KRULIKO4J8KI, MR. EISENBARTH/ MR. AHONEY' MR. WADGWORTH ABSENT; MRS POOLE, EXCUSED AND MR8. TAYLOR' EXCU8ED ALSO PRESENT; LINDA KINCHEN, SECRETARY AND TOM PALMER' CITY ATTORNEY. APPROVAL OF MINUTES; MOTION BY MR. FULLERTON TO APPROVE THE MINUTES OF THE JUNE 4TH MEETING AS SUBMITTEQ' SECOND BY MR. MAHONEY PASSED UNANIMOUSLY. OLD BI -PE -5I NESS; PROPOSED LIBRARY SITE - ANSWER TO LETTER THE FOLLOWING ANSWERS WERE OFFERED TO QUESTION8 NO 1'2 AND 3. 1) YES - BOTH SITE*,=; ARE ZONED FOR LIBRARIES. 2) NO KNOWN DRAINAGE OR TRAFFIC PROBLEMS AT THIS TIME WITH REGARDS TO EITHER SITE. 3) YES - THE PLANNED IMPROVEMENTS FOR CHES8ER GAP WOULD HAVE A POSITIVE IMPACT ON THE LIBRARY SITE ACCORDING TO THE COMMISSION8 FEELINGS. tHE COMMISSION ALSO WANTED IT MADE KNOWN THAT THE CITY OF SEBASTIAN HAS BEEN LO0KIN8 AT THE SITE ON U.S. HIGHWAY l FOR SOME TIME NOW FOR A PARKING AREA FOR THE YACHT CLUB AND RIVERV%EW PARK. THE COMMISSION FELT THE NEED FOR FUTURE PARKING IN THIS AREA WOULD BE A NECESSITY AND FEELS THE CITY SHOULD CONTINUE TO THINK ALONGTHE8E LINES. MR. WAD8WORTH MADE A MOTION TO SEND THE ABOVE ANSWERS TO THE MAYORS OFFICE FOR HIS REVIEW, SECONDED BY MR.FULLERTON PASSED UNANIMOUSLY. NEW BUSINESS; SITE PLAN REVIEW DONNA SKINNER RANDY MOSBY REPRE8ENTS PROJECT. RANDY GOES OVER COMMENT LETTERS ITEM BY ITEM AND THEN TAKES 0UE8TIONS FROM THE B0ARO 1--,LANNIN8 AND ZONING COMMISSION REGULAR MEETING MINUTES JUNE l8TH, l987 PAGE TWO DISCUSSION COMES DOWN TO THE MISSING NINE TREES AND CITY ATTORNEY CLARIFYG THAT SINCE THIS IS A CONDITIONAL U8E THE SPECIAL PROVISIONS UNDER CONDITIONAL USES MAKE THE LANDSCAPE REQUIREMENTS MORE STRINGENT THEN THEY WOULD BE IF THIS WAS JUST A PERMITTED USE AND THAT IS WHY THE NINE ADDITIONAL TREES ARE REQUIRED. RANDY 8TATES BASED ON THAT THAT HIS CLIENTS WILL REVISE THE DRAWING FOR FINAL STAMPED APPROVAL WITH THE NINE ADDITIONAL TREE8. THE FOLLOWING MOTION WAS MADE BY MR. WAD8WORTH| BASED ON THE COMMENTS FROM MR. MO -BY, MR. 8OMMER AND ATTORNEY PALMER AND PROVIDED THAT ALL ITEMS IN LETTERS DATED 6-3, 6-6 AND 6-17 ARE MET' HE RECOMMENDS THAT THE APPROVAL FOR THE CONDITIONAL USE FOR THE EARLY EDUCATION CENTER BE APPROVED AND THAT REVI8ED PLANS SHOW NINE ADDITIONAL TREES' FENCE SET BACKS' PLAYGROUND REWORKED AND THAT ALL OTHER CONDITIONG OF THE ABOVE LETTERS BE MET' SECOND BY MR. FULLERTON FOR DISCUSSION UNDER DISCUSSION; MR. EI8ENBARTH FEELS A CHILD CARE CENTER OF 75 IS INTENSE FOR A RESIDENTIAL AREA AND THAT IT REALLY WASN'T THE INTENT OF THE CODE TO ALLOW A FACILITY THAT BIG. ALTHOUGH HE ALSO STATED THAT THE LOCATION SELECTED SEEMS TO BE THE BEST POSSIBLE ONE FOR THE USE. ATTORNEY PALMER MAKE8 A R � MMENDATION THAT THE POINT BE TAKEN THAT ALL THE EASEMENT8 DO NOT NEED TO BE ABANDONED AND THAT ONLY THE NECESSARY EASEMENTS SHOULD BE ABANDONED AND THE OTHERS LEFT UNTOUCHED. FULLERTON SPEAKS ON THE INLET MARINA DISCUSSION I8 MADE TO WALL TAKEN OUT IN THE REAR AND THE GREEN AREA BEHIND THE BUILDING AS WELL AS THE PARKING AREA ON THE NORTH SIDE OF THE SITE PLAN AND THE ADDITION UNDER THE PORCH. MORE DISCUSSION REGARDING WHETHER I8N8 MEET CODE AND HOW THEY GOT A C.O. TO OPERATE IF IT DID NOT MEET THE SITE PLAN' STAN STATES THEY ARE ALL GOOD POINT -S BUT DOES THE COMMISSION HAVE TO BECOME A CODE ENFORCEMENT BOARD. MR. EI8ENBARTH ASKS MR. FULLERTON WHAT HIS INTENTION IS AND HE 8TATE8 TO SEE WHAT THE BOARDS FEELINGS ARE AND WHETHER THEY FEEL IT SHOULD BE TURNED OVER TO CODE ENFORCEMENT. MR. WADSWORTH ASKS MR. METCALF IF OHR CODE ENFORCEMENT PB]PLE M/4VE BEEN TOLD "HANDS OFF ON THIS PROJECT' HE STATES NOT TO HI8 KNOWLEDGE. MR. FULLERTON MADE AMOTION THAT TWO OR THREE MEMBERS OF THE ' BOARD MEET WITH THE BUILDING OFFICIAL AND MAYOR TO DI8(*_,,US8 THE POSSIBLE SITE PLAN VIOLATION MATTER FOR THE INLET MARINA 8ECRETARY SUGGESTS THEY CHECK WITH ATTORNEY PALMER TO BE SURE THIS WILL NOT VIOLATE THE SUNSHINE LAW. THE COMMISSION SAYS THEY HAD NO OBJECTS AND UNDER NEW BU8INE88 THE HEADING ; LAND DEVELOPMENT CODE CHANGES WOULD BE ADDED TO AGENDAS WITH LIMITED REGULAR BUSINESS. MEMBERS MATTER8: MR. MAHONEY ASKS ABOUT THE SITE PLAN FOR POWELL PERTAINING TO MR. FRANCOS LETTER. SECRETARY EXPLAINS HECTOR'S FEELINGS AND WHY THE LETTER WAS WRITTEN. MR. FULLERTON ASKS ABOUT THE PAINT AND BODY 'SHOP AT KARRS AND ALSO ABOUT THE ONE GOING IN AT HAMILTON'8 WAREHOUSE.
