MEETING WAS CALLED TO ORDER BY CHAIRMAN EISENBARTH
AT 7:00 P.M.
PRESENT:

BOTH ARE EXCUSED.
CHAIRMAN EISENBARTH SAYS HE NEEDS TO ENTERTAIN A MOTION
TO HAVE THE SENIOR MEMBER CHAIR THE MEETING THAT BEING
WILLIAM MAHONEY BECAUSE HE IS A PROPERTY OWNER INVOLVED
IN THE PUBLIC HEARING FIRST ON THE AGENDA AND HYE WANTS
TO SPEAK AS SUCH.
MR. WADSWORTH MADE A MOTION SECONDED BY MR. THOMPSON TO
APPOINT MR. MAHONEY AS CHAIRMAN FOR THE PORTION OF
THE MEETING INVOLVING CHESSER GAP.
MR. THOMPSON RECOMMENDS THAT PRIOR TO THE PUBLIC HEARING
BEING OPENED THAT DR FISCHER BE ABLE TO COME UP AND
GIVE AN EXPLANATION OF THE PROJECT HE WISHES THE CHANGE
FOR.
MR. MAHONEY RECOGNIZES DR. FISCHER.
DR. FISCHER GIVES A SHORT SUMMARY OF WHAT HE PLANS FOR
THE PROPERTY AND THEN TURNS THE TALK OVER TO HIS PROJECT
ENGINEER RANDY MOSBY.
RANDY INDICATES THAT EVERYTHING IS IN THE PRELIMINARY
STAGES AND NOTHING IS PERMANENT.
THE PUBLIC HEARING IS OPENED TO THE PUBLIC.

BUT AGAINST CHANGING THIS LAND TO COMMERCIAL
MR. BARLETT INDICATES IF THIS GOES COMMERCIAL THERE
WILL BE POLLUTION, NOISE AND A LOT OF TRAFFIC.
MR. BARLETT INDICATES WAVE STREET WILL BE THE ONLY
EXIT FROM PROPERTY TO GEORGE ST AND THEREFORE WILL
CAUSE SEVERE TRAFFIC JAMS.
RANDY COMMENTS ON MR. BARLETTS CONCERNS.
DR. FISCHER GIVES SOME COMMENTS AND INDICATES IF WAVE
STREET IS NOT WANTED HE WILL TAKE IT OUT AND TURN IT
TO A BIKE PATH ONLY.

MR. BOWMAN SPEAKS OF CLEARING AND LOOKS LIKE A ROAD IS
GOING IN. DR. FISCHER INDICATES THAT IS GDC CLEANING
THE WATERWAY AND THEN THEY ARE PLANNING TO REFLOOD IT.
MR. BOWMAN THEN GOES ON TO SAY HE IS ALSO AGAINST THIS
WHEN HE BOUGHT HIS PROPERTY HE DID NOT BELIEVE THERE
WOULD BE AN OFFICE COMPLEX BUILDING RIGHT BEHIND HIM
HOWEVER, HE SAYS HE iS NOT ON GEORGE STREET HE IS
RIGHT BEHIND IT ON THE NEXT STREET BUT AGAIN YOU DO HAVE
MORE TRAFFIC MORE NOISE. HE INDICATES HE IS A LETTER
CARRIER UP IN MELBOURNE AND FOR THE LAST THREE YEARS HE
HAS WATCHED NEW CONSTRUCTION GOING UP AND BEFORE THEY
WERE BUILT THERE WAS NICE HOMES AND EVERYTHING THEN
THEY PUT UP A SHOPPING CENTER AND A YEAR LATER HALF
THE HOUSES ARE VACANT NOBODY WANTS TO LIVE IN THEM OR
THEY SEEM TO BE RUN DOWN AND TURNED INTO SEMI SLUMS.
AND HE IS AFRAID THE SAME THING WILL HAPPEN HERE ALSO.
CATHERINE ACKERMAN AND I LIVE ON LANDSDOWNE
EVER SINCE I HEARD ABOUT THIS I AM JUST DELIGHTED YOUR
GOING TO HAVE COMMERCIAL THINGS ALONG 512 ANYWAY AND
DR. FISCHER ANYTHING ELSE HE HAS DONE HE HAS FULFILLED
WHAT HE HAS PROMISED AND IF HE SAYS HE WILL BUILD
A BUFFER I BELIEVE HE WILL. I BELIEVE IT WILL BE GREAT
FOR THE NEIGHBORHOOD AND OUR HOMES WILL GO UP IN VALUE

LIVED IN SEBASTIAN FOR 6 YEARS. MR. SPARKS THINKS THE
PROJECT NEEDS TO BE PUT ON A LARGE DRAWING AND PUT IT
TO SCALE SO THE PEOPLE CAN ACTUALLY SEE WHAT IS PROPOSED.
WHEN ASKED IF HE WAS IN FAVOR SAID YES IF IT IS TAKEN
CARE OF AND DONE CORRECTLY.

