MAHONEY, MR. EISENBARTH, MR. WADSWORTH, CHAIRMAN KRULIKOWSKI ABSENT; MR FULLERTON EXC J.::,ED- MR:-] POOLE UNEXCUSED ALSO PRESENT LINOA KINCHEN, SECRETARY AND BRUCE COOPER BUILDING OFFICIAL. ANNOUNCEMENTS; CHAIRMAN ANNOUNCES THAT CUMBERLAND FARMS WOULD LIKE ACTION ON THEIR BEVERAGE LICENSE AT THE MEETING - ENTERTAINS A MOTION FROM THE COMMISSION~ MR. WADSWORTH MADE A MOTION TO PLACE THE LIQUOR LICENSE FOR CUMBERLAND FARMS ON THE AUGUST 6TH, 1987 AGENDA. SECONDED BY MR. EISENBARTH, PASSED UNANIMOUSLY, THIS ITEM WAS PLACED LAST UNDER NEW BUSINESS APF'ROVAL OF MINUTES; MOTION TO APPROVE THE MINUTES AS PRESENTED BY MR. EISENBARTH SECONDED 8Y MRS. TAYLOR - UNANIMOUS. OLD BUSINESS MAJOR MODIFICATION - F'ISCHER BUILOING RANDY MOSBY REPRESENTS PROJECT - GIVES A BRIEF DESCRIPTION OF CHANGES RANDY STATES HE WAS ADVISED BY THE BUILDING OFFICIAL THAT THE STAIRCASES NEEDED CHANGING AND THAT ISSAM KADI OF THE ENGINEERING DEPARTMENT ADVISED THAT THE SEPTIC TANK CALCULATIONS NEEDED CHANGING. BILL MESSERSMITH WHO REVIEWED AS A CONSULTANT STATED THAT HE WOULD RECOMMEND THAT A 22 FOOT DRIVEWAY iN REAR BE PUT IN BUT THE CODE ALLOWS FOR 18 AND THE OWNER IS PUTTING IN 20, AND TO POSSIBLY ELIMINATE ONE OR TWO DRIVEWAYS ON U. S. HIGHWAY 1 TO AVOID TRAFFIC PROBLEMS BUT THESE WERE JUST SUGGESTIONS AND NOT PROBLEMS. HE INDICATED THAT HE FELT THE PARKING CALCULATIONS WERE WRONG BASED ON THE CODE BUT THAT THERE WAS OVERFLOW PARKING SO IT WOULD NOT CHANGE THE SITE PLAN. RANDY MOSBY ADDRESSES THE COMMENTS; RANDY STATES THAT THE RETENTION AREA IS ON A DEDICATED TRACK A8 LISTED ON THE SITE PLAN AS IT WILL 8E USED STRICTLY FOR RETENTION~ PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES AUGUST ~, 1987 PAGE TWO HE INDICATEO THAT MR. MESSERSMITH HAD POINTED OUT A PROBLEM WITH THE PERC TEST AND THAT HE WOULD CHECK WITH THE FIRM THAT OlD IT BECAUSE IT WAS A GOOD POINT. RANDY ACCEF'TED qUESTIONS FROM THE BOARD; MR. MAHONEY I~UESTIONED THE SIZE OF THE APTS AND BRUCE COOPER, BUILDING OFFICIAL INDICATED THAT HE HAD ALREADY DISCUSSED "FHA'I" WITH THE ARCHITECT AND IT WILL 8E CHANGED. MR. KRULIKOWSKI STATES ONE PARKING SPACE NEEDS TO 8E REMOVED AS IT IS LISTED AS A PLANNER ON THE SITE PLAN AND CANNOT BE USED FOR PARKING - ALSO NO NEED TO RELOCATE AS ADDITIONAL SPACES WERE PROVIDED. MR~ KRULIKOWSKI INDICATES THAT THE S~ FT FOR THE DENTAL OFFICE IS WRONG AND NEEDS TO BE ADJUSTED ON THE PLAN. HE INDICATES THAT THEIR IS A SLIDING GLASS DOOR ON THE ABOVE APT WITH NO PORCH OR LANDING :SHOWN - STATES IT NEEDS TO HAVE SOMETHING THERE. MR. MAHONEY qUESTiONS IF THE ENTIRE TRACK WAS CDR OR JUST THE FRONT SECTION AND SECRETARY ~UOTES FROM THE ORDINANCE REZONING THE ENTIRE TRACT. BRUCE COOPER F'OINTS OUT THAT ONLY THREE ACRES ARE ACTUALLY BEING USED FOR THE SITE PLAN AND THE PLANS SHOULD REFLECT THOSE FIGURES. THERE BEING NO FURTHER DISCUSSION THE FOLLOWING MOTION WAS MAOE MOTION BY MR. EISENBARTH 'TO APPROVE THE MAJOR MODIFICATION FOR THE FISCHER BUILDING WITH-CONTINGENCIES TO BE ADDRESSED SECONDED BY MR. WADSWORTH - CONTINGENCIES TO 8E THAT THE PERC TEST LETTER BE RECEIVED AFTER CHECKING WITH THE