Resolution No. R-18-19 — Increasina the Stormwater Utilitv Fee (Transmittal, Notice, R-18-19, 2013 Update, Seawall Assessment, Report, Map) A RESOLUTION OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, INCREASING THE STORMWATER UTILITY FEE PURSUANT TO SECTION 102-125 OF THE CODE OF ORDINANCES OF THE CITY OF SEBASTIAN; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE. The City Attorney read the title to Resolution No. R-18-19 and Mayor Hill opened public hearing at 5:34 p.m. The City Manager said because the City has fallen behind on major stormwater projects he has found it necessary to double the stormwater fee, noting the fee would pay for the potential $18M seawall project and recommended approval of R-18-19. Public Input Harry Tanner, Belfast Terrace, said he was opposed to the 100% increase. Clara Wisniewski, Academy Terrace, said she could support the increase if it alleviates the stormwater in her neighborhood. John Johnston, President of the Collier Creek Homeowners' Association, said they don't have a problem but they feel ignored when comes to the drainage system. Susan Lorusso said she was not opposed to increase, but the City needs to take care of the stormwater including the seawall which is part of the whole system. Jayne Hayden said 13% of the City's residents live in poverty and asked the fee could only go up to $7.50. Richard Gillmor, 744 Kroegel Avenue, said taking the tax from $5 to $10 was a joke noting the seawall would need to be replaced again in 50 years. 7 of 13� Stormwater Fee Increase Public Hearing & Regular City Council Meeting May 9, 2018 Page Four Nathan McCollum said he was opposed to a 100% increase and asked Council to stager the increase. He complimented Council for notifying all of the residents. Russ Owen said the increase is not right to the people who are on a fixed income. Jean Catchpole representing the Indian River Neighborhood Association said the City is to be commended for having a stormwater utility that will assist with treating the water quality of the Indian River Lagoon. Russell Herrmann said untreated stormwater runoff is the state's leading source of water pollution; noted the economic value the Lagoon adds to our real estate; and asked Council to support the increase. Graham Cox, 1215 George Street, said he was concerned for the Lagoon, and he has invested $40,000 to rebuild two canal side lots on George Street. He said additional money will be needed and there should be a better accounting of the money and the improvements. He asked why the City is not using the Stormwater Park to reduce the TMDL to the Lagoon. Mayor Hill asked him to stay on the subject of the stormwater fee increase. He closed his remarks by requesting a refund of the money he spent on the seawall. Tim Glover, President of the Friends of St. Sebastian River said they supported the increase. Ben Hocker, Sebastian, said the money saved by cancelling the quarter round contract should be used. Pam Carter said the engineers that designed the system should revisit it; the increase should be done in increments with measurements taken along the way. Kevin Dixon said he was a professional engineer and if the seawalls were entombed, habitat and water quality would increase then the City would receive credits from the regulatory agencies. 6:09 pm C. N. Kirrie said over $15M has been spent and asked where it has gone, some of the projects should be completed. He requested a complete reassessment before raising the fee. He has paid substantially to the City of the years. Raymond McDermott, said he has been fighting with staff to take care of the empty lots for years; if the City is not taking care of swales, why should they raise the fee. David Reyes said he hasn't seen a model for what the City is basing the raise on; he didn't think staff is properly trained to grade the swales. He could not support the increase at this time until he received more data. 8 of 13g Stormwater Fee Increase Public Hearing & Regular City Council Meeting May 9, 2018 Page Five Ed Herlihy speaking as an individual resident said Sebastian was originally a ditch/swale/canal system that wasn't built very well and is suffering today; the system is over 50 years old. He said they could borrow money from the bank or start now by increasing the fee and obtain matching grants. He asked for support of the resolution. 6:25 pm 6:35 pm Bob Stephen, 150 Concha Drive, said the new City Manager should analyze it and decide what needs to be done. Ben Donahey, Quarry Lane, said he has been fighting water in front of his house for 14 years; doubling the fee is ridiculous; priorities and projects keep changing. He said no one is addressing any of the issues on his block of Quarry Lane. Juanita Latimer, 1702 Laconia Street, said she supports the increase as long as the City is taking care of the issues other than the seawall. Mayor Hill thanked everyone for their comments. Council Member Dodd stated it is a misnomer to think the City hasn't been maintaining swales in front of people's houses as the City is not responsible for the swale or driveway pipe in front of people's houses. The problems they are encountering today is a result of 30 years of neglect by everybody; the infrastructure must be addressed; the lack of flow is causing us to repair streets because of the degregrated base. The City has no choice but to fix the canal wall system and there is no long term, DEP/SJRWMD approved solution. This proposal will address the biggest problem which is neighborhood drainage. He said the Pelican Island Basin Study concludes the failure of the system is because of lack of owner lot maintenance and new elevations not being maintained. The study recommends that the City take over maintenance. The two ways to raise the funds are to raise the fee or assess each homeowner the cost of repairing their swale which could vary. The least painful way is for the City to assume responsibility for the swale and fix the entire system. He said he was in favor of increasing the fee to address the maintenance. Council Member lovino said he agreed and heard the majority of the folks are for the increase but wanted to discuss how much of an increase. Mayor Hill said he also agreed; stormwater has been the biggest issue since 1999; the quarter round and armadillo didn't work because of lack of maintenance knowledge and in some cases, a homeowner is just fills in their ditch. He said he was concerned about doubling the fee and would be comfortable raising the fee up to $7.50 noting the businesses will be paying a substantial amount. Council Member Dodd suggested having the City Attorney bring back the mathematical calculation for businesses. MOTION by Mayor Hill and SECOND by Council Member Dodd to approve Resolution No R-18-19 with the number in section 1, $10.00 is replaced with $7.50 for one equivalent residential unit and have the City Attorney bring back the business percentage rate. 9 of 13� Stormwater Fee Increase Public Hearing & Regular City Council Meeting May 9, 2018 Page Six The City Attorney suggested the percentage rate for businesses would be a separate process. Upon that advice, Mayor Hill struck the adjustment for businesses from his motion. Council Member lovino confirmed the stormwater fee would be $30.00 a year for an average sized home. Vice Mayor Kinchen said should would like to make sure the listed projects are completed. . Council Member McPartlan said he was in favor of the full increase. The City Manager said the doubled fee would provide $1 M; a half increase would be about $500,000. The additional $2.50 increase could provide for five more people to help with the maintenance. He said if there is a seawall failure, there is not a formal approval to make an emergency repair. He estimated it would take about two years to receive permit approval and ten years to replace the seawall. If Council did not spend the money now, they would have to spend it later. Mayor Hill said he was comfortable with the $7.50 increase but is concerned about the lack of a plan. The Administrative Services Director said the fee could subsidize salaries; it would be transferred over to compensate