THIS STREET IS FLEMING VOCELLE RUNS OFF IT ALL THE WAY
TO ROSELAND ROAD THIS IS RIGHT NO LIGHT TRAFFIC BUT IF
THIS PROJECT GOES iN THE TRAFFIC PROBLEM WILL BE TERRIBLE
SAYS WE NEED A PROJECT LIKE THIS LIKE WE NEED ANOTHER
WORLDWIDE FLOOD.

PROUD OF IT WE WERE ONE OF THE FIRST HOMES TO BUILD
ON THE WATERWAY AND THERE ARE A LOT OF PROPOSED BUILDERS.
I AM OPPOSED TO THIS BECAUSE I LIVED IN MELBOURNE VILLAGE
BEFORE I MOVED HERE AND WHEN THEY PROPOSED THE BUILDING
OF THE MELBOURNE MALL THE PEOPLE IN MELBOURNE VILLAGE
OPPOSED IT BITTERLY.
WE PUT OUR HOME ON THE MARKET WHEN THEY STARTED BUILDING
THE MALL AND CAME TO SEBASTIAN TO LIVE THREE YEARS AGO
AND NOW RIGHT ACROSS FROM US IS ALL THIS COMMOTION
AND NOW YOUR SAYING THIS PROJECT IS GOING TO GO AND
MR. THOMPSON STOPS HER AND SAYS RANDY IS ONLY THE
SPOKESMAN FOR THE DEVELOPER NOT THE CITY. SHE CONTINUES
TO SAY THAT MELBOURNE VILLAGE WAS ONLY THREE MILES
FROM MELBOURNE MALL AND ALL THE PROPERTY VALUES
WERE VERTULIED DESTROYED BY THE MELBOURNE MALL
i WAS THERE AND i SAW IT ALL AND I LIVED IN MELBOURNE
FOR TWENTY FIVE YEARS TEN OF IT IN THE VILLAGE.
I LEFT MELBOURNE BECAUSE OF THE MALL AND NOW IT IS
HAPPENING AGAIN I AM OPPOSED TO THIS BEING

I AM NOT AGAINST THE PROJECT AS A WHOLE SINCE I FIRST
BOUGHT MY PROPERTY I KNEW THAT THERE WOULD BE SOMETHING
LARGE ON THIS PROPERTY AND I PICTURED A SHOPPING CENTER
THAT WOULD BE CENTRALLY LOCATED AND SUPPLY THE NEEDS
OF THE CITY AND LOOKING AT THAT MAP UP THERE IT LOOKS
PRETTY CENTRALIZED TO ME.
BUT THIS PROPOSAL AS IT STANDS DOESN'T ANSWER ENOUGH
QUESTIONS FOR ME WE ARE TOLD THAT THEIR WILL BE SHOPPING
AND COMMERCIAL SOME INDUSTRIAL AND A NEWSPAPERS
REPORTS MAYBE EVEN A LIBRARY SOME OF THESE OPTIONS ARE
LOGICAL IN MY MIND BUT SOME I AM VERY VERY SKEPTICAL
TONIGHT I AM HERE TO GIVE PUBLIC INPUT ON A REQUEST TO
CHANGE THIS PROPERTY TO CG LAND USE.
IN READING THROUGH THE PERMITTED USE I FIND SOME I COULD
AGREE WITH AND SOME I COULD NOT. IN READING THROUGH THE
CONDITIONAL USE I FIND SOME I CAN AGREE WITH AND SOME
I CANNOT THE REASON I BRING TIS UP IS THAT THE REQUEST
IS TO CHANGE TO CG THATS ALL.
IN READING THROUGH THE CG SETBACKS I FIND THEM GROSSLY
INADEQUATE, I FIND A SIDE' YARD OF FIVE FEET EXCEPT TEN
FEET WHEN ABUTTING A RESIDENTIAL ZONE, A REAR YARD OF
TEN FEET EXCEPT THIRTY FEET WHEN ABUTTING A RESIDENTIAL
DISTRICT. THESE ARE THE CG RESTRICTIONS WHEN THESE
MINUTE SETBACKS ARE PUT AGAINST THE PROPOSED COMMERCIAL
PUD SETBACKS OF 100 TO 200 FT THERE IS NO COMPARISON
BUT THIS IS WHAT YOU ARE BEING ASKED TO ALLOW THE REQUEST
IS TO CHANGE TO CG I AM CONCERNED THIS PROPERTY GOING
TO CG AND NOT KNOWING WHAT IS GOING TO BE PUT THERE I
HAVE SEEN THE PROPOSAL FOR A COMMERCIAL PUD BUT THERE
IS NO GUARANTEE THAT THIS WILL COME ABOUT ANY NUMBER OF
THINGS COULD STAND iN ITS WAY SUCH AS THE POSSIBILITY
THAT THE COMMERCIAL PUD ORDINANCE WiLL NEVER BE
ADOPTED BY THE COUNCIL OR AS OUR BOARD ATTORNEY
HAS SUGGESTED THAT IF THE SETBACKS ARE TOO RESTRICTIVE
THAT THE DEVELOPER WILL JUST USE IT UP AS CG AND
FORGET THE PUD. THAT IS TOO-OPEN ENDED FOR ME.
I WOULD LIKE TO SEE THIS REQUEST FOR LAND USE CHANGE AND
A REQUEST FOR A COMMERCIAL PUD MOVE THROUGH OUR PROCEDURES
CONCURRENTLY. THIS WAY WE WOULD HAVE A CONCEPTUAL
PLAN TO REVIEW BEFORE A REZONING WAS APPROVED IF THIS
REQUEST IS APPROVED RIGHT NOW THERE IS NO GUARANTEE WHAT
WILL BE CONSTRUCTED AND BEING A NEIGHBOR THAT IS A
HIGH RISK FOR ME I WOULD LIKE TO SAY AGAIN THAT I AM
NOT AGAINST THIS PROPOSAL BUT I WOULD SUGGEST YOU

