HomeMy WebLinkAbout05021996 PZCITY OF SEBASTIAN PLANNING AND ZONING COMMISSION REGULAR MEETING MAY 2, 1996 Chairman Fischer called the meeting to order at 7:00 p.m. ALSO PRESENT: PRESENT: Mr. Munsart Ms. Kilkelly Mr. Mather Ms. Brantmeyer Mr. Johns Chmn. ,Fischer Mr. Schulke EXCUSED: Mr. Pliska Mr. Robert Massarelli, City Planner Jan King, Zoning Technician Dorri Bosworth, Secretary ANNOUNCEMENTS: Ms. Kilkelly was voting in place of Mr. Pliska who was absent and excused from the meeting. APPROVAL OF MINUTES: Ms. Kilkelly had not finished reviewing the minutes. Approval would be postponed till later in the meeting. OLD BUSINESS: None ~ BUSIM~SS: PUBLIC HEARING - HOM~ OCCUPATIONAL LICENSE - 102 CARDINAL DRIVE - MAURA DIX - LICENSED ~EAL ESTATE BHOKER MS. Maura Dix was present and stated she lived at 102 Cardinal Drive. She was sworn in according to quasi-judicial procedures. Ms. Kilkelly disclosed she viewed the residence. ~.~ There were 25 notices of the hearing sent out. non-ob j-cfi on letters were received back. PLANNING AND ZONING COMMISSION REGULAR MEETING OF MAY 2. 1996 Staff stated the application was for a property auction business. The applicant indicated to staff she had no employees and was asking for an "address of convenience" for mail and phone use only. Ms. Dix stated she specialized in property auction and all business was done.on the site of the property. No clients would be coming to her home. Only her phone number would be listed on any advertisements. The public hearing was opened at 7:03 p.m. input. The hearing was closed. There was no public Mr. Johns made a motion to grant a home occupational license to Maura Dix for a licensed real estate broker at 102 Cardinal Drive. Mr. Mather seconded the motion. Roll call was taken. 7-0 motion carried. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 124 CAPRI AVENUE - HUBERT BROWN - RESIDENTIAL/COMMERCIAL CLEANING SERVICE Mr. Brown was present and stated he lived at 124 Capri Avenue. was sworn in according to quasi-judicial procedures. He There were 16 notices of the hearing sent out. non-objection letters were received back. No objection or Staff updated the memorandum in the packet stating Mr. Brown had no employees and his equipment would be kept in his vehicle. The equipment consisted of basic house cleaning materials. Mr. Brown stated he intended to use the phone only and business cards for advertisement. The public hearing was opened at 7:08 p..m. input. The public hearing was closed. There wa~ no public Mr. Johns questioned what the specific equipment was. Mr. Brown stated window squeegee, window cleaner, vacuum cleaner, rags., etc. Mr. Munsart made a motion to grant a home occupational license to Hubert Brown of 124 Capri Avenue to run a cleaning service. Ms. Brantmeyer seconded the motion. Roll call was taken. 7-0 motion carried. PUBLiC HEARING - HOME OCCUPATIONALLICENSE - 1485 SEAHOUSE STREET - JANET FRANK - PEST CONTROL Janet Karen Frank was present and stated she lived at 1485 Seahouse Street. There was one Staff stated the applicant indicated her home would be used only for the telephone, mail and record keeping. She did-have one employee who would not be coming to her home. The business vehicle was kept at the employee's residence. Ms. Frank stated her office was now in Veto Beach and the move was for convenience and cost. Chemicals were purchased only as needed, per job, which was usually a pint of powder and 2 gallons of mixture. The public hearing was opened at 7:13 p.m. Mr. Angelo Cetola, 1456 Seahouse Street, stated his concerns were with the business vehicle being parked in the neighbor's driveway (which was currently happening), chemicals being store~, and any leakage saturating the drinking water. Mr. Gerben Meindertsma, 1498 Bevan Drive, stated he was against the business because there were no proper storage facilitie~ for vehicle maintenance, disposal of chemicals, mixing the chemicals, and felt it should not be in a residential district. Ms. Frank addressed the concerns stating the vehicle would no longer be parked on her property, chemicals were mixed at.the job site, the chemicals used were Durisban (1 ounce) and'water (2 gallons), and no maintenance would be done on the vehicles. The public hearing was closed at 7:24 p.m. Mr. Johns questioned if employees were allowed with a home occupational license? Staff stated yes, if the license was for an address of convenience. Mr. Johns asked about the size of the truck. Ms. Frank stated it had one 50-gallon tank, hose, and one small equipment box. Mr. Munsart stated he was not against the license as long as there would be no outward appearance of a business being run out of the applicant's home. Ms. Brantmeyer made a motion to approve the home occupational license for Janet Frank doing business as Buggsout Pest Control at 1485 Seahouse Street. Mr. Johns seconded the motion. Roll call was taken. 