the general fund. He said the DST funds can contribute towards the projects but not operating costs. Council Member Dodd WITHDREW his second. Council Member lovino SECONDED the motion to increase the fee to $7.50. ROLL CALL: Council Member McPartlan — Nay Mayor Hill — Aye Vice Mayor Kinchen — Nay Council Member Dodd — Nay Council Member lovino — Aye Motion failed 3-2. MOTION by Council McPartlan and SECOND by Council Member Dodd to approve Resolution No. R-18-19 with a $10.00 increase. He also presented a Certificate of Special Congressional Recognition for his outstanding service to the community. He asked all veterans to salute Mr. Griffin. Mayor Hill presented the City Manager a token of their appreciation and thanked him for his passion that has ignited others. The City Manager noted the employees are what made his service possible all these years. He thanked Council and the citizens for this recognition. Lease, Addendum 1, E -Mail) The City Attorney explained he was contacted by a Council Member that would like to revisit the issue with the Golf Course; a motion from the prevailing side would be needed to put this back on the table for discussion, change the vote or give him direction. MOTION by Council Member lovino and SECOND by Council Member McPartlan to revisit the action taken on the Sebastian Golf Course Restaurant Lease passed with a voice vote of 4-1. (Kinchen-nay) 11 of 13� Stormwater Fee Increase Public Hearing & Regular City Council Meeting May 9, 2018 Page Eight 7:15 pm 7:29 pm Mayor Hill said it should be discussed on why the relief should not happen as it would constitute a rewrite of the lease and out of fairness to the community; it should go out to bid. He said the restaurant is selling cold beer and sandwiches; the non -golfer Eagles Nest customers are gone. He suggested putting a committee together to repurpose the restaurant building. Council Member Dodd said he couldn't support the requests outlined in the tenant's e-mail. He said they were deciding if they are terminating the lease tonight. They will have to charge $1,000 a month for ten years to recoup the money the City has put into the restaurant. The restaurant could be made into a bigger pro shop and convert the bar into a snack bar. He would like to give the tenant an opportunity to rearrange his business plan; have the City Manager and staff have conversations with the operator on what's been done and if he is willing to go forward. Council Member Dodd said the tenant is paid up to the month of June; he was in favor of giving him forbearance until October to see if he can work the business out and give City staff a chance to explore options. Mayor Hill noted October is the start of the golf season and they shouldn't add turmoil during the prime of the season. MOTION by Mayor Hill and SECOND by Council Member McPartlan to direct the City Attorney to not enforce a default for 60 days past the first day of June. Wesley Campbell, restaurant operator, said he has been living and doing business successfully in Sebastian for 14 years; he recognized the restaurant needed help and based on agreements, he worked on remodeling and opening the restaurant. He said Council approved his business plan but he is working against the Eagles Nest Restaurant history and needs more time to draw customers into the location. He requested to operate based on the need of the community such as private parties, golf events which will cut down on the labor and daily operations cost. He said he did not want to walk away from his investment of $200,000 worth of equipment and sweat equity. He has split his customer base from his other restaurant to support the operation. He also requested a rent reduction for at least two years to get the restaurant going, continue to provide jobs and a good, clean atmosphere for people to dine. Ben Hocker, Sebastian, said the contract should be terminated. Mayor Hill said the operator is a high quality man with another outstanding restaurant; the motion on the floor gives the City Manager time to work with him. He also said at the meeting, one of the County Commissioners referenced that the City no longer supports the County's position on the Brightline railroad system. He said a resolution was sent a few years ago indicating the City's support and asked the City Attorney to transmit that resolution to the County Commission. 18. Economic Effect: Provided — Annexation of this property provided an additional 182.87 +1- acres of land area and 586 residential units, which in turn creates an expanded tax base for the City of Sebastian. Fees collected from the development will fund basic services of the City. The proposed development will not adversely affect the property values in the area, or the general health, safety and welfare of the community. 16. Orderly Development: The proposed land use change is consistent with the comprehensive plan and the proposed land use change provides for orderly development given the location of the site as an enclave, adjacent to residential/industrial property. The property has provided assurance of the availability of sufficient public facilities and access. 17. Public Interest: The City of Sebastian Comprehensive Plan outlines the necessity to incorporate and/or annex enclave parcels within the service boundaries of the City. The property is an enclave, surrounded on three sides by the urban service area of the City and would most likely be better served by municipal services. The City does not permit agricultural use and the proposed change to a single-family and commercial development is consistent with the future goals and objectives of the City of Sebastian. Therefore, staff finds that the proposed annexation/land use change is not in conflict with public interest. 18. Other Matters: The requested land use change and accompanying rezoning will provide consistency with the future land use map of the comprehensive plan. Annexation of the parcels will demonstrate compliance with goals and objectives as outlined in the comprehensive plan for annexation of properties adjacent to, or surrounded by, the urban service area. The proposed land use change will create a slightly greater impact on transportation, safety and solid waste facilities within the urban service boundaries. These impacts will be mitigated by the additional generation of taxes and fees. Transportation impacts will be mitigated by intersection improvements addressed as part of the traffic analysis. 19. Analysis: Residential land uses, primarily in the low-density category, represent approximately forth -three (43) percent of the total land area in the City (2009). In 2009, a deficiency of 704 acres of low density residential was projected for year 2025. In the City of Sebastian's adopted 2010 EAR, the City is encouraged to pursue voluntary annexations of enclaves in order to meet the projected need for residential/commercial acreage. The proposed land use change for the infill parcels of land surrounded by City properties will prevent urban sprawl and disjointed urban service delivery system. The property is served by existing utilities and roadways that will provide a development consistent with the neighboring properties. To ensure consistency with adjacent development, consideration includes "Protection of the integrity and stability of established residential areas" and "Assure smooth transition in residential densities" by requiring the application of sound landscaping and urban design principles and practices. 