PRESENT; MR. FULLERTON, MR. SHROYER, MRS. O'CONNOR, MR. MAHONEY, MRS. KILKELLY AND MR. THOMPSON ABSENT; MR. KRULIKOWSKI, EXCUSED MR. WADSWORTH, UNEXCUSED ALSO PRESENT; LINDA KINCHEN, SECRETARY,.BRUCE COOPER, DIRECTOR OF COMMUNITY DEVELOPMENT AND CATHERINE HILTON, PLANNER ANNOUNCEMENTS; A MOTION TO ADD MRS. O'CONNORS RESIGNATION LETTER TO THE AGENDA WAS MADE BY MR. THOMPSON SECOND MR. FULLERTON PASSED UNANIMOUSLY. ------------------------------------------------------------- MOTION CHANGE THE ORDER OF BUSINESS TO ALLOW THE MODEL HOME PERMIT AND HOME OCCUPATION AS FIRST AND SECOND ORDER OF BUSINESS WAS MADE BY MR. THOMPSON SECOND MR. FULLERTON PASSED UNANIMOUSLY. ------------------------------------------------------------- A MOTION TO ADD TO THE AGENDA UNDER NEW BUSINESS A DISCUSSION REGARDING THE FLAGPOLE ON PONOKA FROM LAST MEETING BY FULLERTON SECOND MR. THOMPSON PASSED UNANIMOUSLY. ------------------------------------------------------------- APPROVAL OF MINUTES -- JUNE 18TH, 1992 — CORRECTION ON PAGE TWO THE VOTE SHOULD SHOW 4-2 WITH MR. FULLERTON VOTING NAY FOR CAPTAIN HIRAMS — A MOTION TO APPROVE AS AMENDED BY MR. THOMPSON SECOND MRS. KILKELLY PASSED UNANIMOUSLY. ------------------------------------------------------------- MODEL HOME PERMIT — HOLIDAY BUILDERS — ALAN GREEN IS PRESENT MR_ THOMPSON RECOMMENDS SAVING AS MANY TREES AS POSSIBLE ON THIS LOT AND MR. GREEN STATES THEY INTEND TO RELOCATE A LOT OF THEM — PUBLIC HEARING OPENED AT 7:10 P.M. CLOSED 7:10 P.M. NO COMMENT — A MOTION TO APPROVE THE MODEL HOME PERMIT FOR HOLIDAY BUILDERS AT 1661 BARBER STREET WAS MADE BY MR. THOMPSON SECOND MR. SHROYER PASSED UNANIMOUSLY. ------------------------------------------------------------ HOME OCCUPATIONAL LICENSE — MINOR DETAILS — WILLIAM STANT 365 TUNISON LANE SEBASTIAN PUBLIC HEARING OPENED AT 7:15 P.M. CLOSED 7:15 P.M. NO COMMENTS ONE LETTER OF OBJECTION WAS RECEIVED. A MOTION TO APPROVE THE HOL FOR WM STANT AT 365 TUNISON WAS MADE BY MRS. KILKELLY SECOND MR. THOMPSON PASSED UNANIMOUSLY. ------------------------------------------------------------ LETTER OF RESIGNATION — MAYME O'CONNOR — A MOTION TO ACCEPT LETTER AND SUGGEST CITY COUNCIL GIVE HER A PLAQUE BY MR. HE FEELS THIS ITEM SHOULD NOT HAVE COME BEFORE THE BOARD AND BRUCE QUOTES THE LDC TO SHOW WHERE IT MUST BE APPROVED BY BOTH PLANNING AND ZONING AND CITY COUNCIL. ------------------------------------------------------------- TREE ORDINANCE - IT IS DECIDED TO TALK ABOUT THE LDC CODE CHANGES FIRST. MR. MAHONEY FEELS THERE NEEDS TO BE A CHANGE IN THE PUD ORDINANCE REGARDING TERMINATION OF THE PUD'S. MOST OF THE BOARD FEELS IT CAN STAY THE WAY IT IS AFTER STAFF COMMENTS REGARDING POLICY. A MOTION TO NOT INCLUDE REVISED LANGUAGE FOR PAGE 247 AND ONLY INCLUDE 253 REVISED LANGUAGE 1ST PARAGRAPH UNDERLINED CHANGES ONLY BY MR. THOMPSON SECOND MRS. KILKELLY PASSED 5-1 WITH MR. MAHONEY VOTING NO. ------------------------------------------------------------ MR. THOMPSON FEELS THAT ON PAGE 9 REGARDING MAXIMUM BUILDING COVERAGE FOR MOBILE HOMES SHOULD HAVE BEEN 30% AS PREVIOUSLY VOTED ON BY THE COMMISSION_ THERE IS MUCH DISCUSSION ON THIS MATTER. A MOTION TO LEAVE PAGE 20A3.7(F)7 AND 20A4.8D9 AT 40% WAS MADE BY MR. THOMPSON SECOND MR. FULLERTON PASSED 5-1 WITH MRS. KILKELLY VOTING NO BECAUSE SHE FEELS IT SHOULD STAY AT 30%. ------------------------------------------------------------ PAGE 14 FROM 326.8 THRU PAGE 15 SHOULD BE REMOVED PER CATHY HILTON BECAUSE SHE FEELS THE WORDING WILL CAUSE LEGAL PROBLEMS LATER ON. BRUCE DISAGREES AND ADVISES THE BOARD TO LEAVE IT IN AND LET THE ATTORNEY DRAW UP THE CORRECT LEGAL VERBIAGE. CATHY IS ADAMANT THAT IT BE LEFT OUT IF THE CHANGES ARE FORWARDED TO CITY COUNCIL - A MOTION TO SUBMIT EVERYTHING EXCEPT PAGE 14 THRU 15 MADE BY MR. SHROYER SECOND MR. FULLERTON FOR DISCUSSION. MRS. ALL PRESENT TREE ORDINANCE DISCUSSION - MR. THOMPSON REQUESTS A MINUTE PRIOR TO THE DISCUSSION - MR. THOMPSON MAKES A MOTION TO EXPRESS TO CITY COUNCIL OUR EXTENDED APPRECIATION OF WHAT WILLIAM MAHONEY HAS DONE FOR THE COMMISSION IN 12 YEARS AND THAT CITY COUNCIL PRESENT HIM WITH APPROPRIATE RECOGNITION SECOND BY MR. FULLERTON UNANIMOUS. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES JULY 16TH, 1992 PAGE 'THREE TREE ORDINANCE - MR. THOMPSON STATES WANTS GENERAL DEFINITION OF WHERE THE BOARD IS GOING WITH THIS. MRS. KILKELLY SAYS SURVEYS SHOULD BE REQUIRED WITH TREES FOR ALL INCLUDING RESIDENTIAL THERE SHOULD BE LIMITED MACHINERY AND DAMAGE TO TREES REMAINING SHOULD HAVE SOME CONCERNS. PAGE BY PAGE TO BEGIN - BRUCE STATES NOTHING IN THE ORDINANCE REGARDING CITRUS GROVES MR. THOMPSON FEELS IT IS NECESSARY SINCE WE DO HAVE ONE DEVELOPER WHO HAS CITRUS TREES ON HIS PROPERTY. MR_ THOMPSON QUESTIONS SOME OF THE NAMES OF TREES AND STATES HE COULD NOT FIND THE SAND PINES. PAGE THREE WHAT ABOUT UTILITY COMPANIES PRUNING PRACTICES - BRUCE STATES NOT tTJCH WE CAN DO ABOUT IT.
