MINUTES OF MEETING OF APRiL 28, 1998
Chron. Munsart called the meeting to order at 3:06 pm.

ARTICLE I: PREAMBLE
Mr. Massar~lli noted that this Article, dated 4121198, is the
fmal version.
A,.R. TICLE II: ADMII~]iSTRATION AND ENFORCEMENT
Mr. Massarelli noted that this Article sots up the Community Development Depamnent, which
includes Planning, Code Enforceme~ and Building Departmeats. He also noted that it is being
discussed to do away with the Community Developmem Depamnem, and make a Buildin~ Dept.,
and a Planning and Code Enforcement Dept. He suggest~ that if they do that, everything will
have to be changed because "Community Develepmem Director" appears everywhere in the LDC.
Mr. Fischer noted that this Board could change it, but it seems to be up in the air at this time.
Mr. Massarelli ~ that this Board may be redoing the LDC again in the future.
Chnm. Munsart comm~t~ that if tbe City doesn't ~ tho final product offered by P & Z, th~ the
City should hire an attorney to re-write it.
Section 20A-1.2.4: Planning and Zoning Commlfsion
Mr. Massarelli noted that in this section, the individual requirements of Board Members is
superseded with a roference to the new ordinance, Chapter 2, Article Vi, Division 1 of the Code of
Ordinances, City of Sebastian. He rhea referred to page H-l:5, and noted that he did the same
refereacing for the Board of Adjumnmt.
He noted that "City Council Liaison" has been dropped, and changes were made to "Powers and
Duties", as indicat~ by this Board.
He also noted that the City Attorney has not yet reviewed item O. on page 11-14, but he :suggested
that when this Board is through with changes and reviews, the entire document should be sent to

Section 20A-1.2.10 Vacation of Public Easemants or Rights-of-Way
Mr. Massarelli noted that previously, there had been a review by the P & Z Commissi~ but that
has beea replaced by City Council review. He then questioned the very last ~ on page II,
26, and indicated that this statement needs to be checked out.

Mr. Massaroili noted that there are some typing zrrors to be cio*nod up, otherwise no changes.

Tsble 20A-2.4.2: Future Land Use Map De~ignatiom *nd Compatible Zoning Districts
A glitch with tho official zoning map was noted on page IV-I.
Added to the table on page IV-2 - "PUD(R) and PUD(C) under Riverfront Mixed Use,"
Mr. Massarelli then noted that he will have Article V ready for Thursday's meeting.

Section 20A-2.7.3: WATER FACILITIES
Mr. Massarelli noted that this item reflects the procedure for Indian River County, wl~ich makes us

Page 14, B.4. - Board members noted the last smtenco in this item, and insisted that a change be
made to indicate that "...no recreational vehicle slmll be located in the front yard~ and
Commission members co~h~L~nted that it meant in the "secondary front yard for improved corner
lots".
There was discussion on Section 20A-2.?.24: Adult Entertainment Establ/shu2nts. Mr.
Massarelli pointed out that Adult Entertainment could go in either Commercial or Industrial, but
would not meet setbacks m Commercial.
Section 20A-2.7.30: Gasoline Sales

Section 20A-2.?.31: Day Care Facilities
Mr. Msssareili noted that this is an addition. He notecl that he did not include some items that
were related to site plans, but he attempted to give this Board some flexibility.
Section 20A-2.?.29: Model Homes
Ms. Kilkclly noted that one issue that was omittod is as follows:
Add to B. 4. - No construction materials or construction equipment other titan, display
staples ....
Item 5. -.Take out "business activities" and add ~model homes may be open~.
There was discussion ofitem B.l.a.. and (7), and b. - The differmt distances wore questiom~ and
after explanation, it was accepted. (Section 20A-2.7.24 Adult ~ Establishments)
After some discussion, it was suggested and agreed to delete item # B,(7).
Section 20A-2.7.32: Guest Houses
Section 20A-2.7.33: Veterinary Medical Services
Ms. Kilkelly asked if Veterinary Medical Services were allowed in the Riverfront, and Mr.
Massarolli r~sponded that it is a permitt~ use in the CR zoning designation.