20. Attachment `E' shows the current Indian River County zoning designations of the property, which consist of A-1 (agricultural — 1 unit per 5 acres), RM -6 (multi -family -- 6 units per acre), and IL (light industrial). The underlying Indian River County land use for the property is L-2 (6 units per acre) and C/I (commercial / industrial). With this request, the majority of the property will have a future land use designation of "low density residential" (max. 5 units per acres) along with a PUD -R. The purpose for this request is to secure the proper zoning and density for a planned residential development. Although the maximum density would allow 5 units per acre, it is anticipated 456 single-family and 130 duplex villas residential units (3.20 units per acre) will be planned. The following information is provided to support the property's impact on the environment, public facilities, and compatibility with the neighboring properties: • Environment Prior to submittal of a preliminary plat application, an environmental survey will be conducted on the property for the presence of wetlands and endangered species. Mining operations were previously performed on the property that created four large ponds. As seen with the conceptual development plan, these ponds will be incorporated into the stormwater management system for retention of stormwater runoff prior to any off-site discharge. There also appears to be an environmentally sensitive area in the southwest corner adjacent and contiguous to the Indian River County owned preserve property. Wetlands are protected by state and federal regulations and the master plan will be designed to avoid impacts to this area. Gopher tortoise habitat may also exist due to the site's location on the coastal sand ridge; however, provisions will be made during development to protect or relocate tortoises. a Transportation A traffic impact analysis will be performed prior to submittal of the preliminary plat application. The conceptual development plan shows three (3) ingress/egress points that will help evenly distribute the projected traffic. A good portion of the projected trips will be directed to the adjacent USI commercial area that will provide more economic growth. • Utilities The property will be served by public water and sewer facilities provided by Indian River County Utility Services. Several points of connection are available to existing water and sewer facilities along Old Dixie Highway just north of the property and along the property's southern boundary. There is also a water main stub -out near the western property line at Del Monte Road. Assuming 250 gallons per day per unit, an estimated 146,500 gallons per day of projected flow will be generated for the property. The Indian River County plant information shown in Attachment 7 demonstrates that the North and Central Wastewater Treatment Facilities and the North and South County Public Water System have more than adequate capacity to handle the additional projected flows. Another utility proposed to serve this development will be natural gas, which can provide connection to neighboring properties once these facilities are extended to the property. • Recreation The demand for recreation area shall be determined by multiplying the city's recreation area level of service standard (4.0 acres per 1,000 population or .0040 acre multiplied by each person served by the development). Therefore, assuming 2.5 persons per unit (456 single-family and 130 duplex villa units), a total of 5.86 acres of recreational area is needed for the property. The graphic provided in Attachment `G' shows on-site recreational areas in excess of this required acreage. a Compatibility with neighboring properties As mentioned earlier, the property is directly adjacent to two residential neighborhoods (Sebastian Highlands and South Moon Under) and also near The Laurel Reserve. The proposed "low density residential" land use is compatible with these developments. Objective 1-2.1 of the future land use element states that the City of Sebastian desires to develop a plan that would prevent urban sprawl and disjointed urban service delivery systems. The Spirit of Sebastian fits this mold in every essence of the definition. The concept of this infill land tract prevents urban sprawl and utilizes existing infrastructure. It is a tract of land surrounded by the City of Sebastian with all water, sewer, and road systems in place. This community will allow for a positive and productive tax base assisting the City of Sebastian and its future needs. In reference to the fiscal impact analysis of the community, our tax base will stay ahead of the basic services and their costs. The Spirit of Sebastian, a deed restricted gated community, will feature a community center, various parks, and recreational facilities that will be constructed and maintained by the development. Our experience, over the years with Collier Club and SandCrest, is that the majority of our residents have been second -homeowners and retirees, allowing for less fiscal impact on city services. This demographic frequents local businesses, restaurants, and other leisure based activities which supports our local economy. Mr. Stokes identified Item C as a large-scale comprehensive plan future land use amendment, a land -use change from County Zoning L-2 and CII to City LDR and CG, which is low-density residential and general commercial. The second item is a rezoning and a conceptual planned unit development plan, zoning designation request for PUD - R, which is low-density residential, and the requisite approval of a conceptual. This is the Spirit of Sebastian located off Old Dixie Highway south of Route 512. Mr. Roth then asked for the applicant to make his presentation. Mr. Chuck Mechling, business address 5070 North A1A. He presented a Power Point presentation describing the planned development. SEE ATTACHED. Mr. Roth asked for input from staff. Ms. Bosworth stated the property has been formally annexed by the City, and what is before the Commission tonight is the request for the land use, to remove it from County land use to City land use to low-density residential, and approximately 2.5 acres along Old Dixie to a general commercial land use. Also requested is a rezoning to a PUD -R, and that requires a conceptual plan, which meets what the PUD zoning requires. She described that the Commission's recommendation will go before City Council. After that first hearing, the land -use request is sent to the State of Florida Department of Economic Opportunity for review, after which they will return it with their comments, and it will again go before City Council for final approval. In the meantime, the developer will be working on more details, finalizing their environmental report, a full traffic analysis, etc. She reiterated that tonight is just on the land use, the zoning, and the conceptual 67 of 137 PLANNING AND ZONING COMMISSION Page 10 MINUTES OF REGULAR MEETING OF APRIL 19, 2018 plan. Staff recommends approval with a condition that where the buffers are abutting residential properties the buffers are a full 25 feet wide unless the land is buffered by a drainage easement. Mr. Roth asked for questions/comments from the Commission. Mr. Simmons inquired as to who are the principals in Ridgewood LLC. Mr. Mechling identified Robert Votaw, Karen Mechling, Jim Adams, who are all local residents. Mr. Reyes asked if the property has been declared a wetland. Mr. Mechling said yes. Mr. Reyes inquired if the developers have any other projects in the area that are incomplete. Mr. Mechling stated they are in the process of finishing Sand Crest which is near the post office. Mr. Reyes asked where the villas and the duplexes will be situated. Mr. Mechling stated they will be to the east of the property line off Old Dixie Highway. Mr. Hughan asked about the ingress and egress for construction vehicles, whether that is going to remain after the construction is finished. Mr. Mechling said yes, there would be three ways into and out of the property. Mr. Hughan asked if the lakes are sloped in, and Mr. Mechling said yes, and they would have to meet all safety requirements for a sloped situation. Mr. Reyes asked if there is a plan to mine any more fill out of the lakes. Mr. Mechling stated if they do anything like that, it would be permitted, and if they move fill, it would be used inside the community, and since the property already has an earthen barrier, that area would be landscaped. Mr. Mechling read into the record a letter of support from the President of South Moon Under to Ms. Frazier and Ms. Bosworth. Ms. Bosworth verified that she had received that letter. SEE ATTACHED. Mr. Alvarez asked if there was consideration given by the City to the impact this community will have on police, water, and