KRULIKOWSKI MR. WADSWORTH MRS. YOUNG CHAIRMAN EISENBARTH ABSENT: MRS. POOLE (UNEXCUSED) MOTION BY MRS. YOUNG, SECONDED BY MR. FULLERTON, TO APPROVE THE MINUTES OF THE REGULAR PLANNING AND ZONING MEETING, MAY 2, 1985. MOTION CARRIED. MOTION BY. MRS. YOUNG, SECONDED BY MR. KRULIKOWSKI, TO APPROVE THE MINUTES OF THE PUBLIC HEARING OF PLANNING AND ZONING,~ 'MAY 9, 1985. MOTION CARRIED. OLD BUSINESS: INDIAN RIVER INDUSTRIAL PARK - MASTELLER: THERE WAS A DISCUSSION REGARDING A LETTER FROM RANDY MOSBY, WHICH CHAIRMAN EISENBARTH CONCLUDES WAS ONLY ONE OF THE THREE CONTINGENCIES REQUIRED TO BE MET. CHAIRMAN EISEN- BARTH REQUESTED THAT ATTORNEY PALMER REVIEW THE INGRESS/EGRESS TO THE INDUSTRIAL PARK. CHAIRMAN EISENBARTH STATED THAT A LETTER WAS SENT TO ATTORNEY PALMER FROM RENE VAN de VOORDE ON OCTOBER 17, 1984, REGARDING THE.~INGRESS/EGRESS.?OF~THEZ'INDUS.TRIAL-PARK. THE~E WEBE ? A~SO. REQUEST FROM SECRETARY RE: FILE CABINET: MRS i KRAGES STATED BECAUSE OF THE AMOUNT OF PAPER WORK GENERATED BY THE PLANNING AND ZONING COMMISSION, AND THE LACK OF CABINET SPACE IN THE CITY CLERK'S OFFICE, A PORTABLE LOCKING FILING CABINET IS NECESSARY FOR THE SECRETARY TO THE PLANNING AND ZONING COMMiSSiON. CHAIRMAN'S MATTERS: CHAIRMAN EISENBARTH HAD NOTHING TO REPORT UNDER CHAIRMAN'S MATTERS. MEMBER'S MATTERS: MR. MAHONEY INQUIRED IF ANYONE HAD REVIEWED THE LETTER FROM MAYOR GALLAGHER, REGARDING THE DAN PRUESS PARKING LOT. MR. MAHONEY STATED HE WAS VERY HAPPY TO SEE THE LETTER IN THE PACKETS. CHAIRMAN EISENBARTH STATED, THAT THE WAY HE UNDERSTOOD IT, WAS THAT MR. PRUESS WILL BE ON THE JUNE 6, 1985, AGENDA OF THE PLANNING AND ZONING COMMISSION. MR. FULLERTON STATED THAT WHEN THE PLANNING AND ZONING COMMISSION HAS A ZONING CHANGE, HE WOULD LIKE TO SEE IT ADVERTISED IN THE PARER.ACCOMPANIED WITH A MAP. MRS. KRAGES STATED THAT IT WOULD BE VERY COSTLY TO THE COMMISSION TO HAVE THAT DONE EACH TIME. MR. FULLERTON STATED THAT PERHAPS A STREET ADDRESS COULD BE INCLUDED WITH THE LEGAL DESCRIPTION, TO LET THE PUBLIC BETTER UNDERSTAND WHERE THE PROPERTY IN QUESTION IS LOCATED. MRS. KRAGES STATED SHE WOULD COOK INTO THE MATTER, AND SEE IF IS POSSIBLE TO DO MR. KRULIKOWSKI STATED THAT HE WOULD LIKE TO GET THE TV ANTENNA REQUIREMENTS BE BROUGHT BACK UP TO THE CITY COUNCIL. MR~ KRULIKOWSKI ALSO STATED THAT HE HAS TWO OTHER MATTERS HE WOULD LIKE TO DISCUSS. CHAIRMAN EISENBARTH SUGGESTED THAT THESE MATTERS COULD BE BROUGHT UP UNDER OLD BUSINESS ON JUNE 6, 