ARTICLE VIII: NONCONFORMITIES AND NON COMPLIANCES (dated 4/27/98)
There were just typos and minor chants to this Article.
~TICLE IX: CONCURRENCY MANAGEMENT
(Dated 4/28/98)
Mr. Massarelli noted that after discussing the reconnnendatious of this Board with Les Solin, some
of the recommen~fiom are included and some arc not.
Section 20A-3.9.3: Defmition of ConCurrency Management Terms
Mr. Massarelli noted that "Concurrency Certificate" is added. Ho also noted a cha~ under
Concurrency Status Report - remove "from timo to timo" and add "modified .smd, adjusted
twice a year...".
Developer's Agreement - Change the ref~ to Florida Statutes to "Article iiI~.
He then suggested that Article IX should be put aside temporarily.
At this point, Mr. Pliska rextuestod going back to Article VII, Section 20A-2.7.19 - Construction
of Driveways, Swales, and other Improvements Affecting Drainage. He requested that thc
following be inserted in this Section:
"Swales in tho front lot shall be shaped to prevent the Wamding of watex, therein, where
any drain pipe is hying on th~ driveways of sinxilar installafio~ thc final grade of fib with
sod overlay shall be at least two inches (2") below the invert of the ends of tl~.pipeso the
sod docs not obstruct the flow of water from th~ pipe. C. It shall be the
responsibility of any owner of the lot to maintain such swales, ditch~ and pipe to
maintain the proper flow of surface water."
He requested that a paragraph stating that "...it shall be the continuing respomibility..." and the
rest of thc verbiage from the old LDC under Section 20A-5.17 on page 340, the last sentence on
item B, and all of item C.
Mr. Massareili noted that this is covered on page VII-16, D.3. There was consc~us to insert the
word "continuous" before the word "responsibility". Thoro was much discussion about tho level
of the swale as it relates to the culvert, and how planting grass seed versus sod ~ this heisht.
At this point, Mr. Massarelli drew an example on this issue, and explained the roqulremmts of St.
]ohn's River Wa~r ~ District.
It was then suggested to insert wording that would makz it clear that when the sod is ~ "it
shah be below the invert of the culvert". This phrase was added to Article VII, Section 20A-
2.7.16: Land Excavation or Fill, item D. 2.

Page X-2, D. Mr. Massarelli noted that these requirements are new, as requested 'by this
Board.
Ms. KilkeHy commented that she had a note about "lightin~qo standards" m E. Mr. Massarelli
responded that he feels sure that there are standards, and r~,ommended that Mr. Hass could work
on this in the future. He suggested working up a comprehensive c, ode for lighting by getti~
togotlgr with some lighting ~.
Page X-2, item C., delete the word "concrete" before "polos".
Mr. Massarelli not~ that on page X-3, Section 20A-3.10.6, Potable Water and W~ewater,
h~s he~ moved to Article VII.
He ~hea noted that he is re-writing Article Xi and will have it by Thursday of this week.
ARTICLE XII: SURFACE WATER MANAGEMENT AND

There was discussion on rep~ trees for cutting a specimen tree, and Sl~cifications for other
living plant material.
Mr. Massarelli recommended against using a twenty inch (20") center for shrubs or vinos, and
suggested using demity as a guid~. He also spoke on hedges.
Mr. Pliska suggested that the title for paragraph B. on page fifto~ (15), be sborten~ to "Tr~e
Protmloa Barricade~".
Page three (3) - Nursing lxanes and assisted care faciliti~ - Change "One space for ea~ five (5)
beds" to ~Oae goace for each three (8) beds".
Sec. 20A-15.5 Pag~ five (5) - Add - "Carports and eovered parking shall not b~ leered within
the required setbacks."

Sec. 20A-3.1-~.6 Page eight (8), A.6. Add - "Driveways shall be constructed to meet the

Sec. 20A-3.15.9 Page twelve (12) 2.0. - Add - rock number "57" on the third line of that
paragraph.
Mr. Pliska asked again whe~r the City Engineer has given any attention to turning radiuses for
driveways on main streets. Mr. Massarelli responded that he has discussed this issue with the-City

Mr. Massarelli indicated that he had made changes to replace "free-standing" signs with
"monument signs" throughout this Article,
Sec. 20A-3.16.4 18. Page four. O), item 18 - Add "Off-site garage sale sign".

Mr. Massareili noted that the rest of the chanl~ in this Article were typographical.
Section 20A-3.17.4: Specific Standards for Nuisance Abatement
On page XVII-2, Mr. Massarelli. noted that item 2. was repeated. This will be corrected.
A. 1., 2., and 3. Change I)epartment of En~ Regulation to "Department of
Environmental Protection".
There was discussicm on whether the County had ~tandards for lighting. It was agreed that this

There was discussion on the sidowalk design at the new Winn Dixie.

There was discussion on whether to make bike paths ~xmcrete or asphalt. Mr. Ma~xretli
suggested that he will fix this Article XiX and bring it back tomorrow.

Both Articles, XX and XXI need to have thc page numbers corrected.
Mr. Massarelli rhea noted that the Articles that will need attention on Thursday are V, IX, XI,
XIX, XX and XXII.