employees that will be involved. Ms. Bosworth referred the Commission to the fiscal analysis that was done. Ms. Bosworth stated that as far as traffic, the developer has already begun their full traffic analysis, and staff has reviewed with them the projected streets on which traffic will flow. He also stated this community will be the first in Sebastian to have natural gas, and spurs will be available to businesses along Old Dixie so that gas will be available to those businesses. Mr. Mauti asked for clarification of how many units are to be built. Mr. Mechling stated it would be 456 single-family and 130 villas or 65 units, which is a density of 3.2 units per acre in concept. Mr. Roth asked for public input in support of the proposed project. Mr. Ben Hocker, Sebastian, is in favor of the project. Mr. Roth then asked for public input in opposition to the project. The following spoke in opposition of the application, and their concerns are noted: • Damien Gilliams, 1623 US1, Sebastian, suggested using very low density of three units per acre. • John Norris, 566 Cross Creek Circle, presented an alternate proposal for a land trust and a project called the Sand Mine Park Conservation Area and Greenway Trail. • Ray Fries, 171 Del Monte Road, is concerned about urban sprawl and storm water drainage. • Dr. Patricia Pe=ulo, 438 Georgia Boulevard, Sebastian, asked the Commission not to approve the project until more data is gathered and to consider other uses for this property. • Irene Ferraiuolo, 1525 Crowberry Lane, Sebastian, is concerned about keeping the integrity of Sebastian. • Henry Ghigliotty, 774 South Easy Street, Sebastian, opposes the plan because of the impact on local traffic. • Ben Hocker voiced concerns about the traffic flow onto Old Dixie Highway and asked about the buildable acreage. • Ronald Adamson, 564 Balboa Street, Sebastian, concerned about the plans for traffic onto Old Dixie Highway and plans for increased railroad crossings in the future. Mr. Mauti voiced his concern on the increased traffic on Del Monte and recommends further study on this matter. Ms. Frazier clarified that the over 5,000 trips estimated from this community will be spread out over three access points, and that the traffic impact will be studied at the time of the preliminary plats and any off-site improvements required to mitigate for those impacts will be studied by the consulting engineers at that time, and those improvements will be borne by the developer. The property lies west of the FEC Railroad and Old Dixie Hwy; North and East of existing low density residential developments; and south of an existing industrial park. Existing land use designation within the county is L-2 (Low Density Residential, 6 units per acre) and C/I (Commercial/Industrial). The applicant has requested a Future Land Use designation, consistent with the City of Sebastian Comprehensive Plan, of LDR (low density residential, 5 units per acre). The conceptual plan outlines a total of 456 single-family and 130 duplex villa residential units for a proposed density of 3.20 units/acre. Additionally, a CG (Commercial General) land use designation has been requested for approximately 2.52 acres for a parcel lying within the northeast corner, adjacent to Old Dixie Highway. Current County zoning and land use would allow for higher density and intensity development. The requested land use change along with the appropriate rezoning request to PUD -R will provide for a consistent and compatible use. b. Level of Service (1) Traffic: The estimated preliminary trip generation for the proposed PUD will create an ADT of 5,532 spread over a projected buildout schedule of ten (10) years. Therefore, the proposed development will create an increased demand on the existing roadway network. Traffic impacts to neighboring roadways and intersections will be analyzed during preliminary plat applications to determine mitigation strategies. Phase I and 2 of the subdivision incorporates two "primary" access points; one of which will be a direct access to Old Dixie Hwy and Del Monte Road. Future Phases will require a third exit at Bailey Drive. (2) Potable Water: The property will be serviced by public water provided by Indian River County Utility Services. Several points of connection are available. The Applicant will be required to connect to county utilities and has ascertained that adequate capacity is available at the North and South County Public Water System to handle the additional projected flows. (3) Wastewater: The property will be serviced by public waste water provided by Indian River County Utility Services. Several points of connection are available. The Applicant will be required to connect to county utilities and has ascertained that adequate capacity is available at the North and Central Wastewater Treatment Facilities to handle the additional projected flows. (4) Stormwater: The level of service standard is regulated by the St. Johns River Water Management District, the same for all developments. The stormwater management system will be internal to the development and managed by the HOA. 3 89 of 137 (5) Recreation: The proposed PUD will be required to contain minimum open space and recreation areas in accordance with minimum standards as established by the comprehensive plan. The preliminary development plan will be required to demonstrate proper compliance with this regulation. (6) Solid Waste: There will be an increased demand on solid waste as the property is currently vacant. 10. Conformance with Code of Ordinances: The proposed rezoning is consistent with the Code of Ordinances. 11. Changed Conditions: Existing site consists of an inactive mining and agricultural operation with a proposed change in use to single-family residential. 12. Land Use Compatibility: Subject property is an enclave, adjacent to vacant land, low density residential and industrial land uses. Low density single-family residential, coupled with 2.52 acres of commercial, provides for consistency with relation to future growth and development. 13. Adequate Public Facilities: Provided — public utilities (water, wastewater) will be incorporated within the development of the proposed PUD, and on-site stormwater tracts are also incorporated in the proposal. 14. Natural Environment: The proposed PUD will be required to contain minimum open space and recreation areas in accordance with minimum standards as established by the comprehensive plan. The preliminary development plan will be required to demonstrate proper compliance with this regulation. 15. Economic Effect: Provided -- Annexation of this property provided an additional 182.87 +I- acres of land area and 586 residential units, which in turn creates an expanded tax base for the City of Sebastian. Fees collected from the development will fund basic services of the City. The proposed development will not adversely affect the property values in the area, or the general health, safety and welfare of the community. 16. Orderly Development: The proposed land use change is consistent with the comprehensive plan and the proposed land use change provides for orderly development given the location of the site as an enclave, adjacent to residential/industrial property. The property has provided assurance of the availability of sufficient public facilities and access. 17. Public Interest: The City of Sebastian Comprehensive Plan outlines the necessity to incorporate and/or annex enclave parcels within the service boundaries of the City. The property is an enclave, surrounded on three sides by the urban service area of the City and would most likely be better served by municipal services. The City does not permit agricultural use and the proposed change to a single-family and commercial development is consistent with the future goals and objectives of the City of Sebastian. Therefore, staff finds that the proposed annexation/land use change is not in conflict with public interest. 