1985, AGENDA. MR. KRULIKOWSKI REQUESTED THAT (1) THE TV ANTENNA REQUIREMENT; (2) CLEARING OF PARCELS OF LAND BEFORE SITE PLAN APPROVAL; (3) A REVIEW OF ALL STRUCTURES, iNCLUDING RESIDENTIAL, BY THE PLANNING AND ZONING COMMISSION; BE PUT ON THE AGENDA UNDER OLD BUSINESS FOR THE JUNE 6, 1985 MEETING. CHAIRMAN EISENBARTH REQUESTED THAT ATTORNEY PALMER GIVE THE COMMISSION SOME INSIGHT REGARDING WHERE THE RULES COME FROM THAT ALLOW THE CLEARING OF PARCELS OF LAND BEFORE SITE PLAN APPROVAL. MINUTES: PAGE 3 PLANNING AND ZONING COMMISSION MAY 16,1982 MR. FULLERTON STATED HE WOULD LIKE TO HAVE A LETTER SENT TO THE CITY COUNCIL REGARDING IMPACT FEES. MOTION BY MR. FULLERTON, SECONDED BY MR~ .MAHONEY, TO SEND A LETTER TO THE CITY COUNCIL, REQUESTING IMMEDIATE ACTION TO INVESTIGATE THE POSSIBILITY OF HAVING IMPACT FEES ON THE NEW BUILDINGS THAT ARE COMING INTO THE CITY. THE IMPACT FEE SHOULD BE IMPOSED ON ALL BUILDING, INCLUDING RESIDENTIAL. MOTION CARRIED. MRS. YOUNG STATED THAT SHE BELIEVES THAT THE TRAFFIC STUDY BEING CONDUCTED ON THE CHURCHMAN'S CONDO PROPOSED DEVELOPMENT SHOULD BE DONE IN THE WINTER MONTHS WHEN ALL THE SEASONAL TRAFFIC ISHERE AND THE SCHOOLS ARE OPENED. SHE STATED IT WOULD NOT BE A FAIR STUDY IF IT WAS DONE IN THE SUMMER MONTHS. MOTION BY MRS. YOUNG, SECONDED BY MR. THOMPSON, TO SEND A LETTER TO THE CITY COUNCIL REQUESTING THAT IN'~THEIR..DELIBERATIONS THE T~ME OF THE TRAFFIC STUDY..FOR..CHURCHMAN'S CONDO BE CONSIDERED. MOTION CARRIED. MR. MAHONEY QUESTIONED WHETHER OR NOT THE SPORTMAN'S LODGE IS IN THE CiTY LIMITS OR NOT. THEY ARE DOING SOME BUILDING, AND MR. MAHONEY INQUIRED IF THEY HAD PROPER BUILDING PERMITS IF THEY ARE IN THE CITY. MRS. KRAGES SAID SHE WOULD CHECK INTO IT AND REPORT BACK TO THE COMMISSION HER FINDINGS. NEW BUSINESS: PETITION TO REVIEW AND CONSIDER APPLICATION FOR RE-ZONING A PARCEL OF LAND/WHEATON: MR. WHEATON ADDRESSED THE COMMISSION, EXPLAINING WHERE PROPERTY IS LOCATED AND WHAT HIS CLIENTS WOULD LIKE TO HAVE REZONED. MR. WHEATON EXPLAINED THAT IT IS NOT DESIGNATED A SUB-DIVISION, AND THAT IT IS C-1 AT THE PRESENT TIME. MR. WHEATON EXPLAINED THAT HIS CLIENTS ARE PHYSICIANS AND THEIR INTENT IS TO BUILD A MEDICAL BUILDING (PAIN TREATMENT CENTER). MR. HUSHMAN, WHO IS ALSO INVOLVED WITH THE REQUEST, STATED THAT THERE IS ONLY ONE OTHER PAIN TREATMENT CENTER IN THE COUNTRY TO HIS KNOWLEDGE. MOTION BY MR. WADSWORTH, SECONDED BY MRS. THOMPSON, TO POSTPONE A DECISION ON THE APPLICATION FOR