CITY OF SEBASTIAN PLANNING AND ZONING COMMISSION REGULAR MEETING AUGUST 17, 1995 Chairman Thompson called the meeting to order at 7:02 p.m ROLL CALL: PRESENT: Mr. Munsart Ms. Kilkelly Chron. Thompson Mr. Goldstein ALSO PRESENT: Ms. Brantmeyer Mr. Barnes Mr. Johns Mr. Schulke EXCUSED: Mr. Fischer Mr. Cooper, Director of Community Development/Building Official Doral Bosworth, Secretary ANNOUNCEMENTS: Chmn. Thompson announced that Ms. Brantmeyer would be voting in place of Mr. Fischer. APPROVAL OF MINUTES:.' None OLD BUSINESS: PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - RICHARD AND LOREN WETHERALD - 107 FRIAR COURT - OFFICE CLEANING Mr. Wetherald, 107 Friar Court, Sebastian, was present and was sworn in according to quasi-judicial procedures. The public hearing was opened at 7:04 p.m. There were 16 notices of hearing sent out. 1 objection letter received and no non-objection letters received. The staffhas no objection. There was no public input and the public healing was closed at 7:06 p.m. PLANNI~, G AND ZONING COMMISSION REGU'LAR MEETINO OF AUGUST 17, 1995 MOTION by Barnes/Johns I make a motion to approve the Home Occupational License for Richard and Loren Wetherald of 107 Friar Court, Sebastian. Roll call was taken. 7-0 motion carried. NEW B,~SINESS: PUBLIC HEARING - HOME OCCUPATIONAL LICENSE - PHILLIP W. BARNHART - 157 ROYAL PALM STREET - GENERAL CONTRACTING The applicant, Phillip W. Bamhart, was present and was sworn in according to quasi-judicial procedures. The public hearing was opened at 7:10 p.m. There were 19 notices of hearing were sent out. We received 2 objection letters and no non-objection letters. Staffhad no objection. There was no public input and the public hearing was closed at 7:12 p.m. MOTION by Munsart/Brantmeyer I move that the Commission grant a Home Occupational License to Phillip W. Bamhart of 157 Royal Palm Street to operate a General Contracting business from his home. Roll call was taken. 7-0 motion carried. SITE PLAN REVIEW - ENVIROCRAF1~ - INDIAN RIVER INDUSTRIAL PARK Mr. Cooper noted that it has met all requirements, and we've received a recommendation of approval from Masteller & Moler. Placement of well and septic will have to go before the Board of Adjustment as they are reversed from general placement. Approval tonight is for Phase I and Phase II, total site. Staffhas no objections. Mr. Randy Mosby of Mosby & Associates was present and spoke for the applicant. He explained that the site was designed mainly to preserve the trees. He felt the present code did not adequately cover this site as an adjacent property to the north also has well in front and septic in the rear, and he feels the Code should be corrected, referencing Section 20A-5.6. Staff agreed with Mr. Mosby about the Ordinance, Section 20A-5.6. It needs some flexibility in certain instances. PL~q....AND ZONING COMMISSION REGULAR MEETING OF AUGUST. 17, .! 995 PA~'E ~ Mr. Barnhart explained that an envirocraf~ is a 16 fL Catamaran run by two 3 horsepower engines which are shrouded, and is complete people and manatee safe. It has no emissions and no wake, does not pollute, and is quiet. Mr. Randy Mosby of Mosby & Associates answered questions about the site. 'He explained that this site is in a non-conforming subdivision. The building will be a hangar-type structure made of metal, will be near the Railroad tract, and won~ be seen by the residential neighborhood. Signs will probably be installed and will be according to Code. Most other aspects of this site were discussed satisfactorily. MOTION by Goldstein/Barnes I'll move that the Planning and Zoning Commission approves this site plan for Envirocraft, Inc. based on the presentation today, and the drawings by Mosby & Associates; drawing #95-333, sheet C-1 of 2, revision 2 dated 8/8/95, sheet C-2, 2 of 2 also 95-333, Mosby & Associates, no revision shown; sheet - I believe that's sheet S, this is a sheet that's marked "floor electrical plan", I of 1, #95-333, Mosby & Associates; and also, based on elevation, this document identified as "Global Steel, Inc." received July 6, '95, it is identified as the project for Don Majer, SebaSteen, FL; drawing GB-95-1386, based on the City's TRC dated August 10, '95, the conditions therein and the additional condition that the applicant will provide the irrigation design prior to the building permit. Roll call was taken. 