Thompson Mr. Goldstein Ms. Brantmeyer Mr. Barnes Mr. Fischer EXCUSED: Mr. Johns Mr. Schulke ALSO PRESENT: Mr. Bruce Cooper, Director of Community Development/Building Official (arriving late) Dorri Bosworth, Secretary AlOIIOUHCEMEIITS : Ms. Brantmeyer will be voting in place of Mr. Johns, who is not present at the meeting. On May 19, 1995, Chmn. Thompson signed approval for a shed permit for Skydive Sebastian at 400 W. Airport Road to be located north of the hangar that is under construction. The shed will not have a slab foundation. On May 31, 1995, Chmn. Thompson signed approval for a revised landscaping site plan for St. Sebastian Catholic Church which added additional landscaping to the original plan. PLANNING AND ZONING COMMISSION REGULAR MEETING OF JUNE 1. 1995 PAGE TWO OLD BUSIHESS: None NEW BUSIHESS: PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - CAREFREE LAWN SERVICE - 245 CARAVAN TERRACE The applicant, Mr. Harry Michael Villarose, was present, and was sworn in according to the quasi-judicial procedures. The public hearing was opened at 7:10 p.m. There were 12 notices of the hearing sent out. 1 objection letter was received back. . Chmn. Thompson read a memo from staff indicating the equipment will be stored on an utility trailer which will be stored in the garage. Mr. Villarose stated that was correct, and that he had no employees. Staff had no objections. Mr. Goldstein asked what the applicant did with the lawn clippings? Mr. Villarose stated he mulched his clippings. There was no public input. The public hearing was closed at 7:13 p.m. Mr. Barnes made a motion to approve the home occupational license for Carefree Lawn Service at 245 Caravan Terrace in Sebastian. Mr. Fischer seconded the motion. Roll call was taken. 7-0 motion approved. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE TENNIS - 164 COPLEY TERRACE JOHN DANISE SCHOOL OF The applicant, Mr. John Danise, Jr., was present and was sworn in. The public hearing was opened at 7:15 p.m. There were 15 notices sent out and no objection letters received back. Mr. Danise stated this application was mostly for an address of convenience. He works with his son, who lives at home with him. Mr. Barnes questioned if customers would be coming to his residence? Mr. Danise stated no, he goes to schools, clubs, and . fitness centers for his coaching. Staff's memo indicated they had no objections. . . . The public hearing was closed at 7:17 p.m. Mr. Barnes made a motion to approve the home occupational license for John Danise School of Tennis at 164 Copley Terrace in Sebastian. Mr. Munsart seconded the motion. Roll call was taken. 7-0 motion approved. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - JANICE'S CERAMIC GIFTS - 154 ENGLAR DRIVE The applicant, Janice VanValkenburg-McGurren, is present, and is sworn in. The public hearing was opened at 7:19 p.m. There were 20 notices sent out and one objection letter received back. Chmn. Thompson read staff's memorandum indicating Ms. McGurren would only be painting ceramics in her home to bring and sell at flea markets, and that no customers would be coming to her house. The applicant keeps only a small quantity of paint and supplies at her home, and does not have a kiln. Staff has no objection. There was no public input. The public hearing was closed at 7:21 p.m. Mr. Goldstein asked the applicant what the size of the typical piece she paints is? Ms. McGurren stated about 12 inches. She paints about 5-6 pieces a week, which she picks up herself. She has no employees. Mr. Goldstein made a motion to grant the home occupational license for Janice McGurren Ceramic Gifts at 154 Englar Drive, Sebastian, for painting ceramics. Ms. Brantmeyer seconded the motion. Roll call was taken. 7-0 motion approved. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - GARLAND SEPTIC, INC. - 449 PONOM STREET The applicant, Mr. Frank Garland, is present, and is sworn in. The public hearing was opened at 7:24 p.m. There were 10 notices sent out and no objection letters received back. . . . PLANNING AND ZONING COMMISSION REGULAR MEETING OF JUNE 1. 1995 PAGE FOUR Staff's memorandum indicated that the applicant has an office and storage area outside the city limits (Fellsmere) and wanted to use his residence for mail and phone only. Mr. Garland stated this was correct. Staff had no objections. Mr. Garland also stated he was already licensed with HRS, State certified, and licensed with the city and county. Mr. Fischer asked if any work vehicles came to the applicant's house? Mr. Garland stated only a company pick-up to go back and forth from work. No materials were ever picked up. There was no public input. The public hearing was closed at 7:27 p.m. Mr. Munsart made a motion to grant a home occupational license to Garland Septic, Inc. at 449 ponoka Street, Sebastian, for conducting a business of repairing drainfields. Mr. Shroyer seconded the motion. Roll call was taken. 7-0 motion carried. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - BRIAN A. STANT CONSTRUCTION - 358 TUNISON LANE The applicant, Brian A. Stant, is present, and was sworn in. The public hearing was opened at 7:29 p.m. There were 22 notices sent out and one objection letter was received back. Staff's memorandum indicated that the applicant will store his tools in his van, and is currently going through the process of getting a Sebastian Competency Card. Mr. Stant stated that was correct; his test was June 10th. There was no public input. The public hearing was closed at 7:31 p.m. Mr. Fischer inquired if the applicant had any employees. Mr. Stant stated not at the present time. Mr. Fischer reminded the applicant that no employees are allowed for a home occupational license. Mr. Stant was not aware of this requirement, and questioned the Board on how he could frame a house by himself? Mr. Shroyer suggested using sub-contractors or moving into an office space. Mr. Munsart asked the applicant if he brought any type of materials to his residence? Mr. Stant stated only to the job site. . . . PLANNING AND ZONING COMMISSION REGULAR MEETING OF JUNE 1. 