RE-ZONING A PARCEL OF LAND/WHEATON AND THE APPLICATION FOR LAND USE DESIGNATION FOR A PARCEL OF LAND/WHEATON, REQUEST UNTIL THE JUNE 6, 1985, PLANNING AND ZONING MEETING UNTIL IT iS REPORTED TO THE COMMISSION: (1) WHAT THE ZONING IS ON THIS PIECE OF PROPERTY; (2) WHERE IS THE CEMET<ERY PROPERTY IN RELATIONSHIP TO THIS ZONING REQUEST. IN ADDITION TO CO~[TACT ATTORNEY PALMER REQUESTING IF PLANNING AND ZONING COMPLY WITH CERTAIN FORMALITIES TO SUB-DIVIDE A LOT, AND DOES IT QUALIFY UNDER C-1 AS A MEDICAL CENTER. JOHN HOUCHIN, REAL ESTATE REPRESENTATIVE FOR CUMBERLAND FARMS, EXPRESSED HIS CLIENT'S INTENT FOR THE MEMTIONED PARCEL OF LAND. MOTION BY MRS. YOUNG, SECONDED BY MR. PETITION TO REQUEST VOLUNTARY ANNEXATION/SCHLITT: THERE WAS DISCUSSION HELD CONCERNING THIS MATTER. MOTION BY MRS. YOUNG, SECONDED BY MR. WADSWORTH, THAT THE PARCEL OF LAND BE ANNEXED INTO THE CITY, WHICH IS PORTION OF LOT 25. ROLL CALL VOTE: AYES: MR. THOMPSON MR. FULLERTON MR. MAHONEY MR. KRULIKOWSKi MR. WADSWORTH MRS. MINUTES: PAGE 5 PLANNING AND ZONING COMMISgN MAY 16, 1985 DISCUSSION WAS HELD REGARDING ATTORNEY PALMER"S AND RANDY MOSBY'S LETTER FOR DR. FISCHER'S REQUEST FOR SAND MINING PERMIT. THE COMMISSION INSTRUCTED MRS. KRAGES TO SEND DR. FISCHER A COPY OF BOTH LETTERS. DISCUSSION WAS HELD REGARDING ATTORNEY PALMER'S LETTER FOR A CHANGE OF USE FROM'MS. CARLA CARTER. MRS. KRAGES INFORMED THE COMMISSION THAT THE PROPER OCCUPATIONAL LICENSE HAS BEEN ISSUED TO HER. DISCUSSION WAS HELD REGARDING A LETTER FROM MRS. DEBORAH C. KRAGES TO THE PLANNING AND ZONING COMMISSION FOR THE TRIP TO BIBLE TOWN, IN BOCA RATON. THE COMMISSION DECIDED IF ANY MEMBER WANTED TO GO, IT WOULD BE AT THEIR OWN EXPENSE. DISCUSSION WAS HELD REGARDING A LETTER FROM MAYOR GALLAGHER TO PLANNING AND ZONING COMMISSION ON THE DAN PRUESS PARKING LOT. THIS MATTER WILL BE ON THE JUNE 6, 1985, AGENDA. MOTION BY MR. KURLIKOWSKI, SECONDED BY MRS. YOUNG, TO APPROVE PAYMENT OF A BILL FROM MOSBY, ROBBINS, AND ASSOCIATES FOR ONE HOUR OF ENGINEERING ON THE iNDIAN RIVER SUB- DIVISION FOR $43.75. MOTION CARRIED. THERE WAS CONSIDERABLE DISCUSSION REGARDING THE NEED OF AN ATTORNEY AT THE PLANNING AND ZONING COMMISSION MEETINGS AND THE NEED OF A WORKSHOP MEETING EACH MONTH. THE COMMISSION REQUESTED THAT MRS. KRAGES WRITE A LETTER TO ATTORNEY PALMER, REQUESTING HIM TO ATTEND THE FIRST THURSDAY OF THE MONTH'S MEETINGS. MOTION BY MR. FULLERTON, SECONDED BY MR. WADSWORTH TO ADJOURN THE MEETING.
