NAHONEY, MRS. POOLS, MR. KRULIKOWSKI, MRS. KILKELLY, MR. FULLERTON, AND MR. GILCHER, ALTERNATE. ALSO PRESENT; LINDA KINCHEN, SECRETARY AND BRUCE COOPER, BUILDING OFFICIAL APPROVE MINUTES JULY 21, 1988; MRS. POOLS MADE A MOTION TO APPROVE THE MINUTES AS SUBMITTED SECOND BY MR. WADSWORTH, PASSED UNANIMOUSLY. OLD BUSINESS; INDIAN RIVER INDUSTRIAL PARK- VERO TIES'AND STONE SITE PLAN - DARRYL STENGER MR. STENGER AND HARLAN PETERSON ARE PRESENT TO REPRESENT PROJECT. BRUCE COOPER STATES THAT AFTER DISCUSSION WITH THE ATTORNEY, ITEM THREE OF RANDY MOSBY'S LETTER IS SATISFIED REGARDING RETENTION IN THE DRAINAGE SWALES, MR, WADSWORTH QUESTIONS THE STRUCTURE AND ITEM ONE OF RANDY'S LETTER AND BRUCE INDICATES IT WILL BE A MATTER FOR THE BUILDING DEPARTMENT TO ENSURE THAT THE STRUCTURE MEETS THE STANDARD BUILDING CODE REQUIREMENTS. MR. MAHONEY STATES HE WOULD LIKE A LEGAL OPINION ON THE FACT THAT THE LOADING AREA GAN BE MADE OF COQUINA ROCK AS THE GODE IS RATHER VAGUE AND INDICATES PARKING AND LOADING AREAS ARE TO BE PAVED HE FEELS THIS WOULD BE CONSIDERED A PART OF THE PARKING AREA OR LOADING AREA. MRS POOLS MADE A MOTION TO APPROVE THE SITE PLAN FOR DARRYL STENGER, VERO TIES AND STONE CONTINGENT TO THE BUILDING DEPARTMENT CERTIFYING THAT THE BUILDING MEETS STANDARD BUILDING CODES AND BECAUSE THE OTHER TWO COMMENTS OF RANDY'S LETTER DATED 8-4-88 HAVE BEEN SATISFIED. SECOND BY MRS. KILKELLY ROLL CALL - MOTION FAILS 4-3 MR WADSWORTH, MR. FULLERTON AND MRS. TAYLOR VOTED NO. MAHONEY, MR. AFTER MORE DISCUSSION IT WAS DETERMINED THAT SEVERAL OF THE MEMBERS WOULD APPROVE THE SITE PLAN IF THE MOTION ALSO CONTAINED A CONTINGENCY FOR A LEGAL OPINION ON THE COQUINA ROCK STORAGE AREA. COOPER STATED HE HAD GOTTEN THE ATTORNEYS VERBAL RESPONSE AND HE HAD AGREED iT WAS ACCEPTABLE. MR. MAHONEY MADE A MOTION TO APPROVE THE SITE PLAN FOR DARRYL STENGER, VERO TIES AND STONES CONTINGENT TO THE BUILDING DEPARTI~fENT CERTIFYING THAT THE BUILDING HEETS STANDARD BUILDING CODE REQUIREMRNTS AND CONTINGENT TO A LEGAL OPINION ON THE COQUINA ROCK STORAGE AREA IN WRITING EITHER FROM THE ATTORNEY OR BRUCE COOPER FOR THE ATTORNEY AFTER VERBAL DISCUSSION SECOND BY MR. PHILIP BLACKWELL, PHIL'S LAWN MAINTENANCE 141 CRAWFORD DRIVE SEBASTIAN FLORIDA MR, BLACKWELL STATES THAT HE IS LOOKING FOR APPROVAL OF A BUSINESS PHONE ONLY IN HIS HOHB - AFTER THE STANDARD QUESTIONS REGARDING EMPLOYEES AND VEHICLES THE FOLLOWING MOTION WAS MADE. KILKELLY QUESTIONS THE WEIGHT OF THE VAN AND Ai~TItR DISCUSSION IT IS DETERMINED iT QUALIFIES UNDER THE ORDINANCE., THE QUESTIONS iS BROUGHT UP REGARDING THE BROTHER AS AN EMPLOYEE OF THE BUSINESS AND WHETHER HE IS PAID HOURLY OR CONTRACTUALLY BY JOB. IT IS