LEVIN PROPERTIES .- REPAVING SITE PLAN RANDY MOSBY REPRESENTS PROJECT RANDY GOES OVER THE ITEMS ON HECTOR'S LETTER OF COMMENTS AND THEN THE I'I-EMS S'I-ILL REMAINING - OPENS THE FLOOR FOR ~UESTIONS FROM THE COMMISSION. FULLERTON STATES HE WENT DOWN TO THE COUNTY REGARDING THIS SITE PLAN AND STATED MIKE ORR IS ON VACATION BUT THAT THE COUNTY FELT THIS PLAN SHOULD NOT BE APPROVED WITHOUT THEIR REVIEW, MR, FULLERTON INDICATED HE IS ADAMANT THAT THE COUNTY SHOULD REVIEW THIS PLAN SINCE IT IS ON THE CORNER OF 512 AND U.S. HIGHWAY #1. HE ALSO INDICATED HE HAD DISCUSSED THE SITE PLAN WITH MAYOR HARRIS AND FELT IT SHOULD ALSO 8E REVIEWED BY 'THE COUNTY, MR. MAHONEY INDICATED THAT A HEDGE IS NEEDED ON THE NORTH SIDE NEAR THE COMPACT CAR SF'ACES. RANDY AGREED THAT BOTH HE AND HECTOR MISSED THAT ITEM. WADSWORTH STATES ITEM NUMBER FOUR OF HECTOR'S LETTER MAY NOT BE POSSIBLE AND HATES TO :DEE IT AS A PART OF THE MOTION MR. WADSWORTH :STATES THE APPLICANT SHOULD WORK WITH FPL TO OBTAIN A COVENANT OF RESTRICTION WHICH CAN BE GRANTED IN LIEU OF AN ABANDONMENT. MR. WADSWORTH ASKS IF MRS. POOLE WILL AMENO HER MOTION I'D INCLUDE ITEMS l, 2, AND 3 WITH ITEM 4 TO BE ~ORKED OUT BETWEEN THE APPLICANT AND FPL. SCHLITT BLDG -- SECOND STORY ADDITION JOHN SCHLITT SF'EAKS FOR THE PROJECT MR. SCHLI"rT STATES THIS IS A CHANGE FROM THE ORIGINAL SITE PLAN WHICH WAS SUBMITTED WiTH APARTMENTS ON THE 'SECOND STORY. 'THIS PLAN INDICATES THEY WILL NOW BE ADDING OFFICE SPACE. MUCH DISCUSSION REGARDING WHETHER TRUMAN STREET IS REALLY A STREET. ATTORNEY F'ALMER STATES IF IT HAS BEEN USED AS A ROAD FOR A CERTAIN AMOUNT OF TIME IT IS A ROAD. MR. SCHLITT STATES IT HAS BEEN PLATTED AS A ROAD. MR. WADSWORTH IS ADAMANT ABOUT CLEARING UF' THiS MATTEER, PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JULY 2ND, 1987 PAGE THREE MR. MAHONEY SAYS HE FEELS THIS SHOULD BE A MAJOR SITE PLAN AND NOT A MINOR. ATTORNEY PALMER CHECKS THE CODE WHILE DISCUSSION CONTINUES. MR. SCHLITT STATES THAT WHEN .HE qUESTIONED THE STAFF NEW iMPERIOUS WAS THE ANSWER HE WAS GIVEN TO CALCULATE ATTORNEY PALMER INDICATES THAT THIS :STATEMENT iS CORRECT AND IT IS iN FACT A MINOR SITE PLAN. MR. WADSWORTH ASKS WHAT THE TOTAL HEIGHT OF THE BUILDING WILL BE MR. SCHLiTT ANSWERS THIRTY FEET. MOTION BY MR. WADSWORTH TO APPROVE THE SITE PLAN FOR SCHLITT BLDG CONTINGENT TO MR. FRANCO'S LETTER DATED 6-18-87 WiTH IzIVE CONTINGENCIES. SECOND BY MRS. TAYLOR. UNDER DISCUSSION MR. EISENBARTH ASKS THAT THE MOTION BE AMENDED TO INCLUDE THAT NONE OF THE OFFICE SPACE CAN BE MEDICAL. ATTORNEY PALMER STATES THE WOROS NO MEDICAL. OFFICES AS DEFINED IN SECTION 20A 8.2 OF THE CODE WILL BE PERMITTED. MR. WADSWORTH STATES HE WOULD STILL LI~(E A LEGAL OPINION ON ROAD RIGHT OF WAYS, ATTORNEY PALMER STATES IT IS NOT UP TO THE CITY TO REFUSE AN APPLICANT'S SITE PLAN BECAUSE OF A DISPUTE WITH PROPERTY BOUNDARIES. F'ROPOSED CITY ORDINANCE RE SIMILAR HOUSES TOM PALMER EXPLAINS THE INTENT OF THE ORDINANCE WITH A DRAWING ON THE E:OARO. STATES THIS PERTAINS TO SINGLE FAMILY AND DUPLEXES ONLY. MR. POOLE SAYS SHE UNDERSTANDS WHY THEY ARE PROPOSING THIS ORDINANCE AND THAT SOME OF THESE HOUSES ARE EYESORES BUT FEELS IF A LADY WANTS A HOUSE THE SAME AS ONE ACROSS THE STREET SHE CANNOT HAVE IT IF THIS ORDINANCE IS PASSED AND SHE CANNOT JUSTIFY REFUSING SOMEONE THEIR HOUSE STYLE. · TOM INDICATES IF PASSED THIS WILL BECOME z:)A B.,:_O ON PAGE · .'D '~, .