1995 PAGE FIVE Mr. Goldstein made a motion to grant a home occupational license to Brian A. Stant Construction, 358 Tunison Lane, Sebastian, subject to the applicant receiving the Sebastian Competency Card. Mr. Fischer seconded the motion. Roll call was taken. 7-0 motion carried. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - GEORGE G. POWELL HANDYMAN SERVICE - 1013 GUAVA STREET The applicant was not present. Mr. Goldstein made a motion to defer the hearing until the June 15th meeting. Mr. Barnes seconded the motion. A voice vote was taken, all members in favor. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - R CLEANING SERVICE OF INDIAN RIVER, INC. - 879 MULBERRY STREET The applicant, Ms. Sherry Rogalski, is present, and is sworn in. The public hearing was opened at 7:39 p.m. There were 19 notices sent out. One objection letter and one non- objection letter was received back. Ms. Rogalski explained that before her husband's death, he ran R Cleaning Service as a commercial business doing work mostly at Grand Harbor. The business was too big for Ms. Rogalski to run by herself and since has cut back the amount of jobs they take on and employees. She herself works about 3-4 times a week only using a vacuum cleaner, broom, and basic cleaning supplies. She hires the additional employees through a leasing agent, none of them ever coming to her home. She would like to do her phone and bookkeeping work at her residence. [Mr. Cooper arrived at 7:45 p.m.] There was no public input. There public hearing was closed at 7: 46 p.m. Staff had no objection to the request for the license. Mr. Goldstein asked the applicant if this was a corporation. She stated yes, and is registered with the State. Mr. Barnes made a motion to approve the home occupational license for Sherry Rogalski, operating as R Cleaning Service of Indian River, Inc., at 879 Mulberry Street, Sebastian. Mr. Fischer seconded the motion. Roll call was taken. 7-0 motion carried. . . . PLANNING AND ZONING COMMISSION REGULAR MEETING OF JUNE 1. 1995 PAGE SIX A recess was taken at 7:50 p.m. The meeting resumed at 8:01 p.m., and all members were present. DISCUSSION - CONCEPTUAL IDEA FROM SKYDIVE SEBASTIAN RECOMMENDATION TO CITY COUNCIL - REGULAR MEMBER TERM TO EXPIRE JURE 1998 After discussion, the Board decided to interview the 4 Mr. Earl Shroyer, who wishes to be re-appointed, Schulke, Ms. Jean Brantmeyer, and Mr. Harry Thomas. Each applicant presented themselves to the Board. Chmn. Thompson called for nominations. Mr. Goldstein nominated Mr. Earl Shroyer. Mr. Barnes nominated Mr. Harry Thomas. applicants: Mr. Joseph The vote was as follows: Ms. Brantmeyer Mr. Barnes Mr. Fischer Mr. Munsart Mr. Shroyer Chmn. Mr. Barnes made a motion that the Planning and Zoning Commission recommend to City Council to re-appoint Mr. Earl Shroyer to the Board for another 3 years, of which term will expire in June of 1998. Mr. Munsart seconded the motion. Roll call was taken. 7-0 motion approved. DISCUSSION/ACTION - PUBLIC INPUT CHAIRMAN MATTERS: None MEMBERS MATTERS: Ms. Brantmeyer questioned the height of the new Taste of Philly's sign on the top of the building. Mr. Goldstein asked the status of the pet shop character signs? Mr. Cooper stated he was close to deciding to pursue action. Mr. Barnes asked the status of various proposed land developments such as Collier Creek and Sebastian Groves. Mr. Cooper updated and informed the Board of their current status. . . . PLANNING AND ZONING COMMISSION REGULAR MEETING OF JUNE 1. 1995 PAGE SEVEN BUILDING OFFICIAL MATTERS: DISCUSSION - SELF-SERVICE/MINI STORAGE FACILITIES Mr. Cooper stated in recent weeks he had been approached by three individuals regarding mini-storage facilities. The Land Development Code does not address these specifically. Mr. Cooper feels they fall into the industrial zoning under warehousing. One zone requesting to allow these storage facilities is PUD-C, such as Chessar Gap. PUD-C does allow industrial activities, but it is very inclusive of the specifics. There is little room for interpretation of other compatible uses. Mr. Cooper's suggestion is to amend the code in PUD-C to allow, under conditional uses, light industrial uses, which could specify mini-storage warehouses. He stated the county does allow mini-storage facilities in CG districts, but he feels the two zones should be looked at separately. Does the Board feel they should be allowed as conditional use for criteria in the CG district? Mr. Cooper stated the PUD-C ordinance had enough insurances to provide adequate parameters, buffers, required landscaping, etc. but, should be defined clearly in the recommendation to City Council. Mr. Barnes suggested they should specify maximin square footage for each unit. Chmn. Thompson stated his concerns about the facilities allowing commercial or industrial uses, such as the ones on CR 512. He feels mini-storage should only be used for storage. Mr. Goldstein noted that the codes call for 100-foot setbacks for commercial/industrial structures in residential areas. He questioned if there were any screening requirements? Mr. Cooper stated the normal screening requirements do apply. Mr. Goldstein also stated he liked the county's definition of self-storage facility. The Board asked staff to draw up the proposed additions, including criteria and definitions, and bring to a future meeting. Mr. Cooper reviewed the differences between the PUD-C and CG allowed uses. Commercial General does not normally allow industrial uses. He stated Mr. Steve Philipson was proposing to put a mini- storage facility behind the property where Prima pizza is located. If allowed in the CG district, criteria would have to be made to protect not only the surrounding residential area, but also to , . . . Since there are a few more concerns with the CG district, Mr. Cooper suggested the Board defer this until the next meeting, and ask Mr. Philipson to attend to answer any questions. The Board agreed with the suggestion.