TOGETHER. THEN WE ALL KNOW WHAT IS GOING TO BE WHERE

ART HALGREN MEMBER CONSTRUCTION LICENSING BOARD
FOR THE LAST SIX MONTHS HAVE BEEN AMEMBER AND HAVE SEEN
A LOT OF NEW CONTRACTORS COME BEFORE THEM AS MANY AS
TWELVE TO FOURTEEN COMING INTO THE CITY WE HAVE NO
TRACT RECORD ON WHAT THEY WILL DO OR HOW THEY WILL
PERFORM WE DO OUR BEST TO SCREEN THEM AND CHECK
THEM OUT HERE WE HAVE A MAN WITH A TRACK RECORD THAT
IS PROVEN WE CAN LOOK AT PROJECTS HE HAS DONE HE HAS BEEN
MORE THEN EAGER TO COMPLY ONE GENTLEMEN SAiD HE
HADN'T BEEN IN THE POLICE DEPARTMENT AS A MATTER OF MY
BUSINESS I AM IN THE POLICE DEPARTMENT ON A DAILY BASIS
AND THEY ARE REALLY CRAMPED THE LIBRARY THE LADY POINTED
OUT THE SCHOOLS ON BOTH SIDES WHAT BETTER PLACE FOR A
LIBRARY THEN RIGHT BETWEEN THE TWO MAJOR SCHOOLS
IT MAKES SENSE iT IS BEHIND THE TIMES ALREADY THE CITY
HALL EVEN WITH ALL THE REMODELING THEY HAVE DONE RECENTLY
HECTOR'S OFFICE NEEDS MORE ROOM BUILDING DEPARTMENT
NEEDS MORE ROOM AND THE GROWTH AND THE TIME THIS PROJECT
TAKES JUST TO GET IT UNDERWAY THROUGH ALL THE HURDLES
ITS GOT TO GO THROUGH I THINK WE SHOULD GIVE THEM
EVERY ASSIATANCE THEY CAN AND GIVE THEM EVERY CONSIDERATION
BASED ON THE PERFORMANCE THAT HE HAS DONE BASED ON
THE FACT THAT HE IS A MAN THAT WE CAN TRUST, DEPEND ON
NOT HAVE TO WORRY ABOUT HIM LEAVING THE PROJECT BEHIND
WE HAVE HAD PROJECTS WHERE WE HAVE HAD PROBLEMS WITH
SURVEYORS HAD PROBLEMS WITH CONTRACTORS WE HAD TO GO
CHASE AND FIND WE HAVE BEEN CONSIDERING BONDING CONTRACTORS
HERE YOU GOT A MAN WE KNOW WILL FOLLOW THROUGH ON A
DEVELOPMENT THAT IS GOOD FOR THE CITY THAT IS GOOD FOR
BUSINESS AND IT WON'T HURT THE AREA AROUND IT.

MR. THOMPSON ADVISES HE ADD A C UNDER CG FOR DRIVE IN

MR. OLTMAN QUESTIONS WHY WE DON'T CHANGE FLORIDA
FEDERALS ZONING AS WELL TO CONFORM TO THE LAND DEVELOPMENT
CODE. THE BOARD CAN INITIATE OR THE CITY COUNCIL CAN
INITIATE TO CHANGE THE ZONING ON THIS PROPERTY.
MORE DISCUSSION REGARDING THIS ZONING CHANGE NO OTHER
MEMBERS WANTED TO DO ANYTHING ABOUT iT.
MR. MAHONEY QUESTIONS CHANGES OF USES SAYS WE DO NOT
GET THEM ALL. POSSIBLY WE COULD ASK LINDA OR
HECTOR ONE WHAT THE BOARDS RESPONSIBILITY IS IN LOOKING
AT CHANGE OF USES. SOMETIMES THEY ARE APPROVED AT
THE OCCUPATIONAL LICENSE AREA AND MAYBE WE NEED TO
ADVISE THE CITY CLERKS OFFICE WHAT THE REQUIREMENTS

WOULD CLASSIFY HER.
