CHAIRMAN CALLED THE MEETING TO ORDER AT 7:00 P.M.
PRESENT: O'CONNOR, KRULIKOWSKI, FULLERTON, KILKELLY,
THOMPSON, MAHONEY,, SHROYER, ALTERNATE, WADSWORTH, LINDSEY,
ALTERNATE
ALSO PRESENT: BRUCE COOPER, PETER JONES, LINDA KINCHEN
ANNOUNCEMENTS; MR. THOMPSON MADE A MOTION TO PUT REAPPOINT
CHAIRMAN AND VICE CHAIRMAN UNDER NEW BUSINESS FIRST ITEM
SECOND BY MR. MAHONEY MRS, KILKELLY REQUESTS IT BE MOVED
DOWN TO MEMBERS MATTERS DUE TO THE SIZE OF THE AGENDA MR.
THOMPSON AGREES MOTION PASSES UNANIMOUSLY.
APPROVE MINUTES: MAY 3RD, 1990 MR. WADSWORTH MADE A MOTION TO
APPROVE THE MINUTES AS PRESENTED SECOND MR. THOMPSON PASSED
UNANIMOUSLY.

HOME OCCUPATIONAL LICENSE DISCUSSION AND ACTION
MR. FULLERTON MADE A MOTION TO MOVE THIS ITEM AND SUBDIVISION
ACCESS DISCUSSION TO LAST ITEM UNDER NEW BUSINESS SECOND MRS.
O'CONNOR PASSED UNANIMOUSLY.
PUBLIC HEARING - ZONING AND LAND USE CHANGE US HIGHWAY #1
THIS WAS MOVED TO THE NEXT ITEM IN WAIT FOR THE APPLICANTS
ATTORNEY.
MODEL HOME PERMIT - MASLOW CONSTRUCTION
MRS. KILKELLY MADE A MOTION TO APPROVE THE RENEWAL OF
THE MODEL HOME PERMIT FOR MASLOW CONSTRUCTION AND BUILDING
CONSULTANTS INC AT 909 FULTON WAY SECOND BY MR. WADSWORTH
UNDER DISCUSSION MR. THOMPSON SUGGESTS WHEEL STOPS BE MOVED
BACK AND MASLOW STATES DRAINFIELD IS IN THE WAY
MR. THOMPSONS AMENDS THE MOTION TO CHANGE THE PARKING TO
PARALLEL SECOND BY MR. FULLERTON

COMMENT
A MOTION TO APPROVE THE MODEL HOME PERMIT RENEWAL FOR
MERCEDES AT 873 BARBER STREET WAS MADE BY MR. WADSWORTH WITH
THE PARKING SPACES TO BE CHANGED TO PARALLEL SECOND MR.
THOMPSON PASSED UNANIMOUSLY.
PUBLIC HEARING ON US #1 ZONING AND LAND USE CHANGE
RENE VANDEVOORDE IS PRESENT TO ANSWER QUESTIONS - STAFF GIVES
THERE COMMENTS ON THIS MATTER - REFERENCE CHANGING THE ZONING
FOR THE WHOLE AREA AND NOT JUST THE ONE PIECE IF THEY ARE NOT
TAKING THE WATERFRONT DISTRICT IN MIND AT THIS TIME.
PUBLIC HEARING OPENED AT 7:50 P.M, CLOSED AT 7:50 P.M. NO
COMMENT
MR. WADSWORTH FEELS WE SHOULD WAIT FOR THE WATERFRONT
DISTRICT MR. THOMPSON AND MRS. KILKELLY CONCUR MR, MAHONEY
FEELS IT SHOULD BE CHANGED AS REQUESTED MRS. O'CONNOR iS NOT
IN FAVOR OF REZONING MR. SHROYER STATES HE IS IN FAVOR MR.
KRULIKOWSKI NOT IN FAVOR AND MR. LINDSEY MAKES NO COMMENTS AT
THIS TIME.
MRS. KILKELLY MADE A MOTION TO DENY THE LAND USE CHANGE AT
THIS TIME SECOND BY MR. WADSWORTH FOR DISCUSSION
MR. VANDEVOORDE ARGUES SOME MORE FOR HIS CLIENTS POINT OF
VIEW AND WHY THEY SHOULD NOT HAVE TO WAiT FOR A RIVERFRONT
DISTRICT WHICH COULD TAKE YEARS TO SET UP.

