PRESENT: Ms. Kilkelly(a) Mr. Thomas Ms. Vesia EXCUSED ABSENCE: Chron. Munsart, Mr. MacWilliam(a), Mr. Fischer and VC Schulke ALSO PRESENT: Robert Massarelli, Community Development Director ANNOUNCEMENTS; Chrnn. Vesia announced that all other members have excused absences. NEW BUSINESS: A. LAND DEVELOPMENT CODE REVISIONS - Review of final draft of Land Development Code ~ - Mr. Massarelli noted that all the changes have been made that wore discussed at the previous meeting. Article V - Mr. Massarelli called attention to page V-15, and noted that Tracy needs to see Les Solin about the symbols used with the figure "20,000" under item C, and commzm~ that these symbols did not convert properly from the diskette. He indicated that it should probably be a "less than/~reater than" symbol. He also suggested that staff will need to go through, and correct the over-types. He also noted that the tables that belong on pa~s 31 through 34 are still with Mr. Solin, to be placed in the final draft. Section 20A-2.5.12: PUD(C) COMMERCIAL PLANNED UNIT DEVELOPMENT Page V-38 E. 1.a. - Penuitted Uses -Eli~in~ed Industrial uses. He then noted that :the biggest changes are on pages 16 and 17, with thc addition of "Commercial Riverfront (CR), and Waterfront Commercial Residential District (CWR). The paragraph lettering on the lower half of page V-45 needs to be re-lettered, and this, along with LOCAL PLANNING AGENCY, PLANNING AND ZONING COMMISSION MINUTES OF MEETING OF APRIL 30, 1998 ~ - No change. ARTICLE VII - Mr. Massarelli noted that changes have been made, mchding ~ VII-14, VII- 16, D.2. & 3., VII-27, VII-28, and VII-30. On page VIi-30, Model Homes;ho not~ that he deleted lansuage that said "applicable zon/n8 districts", because if a change is.made'in Article V, and forget to make thc change in Article VII, there will be an inconsistency, and ~le V prevails, so it is no~ needed in Article VII. ' ' to spend a day going throush this issue with Les Solin, and'if changes need to be ciom~, do it then. He noted that this issue is so new to.the City, that the Board should tak~ its time. Mr. Massarelli recommaxt~ that Tracy I/ass do research on exterior lighting, using electrical ~ - (undat~ but printed 4/30/98) Page Xi-1 - C. Remove "field investigation" from line ten (10), E. This item used to be three (3) paragraphs, but l~s been reduced. Page XI-3 - B. 1. - Change first word to "Pre~rv~i~n". Page XI-4 - A. - Take out "lakes and waterways" and added "Collier Creek". B. - Third paragraph - remove '~oulkbeads" and ~ the term "rii~rap", and insert the word "devices" after "... or offer similar..." o~ the firs~ line. Third line, .add "in such case, coquina tip-rap shall be the first alternative.~ Last sentence, strike the word "generally". B.2. - Remove the words %vhenever feasible" at.the emd of the phrase. C. - Fourth line from bottom, first paragraph - Remove the word "City", and yield to Federal and State agencies in re~m'once to Compemato~ Mitigation. beginning of the next s~enc~, line 2. (Coastal building zone does not apply to Sebastian.) LOCAL PLANNING AGENCY, PLANNING AND ZONING COMMISSION MINUTES OF MEETING OF APRIL 4, 1998 Mr. Massarclli noted that no changes were made to the "Marinas and Dock Facilities" section. (There are some type-overs throughout the document that will have to be correxted.) Page XI-$ - H. - Add "Class II waters are defined by DEP..." in the first line. K. - Second line - change "...the lands east" of Indian River Drive... to ',adjaeent..." He noted that wherever the term "Sooth Florida Water Management District" appears, it is changed to "St. Johns River Water Managemem District". There was discussion of #H. on page XI-8, and the Coastal High Hazard Area, and Mr. Massarelli noted that this only applies to mobile home parks in Sebastian, but if Treasure Coast changes their definition, this will automatically chango with their defimfioo, and if"mobile homes" is inserted, it would have to be changed, so b~tter to leave 'M,,obile homes" out. Page X~-10- L. 2. - Eleventh line down - insert "DEP~ af~ "SIRWMD", and on the tenth line, remove '~eld investigation". L. 2. D. Remove terms that refer to linear values, such as '~mininaum of ten (10) square feet per linear foot... ". Line 3, insert "mainly..." before the word "native". Page XI-12 - Section. 20A-3.11.6: lnsm "Development within the floodplain (the A, AE, and VE zone on the FiRM maps) shall meet the floodplain manngment requlreme~s in Article XII, Surface Water 1Vum~mm and Flood Protection". Mr. Massarelli noted that this is a reference only. Section 20A-3.11.7: Remove thc words "transitional wetlands". Section .20A-3.11.8: Paragraph 3. - Change native vegetation from "30% to "50%", which is for commercial sites. Setfion 20A-3.11.9: Lines 4 & 5 - Change "I~li,a Rivor County Building l)opammmt" to Ulndian River County Health Department". ARTICLE Xii: Surface.