MAHONEY, MR. THOMPSON, MR. GILCHER MR. FULLERTON, MR. KRULIKOWSKI, MR. WADSWORTH, MRS. KILKELLY ALSO PRESENT; PETER JONES, DAVE FISHER, LINDA KINCHEN ANNOUNCEMENTS; MR. THOMPSON ASKS TO BE EXCUSED FOR SEPT ? AND POSSIBLE SEPT 21 WiLL BE ON VACATION. MINUTES; AUGUST 3, 1989 - PAGE THREE CORRECTION PER MR. KILKELLY STATED THE WORD FEASIBILITY IS MISSPELLED ON PAGES THREE AND FOUR A MOTION TO APPROVE THE MINUTES AS CORRECTED WAS MADE BY MR. WADSWORTH, SECOND MRS. KILKELLY PASSED UNANIMOUSLY. HOME OCCUPATIONAL LICENSE - ARTHUR FIRTiON - CONSULTANT PATRICIA FIRTION HIS WIFE IS PRESENT TO ANSWER QUESTIONS WHEN ASKED WHAT TYPE OF CONSULTANT HER HUSBAND iS SHE INDICATES HE iS AN ELECTRICAL/MECHANICAL CONSULTANT SHE ALSO STATES THIS IS ONLY AN ADDRESS OF CONVENIENCE REQUEST. MR. WADSWORTH ASKS REGARDING THE DEED RESTRICTIONS AND WHETHER THEY ARE AWARE OF THEM. SHE ANSWERS YES BUT DOES NOT FEEL THIS IS AN ACTUAL BUSINESS REQUEST, SHE STATES THERE ARE NO EMPLOYEES, AND NO ADVERTISING GOES ON THAT SHE HAS BEEN IN THE HOUSE SINCE MAY AND THERE HAVE BEEN NO SIGNS OF THIS BUSINESS. MR. THOMPSON REQUESTS THE LAWYERS OPINION ON THE DEED RESTRICTIONS AND PETER 3ONES READS IT FOR THEM. MR. WADSWORTH ASKS IF DEED RESTRICTIONS ARE RECORDED WITH THE CITY DAVE FISHER STATES NOT TO HIS KNOWLEDGE. THE PUBLIC HEARING WAS OPENED AT ?:22 P.M. MODEL HOME PERMIT-FLA CONSTRUCTION-UDELL iSSAC PRESIDENT IS AVAILABLE TO ANSWER QUESTIONS. MR. FULLERTON QUESTIONS THE PARKING PROBLEM. MR. THOMPSON BRINGS UP THE RULES AND REGULATIONS REGARDING MODEL HOMES. THE PUBLIC HEARING WAS OPENED AT 7:46 P.M. NO COMMENTS CLOSED AT 7:46 P.M. A MOTION TO APPROVE THE MODEL HOME PERMIT FOR FLA CONSTRUCTION AND DEVELOPMENT AT 762 BARBER STREET WAS MADE BY MRS. KILKELLY SECOND MR. WADSWORTH PASSED UNANIMOUSLY. MODEL HOME PERMIT - ZORC AND SONS - TIM ZORC IS PRESENT CHAIRMAN ASKS MR. JONES REGARDING THE LETTER FROM BRUCE COOPER IN REFERENCE TO THE PARKING REQUIREMENTS. MR. JONES TRIES TO EXPLAIN WHAT BRUCE IS REQUESTING THE BOARD TO DO. THE PUBLIC HEARING WAS OPENED AT 7:59 P,M, NO COMKENT CLOSED AT 7:59 P.M. f 1 140`, PLANNING AND ZONING COMMISSION REGULAR MEETING MINUTES AUGUST 17, 1989 PAGE THREE A MOTION TO APPROVE THE MODEL HOME PERMIT FOR ZORC AND SONS AT 1518 BARBER STREET WAS MADE BY MR. WADSWORTH SUBJECT TO THE LETTER DATED AUGUST 3, 1989 FROM MR. COOPER SECOND BY MRS. KILKELLY PASSED UNANIMOUSLY. --------------------------------------------------------- SITE PLAN APPROVAL - SCOTAD INC ADAM BERLIN IS PRESENT TO ANSWER QUESTIONS MR. GILCHER ASKS HIM TO DESCRIBE THE PROJECT AND ITS LOCATION HE STATES SMALL COMMERCIAL BUILDING APPROX 1/4 MILE WEST OF SEBASTIAN ELEMENTARY SCHOOL. AFTER SOME VERY SERIOUS DISCUSSION REGARDING THE LOOK OF THE BUILDING THE FOLLOWING MOTION WAS MADE. MRS. KILKELLY MADE A MOTION TO APPROVE THE SITE PLAN FOR SCOTAD INC WITH THE STIPULATION THAT THE PERFORMANCE BOND FOR THE CURB CUT AS STATED IN APPENDIX B ROMAN NUMERAL V AND VI ON PAGES 166 AND 167 OF THE LAND DEVELOPMENT CODE BE MET AND ALSO A RESUBMITTAL OF EXTERIOR DESIGN OF THE BUILDING WITH SOME CHANGES TO ENHANCE ITS APPEARANCE AND ALSO GIVE A MORE SPECIFIC DEFINITION OF THE LIGHT PINK COLOR BE PROVIDED. MR. GILCHER MADE A SECOND FOR DISCUSSION UNDER DISCUSSION IT WAS MENTIONED THAT A DEED OF EASEMENT FOR CR 512 IS REQUIRED ALSO AND THAT SHOULD BE A PART OF THE MOTION AND MR. GILCHER MADE AN AMENDMENT TO THE MOTION AS FOLLOWS; THAT MR. BERLIN WILL SUBMIT UPDATED ELEVATIONS AND SIDE VIEWS TO CITY STAFF FOR THEIR REVIEW AND COMMENTS. SECOND BY MR. WADSWORTH THE AMENDMENT TO THE MOTION PASSED SIX TO ONE WITH MR. MAHONEY VOTING NO THE MAIN MOTION PASSED 5-2 WITH MR. MAHONEY AND MR. WITH THE LETTER OF AUGUST 11, 1989 FROM THE CITY OF SEBASTIAN AND THE AUGUST 9, 1989 LETTER FROM THE INDIAN RIVER COUNTY HEALTH DEPARTMENT AS CONTINGENCIES. SECOND BY MR. MAHONEY. PASSED UNANIMOUSLY. A BREAK WAS TAKEN AT 9:20 P.M, BACK AT 9:28 P.M. ALL PRESENT SITE PLAN FOR DR. MELROSE - RANDY MOSBY AND DR, MELROSE ARE PRESENT AFTER A BRIEF DESCRIPTION BY MR. MOSBY THE FOLLOWING MOTION WAS MADE. MR. WADSWORTH MADE A MOTION TO APPROVE THE SITE PLAN FOR DR MELROSE AT 1138 US HIGHWAY #1 WITH THE LETTER FROM THE CITY OF SEBASTIAN DATED AUGUST 11, 1989 AND THE AUGUST 1, 1989 LETTER FROM THE INDIAN RIVER COUNTY HEALTH DEPARTMENT AS CONTINGENCIES AND THAT A PROPER WARRANTY DEED BE INCLUDED THE FILE FOR THE CITY, SECOND BY MR. GILCHER - PASSED UNANIMOUSLY. IN ROGER SKILLMAN SPEAKS ON THE MACEDONIA BAPTIST CHURCH MR. WADSWORTH INTERRUPTS AND STATES HE DOES NOT FEEL THIS IS SON~ETHING THAT SHOULD COME BEFORE THIS BOARD MR.