4 90 of 137 18. Other Matters: The requested land use change and accompanying rezoning will provide consistency with the future land use map of the comprehensive plan. Annexation of the parcels will demonstrate compliance with goals and objectives as outlined in the comprehensive plan for annexation of properties adjacent to, or surrounded by, the urban service area. The proposed land use change will create a slightly greater impact on transportation, safety and solid waste facilities within the urban service boundaries. These impacts will be mitigated by the additional generation of taxes and fees. Transportation impacts will be mitigated by intersection improvements addressed as part of the traffic analysis. 19. The Spirit of Sebastian Conceptual PUD Plan indicates that compliance with open space, recreation, and stormwater requirements will be met. (b) Description of proposed recreational facilities; Each phase/Pod, except Pod 2, will be providing recreation tracts and/or Community Common Areas (i.e. recreational vehicle storage, dog park, etc.) within their respective area. Cumulatively, all Pods will meet the subdivision's total recreational space requirement. (c) Quantity of potable water required; Based on Sebastian's adopted Level of Service for potable water, which is 250 gallons per day per unit, an estimated 146,500 gallons per day will be generated for the development. Existing capacity has been verified with Indian River County, (d) Estimated number of school age children expected within the development: The developer must provide a School Capacity Availability Determination Letter (SCADL) from the Indian River County School District prior to approval of the preliminary plat/plan, (e) Estimated property tax and/or sales tax revenue generated by the project by phase; and Provided in Analysis Report. (f) Any other positive or negative public facility impact. In addition, the statement shall also include all public facilities impact information that may be submitted as part of the Development of Regional Impact (DRI) review process, as applicable. This project is not a Development of Regional impact as defined by the Florida Statutes. f. Open space and landscaped areas: The proposed PUD will provide 5.86 acres of recreation space and 50% open space to satisfy the minimum standards as established by the comprehensive plan. The Conceptual PUD Plan indicates areas that will provide perimeter landscape buffer strips which vary in width. Staff recommends that a minimum 6 92 of 137 buffer strip of 25 feet is required between areas of platted lots and bordering residential uses, unless the bordering property is a stormwater ROW or easement. 19. Analysis: Spirit of Sebastian is directly adjacent to existing very low density residential and low density residential neighborhoods. The proposed rezoning request is compatible with the adjacent properties and provides for consistency with relation to future growth and development. The current county zoning and land use designation is L-2 (Low Density Residential, 6 units per acre) and C/I (Commercial/industrial), which would allow for a higher density/intensity use then what is being proposed. In addition, this PUD provides the proper zoning buffer between residential neighborhoods and adjacent industrial/commercial uses to the north and east of the subject property. The applicant has requested a Future Land Use designation, consistent with the City of Sebastian Comprehensive Plan, of LDR (low density residential, 5 units per acre). The conceptual plan outlines a total of 456 single-family and 130 duplex villa residential units for a proposed density of 3.20 units/acre. Additionally, a CG (Commercial General) land use designation has been requested for approximately 2.52 acres for a parcel lying within the northeast corner, adjacent to Old Dixie Highway. This land use designation is consistent with the PUD -R zoning request. 20. Conclusion: The requested rezoning from a mix of County A-1 (Agriculure-1), RM -6 (Multiple -Family Residential), and IL (Light Industrial) to the City's PUD -R, in addition to the Conceptual PUD Development Plan, is consistent with the Comprehensive Plan, Land Development Code and Code of Ordinances. 21. Recommendation: Staff recommends that the Planning and Zoning Commission forward a favorable recommendation to the City Council to approve the requested rezoning, and to approve the Conceptual PUD Development Plan with the following condition: 1. D. Public Hearing — Recommendation to City Council -- Rezoning/Conceptual Planned Unit Development (PUD) Plan — Spirit of Sebastian — Ridgewood Sebastian, LLC, Applicant — Section 7, Township 31 South, Range 39 East — Subject Parcel is 182.87 Acres, More or Less — Request is for PUD -R (Planned Unit Development — Residential) Zoning Designation. Mr. Stokes identified Item C as a large-scale comprehensive plan future land use amendment, a land -use change from County Zoning L-2 and Cll to City LDR and CG, which is low-density residential and general commercial. The second item is a rezoning and a conceptual planned unit development plan, zoning designation request for PUD - R, which is low-density residential, and the requisite approval of a conceptual. This is the Spirit of Sebastian located off Old Dixie Highway south of Route 512. Mr. Roth then asked for the applicant to make his presentation. Mr. Chuck Mechling, business address 5070 North A1A. He presented a Power Point presentation describing the planned development. SEE ATTACHED. Mr. Roth asked for input from staff. Ms. Bosworth stated the property has been formally annexed by the City, and what is before the Commission tonight is the request for the land use, to remove it from County land use to City land use to low-density residential, and approximately 2.5 acres along Old Dixie to a general commercial land use. Also requested is a rezoning to a PUD -R, and that requires a conceptual plan, which meets what the PUD zoning requires. She described that the Commission's recommendation will go before City Council. After that first hearing, the land -use request is sent to the State of Florida Department of Economic Opportunity for review, after which they will return it with their comments, and it will again go before City Council for final approval. In the meantime, the developer will be working on more details, finalizing their environmental report, a full traffic analysis, etc. She reiterated that tonight is just on the land use, the zoning, and the conceptual 94 of 137 PLANNING AND ZONING COMMISSION Page 10 MINUTES OF REGULAR MEETING OF APRIL 19, 2018 pian. Staff recommends approval with a condition that where the buffers are abutting residential properties the buffers are a full 25 feet wide unless the land is buffered by a drainage easement. Mr. Roth asked for questions/comments from the Commission. Mr. Simmons inquired as to who are the principals in Ridgewood LLC. Mr. Mechling identified Robert Votaw, Karen Mechling, Jim Adams, who are all local residents. Mr. Reyes asked if the property has been declared a wetland. Mr. Mechling said yes. Mr. Reyes inquired if the developers have any other projects in the area that are incomplete. Mr. Mechling stated they are in the process of finishing Sand Crest which is near the post office. Mr. Reyes asked where the villas and the duplexes will be situated. Mr. Mechling stated they will be to the east of the property line off Old Dixie Highway. Mr. Hughan asked about the ingress and egress for construction vehicles, whether that is going to remain after the construction is finished. Mr. Mechling said yes, there would be three ways into and out of the property. Mr. Hughan asked if the lakes are sloped in, and Mr. Mechling said yes, and they would have to meet all safety requirements for a sloped situation. Mr. Reyes asked if there is a plan to mine any more fill out of the lakes. Mr. Mechling stated if they do anything like that, it would be permitted, and if they move fill, it would be used inside the community, and since the property already has an earthen barrier, that area would be landscaped. Mr. Mechling read into the record a letter of support from the President of South Moon Under to Ms. Frazier and Ms. Bosworth, Ms. Bosworth verified that she had received that letter. SEE ATTACHED. Mr. Alvarez asked if there was consideration given