7-0 motion carried. A break was taken at 8:03 p.m. The meeting resumed at 8:14 p.m with all members present. SITE PLAN REVIEW - MEL FISi:IER'S TREASURE MUSEUM - 1322 U.S. HIGHWAY #1 Mr. Randy Mosby was present representing the applicant. Mr. Cooper explained that this application is a proposal for an addition to Mel Fischees and utilizing the east side of the property for parking, which was envisioned some time ago, and generated a change in ordinance to provide just such a use on the east side. Most of the conditions in the TRC can be worked with except condition #3, that they must obtain a variance and/or a favorable appeal regarding that lot coverage. Mr. Mosby discussed the "unity of title" aspect of this property. He noted that they would be asking for a waiver on the parking for compact spaces. They will provide necessary hedges, and the open spaces exceed the requirements. There will be chain link opaque fencing installed around the area with artifacts. They choose to argue the interpretation of the "unity of title" by the City Attorney, and will need to go before City Council for this action. PLANNING AND., ZONING COMMISSION REGULAR MI~-~TING OF AUGUST 17. 1095 PAGE FOUR There was much discussion on the "unity of title" issue, what it signifies, and how it influences Mr. Mosby's calculations. He suggested coming back to the next meeting with a plan that is cleared up, and try to work out condition #3. MOTION by Goldstein/Bames I move that the Planning and Commission approve the site plan for Mci Fisher Center, Inc. based on a "Paving and drainage" site plan, which is sheet C-l, 1 of 2, document #95-222, revision #1, dated 21 July of'95; a drawing called "Paving and drainage details and notes", sheet C-2, 2 of 2, #95-222, revision 1, dated 21 July '95; an architectural drawing by James S. G-asparie, entitled "Addition to Mel Fisher's Museum", it's labeled Job FC-11, drawing #1 of 1 sheets;' it shall also be subject to the TRC dated 10 August 1995 including changing condition #3 to require the favorable recommendation from the City Attorney opining that this can he construed as one lot in consideration of calculation of open space and lot coverage' (Madam Secretary, I adopt Bruce Cooper's words as if they came out of my mouth, I wish they did); also have a survey that was produced by James A. Fowler, Land Surveying Co., the Boundary Hunter, dated $ March 1995,' to show topography, drawing #3538-M; it is noted that the survey for the west side of Indian River Drive is in the official file; the Planning and Zoning Commission waives the maximum number requirement for compact parking stalls and delete TRC condition #5; ' and that we, the Commission, approve 9 ff. parking stalls on the east side of Indian River Drive' (i adopt those words into my motion). Roll call was taken. Mr. Munsart - yes Chmn. Thompson - yes Mr. Goldstein - yes Ms. Brantmeyer - yes Mr. Barnes - yes Mr. johns - yes Mr. Schulke - no 6-1 motion carried. MATTERS: None Mr. Goldstein suggested that we place on the agenda, consideration of making maximum coverage limits variable depending whether the application is in the riverside district and they involve lots within a limited distance from each other on either side of Indian River Drive, the intent being to minimize development along the east side of Indian River Drive. Staff will propose langxmge to cover that issue and place it on the agenda for the next meeting so we can get it off' to Council immediately. We also have in the proposed budget for next year, another $5,000 that City Council did not indicate in their preliminary review a problem with. Ms. Kilkelly inquired about the quasi-judicial process discussion that was postponed from last meeting and asked that it be placed on the agenda for the next meeting.
