Chairman Thompson called the meeting to order at 7:00 p.m.

ANNOUNC~I~I~S:
The next scheduled regular meeting for September 7, 1995 is being
pre-empted for a public hearing bythe City Council on the proposed
95/96 budget. Chmn. Thompson guestioned the Board members if they
wanted to move the Planning and Zoning meeting to the following
Thursday, September 14, 1995, or reschedule the meeting for the
available Wednesday, September 6th. Mr. Fischer preferred having
the meeting on Wednesday, Sept. 6th. A voice vote was taken, and
the Board approved.
Chmn. Thompson went over seminar facts for "~reenway Corridor
Connections for Natural and Passive Recreational Environments" if
anyone was interested in attending.
The Commissioners received their packets for the August 17, 1995
regular meeting. The secretary relayed comments from the staff
regarding the two site plan reviews on the agenda.

Mr. Farmer was present and stated his address as being 728 Schumann
Drive.
The public hearing was opened at 7:08 p.m.
There were 16 notices of the hearing sent out.

Chmn. Thompson read staff's comments from a memorandum to P & Z
dated August 4, 1995. He reviewed that the vending machines were
stored in a warehouse at Keith's Oil Can on 99th Street. The
merchandise for the machines (chips, cookies, crackers} were Stored
in a bedroom closet at the applicant's residence. Mr. Farmer
stated this was correct. He goes to Sam's Discount Club to
purchase the food items himself or places orders through D&L
Supplies in Port St. Lucie and picks them up. No deliveries are
made to his house. Chmn. Thompson read that staff has no
objections to this license.
There was no public input.

Mr. Fischer questioned if there was any HRS or state regulatory
requirements for handling packaged food? Mr. Farmer stated he
wasn't aware of any, it was all pre-packaged food, Mr. FisCher
would like the City to check and be certain before the occupational
license is issued.
Mr. Barnes asked the applicant if he had read all the requirements
on .the application for a home occupational license? Mr. Farmer
stated yes.
Mr. Munsart questioned if the applicant had registered with the
State of Florida for the collection of sales tax? Mr. Farmer
stated yes, both for Indian River County and Brevard county, and:he
would supply the City Clerk with those ID numbers.
Ms. Kilkelly asked Mr. Farmer Where he repaired malfunctioning
vending machines? Mr. Farmer stated most could be repaired on
site. Otherwise he brought them home. Mr. Goldstein reminded him
that no repairs could be made in an accessory building at the
residence. Mr. Farmer agreed to fix the machines at the warehouse.
Mr. Barnes made a motion to approve the home occupational license
for Robert Farmer at 728 Schumann Drive to operate a snack vending
machine service. Mr. Munsart seconded the motion.

Mr. Fischer made an amendment to the motion that prior to issuing
the permit the City checks with HRS to be sure that this license
doesn't fall under their guidelines. Mr. Barnes seconded the
amendment.
Roll call was taken on the amendment. 7-0 amendment approved.
Roll call was taken for approval of the license. 7-0 license
granted.

Ms. Roessler was present and stated her address as being 1745
Skyline Lane.
The public hearing was opened at 7:19 p.m.
There were 11 notices of the hearing sent out. No objection or
non-objection letters were received back.
Chmn. Thompson read from staff's comments in a memorandum to P&Z
dated August 4, 1995 that the applicant receives a small computer
part from Germany about once a month which she then distributes to
her clients through the mail only. She indicated that she would
move the proposed work table in her garage into the house. Ms.
Roessler stated that was correct. She then showed the
Commissioners the actual product she was distributing so they could
see the size and how it was packaged.
Chmn. Thompson indicated staff had no objections to the home
occupational license.
There was no public input. The public hearing was closed at. 7:23
p.m.
Ms. Roessler indicated she was going to advertise with flyers, and
an order would be filled by her going to either the post office or
UPS for shipping it. She was picking up the shipments from Germany
at the airport herself.
Mr. Munsart stated the applicant needed to register with the State
for collection of sales tax. Ms. Roessler had already contacted
her accountant regarding this.
Mr. Goldstein made a motion to grant the home occupational license
to Anna-Maria Roessler at 1745 Skyline. Lane for a mail order
distribution business. Mr. Barnes seconded the motion.
Roll call was taken. 7-0 license approved.

Mr. Walter Wunderlich is representing his son, the applicant, and
stated their address is 673 Badger Street.
The public hearing was opened at 7:28 p.m.
There were 12 notices of the hearing sent out.

Mr. Wunderlich indicated his son's equipment will be kept on a
utility trailer on the side of the house behind their 6-foot
stockade fence.
Ms. Maria Sousa of 661 Badger Street, a neighbor, is in favor of
the young applicant working to make extra money for college but,
has. concerns on how the trailer will fit between their two houses
without there being enough room? Mr. Wunderlich explained the
trailer will be on the other neighbor's side, which is' where it was
parked now, and was not noticeable.
Chmn. Thompson read that staff has no objections to this home
occupational license.
The public hearing was closed at 7:32 p.m.
Mr. Barnes questioned what the applicant did with his grass
clippings. Mr. Wunderlich stated his son's machine has a 37-inch
Toro Pro-line recycler.
Mr. Munsart made motion that a license be granted to Joel
Wunderlich of 673 Badger Street for the operation of a lawn
maintenance service from his home. Mr. Fischer seconded the
motion.
Roll call was taken. 7-0 license approved.

The applicants are not present.
Mr. Barnes made a motion to postpone the hearing for Richard and
Loren Wetherald to the next regular meeting. Mr. Johns seconded
the motion. A voice vote was taken, all were in favor.
Mr. William Reardon of 108 Melton Avenue, Sebastian, received
notice of the public hearing and wanted to know what the applicants
had put on their application regarding deliveries. He would like
to verify that this application was basically for phone use.

Mr. Barnes explained that home occupational licenses do allow for
one delivery a week. Mr. Reardon was given a copy of the home
occupational license requirements.

ADOPTXON OF UPDATED QUASX-JUDICIAL PROCEDURES
The members were given proposed quasi-judicial procedures with the
new legislative changes in their packets. Mr. Williams had the
procedures adapted for the Planning and Zoning Commission's use.
The secretary informed the Board that the proposed procedures did
not allow for public input during a site plan review. The Board
had discussed this previously and it was decided informal public
input (no sign-up sheet needed) would be allowed.
Mr. Fischer made a motion to defer the adoption until next meeting
after staff could review and revise the procedures to allow for
public input. Mr. Barnes seconded the motion. A voice vote was
taken, all members were in favor.
BUILDING OFFICIAL MATTERS:
COMPREHENSIVE PLAN REVIEW UPDATE
The secretary informed the members that Mr. Cooper had received a
packet and quote from Mr. Les Solin of approximately $14,000 for
his review of the Comprehensive Plan. Mr. Cooper sent a memo to
the City Manager regarding this, and was in the process of getting
the necessary grant forms from the State for their funding of this
project.
Ms. Kilkelly questioned if the City Council would have to approve
hiring Mr. Solin? Chmn. Thompson stated yes.
Chairman Thompson adjourned the meeting at 7:46 p.m.
