PRESENT; MR. FIRTION, MR. MUNSART, MR. FISCHER, MR. THOMPSON, MR. SHROYER, MR. GOLDSTEIN, MRS. KILKELLY, MR. BARNES, ABSENT; MR. FALKE, EXCUSED - MR. MUNSART IS VOTING FOR MR. FALKE. ALSO PRESENT; LINDA KINCHEN, SECRETARY, ANNOUNCEMENTS; CHAIRMAN ANNOUNCES THERE ARE PAMPHLETS AVAILABLE FOR REVIEW IF ANY MEMBERS WANT TO ATTEND SEMINARS. ------------------------------------------------------------ APPROVAL OF MINUTES: JUNE 3RD, 1993 A MOTION TO ACCEPT THE MINUTES AS PRESENTED WAS MADE BY MR. FISCHER SECOND MR. FIRTION 6-1 WITH 1 ABSTAIN BECAUSE HE WAS NOT PRESENT AT THE MEETING ------------------------------------------------------------- OLD BUSINESS: HOT DOG STAND DISCUSSION - DAMIEN GILLIAMS 713 LAYPORT DRIVE APPLICANT STATES CG ON U.S. HIGHWAY #1 SMALL TRIANGLE PIECE NEXT TO THE CITY'S PROPERTY - HAS OWNED FOR 2 OR 3 YEARS - 2OA7.4A - DAMIEN QUOTES FROM PAGE 470 TAKE OUT ONLY NO SIT DOWN ON THE SITE - DEPT OF BUSINESS REGULATION MUST ALSO ISSUE A PERMIT - APPLICANT STATES 20A -6.1C9 PAGE 400 DRIVE THRU FACILITIES DOES NOT APPLY IN HIS OPINION. APPLICANT STATES IT IS A TRAILER TYPE CART - CHAIRMAN FEELS IT WOULD FALL UNDER A CONDITIONAL USE PERMIT APPLICANT STATES GLOSSARY DEFINITION DOES NOT AGREE. MRS. KILKELLY ASKS IF THE COMMISSION COULD GET COPIES OF INDIAN RIVER COUNTY, BREVARD COUNTY, PALM BAY AND VERO BEACH ORDINANCES REGULATING THIS TYPE OF BUSINESS. SECRETARY TO CHECK. MR. THOMPSON DOESN'T WANT THIS TYPE OF BUSINESS IN THE CITY FEELS IT NEEDS SANITATION FACILITIES AND WOULD HAVE A PROBLEM WITH PARKING. APPLICANT STATES THE TRAILER WON'T BE THERE ALL DAY ONLY THRU LUNCH AND DINNER TIMES. AND COULD MAKE ARRANGEMENTS IF NEED BE WITH OTHER BUSINESSES FOR THE VENDOR TO US THERE SANITATION FACILITIES. MR. MUNSART STATES THE TWO NORTH OF SEBASTIAN HAVE RUBBISH ALL ALONG THE PROPERTIES - APPLICANT ASKS IF PEOPLE OWN THE PROPERTY OR JUST LEASE IT AND MR. MUNSART STATES HE DOES NOT KNOW APPLICANT STATES HE TAKES PRIDE IN HIS PROPERTIES AND WOULD KEEP IT NEAT AT ALL TIMES. MRS. KILKELLY ASKS IF A SKETCH OF THE TRAILER COULD BE MADE AVAILABLE SO THEY CAN SEE WHAT IT LOOKS LIKE - MOTION TO GET THE OTHER ORDINANCES AND REVIEW THEM AND APPLICANT TO SUPPLY DRAWING AND SPECIFICATIONS AND REVIEW THEM ALL TOGETHER BY FIRTION/FISCHER - PASSED UNANIMOUSLY. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JULY 1ST, 1993 PAGE TWO PARKING RESTRICTIONS FOR RV'S IN RESIDENTIAL DISTRICT - MR. SHROYER RECOMMENDS - MR. SHROYER MAKES A MOTION TO PUT H. 0. L. AHEAD OF THIS ITEM SECOND BY MRS. KILKELLY PASSED UNANIMOUSLY. H. 0. L. NEAT AND CLEAN GENERAL MAINTENANCE PAUL SZAFARZ 145 CAPRI AVENUE PUBLIC HEARING OPENED 8 P.M. 17 LETTERS WERE MAILED - NO RESPONSE STAFF HAS NO OBJECTIONS APPLICANT STATES TELEPHONE ONLY REQUEST NO PUBLIC INPUT - PUBLIC HEARING CLOSED AT 8:00 P.M. MR. FISCHER ASKS IF HE HAS READ THE RULES REGARDING HOME OCCUPATIONAL LICENSES AND APPLICANT STATES NO - MRS. KILKELLY STATES A COPY OF THE ORDINANCE SHOULD BE GIVEN TO THE APPLICANT. A MOTION TO APPROVE THE HOME OCCUPATIONAL LICENSE FOR PAUL SZAFARZ AT 145 CAPRI AVENUE WAS MADE BY MR. GOLDSTEIN SECOND MR. SHROYER PASSED UNANIMOUSLY. ------------------------------------------------------------- RECESS CALLED AT 8:05 P.M. BACK AT 8:20 P.M. RV'S IN RESIDENTIAL DISTRICTS - CONCENSUS IS SHOULD NOT BE PARKED IN THE DRIVEWAYS AT ALL SHOULD PARK ON THE SIDE LIKE RV'S MR. GOLDSTEIN STATES HE CONTACTED SEVERAL OTHER CITIES AND THEY ARE NOT ALLOWED IF THEY ARE COMMERCIAL VEHICLES. HE DOESN'T WANT TO CHANGE THE CODE. A MOTION TO LEAVE THE CODE AS IS WAS MADE BY MR. FISCHER SECOND MR. SHROYER PASSED UNANIMOUSLY.