by the City to the impact this community will have on police, water, and employees that will be involved. Ms. Bosworth referred the Commission to the fiscal analysis that was done. Ms. Bosworth stated that as far as traffic, the developer has already begun their full traffic analysis, and staff has reviewed with them the projected streets on which traffic will flow. Mr. Mauti asked for clarification of how many units are to be built. Mr. Mechling stated it would be 456 single-family and 130 villas or 65 units, which is a density of 3.2 units per acre in concept. Mr. Roth asked for public input in support of the proposed project. Mr. Ben Hocker, Sebastian, is in favor of the project. Mr. Roth then asked for public input in opposition to the project. The following spoke in opposition of the application, and their concerns are noted: • Damien Gilliams, .1623 USI, Sebastian, suggested using very low density of three units per acre. • John Norris, 566 Cross Creek Circle, presented an alternate proposal for a land trust and a project called the Sand Mine Park Conservation Area and Greenway Trail. • Ray Fries, 171 Del Monte Road, is concerned about urban sprawl and storm water drainage. • Dr. Patricia Pe=ulo, 438 Georgia Boulevard, Sebastian, asked the Commission not to approve the project until more data is gathered and to consider other uses for this property. • Irene Ferraiuolo, 1525 Crowberry Lane, Sebastian, is concerned about keeping the integrity of Sebastian. • Henry Ghigliotty, 774 South Easy Street, Sebastian, opposes the plan because of the impact on local traffic. • Ben Hocker voiced concerns about the traffic flow onto Old Dixie Highway and asked about the buildable acreage. • Ronald Adamson, 564 Balboa Street, Sebastian, concerned about the plans for traffic onto Old Dixie Highway and plans for increased railroad crossings in the future. Ms. Bosworth stated one of the requirements is that 50% must remain open space. Ms. Frazier answered that Old Dixie Highway is a County road south of Sebastian city limits, and it would be the responsibility of the developer to make any improvements to Old Dixie related to their property. Mr. Alvarez voiced concern about ingress and egress to and from Old Dixie Highway. Mr. Roth called for further discussion by the Commission on Item C — Recommendation to City Council for Large Scale Comprehensive Plan Future Land Use Amendment. Ms. Frazier clarified that the over 5,000 trips estimated from this community will be spread out over three access points, and that the traffic impact will be studied at the time of the preliminary plats and any off-site improvements required to mitigate for those impacts will be studied by the consulting engineers at that time, and those improvements will be borne by the developer. WHEREAS, the City presently owns and operates a stormwater system which has been developed over a number of. years to serve the purpose of collecting, purifying and disposing of storm and other surface waters, and is in the process of expanding, constructing and improving the system; and WHEREAS, the city is authorized by the provisions of Florida Statutes Chapter 166, the Florida Constitution, the City Charter, and Fla. Stat. § 403.0893, to construct, reconstruct, improve, and extend stormwater utility systems, to issue revenue bonds and other debts if needed to finance in whole or part the cost of such a system, and to establish just and equitable rates, fees, and charges for the services and facilities provided by the system; and WHEREAS, this stormwater management system benefits and services all property within the City both directly and, less obviously, by keeping streets open for passage as well as by monitoring and minimizing pollution levels in adjoining waterways; and WHEREAS, based upon empirical functions of personnel serving the City's stormwater needs, the resources needed to perpetuate the stormwater system for an undeveloped lot are not substantially different from those needed to perpetuate the stormwater system for a developed lot; and WHEREAS, the cost of operating and maintaining the city stormwater management system and financing necessary repairs, replacements, improvements, and extensions thereof should, to the extent practicable, be allocated in an equitable manner among those who are served by the system; and 112 of 137 WHEREAS, the City Council has determined that it is in the public interest to establish a stormwater utility in accordance with Florida law; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEBASTIAN, INDIAN RIVER COUNTY, FLORIDA, as follows: Section 1. That the Code of Ordinances, City of Sebastian, Florida, is hereby amended to create Chapter 102, Article V Sebastian Stormwater Utility beginning with section 102-100 which shall read as follows: Sec. 102-100. Utility established. There is hereby created and established in the City, in accordance with section 403.0893 of the Florida Statutes, a stormwater management utility entitled the Sebastian Stormwater Utility. This utility shall be responsible for the city's stormwater management. Section 2. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section to be numbered section 102-101 which shall read as follows: Sec. 102-101. Powers and authority. The Sebastian Stormwater Utility shall have all powers necessary for the exercise of its responsibility for the drainage from all properties within the City, including, but not limited to, the following: (1) Preparation of plans for improvements and betterments to the stormwater management system. .(2) Construction of improvements and betterments to the stormwater management system.. (3) Promulgation of regulations for the use of the stormwater management system, including provisions for enforcement of such regulations. (4) Review and approval of all new development permits within the City for compliance with stormwater management regulations included in present city ordinances or ordinances later adopted. (S) Performance of routine maintenance and minor improvement to the stormwater management system. 113 of 137 (6) Establishment of charges for connection and use of the stormwater management system. (7) Evaluation of water quality concerns for discharges to the stormwater management system. (8) Performance of all normal utility functions to include construction, operation, and maintenance of the city's stormwater management system, including, but not limited to, the hiring of staff, the selection of special consultants, the entering into contracts for services and construction of facilities, and the handling of purchase, lease, sale or other rights to property for the stormwater management system. (9) Issuance of revenue bonds or other debt instruments for the purpose of performing those duties as described herein. Section 3. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section to be numbered section 102-102 which shall read as follows: Sec. 102-102. Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning, Calculated impervious surface of an E.R. U. For purposes of determining a stormwater fee, the calculated impervious surface of an ERU shall be deemed to be 3,285 square feet. Developed nonresidential property. Property zoned for uses other than for residential purposes upon which improvements have been constructed. Developed residential property. Property zoned for residential use upon which is constructed one or more dwelling units. This would include single-family or multi -family dwellings, condominiums and duplexes. Equivalent residential unit (ERU). The statistical average horizontal impervious area of all residential units in the city. Exempt property. Property which shall not subject to a stormwater fee, which is limited to: a. Common areas within multi -family areas. b. Property which is perpetually designated for conservation land uses or which, because of its environmentally sensitive character, cannot be 114 of 137 developed under present environmental protection regulations. C. Publicly owned road and drainage right-of-way, Undeveloped parcels. Unimproved property zoned for uses other than for single-family residential purposes or property zoned