HomeMy WebLinkAbout08151996 PZCITY OF SEBASTIAN PLANNING AND ZONING COMMISSION REGULAR MEETING AUGUST 15, 1996 Chairman Fischer called the meeting to order at 7:03 p.m. ROLL CALL: PRESENT: Mr. Munsart Ms. Kilkelly Mr. Mather Mr. Pliska Ms. Vesia Mr. Driver Mr. Johns Chmn. Fischer Mr. Schulke (arrived at 7:09 p.m.) ALSO PRESENT: Robert Massarelli, City Planner Jan King, Zoning Technician Dorri Bosworth, Secretary ANNOUNCEMENTS: Mr. Massarelli stated because of a scheduling conflict, Ms. Valerie Settles could not attend the meeting and the discussion on Board procedures would be postponed until another meeting. Mr. Driver would be voting until Mr. Schulke arrived. APPROVAL OF MINUTES: Mr. Mather made a motion to approve the minutes of August 1, 1996. Ms. Vesia seconded the motion. A voice vote was taken. All members were in favor. OLD BUSINESS: None NEW BUSINESS: PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 202 DELAWARE PHILLIP WESTOVER - REAL ESTATE BROKERAGE The secretary stated the applicant had called and hearing be deferred. Mr. Mather made a motion to de: until the next meeting. Mr. Johns seconded the vote was taken. All members were in favor. 5. PLANNING AND ZONING COMMISSION PAGE TWO REGULAR MEETING OF AUGUST 15 1996 PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 355 TOLEDO STREET - HOTEL SAFETY CONSULTING The applicant, Debra Pendergast, was present and sworn in according to quasi-judicial procedures. There were 26 notices of the public hearing sent out. One objection letter was received back. Ms. Vesia stated she visited the site. Staff reviewed its report stating the applicant would be using her home for mail, telephone, and general record-keeping activities. No additional traffic would be generated. Staff recommended approval. Ms. Pendergast explained she basically conferred with legal departments in the hotel industry to resolve liability problems. The public hearing was opened/closed at 7:07 p.m. There was no public input. Mr. Johns questioned Ms. Pendergast how she got her new business? She stated she had been in the business for seven years and was well know in the hotel circles. Her clients usually called her. Mr. Johns made a motion to approve a home occupational license for American Safety Products at 355 Toledo Street. Mr. Munsart seconded the motion. Roll call was taken. 7-0 motion approved. Mr. Schulke arrived at 7:09 p.m. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 124 FRIAR COURT - VENDING MACHINE SERVICE The applicant, Mr. Peter LaRosa was present and sworn in according to quasi-judicial procedures. There were 20 notices of the public hearing sent out. No objection or non -objection letters were received back. Ms. Vesia stated she visited the site. Staff reviewed its report and stated they hadn't been able to contact Mr. LaRosa regarding questions on the storage of the merchandise for the machines and how the merchandise was delivered to Mr. LaRosa's house. Mr. LaRosa stated he was starting out with gumball and mint machines. He bought the merchandise himself at Sam's Food Club stores. The machines usually had to be filled every 2-3 weeks and he bought the merchandise the night before. He stated if his business expanded he would rent a warehouse. �1 PLANNING AND ZONING COMMISSION PAGE THREE REGULAR MEETING OF AUGUST 15 1996 The public hearing was opened/closed at 7:12 p.m. There was no public input. Mr. Driver questioned if any merchandise would be stored in the residence if the routes weren't finished or any merchandise was left over? Mr. LaRosa stated the merchandise was prepackaged. Mr. Mather asked if any repairs on the machines were done at home? Mr. LaRosa stated no but, he might have a couple of extra machines stored in the garage. They were only 2-3 feet high. Staff recommended approval of the license subject to no storage of the equipment or merchandise in any accessory building including the garage. Mr. Munsart made a motion to grant a home occupational license to Peter LaRosa operating as LaRosa Vending at 124 Friar Court with the condition that there will be no storage in the garage. Mr. Mather seconded the motion. Roll call was taken. 7-0 motion approved. PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 202-B KEEN TERRACE - OUTDOOR WOOD FURNITURE The applicant, Mr. William Beard, was present and sworn in according to quasi-judicial procedures. There were 14 notices of the public hearing sent out. No objection or non -objection letters were received back. Ms. Vesia stated she had visited the site. Staff reviewed its report stating the applicant was requesting an address of convenience for mail, phone, and record keeping. There would be no production of the furniture at his residence. Staff recommended approval of the application. Mr. Beard stated he would be showing his furniture at art shows and primarily selling to interior decorators. The public hearing was opened/closed at 7:18 p.m. There was no public input. Ms. Kilkelly questioned where the woodworking would be done? Mr. Beard stated at a friend's shop in Vero Beach. Mr. Pliska asked if any deliveries of tools or supplies would be delivered to Keen Terrace? Mr. Beard stated no. Mr. Driver asked if any stain or paint was stored at his residence? Again, Mr. Beard stated no. Mr. Johns made a motion to grant a home occupational license to Williams Wood Products at 202-B Keen Terrace. Mr. Mather seconded the motion. Roll call was taken. 