NEW BUSINESS: A. LAND DEVELOPMENT CODE REVISIONS - Review final drs~t of, Land Development Code Mr. Massarelli indicated Articles I, III, IV, VI, VII, VHI, XIII~ XV, and XVI. He noted that the copy of Article H that was scm from Les Solin of Solin and Associate, is un-reproduc~le and a n~v copy will be roceived shortly. Ho the~ noted that ho is reformatting A~icle V and h~ isn't ~ yet. Article IX needs only one item checked and it should be ready for Thursday. Articl~ X, XI, a~d XII will be corrected. Article XIV is reserved. Article XVII, XVIH, XIX and XX are tho one we are still working on. He commemed that he has been spending a lot of time on Article XXII, the Glossary and it has been very difficult. He suggested that we start with Article I. ARTICLE I: PREAMBLE Them were no ~ or questions. DEVELOPMENT AGREEMENTS There were no comments or questions. LOCAL PLANNING AGENCY, PLANNING AND ZONING COMMISSION MINUTES OF MEETING OF APRIL 21, 1998 ARTICLE IV: LAND USE COMPATIBILITY Mr. Massarelli referred to table #20A-2-4.2, and noted that PUD should be allowed under Commercial Limited, and under the Riverfront Mixed Use, PUD (C) & (R) should be included. CONDITIONAL USE CRITERIA D. 6. There was discussion on the term "reasonable cause". There was also discussioncm conditional uses. Section 20A-2-6.4 APPEALS OF CONDITIONAL USE ACTION Insert "except for home occupation licenses" in first sentence. GENERAL REGULATIONS Section 20A-2.7.3: Water Facilities is a change in rifle. There was discussion on mandatory hook-up to the County Water System. Mr. Massarelli referred to Article XX, pag~ X-3, Section -3-10.6, Potabl~ Water and Wasm Water. It was ~ to move this section to Article VII, and reference it m Artiole XX. Section 20A-2.?.5: Accessory Structure There was discussion aboUt a recreational vehicle parked on a sid~ yard of a con~r property, and it was not~ that it was unsightly. There was a suggestion that the code could be cban~ to prohibit storing of RV's in the front ysrd or s~condsry front yard of a coruer property. Members agreed to tiffs chsage. Mr. Massarelli referred to S~'rion 20A-2.7.14, B.4. and noted that tiffs paragraph would be chang~ to read "...no reereatlonal vehicle shall be located in the front yard." He nol~l that corner propert~ have two front yards. He then noted that accessory docks, ~,c., have bee~ moved to another section. There was much discussion on which direction the finished side of a fence should face. F.2. - Has been changed to comply with Ordimnc~ 96-26. G. - Wording in the first semence was changed from "...at least four sides... ", to road ",..shall be screened on all four sides..". Section 20A-2.7.8: Regulation of Watercraft (This rifle has been changed.) No chax~e, No cha~e. Airport Height Limitations - It was noted by Mr. Massarelli that John VanAntwcrp suggested that some wording could be added to addr~s soundproof~ of homes built close to thc runway. There was discussion on this issue. It was determined that it was not the City's responsibil~ to ~ involved in this issue. Section 20A-2.7.14: Mobae Homes, Travel Trailers, Cmnpers, Boats, Trsilers, and Recre~ional Vehicles One change was noted in keeping with City Council's deterwinntion - not to exceed thirty- six (36) feet in length, and no more than two recreational vehicles on any lot outside an enclosed garage. Section 20A-2.7.15: Large Trucks and Heavy Equipment Change the term "one (1) ton" to "twenty-three (23) feet in length and/or .nine (9) feet in height". Section 20A-2.7.16: Land Excavation and Fill - Discussion. Section 20A-2.7.17: Commercial Mulching Machines - Discussion. Section 20A-2,7.18: Swimmln~ Pools - Discussion Section 20A-2.7.19: Construction of Driveways, Swales, and Other Improvements Affecting Drainage. ~. Massa~lli suggested modify~ 2.7.19, and have part cover residential, and part cover commercial, and the commer~ ~ rear bark to the Parlc~ Ordinance (Article XV). There was discussion about a ~ recluirem~ for property owners to maintain their swales. Section 20A-2.7.20: Manufactured Housing Section 20A-2.7.21: Community Residential Homes and Foster Care Facilities - No ~ange. Section 20A-2,7.22: Prevent Adverse Impact of Development on Historic or Archaeological Sites - several gtitches to be corr,--ted. There was also discussion on when a Home Occupational License holder may haw employees. It was noted that partners have ~ right to be in the residence. 'Thisissue was added to paragraph B.3. Stair notexi that "except as provided" would be added to paragraph three (3), and change the second and third paragraph to para~aph. A. & B, There was a consensus in favor of this cha~e. There was discussion about whether o~rin8 crai~ items from one's homo wa~ rumi~ a business, and the resident on Barber Str~ with the fishes was noted. This issue was discussed at length. B. 8. Staff recommended that deliveries to a residence with a Home Occupational License be clia~ed to "three (3) deliveries or pickups a day." Section 20A-2.7.25: Bars and Lounges A. Change "CG or RMU" to "CG or CR" district... A. 1, Add "residential use", Section 20A-2.7.26: Affordable Housing - Same Section 20A-2.7.27: Convenience Stores - Same Section 20A.2.7.28: Mini-Storage Facilities - New Section 20A-2.7.29: Model Homes B, 4'. Change to read - "No, construction mamas other than display samples.... B. 5. Change to - '~ne model homo may be open only between the hours of 9:00 am and 6:00 pm..."
