE MEETING TO ORDER AT 7:10 PJ11.
PRESENT; MR. THOMPGON' MRS. TAYLOR' MR. MAHONEY' MR.
WADSWORTH' MR. EISENBARTH' MR' KRULIKOWSKI
ABSENT; MR. FULLERTON/ EXCUSED
ALSO PRESENT: SECRETARY LINDA KINCHEN, ATTORNEY TOM PALMER
ANNOUNCEMENTS; MR. THOMPSON REQUESTED THAT TWO ITEMS BE PUT
ON THE AGENDA UNDER ANNOUNCEMENTS.

MR. THOMPSON MADE A MOTION TO ADD THE ITEMS TO THE AGENDA
SECONDED BY MR. MAHONEY AND PASSED UNANIMOUSLY
APPROVAL OF MINUTES MARCH 9TH, 19-847
DISCU8SION TURNS TO PAGE TWO WHERE THE MINUTES STATE THE TAPE
WAS INAUQIBLE
MR. THOMPSON CLARIFIES WHAT WAS SAID AND INDICATES IT SHOULD
READ APPLICANT SHOULD BEAR THE COST OF GIVING REQUIRED
NOTICES TO SURROUNDING PROPERTY OWNERS.
THIS SENTENCE GOES IN THE THIRD PARAGRAPH FROM BOTTOM PAGE
272 AND THE LAST PARAGRAPH STARTING PA8E768. BOTH PARAGRAPHS
INDICATE THE TAPE WAS INAUDIBLE.
MR. THOMPSON MADE A MOTION TO APPROVE THE MINUTES AS
CORRECTED SECONDED MR. MAHONEY PASSED UNANIMOUSLY.

INVESTIGATE AND RECOMMEND CHANGES FOR THE LAND DEVELOPMENT
CODE AS RELATED TO POROUS PARKING 8ECONDED BY MR. WAQSWORTH
PASSED UNANIMOUSLY.

MR. WAD8WORTH ASKS ATTORNEY PALMER IF DEALING WITH THE
RAILROAD IS HARD. TOM STATE8 IT IS POSSIBLE TO GET MORE
CROSSIN8S BUT YOU WOULD HAVE TO MAKE A VERY STRON8 CASE OF
NEED AND TOM STATES IT IS ALSO A VERY EXPENSIVE PROPOSITION.
MR. THOMPSON MADE A MOTION TO WRITE TO THE MAYOR AND CITY
COUNCIL THAT THE COMMISSION FEELS 8TRONGLY THAT THE OLD DIXIE
CROSSING OF THE FEC NOT BE TRADED OR REMOVED THAT THE
COMMISSION FEELS IT IS AN IMPORTANT PART OF ANY OVERALL FIVE
OR TEN YEAR PLANNING, SECONDED BY MR. EISENBARTH AND ["IRS.
TAYLOR PASSED UNANIMOUSLY.

MR. KRULIKOWSKI STATES THI8 WAS HIS REQUEST TO LOOK INTO THE
POSSIBILITY OF PHASING OUT HOME OCCUPATIONAL LICENSES ALL
TOGETHER.
HE INDICATES TO THE COMMISSION THAT APPLICANTS ARE NOT
FOLLOWING THE RULE8 AND CODE ENFORCEMENT IS NOT DOING
ANYTHING ABOUT IT.
TOM SAYS THE COUNCIL WILL NOT WIPE OUT ALTOGETHER ANQ HE
THINKS IT IS WELL WRITTEN BUT MAYBE WE NEED TO HAVE SOME
ADDITIONAL COMMENTS IN THE AREA WHICH Ll:' ---"TS OCCUPATIONS WHICH
CANNOT BE HOME OCCUPATIONS. TOM TO GET INFORMATION FROM OTHER
AREAS AND ADVISE, MR. WAOSWORTH MADE A MOTION TO PUT HOME
OCCUPATIONAL LICENSES ON NEXT MEETING AGENDA FOR MORE
DISCUSSION REGARDING THE PROBLEMS' SECONDED MR. MAHONEY

ITEM NO. 6| CONFLICT IN SECTIONS AS PER TOM'S LETTER
ATTORNEY PALMER STATES HE FINDS NO CONFLICT IN THE WAY THESE
SECTIONS ARE WRITTEN HE ASKS WHY THIS WAS BROUGHT UP. THE
COMMISSION GIVES THEIR FEELINGS ON THE TRI -FLEX WHICH WAS,
JUST APPROVED FOR INDIAN RIVER DRIVE AND STATES THEY FEEL
THEY DO NOT WANT ANY MORE OF THEM DOWN THERE. '
TOM SAYS THE SITE PLAN WAS ALLOWED IF ALL THE OTHER SET BACK
REQUIREMENTS WERE MET ALONG WITH THE OPEN SPACE REQUIREMENTS.
HE INDICATES IF THEY WANT TO DISCONTINUE THIS TYPE OF PROJECT
THENTHE FOLLOWING SENTENCE CAN BE ADDED TO PARAGRAPH Q-2.

SECTION 20A-9.4' 20A-5.4 OR 20A-5.5 (C) (l).
MR. THOMPSON MADE A MOTION TO ADD THE SENTENCE TO THE CODE

ATTORNEY PALMER STATES WE CANNOT PUT A TIME LIMIT ON CITY
EMPLOYEES THAT COUNCIL WILL NOT APPROVE SUCH A REQUEST.
MR. THOMPSON MADE A MOTION THAT NO FURTHER ACTION BE TAKEN ON
THIS ITEM

TOM STATES HE CAN SAVE TIME BY ANSWERING THAT ANY FRACTION OF
A SPACE IS ROUNDED TO THE NEXT HIGHEST SPACE. THAT WAS THE
INTENT OF THE CODE. STATES WE DO NOT ROUND DOWN.

BOTH BY MR. PALMER AND THE COMMI8SION THAT THE ORDINANCE'S
INTENT IS EXACTLY WHAT IT STATES AND THE 100 FEET IS FROM
PROPERTY LINES AND NOTHING ELSE.
THE COM11IS8ION ADVISES MR. SOMMER8 TO HAVE HIS CLIENT
CONSIDER APPLYING AS A CHILD CARE CENTER TO MAKE THE PROJECT
WORKABLE.
MR. THOMPSON MADE A MOTION TO REMOVE ITEM l0 FROM FURTHER
DISCUSSION SECONDED BY MR' WADSWORTH PASSED UNANIMOU8LY.
THE COMMISSION ADVISE THE SECRETARY TO SUBMIT ALL CURRENT
CHANGE RECOMMENDATIONS TO THE COUNCIL NOW AND ADVISE MORE
WILL BE FORTHCOMING.
NEXT MEETING SCHEDULED FOR MAY 11TH AT 7 P.M.