CHANGE WAS MADE BY MR. MAHONEY SECOND MR. FULLERTON ROLL CALL

MRS. KILKELLY - NO FEELS THERE IS NO INDIVIDUAL HARDSHIP, MR.
FULLERTON-YES, MR. THOMPSON-NO FEELS IT INTENSIFIES THE USE
MR. KRULIKOWSKI - NO - MOTION PASSES FOUR TO THREE
HOME OCCUPATIONAL LICENSE - SEBASTIAN ROOFING- DANE RUSSELL

MRS. O'CONNOR ASKS HOW A ROOFING BUSINESS CAN BE RUN WITHOUT
EMPLOYEES MR. RUSSELL STATES MATERIALS ARE DROPPED AT THE
SiTE ON THE ROOF AND HE INSTALLS THEM HIMSELF.
PUBLIC HEARING OPENED AT 8:30 P.M. MR. FRANK OSTROSKY SPEAKS
FOR MRS. BARON WHO SUPPLIED A LETTER TO THE COMMISSION
STATING THEY HAVE NO PROBLEM WITH THE LICENSE BUT IF HEAVY
TRUCK TRAFFIC DAMAGES THE ROAD MR. RUSSELL SHOULD HAVE TO FIX
IT. THE COMMISSION ADVISES MR. OSTROSKY THAT THEY CANNOT
ENFORCE SUCH A RULE AND IT WOULD BE A CIVIL MATTER BETWEEN
MR. RUSSELL AND MRS. BARON - PUBLIC HEARING CLOSED AT 8:31
MRS. KILKELLY MADE A MOTION TO APPROVE THE HOME OCCUPATIONAL
LICENSE FOR DANE RUSSELL AT 930 TALL OAKS FOR SEBASTIAN
ROOFING AND THAT ITEMS ONE AND TWO OF THE DEPARTMENT OF
COMMUNITY AFFAIRS DIRECTOR LETTER BE INCLUDED SECOND BY MR.
WADSWORTH ROLL CALL AS FOLLOWS

MEMBERS OF THE PUBLIC WANT TO SPEAK ON THIS MATTER.
A MOTION TO EXTEND THE MEETING TO lO:15 WAS MADE AT 9:45 P.M.
DUE TO THE PUBLIC INPUT WAS MADE BY MR. WADSWORTH SECOND MRS.
O'CONNOR PASSED UNANIMOUSLY.
JOE BERLIN REPRESENTS SCOTAD INC - SPEAKS REGARDING PET
GROOMING AND TROPICAL FISH
FEELS THAT TROPICAL FISH IS A HOBBY AND PET GROOMING SHOULD
FALL UNDER ITEM (B) ON PAGE 63 OF THE LDC
MR. COOPER STATES PLANNING AND ZONING HAS NO AUTHORITY TO
INTERPRET ZONING ORDINANCE AND HE SHOULD APPEAL TO THE BOARD
OF ADJUSTMENT, AT THIS POINT THE CHAIRMAN PUTS A HOLD ON THE
DISCUSSION SINCE IT DOES NOT PERTAIN TO THE ITEM UNDER
DISCUSSION.
CONNIE LAROCH SPEAKS STATING SHE IS INTERESTED IN A FAMILY
BILLARD CENTER ON 512 WOULD APPRECIATE THE COMMISSIONS
CONSIDERATION OF THIS USE UNDER THE NEW ZONING.
MRS. KILKELLY QUESTIONS THE CURB CUTS ON 512, BRUCE EXPLAINS
THAT THE CODE PROVIDES FOR TEMPORARY CUTS AND ALSO STATES
WHERE THE PERMANENT CUTS SHOULD BE.
A MOTION, TO RECOMMEND TO CITY COUNCIL THAT SECTION 20A3.8A BE
REVISED AS CONTAINED IN THE DEPARTMENT OF COMMUNITY
DEVELOPMENT MEMO DATED MAY 7, 1990 WITH THE CHANGE THAT
ENCLOSED COMMERCIAL AMUSEMENTS BE A PERMITTED USE AND DELETED
FROM THE CONDITIONAL USE SECTION AND THAT ALL TYPO'S BE
CHANGED TO C-512 AND PARAGRAPH H LINE ONE SECOND SENTENCE BE
REVISED TO SAY NO PRINCIPAL STRUCTURE. MADE BY MR. THOMPSON
SECOND MR. MAHONEY