7-0 motion approved. PLANNING AND ZONING COMMISSION PAGE FOUR REGULAR MEETING OF AUGUST 15 1996 PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - 292 FLEMING STREET - SATELLITE DISH INSTALLATION The applicant, Mr. Vito Gioia, was present and sworn in according to quasi-judicial procedures. There were 17 notices of the public hearing sent out. No objection or non -objection letter were received back. Ms. Vesia and Mr. Mather stated they had visited the site. Staff reviewed its report and stated the applicant would be only using his home for phone, mail, and record-keeping. Tools and stock would be stored within an enclosed vehicle. Mr. Gioia stated he basically did subcontractor work for a company out of Fort Lauderdale. Supplies are sent to him when needed and paperwork is faxed. The public hearing was opened/closed at 7:23 P.M. There was no public input. Mr. Johns questioned if all equipment was stored in the van? Mr. Gioia stated yes except when he needed the van for personal use. f �1 Mr. Munsart asked how many deliveries in a week he expected to have? Mr. Gioia stated perhaps 50. Staff explained the requirement of no more than one delivery per week was allowed. Mr. Munsart made a motion to grant a home occupational license to Vito Gioia at 292 Fleming Street for satellite dish installations. Mr. Mather seconded the motion. Roll call was taken. 7-0 motion carried. RECOMMENDATION TO CITY COUNCIL - PROPOSED ORDINANCES AMENDING THE LAND DEVELOPMENT CODE: 1. Permitted Uses in the PUD -C and IN Zoning Districts Mr. Massarelli reviewed that the ordinance had been before the Commission previously and they had recommended to City Council that mini -storage facilities be allowed in a Commercial PUD. However, the proposed ordinance from the past city attorney could be interpreted as to not allow mini -storage facilities in the Limited Commercial district which, would be inconsistent with the Comprehensive Plan. Mr. Massarelli went over the new proposed ordinance with the Commission. Ms. Kilkelly had concerns regarding Section 20A -4.6.L.9 which stated "All storage areas shall be located at the rear of all structures." that it may be interpreted to mean mini -storage facilities also. PLANNING AND ZONING COMMISSION PAGE FIVE REGULAR MEETING OF AUGUST 15 1996 Mr. Massarelli stated "excluding mini -storage facilities" could be added. Ms. Vesia made a motion to "make a recommendation to City Council that they approve Ordinance 0-96-{25} concerning the amendment to the Land Development Code regarding permitted land uses in a commercial planned unit development as amended." Mr. Pliska seconded the motion. Roll call was taken. 7-0 motion carried. 2. Fences, Section 20A-5.9 Mr. Massarelli reviewed the ordinance with the Commission going over Section 1, General Provisions, and the two proposed additions to the code. The first addition dealt with the height of a fence. Because of the landscape affecting fence height and measurement, an explanation of how fences will be measured for the code was added: the highest point of the ground in an eight foot run. The second addition was to allow temporary fencing for 30 days. After discussion, the Board agreed it should be changed to 90 days to allow for construction of new houses and that the Building Official would permit temporary fences in the ROW. The change to Section 2, Types of fences and walls permitted, eliminated hedges and hedge rows. Section 3 addressed changes to the barbed-wire fence regulations. Mr. Johns made a motion that "we recommend to City Council the approval of Ordinance No. 0-96 - as amended. 1t Mr. Schulke seconded the motion. Chmn. Fischer suggested Mr. Johns be more specific. Mr. Johns withdrew his motion. Mr. Mather made a motion that "we approve the ordinance to the City Council, recommend to the City Council, 0-96- , regarding fences, final number to be determined later, as amended.,, Mr. Schulke seconded the motion. Roll call was taken. 7-0 motion carried. 3. Tree Advisory Board Mr. Massarelli explained the Tree Advisory Board was developed as part of the Tree Ordinance which was a part of the Land Development Code. Any change to the LDC had to be reviewed by Planning and Zoning. The Tree Advisory Board was requesting to have alternate members on its Board. Mr. Massarelli read the proposed ordinance. Roll call was taken. CHAIRMAN MATTERS: MEMBERS MATTERS: 7-0 motion carried. None Mr. Mather questioned when the sidewalks for Harbor Point would be put in. Mr. Johns asked to be excused for the September 4th meeting. Mr. Driver asked Code Enforcement to check a residence in the 1700 Block of Barber Street . Mr. Pliska suggested the Home Occupational License application be clarified regarding the applicants commercial vehicles. CITY PLANNER MATTERS: Mr. Massarelli informed the Board of the Riverfront Committee s discussions on land uses within the riverfront district. Currently there was seven different zoning districts within the riverfron area. The Committee was considering the concept of a single land use classification, Riverfront Mixed Use, for the whole area. Mr. Massarelli then updated the Board on construction of a previously approved site plan for Chase Restaurant on CR 512. The Board Mr. Mather made a motion that "we accept the site plan as submitted for Lot 11 Block 188, Unit 61 regarding the landscaping plan as approved 2/6/9611. Mr. Munsart seconded the motion.