DETERMINED IF HE IS A CONTRACTUAL EMPLOYEE THEN IT WOULD NOT VIOLATE THE ORDINANCE BUT IF HE PAID HOURLY THE LICENSE COULD NOT BE APPROVED. lfRS. ROLAND IS TO CHECK WITH HUSBAND WHEN HE CALLS AND ADVISE BRUCE REGARDING THIS MATTER. KILKELLY CONTINGENT TO A WRITTEN NOTARIZED STATEMENT THAT THE OTHER PERSON INVOLVED IS ON A CONTRACTURAL BASIS AND NOT AN HOURLY EMPLOYEE. SECOND BY MRS. POOLS PASSED UNANIMOUSLY. NEW BUSINESS - MODEL HO~[E PERMIT - SOUTH RANGE CONSTRUCTION JIM LIEFFORT IS PRESENT TO ANSWER QUESTIONS MRS. KILKELLY QUESTIONS THE PARKING AND FEELS THREE SPACES WILL NOT FIT WHERE SHOWN WITHOUT DESTROYING THE SWALE AREA. BRUCE STATES THAT HIS OFFICE WILL WORK WITH THE APPLICANT TO SOLVE THIS PROBLEM IF THE SPACES WILL NOT FIT. THERE BEING NO OTHER MAJOR PROBLEN~ WiTH THE APPLICATION MR. WADSWORTH MADE A MOTION TO APPROVE THE MODEL HOME PERMIT FOR SOUTH RANGE CONSTRUCTION AT 1307 BARBER STREET, SEBASTIAN, FLORIDA SECOND BY MRS. POOLE - PASSED UNANIMOUSLY. GILCHER ASKS ABOUT THE LEGAL OPINION ON THE OYSTER POINTS SiTE PLAN AND THE STATUS OF THE ALLEYWAY FOR GUTTERIEZ BRUCE EXPLAINS ~rHAT IS TRANSPIRING ON BOTH PROJECTS AT THIS TIHE. HR. FULLERTON ASKS ABOUT THE BULKHEAD GOING IN ON INDIAN RIVER DRIVE - BRUCE STATES HIS OFFICE ISSUED A BUILDING PERMIT BECAUSE THE APPLICANT HAD A VALID DER PERMIT ALSO, HE STATES THAT THE OLD PRUESS BUILDING HAS BEEN TORN DOWN AND THE NEW BUILDING IS BEING BUILT FROM SCRATCH. BRUCE STATES HE IS AWARE OF THIS AND IT WILL BE BUILT ACCORDING TO SITE PLAN WiTH NO CHANGES. HE STATES THAT HR. PRUESS HAS REQUESTED A CHANGE IN THE SIZE OF THE BUILDING HOUSING THE WATER PUNP WHICH IS A MINOR MODIFICATION ONLY TO BE SIGNED OFF BY THE CHAIRMAN. HR. FULLERTON ALSO ASKS IF BRIAN HUGHES HAS A CiTY LICENSE AND BRUCE STATES NO HE DOES NOT AND THAT THE CODE ENFORCEHRNT BOARD IS WORKING ON THIS PROBLEM RIGHT NOW. HR. FULLERTON ALSO BRINGS UP THE AMUSEKENT CENTER ON CL 512 AND STATES THAT THE CODE NEEDS TO BE CHANGED TO BETTER DEFINE THIS BECAUSE HE DOES NOT FEEL THAT THIS TYPE OF BUSINESS IS ~IAT WE SHOULD HAVE ON 512. HR. WADSWORTH GAVE A BRIEF STATEHENT ABOUT HIS RECENT TRANSPORTATION HRETING AND ASKED KR. EISENBARTH IF HE COULD SUPPLY HIM WITH A COPY OF THE FIRST LETTER YRITTEN REGARDING THE 512 EXPANSION PROJECT. HRS. POOLS ASKS BRUCE TO CHECK ON THE SEBASTIAN LAKES SIGN AND STATES THEY ARE ADVERTISING SINGLE FAMILY RESIDENTIAL HOMESITES. HRS. KILKELLY ASKS REGARDING THE SPECIAL HEETING WITH.LES SOLiN AND BRUCE TELLS HER HE WILL TRY TO SET IT UP AS SOON AS POSSIBLE. BUILDING OFFICIAL MATTERS; BRUCE GIVES A BRIEF DISCUSSION REGARDING ALL THE PENDING ANNEXATIONS AND ZONING AND LAND USE CHANGES WEIGH WILL CONE BEFORE THE BOARD.