COMPANY 'THAT THE CHANGES IN SITE SIZE BE NOTED ON THE PLAN, THAT THE STAIRWELLS BE CHANGED THAT THE SEPTIC TANK ADJUSTMENTS BE MADE AND THE REVISIONS TO THE PARKING CALCULATIONS BE MADE AND SHOWN ON THE SiTE PLAN. PASSED UNANIMOUSLY. MINOR MODIFICATION- MAXWELL PLUMBING RANDY :SPEAKS BRIEFLY BUT SAYS HE HAS TO LEAVE AND WILL ADDRESS ANY COMMENTS THROUGH THE BUILDING OFFICIALS OFFICE IN THE MORNING IF CHANGES NEED TO 8E MADE~ BRUCE GIVES A BRIEF DESCRIPTION OF THE PROBLEM AND THE CHANGES. PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES AUGUST ~5TH, 1987 PAGE THREE BRUCE COOPER STATES THAT A METAL TO CONCRETE ADDENDUM IS IN HIS FILE WHICH WAS ACCEPTED BEFORE HE BEGAN. HE INDICATES THAT 'THE CHANGES OF 2080 Sq FT REQUIRE ADDITIONAL PARKING TO BE A TOTAL OF TWENTY WITH TWO COMPACTS. HE STATED THERE WILL BE NO LOADING ZONE AND THE RETENTION HAS BEEN CHANGED TO MEET THE CODE. MR. EISENBARTH STATES HE FEELS THE SITE PLAN MEETS THE CITY CODES NOW AND HAS NO OBJECTIONS TO CHAIRMAN SIGNING OFF MINOR MODIFICATION. ''l CHAIRMAN KR]LIKOWSKI ASKS IF ANYONE ELSE HAS OBJECTIONS TO SIGNING OFF AND THERE BEING NONE HE INDICATES HE WOULD SIGN THE MODIFICATION. HOME OCCUPATIONAL LICENSES: WOOD AND NICKELS RICHARD NICHOLS REPRESENTS THE PROJECT. - MR. NICHOLS INDICATES HE WILL ONLY BE USING HIS PERSONAL VEHICLE~ HAVE NO EMPLOYEES AND NO STORAGE STATES HE DOES OWN A 12 FT TRAILER WHICH HE USES FOR THE JOB. BRUCE COOPER ASKS THE POLICY OF THE BOARD REGARDING WHETHER TRAILERS ARE CONSIDERED VEHICLES SINCE THE CODE STATES ONLY ONE VEHICLE iS ALLOWED IN A HOME OCCUPATION. BOARD STATES THIS IS THE FIRST TIME THE QUESTION IS RAISED AND BRUCE INDICATES HE WILL CLARIFY WITH ATTORNEY PALMER. MR. NICHOLS IS ASKED IF HE WILL KEEP THE TRAILER IN THE GARAGE TO AVOID PROBLEMS - APPLICANT AGREED TO GARAGE THE TRAILER. WADSWORTH SECOND 8Y MRS,TAYLOR - PASSED UNANIMOUSLY, CHAIRMANS MATTERS; NONE MEMBERS MATTERS; MR, MAHONEY ASKS ABOUT LETTER FROM BRUCE REGARDING FRED AND MARY'S BRUCE iNDICATES HE PUT SOME RESTRAINTS ON THE LICENSE TO AVOID PARKING PROBLEMS 8UT THAT THEY PROBABLY WILL NOT SELL ICE CREAM ANYWAY DUE TO THE HEALTH DEPARTMENT REQUIREMENTS, MR. E ISENBARTH REQUESTED THAT THE ZONING NEWS 8E PURCHASED AND BRUCE COOPER INDICATED THAT HE WOULD PURCHASE OUT OF HIS BUDGET SINCE THE COST WAS ONLY $2S.00. BUILDING OFFICIAL MATTERS; MOOEL HOMES - BRUCE EXPLAINS THAT THE OROINANCE DOES NOT ALLOW FOR MODEL HOMES WITHIN A PUD AND ASKS THE BOARD IF THEY FEEL THEY SHOULD BE ALLOWED. HE STATES HE WILL CHECK WITH ATTORNEY PALMER AND ADVISE BRUCE ASKS IF THEY WOULD BE INTERESTED IN SEEING THE REVISED RECOMMENDATIONS FOR OCCUF'ATIONAL LICENSE FEES. AND THEY STATE YES HE TO PROVIDE COPIES OF THE CHANGES. OYSTER POINT HAS BEEN NOTIFIED TO FINISH THEIR SITE PLAN BEFORE PLANNING AND ZONING OR rEVERT BACK TO ORIGINAL APPROVED PLAN. BRUCE STATES HE WOULD LIKE TO PREPARE A LANDSCAPE PROPOSAL FOR SINGLE FAMILY RESIDENCES AND GET THE BOARD RECOMMENDATIONS. BRUCE STATES HE WILL BE REQUIRING A PROFILE REGARDING SWALE SIDES AND REAR GRADINGS ON NEW CONSTRUCTION, MEETING ADJOURNED AT 9:40 P.M. L.
