CALL TO ORDER ROLL CALL ANNOUNCEMENTS APPROVE MINUTES: OLD BUSINESS: NONE NEW BUSINESS: NONE DISCUSSION OF PROPOSED TREE ORDINANCE PUBLIC INPUT: ADJOURN NOTE: IF ANY PERSON DECIDES TO APPEAL ANY DECISION MADE ON THE ABOVE MATTERS, HE/SHE WILL NEED A RECORD OF THE PROCEEDINGS, AND FOR SUCH PURPOSES HE/SHE MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE WHICH RECORD INCLUDES THE TESTIMONY IN EVIDENCE ON WHIG{ THE APPEAL IS MADE. IN THE CITY COUNCIL CHAMBERS, 1225 MAIN STREET, SEBASTIAN, FLORIDA. PLANNING AND ZONING COMMISSION SPECIAL MEETING MINUTEs AUGUST 13, 1992 CHAIRMAN KRULIKOWSKI OPENED THE MEETING AT 7:00 P.M. PRESENT; MR. THOMPSON, MRS. KILKELLY, MR. FISCHER, MR. KRULiKOWSKI, MR. FIRTION, MR. SHROYER, MR. FULLERTON ABSENT; MRS. O'CONNOR, MR. WADSWORTH BOTH RESIGNED ALSO PRESENT; LINDA KINCHEN, SECRETARY, BRUCE COOPER AND CATHERINE HILTON, ANNOUNCEMENTS; A REQUEST WAS MADE BY THE CHAIRMAN THAT THE PUBLIC BE ALLOWED TO HAVE INPUT. MR. THOMPSON MADE A MOTION TO ALLOW PUBLIC INPUT SECOND MR. FISCHER, PASSED UNANIMOUSLY. PUBLIC INPUT OPENED AT 7:10 P.M. - JEAN BRANTMEYER OF STARFISH LANE PRESENTED A PETITION OF 300 NAMES TO SAVE.~TH~ TREES. LEE REED 674 CRYSTAL MIST STATED HEHIRED A BUILDER. 3. YEARS AGO TO BUILD HIS HOME AND ASKED HIM TO SAVE ALL THE TREES POSSIBLE UP UNTIL THE FINAL GRADE H]~'HAD LOTS OF TREES TH~ COMPANY DOING THE FINAL GRADE TOOK DOWN ALL THE REST OF THE TREES AND HE COULD NOT GET THE BUILDER TO REPLACE THEM. HIS BUILDING CONTRACT STATED THAT THEY WERE NOT RESPONSIBLE FOR TREES DAMAGED OR REMOVED. STATED THERE ARE BUILDERS OUT THERE WHO RAPE THE LOTS AND WANTS THE ORDINANCE TO PROTECT ~ FOR RESIDENTS IN THE FUTURE. NORMA DAMP 309 BENEDICTINE SAYS WE HAVE A MINIMUM SQ FTFOR BUILDING COVERAGE COULD A MAXIMUM BE SET - BRUCE ADVISE NO IT WOULD BE TOO RESTRICTIVE. SHE STATES THE MINIMUM HEIGHT FOR TREES TO BE REPLACED SHOULD BE TEN FEET. PUBLIC INPUT CLOSED AT 7:20 P.M. MR. THOMPSON STATES HE LIKES THE BREVARD COUNTY POINT~.'$YSTEM SUPPLIED BY TOZZOLO BROTHERS'AND FEELS IT COULD'WORK IN SEBASTIAN. MR. FISCHER ALSO LIKES THE POINT SYSTEM. MRS. KILKELLY FE~LS THE BREVARD SYSTEM HAS MERIT AND SH~ COULD GO ALONG WITH IT. FEELS A TREE SURVEY IS NECESSARY~EVEN IF DONE BY THE CONTRACTOR - ALSO.WANTS A NOTICE SIGNZD.BYTHE OWNER AND CONTRACTOR REGARDING THE TREE ORDINANCE. SHROYER STATES HIS PROPOSED 20A-13.2 SPEAKS FOR ITSELF AND REQUIRES ONE TREE FOR EVERY 2000 SQ FT. MR. FULLERTON FEELS THE DEVELOPER AND CONTRACTOR SHOULD BE PROTECTED. IF AN OWNER BUYS A LOT WITH NO TREES HE SHOULD NOT BE REQUIRED TO REPLACE THEM - STATES TREE PROTECTION IS FOR EXISTING TREES NOT TREES THAT WERE NEVER THERE TO BEGIN' W.fTH. ANDO BUILDERS - STATES SEBASTIAN HAS SMALL LOTS AND OVER REGULATIONS WILL NOT HELP SUGGESTS 7 TREE MINIMUM IS BEST BUT IT SHOULD BE UP TO THE OWNER OF THE LOT. CHAIRMAN FEELS WE NEED TO RETAIN THE AIR QUALITY NOW OR BETTER IT BARE LOTS NEED A MINIMUM NO OF TREES EXAMPLE .A LOT WITH 1.5 OR 20 TREES SHOULD BE REQUIRED TO SAVE 8 OR 10 APT~ TAKING TREES OUT FOR THE HOUSE NO OTHERS SHOULD BE REMOVED. IF THEY REMOVE A 20 FOOT TREE SHOULD BE REPLACED WITH A 10 FOOT 30 FOOT TREES REPLACED WITH 15 FEET - BUILDERS AND OWNERS MUST BE MADE AWARE THAT THERE IS AN ORDINANCE 'AND iT WILL:BE ENFORCED. MRS. KILKELLY STATES ON SEA HOUSE ST THERE ARE 15 LOTS 4 HOUSES WERE CONSTRUCTED ON LOTS WHERE EVERY PINE TREE WAS TAKEN OUT. STATED 2 DOUBLE LOT HOUSES SAVED A FRINGE OF PINES ON THE SIDE BUT THEY COULD HAVE SAVED MORE TREES'. CHAIRMAN STATES WITH 400 PERMITS A YEAR AND 10% RAISED THAT IS 8 TREES PER LOT TIMES 40 LOTS IS A LOT OF TREES FEELS 2% IS EVEN TOO MANY. MR. SHROYER ASKS IF MEMBERS CAN PUT THOUGHTS IN WRITING AND PROVIDE TO THE OTHER MEMBERS FOR REVIEW SO THEY GAN 'BETTER UNDERSTAND WHAT EVERYONE IS LOOKING FOR. THEY FINALLY AGREE TO GIVE IT BACK TO STAFF WiTH THEIR PERMANENT RECOMMENDATIONS TO BE READY FOR THE FIRST MEETING IN SEPTEMBER THOSE RECOMMENDATIONS ARE AS FOLLOWS: 1) FOOT PRINT OF HOUSE PLUS 5 FOOT IS. AGREED UPON 2) MINIMUM NUMBER OF TREES PER LOT MUST BE 8 FOOT HIGH, REPLACEMENT TREES 10 FOOT HIGH $) OWNER AND CONTRACTOR SIGNED AGREEMENT 4) TRK~ IDENTIFICATION PLAN BY CONTRACTOR NOT 'SURVEYOR