__Water Manam~nent and Flood Protection reviewed by the City Engineer. Fini,hod, but not ARTICLE Xlll: Only a minor word usage change, dropping the word "erection", as requested by Mr. Pliska, on pages 13 and 15. ARTICLE XV: Section 20A-15.5 Design and specifications for parking areas. Page. XV-5 - A. 1. - Add "Carports and covered parking shall not be located, within the required setbacks''. ARTICLE XVII: NUISANCE ABATEMENT Change several references to "Department of Environmental Regulation" to "Department of Environmental Protection". Page XVII -4 - D.3. - Correct third line below the chart to read "7:00 a.m. and 5:00 p.m.". Page XVII -2 - Section 20A-3.17.4: Renumber sub -paragraphs properly. ARTICLE XVIII: ADMINISTRATION OF SITE PLAN REVIEW AND SUBDIVISIONS Page XVIII -7 - D.b. - Corrected printing error on the word "compatibility". ARTICLE XIX: SUBDIVISION Mr. Massarelli noted that he has run out of time on Article XIX, he has talked to Tracy Hass about it, and he will take the disk with him, make changes, send it back to Tracy for him to bring it to this Board. ARTICLE XX: PLANNED UNIT DEVELOPMENT (PUD) Mr. Massarelli indicated that this Article is finished, except for printing glitches. Page XX -3 - F.5. - Remove sentence on third line - "There shall be no minimum setbacks aside from perimeter boundary setbacks." Page XX -4 - H. - Has been deleted except for a reference to Article III in the LDC. J.1. - Second sentence - Change to read "The Community Development Director, the City Engineer, and the Planning and Zoning Commission..." Page XX -5 - 4. - Change "Lighting and Signage" to "Lighting and Traffic Markers", to be consistent with the Subdivision section. 8. - Second line - add "... or within forty (40) feet of any... ". Section 20A-4.20.2: Add the word "ZONING" to the title, after the word "PUD". Page XX -6 - A.2. - Line 1, add "PUD zoning and conceptual plan approval...". Page XX -7 - 4.a. - Change "final" development plan to "conceptual" development plan. Page XX-9 - (4) - Add -"The City Council shall hold a public hearing with due notice and approve,...' (2) - Line 3, add "... rezoning..." before the word request. Page XX-10 -(9) - At the end of this paragraph, add the sentence "The devdoper shall apply for the extension at least ninety (90) days before, the.conceptual becomes void." B.1. - Second line - add "...at least one (1) inch = two hundred (2t)0) feet..." 3. - Fourth line - add "A, Al!:, and Vii: Zones..,", and strike "Coastal Construction Control line...", and change "five hundred (500) feet" to '~hree hundred (300) feet", on line 6 & 7. Page XX-11 - 4.e. - Add "...plan designed by a registered professional ea~a~,r in the State of Florida." 5.b. - Add the word "...binding..." development schedule. Section 20A-4.20.3: In the title, add the word "PRELIMINARY" after (PUD), and also in the title of paragraph A. Page XX-12 - 4.b.(3) & (4) - Add - (3) "Compliance with the Comprehensive Plan, The Prdiminary Development Plan shall comply with the City of Sebastian's Comprehensive Plan~, and (4) "Compliance with the Conceptual Development Plan. The Preliminary Development Plan shall comply with the approved Conceptual Development ~" Page XX-12 & 13 - c.i. Delete the reference to Article XIlI. Page XX-13 - iv. First line, .alter tho words 'The City Council shall"- add "hold a public hearing with due notice, and shall..." approve, approve with... viii. Add on line 7 - "The request for such as extension shall be ma~ie no later than ninety (90) days before the preliminary development plan becomes void." vii. Strike "rezoning application and" on line 5. Page XX-14 - ix - On line 6, add "site plan" before the word '~nodifications". B. 1.a. - "Supply and maintain construction bond" has been moved to page 20. Page XX- 15 - 2. Insert "Preliminary" before the word "Development..." in the title. 2. a. - Removed the toan "and site plan". Page XX-18 - g,(1) Changed "...500'..." to "three hundred (300) feet..." on first line, f. Remove the reference to Article XIV, g. (Second"g") Reaumbor. Added new - Section 20A-4.20.4: Subdivision Construction Approval - "Upon approval of the preliminary development plan for a subdivision, the developer may apply to the City Engineer for approval of the construction drawings of the proposed' subdivision. The procedures shall be the sine as outlined in Artide ~ "Subdivisions". Mr. Massarelli then noted that the savings clause in old Section 7 has been deleted. ARTICLE XXh RIVERFRONT PERFORMANCE OVERLAY DISTRICT ARTICLE XXII: GLOSSARY Mr. Ma~sarelli noted that he haz.just nm out of limo and he will work on it, s~d it to Tracy, and h~ can bring it to this Board. Ho also noted that the Glossary is about ninety,five pot cent (95%) He also. noted that Tracy will do the Tablo ot' Conteats, double-check the pages and soOions, and make sure that everything is in properly, and also 8~t from Les Solin the conversion'ch an and double-check it. He commented that this chart should make it easier to go through thc transition from the old code to thc new code. Several members gave Mr. ~ comp~ comments and wished him well in his new job.