for residential uses upon which no subdivision improvements have been constructed. Undeveloped single-family residential property. Property improved and subdivided into single-family residential lots upon which no dwellings have been constructed. Section 4, That the Code of Ordinances, City of Sebastian., Florida is hereby amended to create a new section to be numbered section 102-103 which shall read as Mows: Sec. 102-103. Stormwater fee; imposition and calculation of. (a) Imposition. A stormwater fee is hereby imposed upon all property within the city unless otherwise exempted, for services and facilities provided by the stormwater management system. For purposes of imposing the stormwater fee, the city has obtained the services of a consulting engineer to develop the statistical rationale for providing just and equitable rates, fees, and charges for the facilities and services provided by the system. (b) Application and classification. (1) Developed residential property. Each dwelling unit shall be billed at a flat fee of one ERU per month. (2) Undeveloped single family residential property. Each undeveloped single family lot shall be billed for one ERU multiplied by a correction factor of 0.67 to calculate the flat monthly rate. (3) Undeveloped parcels. Each undeveloped parcel shall be billed at a rate determined by dividing the total land area of the properties, in square feet, by 11,154 which represents the square footage of a statistically average residential building site in the City, multiplied by a correction factor of 0.67 to arrive at the number of ERUs for that parcel. (4) Developed nonresidential property. Each parcel of developed nonresidential property shall be billed at a rate determined by dividing the total impervious area of the parcel by the Calculated Impervious Surface of 115 of 137 an ERU to arrive at the number of ERUs for that parcel. (5) Exempt property. Service charges shall apply to all properties within the city, including those properties classified as nonprofit or tax-exempt for ad valorem tax purposes. Service charges shall apply to all government properties, including properties of the city, including the city -owned buildings, parks, and other properties. However, Exempt Property shall not subject to a stormwater fee. Section 5. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section to be numbered section 102-104 which shall read as follows: Sec. 102-104. Establishment of fee. There is hereby established as the initial fee for one equivalent residential unit (E.R.U.) the sum of $4 for each month. Said fee shall continue in effect unless and until the City Council, by resolution passed by supermajority, establishes a different rate for any fiscal period following the 2001-2002 fiscal year. Section 6. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section to be numbered section 102-105 which shall read as follows: Sec. 102-105. Collection. (a) Fees for the Sebastian Stormwater Utility levied pursuant to the code shall constitute a non -ad valorem assessment, as set forth in F.S. ch. 197 and shall be collected pursuant to the uniform method of assessing, billing and collecting of the same. The stormwater fee 116 of 137 is to be henceforth assessed annually to the owner of each parcel which is subject to the stormwater fee. The assessment roll prepared on electronic medium by Camp, Dresser & McKee, September 15, 2001, from records provided by the Property Appraiser of Indian River County, Florida, and as modified annually hereafter, is hereby adopted for this purpose. The period for which the fee is charged shall coincide with the City's fiscal year. (b) The City may utilize any other method available under the law to collect the stormwater utility fee provided herein, including placement of a lien against the subject property and any real or personal property of landowner, effective as of October 1 of each fiscal period and charged until the same has been paid in full, and said lien thereby created shall be co -equal with the lien of all state, county, district and municipal taxes, superior in dignity to all other liens, titles, and claims, until paid and shall be enforceable in accordance with all available provisions of law. Section 7. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section to be numbered section 102-106 which shall read as follows: Sec. 102-106. Stormwater utility trust fund, use of funds. (a) There shall be established a Sebastian Stormwater Utility Fund for the deposit of a[[ fees collected pursuant to this Article. (b) The stormwater utility fund shall be used exclusively to provide funding for the stormwater management program. (c)--- No less than 80%--of-uU4 fees—shall be used to fund Per Ordinance capitalt projects as delineated ptogracnmed in—the 0-05-16 Stormwater lVlastsr Plan adopted by City Council. Section S. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section to be numbered section 102-107 which shall read as follows: Sec. 102-107. Appeal of fee amount; procedure. (a) After having paid in full all utility fees invoiced against his property, any property owner shall have the right to appeal either the utility fee charged, or a credits determination pursuant to Section 102-103(c), with respect to his property as follows: 117 of 137 (1) Within 30 days of either the initial mailing of the utility fee bill, or the written determination as to credits, whichever date is relevant, the property owner shall have the right to appeal to the city council. The city council shall have 30 days from the receipt of the notice of appeal within which to hold a hearing on the appeal and thereafter shall render a determination. (2) If the appellant prevails and it is decided a refund is due, the refund amount shall be in accordance with the determination on appeal but shall not include any interest on the refunded fee. (3) Upon filing of a proper petition within thirty (30) days of the determination of City Council, said determination may be reviewed in the Circuit Court by writ of certiorari upon the record made before the City Council. (b) Notwithstanding the provisions set forth above, any property owner shall have until December 1, 2001, to request a review by the City Manager of the utility fee bill for fiscal year 2001-2002 for claims of errors in classification or calculation. As a condition of requesting such review, the property owner must pay his good -faith estimate of the fees actually due. The City Manager may deny the appeal or modify the amount of the fee. The owner may appeal the City Manager's determination to City Council within thirty (30) days and thereafter follow the procedures set forth in subsections (a)(1) — (3) above. Any claims relating to a credits determination pursuant to Section 102-103(c) must be appealed in accordance with the standard procedure set forth above. Section 9. That the Code of Ordinances, City of Sebastian, Florida is hereby amended to create a new section numbered section 102-108 which shad read as follows: Sec. 102-108. Additional regulations. The City Manager may promulgate reasonable regulations concerning the operation of the Sebastian Stormwater Utility, with said regulations subject to modification or nullification by resolution of the City Council. Section 10. CONFLICT. All ordinances or parts of ordinances in conflict herewith are hereby repealed. 