ANNOUNCEMENTS:
Chmn. Thompson 'welcomed Mr. Johns to the Planning and Zoning
Commission and wished him well.
Mr. Fischer made a motion to move Old Business on the agenda to
right after the New Business. Mr. Johns seconded the motion. A
voice vote was taken, motion approved.
Mr. Barnes asked to be excused for the May 18, 1995, regular
meeting.

Chmn. Thompson noted a correction that needed to be made on page
eight of the April 6, 1995 minutes, as presented.
Mr. Fischer made a motion to approve the minutes of April 6, 1995,
as amended. Mr. Munsart seconded the motion.

PUBLIC HEARING - MODEL HOME PERMIT - OCEAN HOMES CORPORATION - 1711
BARBER STREET
Michael Oliver, the applicant and president of Ocean Homes Corp.,
is present, and is sworn in according to quasi-judicial procedures.
The public hearing is opened at 7:09 p.m.

Mr. Cooper noted to the applicant that his proposed parking
arrangements (5 spaces required) should be to have two in the
driveway and three by the street, thereby keeping the required 10-
foot side yard setback. The applicant agreed.

PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 473 ALAMANDA AVENUE -
G&B LAWN SERVICE AND MAINTENANCE
The applicant, wiliawun Smallwood, is present, and is sworn in.
The public hearing is opened at 7:15 p.m.
There were 24 notices sent out. One objection letter was received
back.
Mr. Cooper questioned the applicant on the size (weight) of her
truck. The applicant stated 1/2 to 3/4 ton.
Ms. Smallwood stated her husband was a full-time employee for MGB
Construction, Inc. and cut lawns with her in the evening as part-
time work.

Mr. Fischer asked if there were any other employees? Ms. Smallwood
stated no. Mr. Barnes asked where they would be dumping the
clippings? Ms. Smallwood stated at the landfill dumping site.
Mr. Barnes made a motion to approve the Home Occupational License
for G&B Lawn Service and Maintenance at 473 Alamanda Avenue. Mr.
Fischer seconded the motion.
Roll Call was taken. 7-0 license was approved.
PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 922 CANAL CIRCLE -
CATHY NELSON LAWN CARE
Mr. Roger Nelson represented the applicant and stated his address
was 922 Canal Circle also, and was sworn in.
The public hearing was opened at 7:23 p.m.
There were 17 notices sent out. One objection letter was received
back.
Mr. Cooper clarified with Mr. Nelson that the utility trailer will
be kept in the garage when it is located at the residence. Mr.
Nelson stated yes. Mr. Cooper asked if there any other employees?
Mr. Nelson stated his wife and his 9 year old son.
Staff has no objections.
There was no public input.
The public hearing was closed at 7:25 p.m.
Mr. Fischer made a motion to approve the HomeOccupational License
for Cathy Nelson Lawn Care at 922 Canal Circle, Sebastian, Lot 24,
Block 417, Unit 9. Mr. Barnes seconded the motion.
Roll call was taken. 7-0 license was approved.

Mr. Goldstein made a motion to defer the application for Offshore
Connection to the May 18, 1995, meeting. Mr. Barnes seconded the
motion.
A voice vote was taken, application was tabled to next meeting.
PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 537 WIMBROW DRIVE -
ROBERT DEE X~i~I CARE
The applicant, Mr. Robert Dee, was present and sworn in.
The public hearing was opened at 7:29 p.m.
There were 14 notices sent out. One objection letter was received
back.
Mr. Cooper questioned Mr. Dee on his utility trailer. Mr. Dee
stated it was a 4X6 trailer and would be kept in the garage when at
home. He also stated his sister had a mulching unit and that's
where all clippings would be disposed of. The lawn service is only
for part time employment.
Staff has no objections.
The was no public input.
The public hearing was closed at 7:31 p.m.
Mr. Barnes made a motion to approve the Home Occupational License
for Robert Dee at 537 Wimbrow Drive for a lawn maintenance
business. Mr. Munsart seconded the motion.
Roll call was taken. 7-0 application was approved.
PUBLIC HEARING - AMENDMENT TO THE COMPREHENSIVE PLAN - NON-
CONFORMING MOBILE HOME PARKS
Mr. Cooper reviewed that this matter has been before the Planning
and Zoning Commission previously regarding whether or not a mobile
home can be replaced. It was to go before City Council based on
the Commission's last recommendation. The City Attorney wanted to
be cautious and ensure all proper due notice to any affected owners
and decided to bring it back as a public hearing to be safe. Mr.
Cooper states the recommendation still stands, the basic concept
being that the Land Development Code is in conflict with the
Comprehensive Plan, of which the Comp Plan is allowing replacement
of mobile homes in non-conforming mobile home parks.
The public hearing was opened at 7:33 p.m.

Mr. Barnes asked if the hearing was posted and letters were sent to
the property owners? Staff stated yes.
Mr. Fischer made a motion, to recommend to City Council that Policy
1-2.1.6 of the Comprehensive Plan, Goals and Objectives, first
paragraph,' last sentence be deleted which states "ReplaCement of
existing mobiles homes in existing mobile home plats and sites of
record, as of the effective date of this ordinance, shall be
permitted and shall not be deemed inconsistent with the
Comprehensive Plan." Mr. Barnes seconded the motion.
Roll call was taken. 7-0 motion passed.
OLD BUSINESS~ Discussion - Barbed Wire Fences - Possible Amendment
to Section 20A-5.9.F.2
Mr. Cooper stated that he received information regarding
manufacturer's specifications for standard fencing with barbed wire
attachments. He also stated that some recent situations involving
fence height suggested the Board should look more closely at the
language in the fencing ordinances and allow for a little variation
in that requirement.
Mr. Barnes questionedthe current requirement that the barbed wire
be angled inward. Mr. Cooper recommended that language be removed
and suggested that any barbed wire fence that is on an angle shall
not project over the property line or proper setback.
The Board had a discussion on the changes they would like to see in
the amendment language.
Staff stated they would work on the changes and bring back to the
Commission a proposed amendment at a future meeting.

Mr. Barnes would like to see a schedule set up for the upcoming
comprehensive Plan review.
Mr. Shroyer stated his 1st full term is expiring in June and he
will be re-applying for the position.

REGULAR MEETING OF MAY 4, 1995,
Mr. Munsart would like to see the Board come up with some written
definitions for "temporary" when used in permit situations. Mr.
Cooper stated that City Council is also beginning to look into this
and also re-evaluating the permit fee schedules.
Chmn. Thompson would like staff to look into the problem of
tractor-trailer parking at the vacant Keen Foodtown building on
u.s. #1.

Mr. Cooper would like to set some dates to begin the Comprehensive
Plan review. The Board would like to put it on the May 18th's
agenda. Staff will provide copies of calendars to the Board at the
next meeting.
