The Pledge of Allegiance was said. It was noted that this meeting is being voice transmitt~ over Falcon Cable Television charnel 35. MOTION .by VesiaAiilkelly I make a mofi/m that we approve the minutes ofthe LPA of April 25, 1998. A voice vote was taken. & - 0 motion carded. Chmn. Mnn.~rt inquired about the Glossary. Mr. Hass informed thc Board that Les Solin is workin~ on a Glossa~. MOTION by Mather/Vesia I make a motion that we accept the minutes of the April 30~h LPA meetly. A voice vote was taken. 6 - 0 motion carried. PLAJqNING AND ZONING COMMISSION MINUTES OF REGULAR MEETING OF AUGUST 20, 1998 MOTION by Kilkeily/Matber I move that we approve the minutes of the special meeting of the Local Planning Agency of July 30th, 1998. A voice vote was taken. 6 -0 motion carried. MOTION by Matber~esia I make a motion that we approve the pl~nnln~ and Zoning minutes of August 6~. A voice vote was taken. 6 - 0 motion carried. NEW BUSINESS: A. ACCESSORY STRUCTURR RI~VIEW - David B. Smith - 973 Oswego Avenue - Carport 20~ David Smith, 973 Oswego Avenue, was present. Tracy Hass gave staff presentation and recommended approval. Questions of paint color were answ~ed satisfactorily by the applicant. Ms. Kilkclly asked about the lot numbers indicated on the Unity of Title, and Mr. Smith responded that there was a mistake made and it should be lots 23 and 24. There was discussion about a driveway, which was not indie, at~ on the drawing. Mr..Hags pointed out where the driveway would be going. There was also discussion on whether or not a culvert is needed. Mr. I-lass suggested that this issue be a condition on the motion. MOTION by Pliska/Mather I make a motion that we approve the accessory building for Mr. David Smith at 973 Oswego Avenue, and with the condition that the culvert or the swale meet the standards of A voice vote was taken. 6-0 motion carried. B. Mansart opened and closed the public heafin~ at 7:13 pm, as there was no public input. MOTION by Vesia/Mather I make a motion that we approve the condiu~ use permit for Sheldon Suga & Associates at 105 Harbor Point Drive, Sebastian. A voice vote was taken. 6 - 0 motion carried. 2. 326 FLEMING STREET - Mike Peppe Mr. Mike Peppe, 326 Fleming Street was present and gave a brief presentation of his fishing guide business. There Were thirty-one (31) notices of hearin8 sent out and there was one (1) objection letter andno non-objection letters received. Mr. Haas gave staff presentation and recommended approval. He noted that scieeniug material must be installed around his boat parking arm. Chnm. Muusart opened and closed the public heating at 7:16 pm, as there was no public input. There was discussion on the height of the hedge, which tham brought up a discussionl~:mt a review procedure for Code Enforcanent for roiusp~ti°n in one (l) year on tho hedge..Mr; Haas noted a computer program tha~ is being investigated, that would give a one-year rem/uder; MOTION by Mather/MaoWilliam I make a motion that we approve an occupational license for Captain Mike Peppe at 326 Fleming Street. A voice vote was taken. 6 - 0 motion carried. 3. 1057 GEORGE STREET - Mark En~strom Mr. Mark Engstrom, 1057 George Street, Sebastian, was present and gave a brief presentation on his sign business. Mr. Hass gave staff presen~on and rw, oummtmded approval. A copy of the objection letter was given to the apphcant. Chnm. Munsart opened and closed thc public hearing at 7:22 pm, as there was no public input. In response to a question from Mr. MacWilliam, Mr. Engstrom explained his sign-making process satisfactorily. MOTION by Pliska/Mather I'll make a motion that we approve thc Home Occupational License for Mark Engstrom, under the business name, Sign Guy, at 1057 George Street. A voice vote was taken. 6 - 0 motion carried. 4. 925 INDIAN RIVER DRIVE - Robert Aidulms Mr. Robert Aidukas, 925 Indian River Drive, was present and gave a brief presentation. There were twcnty-~ (29) notices of hearing sent out and there were no objection or non- objection letters received. Mr. Hass gave staff presentation and recommend~ approval. Mr. Aidukas provided his Federal I.D. # to thc Secretary. Mr. Hass also indicated that since Mr. Aidukas r~s his home, the property owner has given permission for this business to be run out of his home. Chmn. Munsart opened and closed the public hearing at 7:29 pm, as there was no public input. MOTION by Kilkclly/Mather I move that we approve thc Home Occupational License for Robert Aidukas, lnletweb Marketing, Incorporated, at 925 Indian River Drive, Sebastian. MBERS MATTERS; Mr. Pliska inquired about Winn Dixie - when are they going to fix the timces, correct their mistakes, and