118 of 137 Section 11. SEVERABILITY. In the event a court of competent jurisdiction shall hold that any part of this Ordinance is invalid, the remainder of the Ordinance shall not be affected and it shall be presumed that the City Council did not intend to enact such invalid provision. It shall further be assumed that the City Council would have enacted the remainder of this Ordinance without said invalid provision, thereby causing said remainder to remain in full force and effect. Section 12. EFFECTIVE DATE. Following its adoption by the City Council, this Ordinance shall take effect October 1, 2001. POLICY Developed property from which stormwater runoff is discharged, either directly or indirectly, to the stormwater system or to water bodies within/surrounding the City may be eligible for a reduction in the fee for the Sebastian Stormwater Utility, hereinafter called a "fee credit", if that property employs on-site optimally designed, constructed, and maintained stormwater management facilities. Additionally, property with unique and atypical physical features which substantially mitigate the impact upon the stormwater discharge into the system may likewise be eligible for a fee credit. The fee credit will be based upon the savings to the utility resulting from the property's stormwater facilities or unique features. Even properties that do not discharge stormwater directly into the Utility system will pay a proportionate share of the Utility expenses incurred in providing generalized benefits to the system, such as management of stormwater upon the public rights-of-way and administrative costs. Additionally, capital improvement projects that improve water quality in the waterbodies of the drainage basin are included in such generalized benefits. The owner of the property for which the fee credit is sought shall be responsible for requesting the fee credit and for supplying sufficient information as may be required by the City to evaluate the merits of the fee credit request. Engineering calculations, prepared and sealed by a professional engineer or land surveyor licensed to practice in the State of Florida, and other documentation that substantiate the fee credit request, must be submitted with the request. The engineering calculations and other documentation shall be in accordance with the requirements established herein and contained in the Stormwater Management Utility Fee Credit Application. 120 of 137 The application will be reviewed by the Stormwater Utility Manager or his designee, who shall have the authority to approve or disapprove the request and to establish conditions of issue for the fee credit. By accepting a fee credit, the property owner agrees to comply with the conditions of issuance and authorizes the City to enter upon the property, without additional notification, to verify compliance with the conditions of issue of the fee credit. Failure to comply with any of the conditions of issuance of the fee credit will result in the rescission of the fee credit, until the violation(s) are corrected to the City's satisfaction. II. FEE CREDITS Credits shall be granted'on an annual basis and requests therefore must be made each year. Properties having received a credit the previous year, however, may submit an abbreviated credit renewal request if conditions at the site have not substantially changed. A. Initial ADDlicationt Properties that have constructed stormwater retention or detention facilities may be eligible for a percentage reduction, or credit, in that property's stormwater service fee. The amount of reduction will be determined by the City on a case-by-case basis. Credit requests must be applied for in writing by the property owner using Application for Stormwater Credit Form and submitted to the Stormwater Utility Manager. To receive the credit, first-time applicants must supply to the City the following: 1. Site plan and as -built construction drawings (as certified by a licensed surveyor, architect, or engineer) at an appropriate scale, showing the site, topographic details, overland flow paths, all stormwater facilities, and surrounding area; 2. Detailed hydrologic and hydraulic calculations using methodology approved by the City that accurately describes the runoff through the site; 3. Topographic map outlining the size of the drainage area upstream and downstream of the stormwater management structure; 4. Detailed floodplain information, if it exists on the site; r 121 of 137 1 5. A detailed report that clearly describes how the basin functions for all of the design storm events from the 1- through the 100 -year events with percent of over - detention for each event. b. A proposed maintenance agreement between the City and the customer describing in detail the maintenance activities for the stormwater basin. Failure to operate the facility as designed shall be reason for forfeiture of the credit. The City shall inspect and notify the property owner/operator of the facility's deficiencies. B. Basis for Credits Customers are entitled to a credit when they can demonstrate that their existing or proposed stormwater facilities provide the Utility with a cost savings that the City otherwise would incur as part of its efforts to manage stormwater. The Utility incurs several costs associated with stormwater management including planning, engineering, capital construction, operation/maintenance, and administrative costs. The Utility incurs planning, engineering, and capital costs related to the construction of stormwater collection and treatment facilities. These facilities include, but are not limited to, the design and construction of swales, curbs, gutters, catch basins, stormwater sewers, regional detention basins, and retention basins. Stormwater construction projects address two aspects of stormwater management; water quantity (facilities that convey stormwater runoff) and water quality (facilities that reduce pollution). The Utility also incurs costs related to the operation and maintenance of stormwater facilities located throughout the City. These costs include, but are not limited to catch basin cleaning; detention/retention basin sediment removal; inspecting, cleaning, and repairing storm sewers; and mowing/maintaining drainage swales and basins. For each customer, the amount of credit will be proportional to the savings provided to the Utility by the customer's stormwater facility. Customers are entitled to a credit if they perform operation and maintenance, including capital costs for repair and replacement, of a facility that significantly reduce the Utility's responsibilities in processing stormwater, including drainage from off-site sources. Customers must provide an annual maintenance record documenting all maintenance procedures conducted including inspections, mowing, and trash/sediment removal. Failure to operate or maintain the facility shall be reason for forfeiture of the credit. 122 of 137 No credits shall be granted for the City's costs associated with administering the Utility's stormwater management program. Since all residents receive the benefits (protection of property and improved public health and safety) associated with the development and operation of the Utility, all property owners within the City will bear these costs. Table 1 presents the Utility's total projected stormwater management costs as well as local and system -wide percent spending for Fiscal Year 2002. The residential property is handling all the local collection functions for the Utility while the commercial property in the example essentially only provides basic water -quality treatment. III. PROCEDURES Applications for storm water utility fee credits can be obtained and should be submitted to the Growth Management Office, City Hall, 1225 Main Street, Sebastian, Florida. A renewal request form shall be available for subsequent years. After the application form and related materials have been submitted, the application will be reviewed and processed by a City agent for conformance to the regulations listed below. A City agent will review the application within 30 working days, unless extensive modification to the application or extenuating circumstances require additional time. If the application is approved, the conditions of approval will be noted upon the application. If the application is rejected, or modified, reasons for rejection or modification will be noted on the application. 124 of 137 Credit request applications and renewal requests for Fiscal Year 2002/2003 and subsequent years must be filed by June I" of each year in order to avoid having the full stormwater fee appearing on the customer's property tax bill. IV. Legal Effect and Appeal Appeals of a determination ' as to fee credits must be taken pursuant to the provisions of City Code Section 102-107(x). This fee credit policy, maximum credit guidelines, and the procedural requirements herein may be revised by the .City at its discretion at any time.