7-0 motion carried. PI~NNING .HAND ZONING COMMISSION REGU~A~ MEETING OF ~A¥ 2. 1996 C.I.TY PLANNER MJtTTERS/ 1) Mr. Massarelli presented a proposed meeting schedule for the Planning and Zoning Commission and the Local Planning Agency for the review of the Comprehensive Plan Appraisal and Evaluation RepOrt. After a discussion, the Commission agreed on the proposed dates and set times for the meetings where Mr. Les Solin would be also be in attendance: May 30, 1996 June 20, 1996 July 11, 1996 2:00 p.m. 5:00 p.m. 2:00 p.m. 2) Mr. Massarelli also discussed an Ordinance Review List of proposed changes to the Land Development Code that members had suggested during past meetings. Mr. Munsart requested that vehicle parking discrepancies for home occupational licenses be added to the review list. #¢, Ordinance Review List, Screening for A=cessor~ Structures The code allows for accessory structures to abut the 10' utility easement in the rear. Mr. Massarelli stated the Board would have to review the policies of the utility companies to see what use the easement could have. Ms. Kilkelly stated required screening should be 2' - 5' shrubs as trees might interfere with utility wires. Ail sides of the accessory structures abutting adjacent properties should be required to have screening. She felt most accessory structures over 200 sq. feet were actually garages, which were co~idered principal structures, and should be required to also comply with the 20 foot rear yard setback. She would like to see the storing of trash bins and other items behind accessory structures be prohibited. Requirements of Section 20A-13.9.B of the Land Development Code could be adopted for the screening of the accessory structures. Also, the code should require that bushes that die should be replaced. Mr. Johns felt that if screening wasn't required, except for trees, for principal structures and garages, it shouldn't be required for an accessory structure, or the requirements made more stringent.. Mr. Schulke and Mr. Munsart agreed. Mr. Mather noted proper screening would be seen differently by each homeowner. pLAN~ING AND ZONING COMMISSION REGULAR MEETING OF MAY 2. 1996 Mr. Schulke stated he agreed with Ms. Kilkelly's suggestion that accessory structures over 200 sq. feet should meet a 20' rear setback requirement. Ms. King explained the codes for rear yards did currently require any accessory structure over 400 sq. feet to meet a 20' setback. Mr. Munsart agreed with changing the requirement and suggested making it 250 sq. feet or larger. Mr. A1 Goelz reviewed a field study he did on accessory.structures currently existing in the Highlands. Mr. Massarelli stated it would be hard to prohibit homeowners from storing items behind their sheds. Junk means different things to homeowners. Only items that were clearly objectionable to public health, safety, and welfare could be enforceably removed. The Board was in consensus to have the code changed to require any accessory structure over 200 sq. feet (since the BOard had to review this size per code) to meet a 20' rear setback and have the 10' side setback remain. 3) Mr. Massarelli stated a project he was ensuing was to re-write the Land Development Code due to inconsistencies and updates that needed to be corrected. Any code changes could be done during the re-write. Other items on the Ordinance Review List were briefly discussed: termination of site plans, mother-in-law apartments, living in accessory structures, contractors abusing private proper~y during construction, and vehicular signs. Mr. Munsart stated that a previously discussed code change, plantings and structures in the right-of-way, had not been finalized. Mr. Massarelli stated he would contact the P~b~ic Works director for input. ~PPROVAL OF MINUTES ~ONTIB~JB~ Mr. Johns made a motion to approve the minutes {of April 18, 199.6}. Ms,. Brantmeyer seconded the motion. A voice vote was taken. 6-1 motion carried, with Ms. Kilkelly voting nay.