what is the City doing about it? Mr. Hass responded that he sent a letter and called the owner of the property, PTC Enterprises, Mr. Patrick Christiausen. Mr. Christiansen was under the impression that the landscaping was already in place since he had received a bill from his landscaping. He theo indicated that he would get in touch with his landscap~ and they would take care of. Mr. I-lass cornmeal that tho City will not require the removal of the ronco at this sito for present, but give them time for the wax myrtles to grow. He indicated that as soon as.tho plauts Mr. I-lass noted that as soon as thoy put up a new soction of fence, another section is knocked down. Ho also indicated that landscaping is roquired around th~ emire ~ ~ ~. He also noted that there was ho.objection to tho fen~ around the holding pond. Mr, Pliska again noted that it is Mr. Chrisfiansea's responsibility to maintain and figure out a way Mr. Hasa noted that poople using thc area of thc fcawo for a walking,path ar~ rcsponsiblc for knocking downportiom ofthe fcn~. He also not~ that the Citycannot policcthat fence lO0%of the time, but we do our best. He indicatod that thero is an on-site numager who is supposed t~ take care of that. Ms. Kilkolly indicated that sh~ has observed s~v¢~l times who tears down that fem., ami'she suggested to fmd out who they are, and have their parents repair it. It was noted that a walkway was su~ on th~ original plan, but it was eliminated.~ of a safeiy issue. Ms. Vosia asked what could be done about buildings that are painted outlandish colors, ~nw~h as Prima Pasta's new paint job. Th~ Riverfrom Ordinan~ ~olor sug~ostions were dis~ssvd, .but Mr. Hass indicatod that this Ordinanc~ does not specifically cover those colors, lie also not~l that the only time color can be enforced is on new constmctim, since established businesses don't have to have a permit to re-paint. Mr. Pliska sug~xi adding a "side-bar" to tho Onlimm~ covering the re-paint issue. Mr. Hass indicated that it is possible that the Article mx, ming this subject can still be revise~ if it is detormin~ to do so. He also noted that it is v~ry di~cult to enforce this, and every property owner would need to be notified, and would be required to come for a paint color approval. Ms. Kilkelly suggested writing a memo to City Council, recommending that when they come to that section in the Code, that they consider "an amendment as follows:" - and we can prepare an amendment. Mr. Ha,ss agreed that this would probably the best manner in which to handle this. will be brought up under the review process for discussion. PLANNING AND ZONINO COMMISSION MINUTES OF REGULAR MEETING OF AUGUST 20, 1998 should be vague eaough to allow interpretation by the Planning and Zoning Commi~. He comn~ted that no matter how it is done, a legal battle.may not be avoided. Mr. I-lass referred to the term "... offensive color..." in the present code. Ms. Kilkelly referred to Section X on "..overall harmonious design..." for new consuuetion, and suggested that some of this wording could be used in the proposed amendment. She zmted other wording: "... in harmony with the site; and general character of the impacted area..." Mr. MacWilliam suggested that it might be better applying this issue to the above Section;rather than try. to write an amendnamt. There was much more discussion on this subject. Mr. Math~ cxmmumt~ that he felt that basically, there might be an attempt to get too,much government control, and people want to have a celqain amount of choice, and if the ~ goes placed onthe population, tbe people will rebel. H~ also commtmted that "good taste" is hardto defiue. Several terms that apply to this issue, as take~ from ~ new Riverfront code, were discussed. Consensus was not d~wmined at this point. In re~lmme to a question by Ms. Kilkelly, Mr. Hass noted that the property that was Pind~'s Shell Shop (CR 512) has beeu purchased by Landsca~ .Stop, under a minor modification of use, and. it will be used as a retail site for that business, and a fmce is being installed. The new owne~ did an abandonment of ~ for his fence, with the understanding that if a through road is ever designed, he would have to remove the fence. Chnm. Munsan commented that land acquisition would probably be more important. It was detennin~ that Mr. Haas would write the memo to City Council about paint colors, after some consultation, then brin8 it back to this Board for approval. D~RECTOR,~.~ATTERS: Mr. Hass noted that there will be three or four site plans coming up probably in the'second mee/in~ in Saptember and in Ootober, He nord that he will not be present for the first meeting in Chmu.
